This is like if John Mulaney decided to sue Drew for sounding so similar to him...

Haggai so this past week has kind of sucked I got the flu for Christmas it came a few days early so I got to enjoy it for a while the flus always kind of confusing to me because it doesn't sound that bad I mean Michael Jordan once played a whole basketball game with the flu but when I was sick I couldn't stand up for three days did we have the same flu but hey I guess that's just the difference between a superhuman world-class athlete and me an adult toddler anyway I had a lot of time this past week to think and reflect on things and one thing I couldn't stop thinking about was this article I had read before I got sick about yellow car now like less than a month ago I admitted to the world that yellow card used to be my favorite band and no one was surprised however I was surprised to find out that they are suing juice world who tragically passed away this month and they're suing him now in fairness to yellow card they sued him before he died and then when he died they paused the lawsuit for a little bit for like a couple days and they thought about it and then they were like let's keep suing him and so they did basically yellow card alleges that in juice world's very famous song lucid dreams he uses a melody of theirs from a song that they released in 2006 now here's the thing I am a self-admitted fan of yellow card I spent a lot of my life listening to their music especially the first couple albums that was back in the early 2000s when I didn't have like an mp3 player I had a CD player so I only had like three or four CDs I would listen to over and over again so their original music their first two albums especially I listen to all the time I know these songs very well they're very deeply ingrained into my brain and when I heard lucid dreams I didn't hear the song that they're suing him for allegedly ripping up out on the highway to some when you left me falling and landing inside my gray now personally I don't see anything super egregious here it's obviously very similar melody but it's also extremely simple to the point where it's like I don't think you can say that he couldn't have come up with this melody without hearing the Yellowcard song first and that's actually probably gonna be one of the trickiest aspects of the lawsuit for the band is finding a way to prove that juice world did hear this song first and then blatantly ripped it off as one of the articles covering the story put it it'll be difficult to prove that juice world who was eight years old when the song came out in 2006 knew about it beforehand I think the thing that I don't understand the most about these lawsuits is that to me there doesn't seem to be any loss involved like no one was bumping yellow cards 2006 album like oh yeah this shit's laps I will buy this album oh wait is someone playing juice world over there I will buy that song instead like there's nothing like that here it's just greed it's just a scenario where I think a couple lawyers approached the band saying hey you guys might have a case here based on the precedent set by other similar lawsuits and they were like okay we'll do it but then he died and it should have ended their they should have dropped it and they didn't and that's why this is so fascinating I think the thing that's most interesting to me about this lawsuit other than the fact this is a band that I supported for most of my life is that they're so desperate for money that they're willing to alter their legacy forever to make villains out of themselves just for a small payday there are dozens of examples of songs or risks being similar to other songs where the artists who have been ripped off could have pursued a lawsuit but didn't they've even spoken out against the idea of a lawsuit which is really interesting to hear when you think about how much money they could have potentially earned in court Def Leppard didn't care that onedirection used the same chord progression as them and one of their song because they said that chord progression was just one of the building blocks of blues music so they didn't pursue a lawsuit you could argue Tom Petty was ripped off by the Red Hot Chili Peppers but he said that he didn't see an email intention there so he didn't pursue a lawsuit he actually said there are too many lawsuits and he didn't add on to break bot whose song baby I'm yours is almost identical to a Bruno Mars song that was released three years after it basically came out and admitted he felt like he was ripped off but it didn't matter he was cool with it basically saying that every musician is influenced by another musician even himself every song has elements of other songs in it and that's just how music works and that is how music works that's how all of art works every artist ever was inspired by other artists who came before them and that influence is always going to be there whether it's music or comedy or finger painting every artist is just a combination of all of the artists that they've been influenced by and to expect that every song that ever comes out has absolutely zero ties to any previous songs that came before it is just unrealistic I think a lot of songwriters relate to this this happens every time I try to play the guitar a few weeks ago I was writing something and it sounded like this and I was like cool awesome I like the way that sound and then a few days later I was listening to hail the Sun and I realized that the riff I wrote is extremely similar to a riff in one of their songs [Music] at first I was upset and I felt angry and unoriginal but then I accepted that that's just how music is always gonna be for me I'm always just doing an impression of all the other guitarists that I've been influenced by like will Swan Evette young ichika the tippecanoe guy from vine so tying this back to yellow card who think they're so important that they invented this melody that's so integral to the success of juice world that it's worth them becoming villains over forever like think about it these guys are so desperate for money that they're willing to destroy any legacy they might have had left at this point and replace it with infamy with pure hatred I saw hashtag fuck yellow card all over Twitter for a few days and it's totally worth it to them because they're that desperate for money which I will say this all doesn't really surprise me after I saw them lust over money for the last like ten years of their career the singer especially always seemed to be the one leading the charge despite the fact that they had a loyal following still listening their music and going to their shows and buying their albums he was like nah we gotta get on the radio he was so certain that he could turn yellow card into Coldplay that they started putting these stupid radio songs onto their album these like dog shit transparent attempts at pop music and it didn't work they still didn't get on the radio so then in 2013 they kicked either drummer who was like the only thing setting them apart from just being another average punk band and they signed with Razor and Tie Records you know who raised her and Ty is they make Kidz Bop I'm not even joking these guys were so tired of being a mildly successful niche rock band that they were like let's sign with the fucking Kidz Bop record label and make shitty pop music and then we'll be famous again and it didn't work because of course it didn't because nobody cares about yellow card and so they broke up like two years later and now they're still broke probably working regular ass jobs again as they should and they saw this opportunity and we're like hell yeah we can sue this kid get that Ocean Avenue money back pay off our credit card debts it's gonna be great oh wait he died we could still sue him though right yellow card you're fucking pathetic I supported this ban for years I bought their CDs I went to their show I brought my friends to their shows I swore by my was like nah they're good you don't get the violin isn't just to get man but you know what I'm starting to think that maybe I was wrong and I shouldn't have done that and now I'm done I don't care if they come back and do a reunion tour or make more music I'm not supporting them anymore I'm not supporting a band who's willing to sue the family of a dead kid just because they think they own a melody fuck yellow cars anyway y'all already know how we do it on this channel when I get sick I like to complain about things that no one else cares about there's cream cheese I'm like three of her fingers it is the end of the year it's the holiday season and I'd like to give back I'd like to start doing this every year we're in December I picked the last video of the year and giveaway the Adsense to a couple different charities so if you have any in mind comment them down below if this video gets you monetized or copyright claim they'll just be donating a portion of the brand deal instead speaking of which today's video is sponsored by autumn everyone loves books but reading is time consuming and hard and requires your full attention so get audible instead and start listening to the largest selection of audiobooks anywhere anytime while doing anything as long as it's not a crime I don't endorse doing crimes even if you're listening to a cool book while you do it see books like play video games or learn Taekwondo talk about a slam dunk right now audible members get more than ever before every month you can choose one audio book regardless of price as well as two audible originals you also get unlimited access to exclusive fitness and meditation programs and members can exchange any title that they don't love at any time right now I'm listening to Amy Poehler's yes
