so when it comes to Johnny Depp versus the Sun there have been plenty of damming and I mean damning statements when it comes to aah many of those are encapsulated in the claimants opening statement this is what Johnny Depp and his team have to say this is a long document but I thought you and I would go through it because hey why not so hey there now before we get started this is our second comic another case philatelist on Brella we have two days and change left remaining and we need your help getting the word out why because we could shut down by the mainstream media no matter how much success we have we talked about wrong think issues and that's fine we don't need them we need you so check that out back if you want more on that at the end of the video and thank you in advance now like I said for this remember this is the claimants opening statements so we're hearing about the entire case why Johnny Depp is putting this on from his team these are their opening remarks and also just a note we have the sun's opening remarks - if you want to know about those let me know as well so to begin this you have your introduction this is a libel claim brought by a well-known actor Johnny Depp over allegations that he seriously physically assaulted his former wife the actress aah not just one but on at least 14 different occasions it is now said causing her serious injuries and being so violent that it led aah to fear for a very life those are the allegations that form the subject matter of this libel claim the claim however is not brought against aah rather it is brought against the publisher of The Sun newspaper and its executive director Dan Wooten true it was aah who initiated these claims back in 2016 when at the time of her divorce she used them very publicly up to obtain an ex parte temporary restraining order against mr. Depp alleging in support of this to specific acts of DV which she claimed caused her to fear for her own life aah appeared in the Los Angeles courtroom on May 27 2016 trailed by photographers and sporting what appeared to be an obvious bruise to her face which were no doubt designed to be visual demonstrations of her primary incident of alleged violence which she claimed had occurred six days earlier on the 21st of May I will come back later to this last incident and how neither the police officers one of them a trained and experienced a domestic abuse officer who attended the Paramus is when it's opposed idli happened nor the building's attendants who saw an interactive with aah and the ensuing days saw many injuries on the night they were allegedly sustained or in the next few days there is a substantial body of evidence including from these and other witnesses which clearly demonstrates that this was a live manufactured by aah and her friends in any event that notorious incident to May 21st is how the allegations of domestic abuse were first aired to the world at large though aah very publicly seeking a restraining order although the alleged incidents have expanded and become embellished and even changed character quite dramatically over the years since then and I will explain in due course the article complained of however despite them having been initiated in a blaze of publicity in 2016 and repeated by aah in various guises since then it was the defendants who chose to publish these allegations in an article in The Sun newspaper both in hard copy form and online in April 2018 under the headline gone potty how can JK Rowling be genuinely happy casting wife beater Johnny Depp in the new fantastic beasts film the article was written by Dan Wooten in it he branded mr. Depp a wife beater he repeated AHS allegations referring to what he described as quote unquote overwhelming evidence in her favor in an obvious attempt to confirm categorically in the readers mind several million readers minds that these appalling serious allegations of criminality were true he did not stop there though mr. Wooten and the Sun newspaper which is liable for his actions also chose to make deliberate and highly topical references to the hashtag me too and hashtag times up movements and even the disgraced film mogul and serial abuser of women Harvey Weinstein suggesting that mr. Depp was in the same category and quoting one of mr. Weinstein's victims in support of this comparison actress Cathleen Kendall miss Kendall will give evidence to explain how annoyed she was that the article was presented as if she was endorsing this comparison and how she even contacted the newspaper to complain her complaint was as follows I never meant to be in an article that called Johnny Depp a wife beater I told you that I didn't know it to be true at all I've heard several times that she was in fact abusive to him he's never been a convicted wife beater it seems that the whole article was about defaming him I said over and over that I didn't know that he had caused her harm even a pitcher only makes it seem so I'm telling you that you misquoted me and intentionally took things I said out of context in what I now realize what's your purpose in defaming Johnny Depp I told you I have heard aah had hit him which is why as you know I don't condone any violence you've improperly tried to use the me2 movement for your purposes by using me in this way so that's her statement do it the article was written by mr. Wooten with a deliberate purpose in mind it was framed as a plea to author JK Rowling that she should recast her latest Harry Potter movie and not use mr. Depp notwithstanding that this quote/unquote would cost millions and more important despite the fact that mr. Depp had never been charged with any serious allegations little unfound guilty as the article clearly presumed this is the article which in the subject of this case for libel and this is why mr. Depp is here and the court bringing his claim against both the Sun newspaper and mr. Wooten its publisher and its author this is why mr. Depp has come here to give evidence as have a number of people on his behalf some of whom haven't worked for him or still do but a number of whom have never met him or a plainly independent they support its denial that carried out a series of physical assaults on his former wife in other words that he is guilty of being a quote unquote wife beer by contrast mr. Wooten is not coming to give evidence to defend this article nor is anyone else coming from the Sun despite the unequivocal way then which they chose to endorse the allegations and the somewhat ironic man that miss Raleigh should actively investigate for herself the allegations before continuing to defend her decision to support mr. death mr. Wooten poses five questions for Miss Rowling in the article that she must answer in relation to these allegations but he has chosen not to come to court and not to answer a single question himself about what actual investigations he made prior to publishing such a damning and unambiguous impact of mr. death or why he chose to make no mention even of mr. Depp's persistent denials of the allegations let alone miss Kendall's complaint that he sought to use a very real concerns of a hashtag me to movement these are issues raised squarely on the claimants case as to which mr. Wooten is conspicuously silent instead aah is coming to give evidence as well as a small group of her close friends not all of the ones that it was initially suggested would do so but something still however it is important to note that other than in the relationship to one of these 14 alleged incidents for which her sister Whitney claims she was present none of these friends of hers witnessed any of the physical assaults which aah said characterized their relationship throughout both from the early stages of 2013 to getting engaged to mr. Depp and then moving together properly and still continuing after she married him in 2015 so AHS allegation as allegations go it is hard to think of ones in terms of physical abuse between two people in a relationship that could be any more extreme or more violent than those aah will make up against mr. Depp in this court recently aah raised one new allegation that she is even asked to be heard in private because of its supposedly horrific nature an allegation which is never before been raised so look at that never been raised before there nor made anywhere in the last four years since this story has been blasted across publication after publication including in any of the many court depositions and other documents produced and litigation which has been conducted since the breakdown of their relationship in 2016 or for that matter in any of the contemporaneous communications at all which passed between the couple or their friends nowhere so we're gonna have a new allegation in this sounds real sounds legit right nevertheless even the ones which aah is content to be heard an open court or extreme enough in themselves they include prolong acts of violence such as repeated punching and slapping being grabbed by the throat being dragged across the floor by her hair having her lip punch so hard that it's splattered blood on the wall a broken and busted nose and so on violence which caused her to fear for life would end she says in Australian 2005 she even claims that she was subjected to a quote-unquote three-day hostage situation involving a catalogue of brutality one which ended critically with mr. Depp having part of his finger chopped off and requiring hospitalization but no medical attention being sought by Miss aah despite their doctor being on the scene or close by I'll have more to say on this later so on AHS account she suffered a litany of persistent and continual violence and mr. dibbs hand and yet a despite its starting from early on in their relationship she says with being slapped so hard in early 2013 that she was knocked from the couch to the floor that's incident one and being hit so hard by him in the course of a fight in her apartment over a painting on the 8th of March 2013 that her lip split splashing blood on the wall incident - despite this she continued still to date mr. Depp be similarly despite a further horrific alleged incident when staying in a camp in Hicksville which is one of the more recent allegations that a surface and is said to have taken place in June 2013 incident 3 she was still keen and moving in with mr. Depp on a permanent basis and later getting engaged in in September of that year see and finally despite on her account further serious incidents of violence in 2004 such as a nasty fight on a plane in May kicking slapping and grabbing her by the hair in the Bahamas in August and similar violence in the hotel room in Tokyo at the beginning of 2015 incidents 4 5 & 7 she was still eager to get married to him in February of 2015 d even in relation to the remaining incidents in 2015 and 2016 such as the Australian quote/unquote three-day hostage situation incident 8 in March the allegations that he hit her pushed her against the wall and grasped her by the throat causing her to quote/unquote fear for her life on a train journey during their honeymoon in Southeast Asia in July 2015 incident 10 or the argument in their bedroom during a Thanksgiving dinner for their family and friends in their apartment in Los Angeles in November 2015 when mr. Depp is supposed to have thrown her around the room ripped her clothing thrown a wine glass in a decanter in her shattering glass and wine on the bed and causing serious injuries to her incident 11 despite all of this aah chose not to leave mr. Depp or to even call the police or seek some official assistance until finally it was clear he was going to end their marriage for good whilst uh mr. Depp denied these allegations of violence aah cannot deny these acts of her own free will it is not just that she chose not to end things with mr. death despite these alleged violence right from the outset she happily chose to move in with him to get engaged to him and then get married to him something we which he had not done in any other previous relationship and the full knowledge on her account of what he was supposedly like and what the nature of their relationship was and was continuing to be indeed it was mr. Depp who in the end was forced to finally called time on this relationship largely after the behavior of her and her friends following her birthday party in their flat in 2016 including he says one of them defecating in its bed something with aah blames on their tiny dog but which she had confessed to mr. devs estate manager was quote-unquote just a harmless prank by her friend her and her friends it was on the night of the 21st of May when mr. Depp returned to the penthouse when where aah was still living and her friends living in and using his pin houses next door having notified aah earlier that day that the marriage was over that the final alleged incident is said to have taken place I will say more about AHS account of that final allegation in due course especially 6 days later she appeared at the LA courthouse sporting what appeared to be a prominent bruise on her face requesting a restraining order against mr. Depp surrounded by press aah was the abuser not mr. Depp mr. Depp's account as you will hear is completely different he says that he did not attack aah on these occasions or at all aah has invented these stories of serious violence he is not never has been a wife-beater indeed he says that it was a age he was the one who started physical fights who punched or hit him and there was little he could really do to stop this she was the abuser not him and the contemporaneous evidence fully supports that as the court will hear for example we have early recorded conversations between them in September 2015 recorded conversation was a tool they sometimes employed on mr. Deb's case as a method of resolving and analyzing their arguments on AHS case she claims she recorded mr. Depp to demonstrate the next day what she said was his violent behavior because he would quote unquote forget what he had apparently done and this one from September 2015 the court can very clearly hear what aah is angry and shouts at mr. Depp about namely the fact that and that is consistently her anger and that fact that when they have an argument he runs away he splits clearly this is exact opposite of the alleged acts of violence and utterly contradictory to AHS case in a series of compelling insights as are even clearer on the actual recording as the court will have noted one can hear how a aah bitterly complains over and over that mr. Depp doesn't fight for her or quote fight when there's a real problem hardly consistent with her claims that he repeatedly subjected her to physical violence B although she admits that she quote unquote throws pots when mr. Depp explains that he leaves because she gets physical with him aah says that's different ie it's not a reason for him to split which means leave this demonstrates that she is the violent one she considers that throwing objects and mr. Depp is acceptable most of all rather than complaining that he is violent with her aah begs mr. Depp not to retreat from a fight a words which is consistently used by her to mean an argument she seems to thrive off of these arguments and takes a whole no-holds-barred approach to pursuing them she is annoyed when mr. Depp responds to her physicality by quoting quote running away or escaping to another room often a bathroom where he can lock himself away crucially on these tapes you can hear aah explicitly admits to hitting mr. Depp and starting a physical fight with him the court will have firmly in mind that if this was a man admitting openly to hitting or punching a woman not once but serially which aah does here and elsewhere that would be the subject of the strongest possible condemnation this is especially the case when one hears how the victim mr. Depp is a fur stole he is lying when he says that she attacked him B next argued with for his use of language you didn't get punched you got hit but I did not punch you I did not effing deck you I was hitting you see and then finally belittled him for complaining about the physical abuse he has suffered you're an effing baby you're such a baby grow the F up interestingly while she says repeatedly that she does not feel safe in their relations it is abundantly clear that eh-eh is definition of safe has absolutely nothing to do with any fear that she might be beaten up by mr. Depp or have any fear for a life quite the opposite and she makes clear to him time and again she feels unsafe because she fears he may split or leave her for a aged life without being able to get mad is living in a mother-effing fairy tale a mother-effing fairy tale there indeed e as further confirmation that she is the one with violent tendencies she goes on to admit in an exchange where they're trying to agree to have timeouts during any future arguments that she cannot promise mr. death she'll not get physical again the words God I think sometimes get so mad I lose it are not those of someone repeatedly beaten by her husband to the point of fearing for a life mr. Depp's position to this then wife was there can be no physical violence to one another AHS recorded confessions that she was the perpetrator of violence are crucial because they undermined the very foundation of the case against mr. Depp they are completely inconsistent with the picture she paints of herself being a vulnerable victim they also undermined the credibility of her account of each of these 14 alleged incidents given the importance of such a contemporaneous and impartial record of their relationship before a public and acrimonious divorce is on the horizon the court will obviously want to listen to the entire recording of this conversation the transcript alone is simply no substitute for the tone emphasis and true meaning of what both mr. Depp and aeh say to each other and is critical to a proper and informed understanding of the real dynamic of their relationship it is this dynamic which lays at the heart of the question of whether the defendants can prove their case that mr. Depp quote beat his wife causing her to suffer significant injury and on occasion leading her to fear for her life furthermore the true dynamic of their relationship that is revealed in these recordings and the way they speak and interact is the clearest possible contradiction of the suggestion that mr. Depp has been repeatedly violent toward aah and that she was in fear of her life from him and she and the defendants maintained quite the reverse we say this is not the only recording though where aah admits to violence against mr. Depp for example in a further recording disclosed in the course of the u.s. divorce proceedings aah admits to having kicked a door into a crouching claimants head and then punching him in the aftermath of the incident which started with her coming at him in a bathroom to which he had to remove himself from her and him then accidentally opening a door onto her toes as she except she act admits that she punched him in the face on purpose but denies someone strangely that she kicked the door into his head on purpose there is no mention that he responded in any physical way to these acts of violence against him her instant resort to violence that and his nonviolent reaction his direct contradiction to the evidence which she seeks to give in her witness statements similarly in a recent disclosed recording made by a H of the one-on-one meetings she saw it with mr. Depp in July 2016 mr. Depp refers back to the alleged incident to have taken place around her birthday April 2015 that would be incident 13 he says to her I didn't want you to effing go to Coachella without effing talking to me because I left you because you were effing you effing haymaker me man you came around the bedroom to start effing start punching on me a statement which aah does not deny even though she knows she is secretly recording him as she speaks and at a time when she had already been preparing her case against him for future use so that I think is a very damning statement there for example she's recording him not him recording her what is also telling I did a video on this by the way that is in this meeting between them alone in a hotel room in a San Francisco hotel which was asked for by aah again of her own free will despite her recently seeking and obtaining a domestic violence restraining order again mr. Depp in which she says that she feared for her life because he was so violent and part of this conversation secretly recorded by aah she repeatedly begs mr. Depp to quote/unquote hug her something which he steadfastly refuses to do you could hear mr. Depp asked her with obvious and credulity as appears in the audio of the recording after all the s that you effing accused me of now you want to touch me a clear reference to the allegations of domestic violence she made in order to get the restraining order and the fact that it was untrue aah still persists and one in physical contact despite him calling her effing nuts as a result plainly this behavior is utterly inconsistent with any suggestion aah was afraid of mr. Depp let alone that she feared for her life as she told the LA Court in her request for a restraining order it is also no word this recording was made without mr. dibbs knowledge or consent which meant she was committing a criminal offense in the United States controlling behavior as part of the defense in this context is also important to note that the allegations which the defendant had advanced are deliberately not confined to those of physical violence their stated case is that quote throughout their relationship to claim it was controlling unquote as well as quote verbally and physically abusive toward aah this is presumably a fundamental part of AHS case in an attempt to explain away why she did not leave mr. Depp despite this stream of brutal physical attacks as you will hear and is rehearsed at some length that her witness statement she alleges that mr. Depp controlled her in a number of different but extreme ways from limiting her career to preventing her from driving her own car even to making false and paranoid allegations that she was having affairs with co-stars and other individuals the court will know that this is her positive case in advance by the defendants through her as part of their section to defense of truth it is not some response to mr. Depp's evidence as such the court will need to determine it since she says that it was these false allegations of infidelity the fact that mr. dev would refuse to accept that they were untrue says aah which drove him to violence against her that an on occasion the influence of alcohol or drugs mr. dev will demonstrate as he has and is entitled to that this is completely untrue in particular mr. Depp's case is that it's just another false narrative created by aah in order to make the abuse allegations plausible if as he says it is untrue that he limited her career it is nonsense that she was unable to drive her own car and that she did in fact have a number of affairs then this supports his case in a number of important ways firstly it shows that this is another manufactured lie by aah secondly it completely undermines her stated basis for the allegations or violence she says he became physically violent because he wrongly can convinced himself that she was cheating on him that is her evidence thirdly it flatly contradicts the suggestion that she only endured such a catalogue of repeated violence because she was so hopelessly in love with mr. death something that is utterly inconsistent with her persistent unfaithfulness the court will need to decide this issue it has to decide it because this is what the opposing party cases are as each will explain in their evidence as will their supporting witnesses of course this is the inevitable consequence of a very wide way in which the defendants have deliberately sought to prove their allegations and in particular how aah is chosen to explain the reason why mr. Depp was supposedly violent if there was no reason than her allegation of violence falls away as to the influence of drugs and alcohol mr. Depp has been frank about his use of both at various times throughout their relationship as well as his life more generally as the court has already heard he has already had a well-documented problem with prescription drugs aah we say miss Bendall is frank about the nature or extent of her use but she does admit to it on any view however this is a couple for whom the consumption of drinks and drugs was normal in common place the same is true of their way of speaking to each other and their friends the profuse swear the use of extreme WordArt metaphors and the general quote unquote bad-mouthing which can be heard on recordings or seen in text and other communications is just part of their everyday lexicon of their relationship even if it looks surprising to those outside of it or unfamiliar with mr. Depp or aah despite the Ferrari which has been created around the issue of disclosure of documents referring to drugs the only relevance that this really has in the extent to which if at all the defendants can prove that the consumption of drugs and alcohol on our particular occasion made mr. Depp commit acts of violence against aah as opposed to simply being wasted or similar especially given what must be their tolerance of such substances of course unless the court finds that there were actual acts of violence committed by mr. Depp he is use of drugs or drink is irrelevant that's a big thing there to substance abuse does not equal domestic abuse continuing now this next part comes up in the sons documentation all kinds of stuff there it is in this context that aah has sought to rely on what is called the monster for aah it appears she is now saying that this is the person mr. Depp allegedly becomes when he is carrying out physical assaults which she claims she suffered from mr. Depp it is meant and intended by both of them in a far more nuanced and metaphorical way referring mostly to the negative to turn which their arguments would often take it was a term first applied by aah which he later adopt as part of vocabulary of their constant verbal arguments however it was certainly never intended or understood as a reference to some alter ego which assaulted her nor some sort of shorthand for physical violence nor do the contemporary igneous references support any such suggestion this seems to be a later construction by aah for example on the 26th of September 2015 mr. dev and eh-eh-eh had a long exchange of text messages as well as demonstrating the use of the term their amassed these messages also give us a further insight into the true nature of their mr. Depp messaged his security because he wanted to split I leave and avoid confrontation with aah in the ensuing text between him and aah her complaint is once again that he leaves her at the first sign of trouble she repeatedly pleads with him to call her while at the same time using the term monster tellingly there is no connection or association in these texts between the monster label and any alleged violence on the part of mr. Depp quite the opposite when mr. Depp replies he refers to what prompted him to split in a long text he said your mood swings and tempers are going to F us over if you don't calm down and think about what you're doing wouldn't even admit to clocking in the job to Travis who by the way I asked to be ready to come up because I knew that you'd get effing violent again aah is ensuing message do not dispute or take issue with what this clear record of her violent behavior towards him or his fear about what she is capable of doing hmm so it sounds like he's afraid doesn't it this exchange continues and the pair referred to mr. Depp leaving the marriage aah says I don't think I could make you happy to which mr. Depp replies I have also summarized that for the last five or six sucker punches to my face and head that you aren't at all happy again tellingly aah does not dispute the characterizations of their relationship as her being the violent one instead she simply apologizes for quote unquote having issues Estee aah the documentary evidence shows that she is a highly complex and aggressive individual who suffered extreme mood swings who provoked endless circular arguments and would fly into violent rages during her relationship with mr. Depp as we say and as partly admitted she was taking a wide range of prescribed medication and other drugs and her behavior was extremely unpredictable more importantly the description of her being controlled by mr. Depp is fatally undermined by her true position as well as the recordings of their conversations as listening to these conversations demonstrates much more so than reading the transcripts she is largely in control of the situation even if not her feelings capable of standing up to and even physically attacking mr. death and generally being in no way scared of him let alone quote unquote in fear of her life when they argue indeed the far from her character that aah will seek to portray herself as she was the one who controlled their relationship and both wanted to and got her own way she got to live in an amazing penthouse which mr. Depp owned at the iconic historic Eastern Columbia building she moved her friends into the journeyman houses which mr. dead own she persuaded mr. Depp to support her career such as attending the Toronto Film Festival with her for her role in the Danish girl in September 2015 which got him into trouble with the film company and far more importantly when asked to sign a prenuptial agreement she created a huge argument and point-blank refused which mr. Depp accepted as he loved her and he wanted to marry her he also accepted that she did the same thing when he asked her to sign a post-nuptial agreement instead as to the suggestions that mr. Depp controlled her through his false and paranoid accusations of infidelity this we will say is also untrue as is the false narrative that aah has constructed around it in order to quote/unquote prove that the acts of violence she says she suffered as a result aah consistancy lied about her infidelity or relationships with third parties this even started with the argument the day that they both attended the set with the documentary of Keith Richards was being filmed along with her sister Whitney in March 2013 mr. dev will say that this argument was caused by him discovering a eh had been lying about the nature of a relationship with the Spanish quote unquote friend of hers whilst there was no physical fight about this at all it was an upsetting argument about her habit of lying aah had ascribed the argument on that day they were at the set to mr. dev being angry about a painting of her former wife hanging in the flight that he tried to set fire to and hit her so hard during the ensuing argument that he caused blood from her busted lip to hit the wall aah claims that this argument caused by mr. Depp's violent reaction over the painting led to the whole filming being held up much to the annoyance of everyone on set that's incident to mr. Depp says that this is untrue the court will hear the two conflicting accounts and decide which is correct as it will the other incidents this is just one example if mr. Depp is correct and it was him confronting her correctly with her lies about a male quote/unquote friend then the argument involved no violence by contrast AHS account if believed involved a huge argument about a painting in March 2013 with her being left with a busted lip caused by mr. Depp in a thoroughly annoying film set this is just one example but it does show that the truth about her infidelity is plainly relevant aah has made it an integral part of her quote unquote a lie the affairs which we say aah was having with other third parties during the course of the relationship clearly undermined the suggestion that aah was so controlled by mr. Depp Tate James Franco for example who is specifically mentioned by her in a list of co-stars whom she will say mr. Depp wrongly accused her of having an affair with their CCTV footage taken only hours after the alleged incident on the 21st of May that shows him being escorted up to the matrimonial home by aah who comes down in a lift to meet him in the parking garage below and then takes him up to the penthouse suite she shared with mr. Depp as the footage shows despite the pains they take to avoid the CCTV camera filming their faces she and mr. Franco are already intimate by this date another example is the well-known billionaire Elon Musk the space and vehicle entrepreneur we know that aah was publicly admitting to being in the relationship with mr. musk shortly after a split with mr. death however mr. Depp will call evidence to show that this relationship started long before then one of the concierge for the apartment building will testify that in March 2015 while mr. Depp was away aah would be visited late at night by mr. musk and so frequently that he was eventually given his own key to the penthouse mr. musk we will say is plainly rocket man the man with whom aah exchanges text only hours after the 21st of May incident in these exchanges Rocket Man expresses how much he likes her and how sorry he is for something had previously done which meant she had stopped speaking to him he is quick to offer to pay for around-the-clock security when he is told of the allegations against mr. death and explains quote the offer would stand even if you never wanted to talk to me again anyhow sorry for being an idiot the radio silent hurts a lot it only matters because I really like you it is obvious that these that mr. musk and eh-eh-eh have been involved in a relationship prior to the 22nd of May has already explained as well as proving to her account of being controlled by mr. Depp is simply an invention a false narrative created for this alleged abuse the affairs carried on by aah also showed that the suggestion she stayed in the relationships despite his violence because she was so in love mr. Depp is wholly unsustainable moreover as the documents demonstrate and mr. Depp's witnesses will say aah clearly got her own way and was prepared to lie or attempt to get others to lie for her even if she got into trouble in the process for example as mr. Kevin Murphy mr. dibbs estate manager will say aah was told and knew full where that she would be acting illegally if she took her dogs into Australia in April 2015 without the necessary paperwork vaccinations or quarantine she ignored the warnings this has nothing to do with mr. Depp as he never wanted the dogs to travel from LA in the first place however as mr. Murphy will say aah was not prepared to take no for an answer when the Australian authorities found out and wanted to press charges eh-eh-eh sought to prevail via Kevin Murphy upon her former assistant miss cage aims to provide a false witness statement to the court in order to exculpate aah even her US lawyer Marty singer warns aah when she asks mr. Murphy if she should get miss James to provide this statement you will have to be careful that she will cooperate and will not go public if you ask her not to be truthful in the end miss James was not asked to live but mr. Murphy was still working for aah and mr. death and he did feel he had to lie for her he in fact provided a false declaration for aah to use in relations to the criminal charges she faced in front of an Australian Court as he will say he was so troubled by the false statement that he later sought independent advice as to how he might withdraw it and what sanctions he might face in Australia as a result as the evidence will also show this is not the first time that a eh has been prepared to lie to get out of a difficult situation again even the face of legal sanctions as miss James will also say in the documents show we suggest eh lied to the US Department of Homeland Security by falsely stating in a letter that her set assistant Savannah Macmillan was just a personal friend and has never worked unlawfully or otherwise in the United States or for me this was a response to the complaint about the fact that mr. Macmillan was only on a tourist visa in the United States and therefore working illegally once again no further action was taken it appears based on AHS false statement the starkly contrasting nature of the evidence the starkly contrasting nature of the evidence given by mr. Depp and aah is one of the defining features of this case and the court will obviously need to resolve their conflicting testimony there's no real room for a middle ground here one side is plainly lying and to an extraordinary extent either AHS allegations are true in all of their various forms now or therefore mr. Depp is chosen to launch and pursue a lengthy libel claim despite knowing but the article which forms the subject matter of the claim is completely true or as we say aah has concocted in embellishing and adding to them over the years include leak ompletely fabric the ones which were made for the first time shortly before the trial was adjourned and her said to Abby to private and horrific to be heard in open court which means that mr. Depp is right in seeking vindication before this court from a hugely influential newspaper that is sought to act as judge and jury by energy by endorsing and convicting him in relations to AHS allegations not to mention demanding an end to his career as the punishment he supposedly deserves you might be forgiving for wondering why mr. Depp put himself through all of this process otherwise ie if he were in fact guilty that is the determination for this Court mr. Depp is either guilty of being a wife-beater for having assaulted his ex-wife on numerous occasion causing the most appalling injuries or he hasn't been very seriously and wrongly accused notwithstanding the starkly contrasting accounts for aah and mr. Depp themselves there are a number of witnesses who come to give evidence for each side for miss her their sister and a few friends save for one incidents where her friend her sister Whitney will claim she was present all be that is mostly an incident even on their account where aah punched mr. Depp none of the 14 incidents when mr. Depp is alleged to have attacked her repeatedly in a violent manner were ever witnessed by any of them mr. Depp intends to call a large number of witnesses to support his case which is effectively a denial that he did attack her on these occasions while some of these witnesses who will provide no such attack did take or could have taken place on the dates and questions our friends or employees of his a number of them are not they are also independent witnesses who directly contradict our completely undermine AHS evidence that is of course over and above the sheer and probability we say as well as the inconsistency of the versions of our offense she and her friends are now giving as I will explain in a moment these independent witnesses are extremely important as the result especially to some of the later incidents it is obvious though that the credibility of aah or mr. Depp is also key to the incidents of alleged violence if a HR friends are found to be lying then I don't know when this proves that particular allegation of violence on that occasion but crucially it undermines the defendants case as a whole in particular if aah is found to have invented any allegations of violence and is inherently unlikely that the other allegations are true she would not resort to invention if this were true that mr. Depp was a wife-beater which she denies there would be no need for aah to do so inventing instances of violence and running the risk of being caught out lying is a risk worthy of taking only if the central allegation is untrue the court will need to carefully consider the nature and development of a h's account of these incidents this is particularly so with regard to the new and atrocious allegation which will be heard in private an allegation which has never been raised before in any litigation over the past four years if as mr. Depp says this is just fiction and the Court finds the allegation is untrue then we will say that the only reason for her inventing it in the face of this trial was because aah realized that her other lesser allegations of violence would not be believed by the court there is no other plausible explanation for such an extraordinary behavior of course if the Court finds it to be proven then the defense is likely to succeed it is not proven however then we say the reverse should follow for obvious reasons that is how high the stakes have been raised by H and she and the defendants must know that the incidents here as the court will hear some of the accounts of these incidents are very short and depend on relatively straightforward he-said she-said dispute between mr. death and aah since known as president and there's no evidence at all to support the allegations other than aah is word there surrounding the circumstance and credibility will obviously be important this is especially so where there are injuries claimed by aah and contemporaneous accounts and documents demonstrate that there were no such injuries or the incident could not have taken place for example in relationship to what is said to be the painting incident in March 2013 incident to the southeastern Asia train incident previously alleged to have been August 2015 but now July incident in our the Thanksgiving dinner episode in November 2015 incidental leaven again if the Court finds that aah has invented these allegations that our whole case is fatally undermined some incidents though are said to be longer and the conflict of evidence involves more detail for example in relationship to the incident which is alleged to have taken place on the 15th of December 2015 incident 12 H describes this night as quote one of the worst and most vile at nights quote unquote of a relationship with mr. DEP a legend that he slapped her heart grabbed her by the hair pulling large chunks of hair and scalp out of her head in the process dragging her through the apartment and up the stairs punching her in the back of the head the threatening her deliberately and violently head-butting her on the nose causing bleeding and searing pain and screamed at her that he was going to kill her or so she says aah will claim that she screamed and feared for a life that she suffered severe headaches and other pain for at least a week afterward her injuries presumably being so severe and pronounced despite this extraordinarily brutal incident on AHS account there are text exchanges the following day the 16th of December which show aah sending perfectly cheerful text to mr. Depp's daughter about the mall spending family time yay over Christmas together in the Bahamas hmm furthermore even though it became clear she was not going to the island aah suggested meeting up with mr. Depp's daughter that day or the next if mr. Depp had actually inflicted serious facial injuries on H by beating her up why was she even considering meeting them his with his daughter whom it must be assumed would have asked about any such prominent invisible injuries if a HS account were correct in fact we know that it was on that evening December the 16th when aah appear for the recording of The Late Late Show with James Corden there is a clip which the court will no doubt want to wash of aah being on this show as well as a number of still images of her her account is clear le uncanny consistent with the serious and obvious injuries which she's claimed that she inflicted just the night before namely two black eyes a busted lip a broken or seriously damaged nose and torn out hair furthermore mr. Depp will call Samantha McMillan AHS stylist who was responsible for making her ready for the Late Late Show that night the independent impartial witness will give evidence that she worked with aah that day saw her without makeup on it all and saw no visible injuries bruises cuts or marks on a H's face a couple of days later on the 18th of December we have further insight into the couple's recent argument courtesy of a text from mr. Depp to his friend Isaac B I'm staying up at Sweetzer for the moment the ph3 marriage has gone sideways we've been amazing for like four months and then her effing temper can't live like that man she's gonna effing kill me one day another example of one of the more colorful or dramatic stories which is told by her with extensive details is what aah is referred to as the three date hostage situation in Australia in March 2015 or incident 8 in early March the couple was staying in Australia mr. Depp arriving earlier to film the Pirates of the Caribbean movie mr. Depp's evidence is that his lawyers had been in contact with aah about a post-nuptial marital agreement her having declined to sign a prenuptial agreement and having got her own way on that and she was clearly angry as a result there can be no dispute that aah berated him continuously in Australia aah describes the couple's confrontation as like a three-day hostage situation bear in mind the presence of security personnel at their property her version of events is inherently implausible AHS account will be that they argued and then mr. Depp quote cut off for broke his own finger mr. Depp says that during an argument she threw two vodka bottles at him one of which smashed onto his finger as he rested on a marble bar top severing part of it entirely although he was keen to cover for aah for having caused it in this way this act of violence required hospitalization and surgery for mr. Depp as the rather graphic photos demonstrate by contrast despite claiming multiple injuries herself during her account of prolonged violence toward her on this three day ordeal some of which she has requested only be heard in private given its horrific nature aah did not seek or require any medical attention Iyer while in Australia or when she returned to LA without mr. Depp it was mr. dev who asked aah to leave not the other way around furthermore there will be evidence called by him for those who were present and saw her at the time evidence which shows the absence of injuries consistent with this horrific account it is striking that despite so aah says having made a conscious decision to catalogue mr. Depp's alleged violent behavior the only photograph she took from Australia appear to be of the house there are no photographs of aah of parent injuries despite the days of brutality she claimed to have endured bearing in mind her stated decision to document matters her failure to do so is telling finally there is the night of the 21st of May 2016 the last incident of alleged violence incident 14 the day after mr. Depp's mother passed away he returned to the penthouse flat where aah was still saying with her friends installed next door in order to break the news that he wanted to bring a final end to their marriage this was mr. Depp the claimed abuser bringing it into the marriage knot aah the claimed victim aah is account of the event is then in the ensuing argument partly over the human faeces left on the bed by aah or one of her friends mr. Depp apparently wound back his arm like a baseball pitcher and threw her phone at her face us hard as he could from a point-blank range causing her facial bruising to her right eye and her cry out in pain he then grabbed her hair and started yanking her around slapping and shaking her she says that part because of her fears she had already arranged for a friend rocky we're gonna call Rocky instead of Raquel to come over and another was the input on the speakerphone IO till it right suppose only to hear what was going on the police were called and arrived as did mr. Depp security team to Los Angeles Police Department officers who attended the scene one of them a very experienced officer with domestic abuse issues had already given a deposition in the u.s. proceedings their independent evidence completely refutes the account given by aah they saw absolutely no sign of any injuries to AHS face no bruising or swelling of anything else thereby entirely contradicting her account of the violence she says she suffers at the hands of mr. Depp only short time before they have been asked to attend the court for this trial as well that's not all mr. Depp will also call evidence from the concierge team that worked at the apartment block who also confirmed that they saw no visible injuries at all on AHS face in the days following the incident quite the opposite there are also images of her which have been captured on CCTV footage from the building in the days following the alleged incident footage which shows aah without any signs of facial injury despite her account to the contrary in addition there is a photograph taken at the party she attends for a friend Amanda Deb however you pronounce that the very next day 22nd of May which shows a smiling and Follis I H devoid of any such facial injuries and yet by the 27th of May aah attends the LA courthouse to seek her ex parte a temporary restraining order against mr. Depp for alleged domestic violence very publicly sporting what appears to be facial injuries which she claims she suffered during the incident on any view it was a busy week for aah not only did she decide to file her petition for divorce ahead of mr. Depp on the 25th of May she also prepared and filed a request for a temporary restraining order instant for the application on the 27th of May that date range is wrong by the way in addition she also had a forgiving liaison with mr. Franco as the CCTV footage shows on the 22nd of May hours after the alleged incident of brutality while she simultaneously in communication with mr. musk a billionaire businessman with whom she had clearly had liaisons during the course of the relationship with mr. death and he wanted to restore their really azon as they plainly did shortly afterwards there will be a lot to say about this final incident in 21st of May not least because it is one of which aah principally cited in order to obtain the temporary restraining order which first made her allegation of physical violence by mr. Depp albeit now much embellished adapted or added to and that she supposedly feared for her life a matter of public knowledge for the moment it is sufficient to say that this allegation of violence is yet another lie again if the court finds its evidence demonstrates no such injuries were sustained by aah but she had manufactured this too then given the significance which was placed on this alleged incident so publicly by aah it is hard to see how it can be accepted any part of her account of being the victim of physical violence meaning the defense of truth and the burden and standard of proof now there was a relatively brief summary of some of the main incidents that surround the principal question to be decided by the court in this case namely whether the article is true or not in the meaning which we say it bears although the court may understandably feel that is not one which will occupy it for long there's still a measure of dispute between the parties or so it appears on the statements of the case as to the meaning of the article complained of we say it is beyond doubt that it unequivocally states that mr. death is guilty of some serious physical abuse ie in terms of levels of gravity it clearly conveys a meaning of guilt this seems to be agreed upon by the defendants as does the fact that the article also suggests that mr. Depp caused aah significant injury and that he was so violent and dangerous that he put her in fear for a life put shortly there is no dispute between the parties therefore that the article accuses mr. Depp of extreme and repeated violence nor could there sensibly be any however mr. Wooten and the son appeared to challenge the suggestion that the hook for the article was a decision by miss Rowling who they accused of being a Hollywood hypocrite to stand by her casting of mr. Depp in the then forthcoming film from the Harry Potter series fantastic beasts if it needs to be spelt out this casting decision is mentioned in the headlines as well as in the body of the article itself and the photo caption to the outrage possessed by mr. Wooten its author at the decision to give mr. Depp a leading role in this major film despite its being overwhelmingly clear that he is a wife-beater or so says mr. Wooten is an essential and damning element of what the article was trying to achieve indeed it is off the back of this that mr. Depp is said to be unfit to work in the film industry at all a statement to which false credit II is linked by the misuse of a quote from the highly respected hashtag me to campaigner and Weinstein victim miss Kendall as I say this measure of dispute about the meaning of the article may not be trouble for the court for too long but has been raised by the defendants once the court has made its finding as to what the article meant then really there can be only two issues left to decide the first is whether the allegations published by the defendant are true if they find these are untrue as we say they are the court will proceed to award of damages and what come as no surprise to hear that this case is not about money it's about vindication mr. death has made clear that at various hearings that is why he has come here to clear his reputation and if the Court finds that has been wrongly traduced by mr. Wooten and the son and it will determine the appropriate figure to reflect the serious of allegations the way in which they were published and their likely impact I will address you on that the relevant factors and the correct Roach they should be taken in this issue although the court will be familiar with these principles at the end of the case in the meantime there is only one thing left to say about the defense and the position of the defendants as I have already explained whatever may be said of AHS motives from the publicly making such allegations starting in May 2016 mr. Wooten and the son chose deliberately and wholeheartedly to endorse them there was no reason to have done so little on to do it with such vehemence it is important to remember as the court will no doubt hear that where an action for liable a defendant seeks to prove that the claimant is guilty of what amounts to a criminal offense they need to be cogent and compelling evidence of charge before the court can find the matter proved lawyers talk about the need for compelling cogent evidence where a criminal allegations are made in the civil context the public would see that this is an operation of the presumption of innocence until proven guilty this principle squarely apprise to this case it is against that starting point that mr. Wooten and the son need to prove their allegations they chose to repeat and endorse the allegations that mr. Dib is a wife-beater guilty of serious physical and unprovoked assaults on aah they have chosen to persist in defending them in this proceeding and now they must prove them to this court to the requisite level that is the claimants opening and with that introduction and with your Lordships permission we'll call our first witness mr.
