proved myself to them that I could do the job that they would warm up and I would be accepted as a member what impression did you have of police work before you became a police officer it was very exciting it looked very rewarding it was challenging it was a physical job I thought the department looked like a very good place to work I loved being a cop all right what exactly happened I don't lost my career I'd lost my self-esteem my whole life was destroyed I didn't know if I could ever return to the Long Beach Police Department because of the fear of retaliation I could hardly function as a human being let alone a police officer it's not just the attack it's the constant hostility and hatred since the day I joined the unit you can take it and take it and then you can't take it anymore you can't work like that the seal you mean you're going after workers comp I just need some stress Leif it's going around first Miranda Berkeley now you what happened to hypoglycemia and well they all know they can get away with it because nobody stops them higher up okay you know you may be home all day but I happen to still work there department paychecks pay the mortgage and the food and the clothes and the cars and the toys oh and I'm supposed to be grateful I know what happened to me in the department let it happen you need to start thinking about some beside yourself Kathy an ia team can bring her in is that right you're risking a charge of insubordination officer no actually according to union rules I'm not I'm calling the Union you do that Cathy the ia is on his way it's one of the defendants this is a civil rights case to demonstrate a pattern and practice of tolerating sexual harassment the defendant should be the city of long beach we're dropping the individual cops even the k-9 cops yes all of them why because each of them hired their own lawyer who would have the chance to cross-examine you it would be a feeding frenzy no this is great I'm divorced unemployed I can't even afford a babysitter and they're not even gonna have to testify no no we can call anybody we need for our cases a witness and the city can call the k-9 boy stur about your testimony if they dare my guess is they won't what about Harry I'm counting on it all rise the United States District Court for the Central District of California is now in session the Honorable Harlan Upshaw presiding I knew from prior contact with Miranda that she could be very violent she threatened me on numerous occasions she threatened to do herself she threatened to do my family she threatened to herself in front of my family Miranda Berkeley has stated that you followed her so closely in the police building that she could feel your hot breath on her neck did you in fact do that no I did the best I could not to be around her I didn't want any more trouble with her did you glare at her during the course of squad meetings no did you destroy her labor cards no isn't it a fact that Miranda began to distrust you more and more because you told her lies after she threatened us both their gun I told her exactly what she wanted to hear and you told her you loved her I did tell her I loved her but that was only because you were afraid of her is that your testimony sergeant she could go off on me in a heartbeat I mean we'd be sitting in her apartment on the couch having a rational discussion and all of a sudden she'd go off on me it was like a Jekyll and Hyde type personality so you yourself had no interest in her whatsoever aside from wanting to protect your family and to protect yourself I didn't have a romantic interest in her I still you know valued her as a person didn't you continuously seek her out range to have dates with her to take her on camping trips with you those trips in our relationship went on at her insistence not at night but the answer is yes isn't it yes sir the answer is that we did go on trips and we did continue to see each other how many trips did you take together I couldn't give you a number eight or nine and each of these lasted two or three days I'd say probably two or three days so the only reason you went away with her was to break up with her is that accurate that was my intention now you often wrote loving notes to Miranda didn't you sometimes alright and in these notes when you said love and miss you those were lies is that correct some of them work well which were lies in which were the truth well I have a problem with these notes I mean I don't know where in the relationship I wrote it suppose you tell us the period of time when statements like love and miss you and kiss you and statements of that kind were the truth and when they became lies from the beginning of our romantic relationship up until the time I started to break it off and after that you didn't mean it I didn't say I didn't mean it all right trying to keep peace no further questions the witness may step down now chief you ordered a survey taken of the department's policewomen regarding sexual harassment excuse me would you turn to the second page of Exhibit A their first question have you experienced sexual harassment within the past two years yes 83% no 17% did you consider that a serious problem yes ma'am as a result did you discuss the issue of sexual harassment with your supervisory personnel I know I said a boy's remember sexual harassment is out there and you've got to be sure that all of you pay particular attention to this as a major issue you also stated in your deposition mm-hmm quote I don't believe I have any problem with sexual harassment in the Long Beach Police Department and quote so which is it G objection argumentative I'll withdraw that you nailed his feet to the floor oh that was a short moment Rafi we're gonna need your ex why we talked about this I'm not going to ask him the police department ruined your marriage and they broke up your family the jury needs to cry about it that will leave him out of this he's doing just fine in the department and he doesn't need the hassle neither did you I don't want you calling him Louis noted did you reach any conclusion as to why sergeant McCarthy was engaging in hostile conduct towards you yes he wanted me out of the department I didn't want to have anything more to do with him and I asked him to just leave me alone and what effect did your request have on the way he was acting he just got angrier and angrier and all of his antics just got worse the examples of treatment you received after the internal affairs investigation began how frequently did you experience conduct like that it seemed like every day once a week at least actually it seemed like it was happening all the time what finally ended up leading to your departure from the department I just couldn't take it anymore I was depressed I felt like my life was meaningless Brian lost my self-respect are you seeing a psychiatrist Miranda yes ever since I left the department and have you been able to work at all since then I worked for a while at a bird farm putting birdseed into sacks and now I'm working at a rubber stamp store what's your wage by 50 an hour and what were you earning when you were last employed as a police officer $18 an hour no further questions if there were jokes of a sexual nature told I never heard them well did you ever hear profanities in the k-9 meetings I've heard profanities now some nights you stayed for the training sessions and some nights you didn't isn't that correct sergeant on occasion I would uh I would go back to the station and take care of some other administrative work mm-hmm and how often would you do that approximately I couldn't say were you present the night that Kathy was bitten by two of the canine dogs no I was not and yet when Kathy tried to contact you as her canine supervisor you were not at the station you were not on the computer you did not answer your radio where were you sergeant objection your honor this is just totally irrelevant I am trying to establish the units absence of adequate supervision Your Honor the witness is directed to answer well I am I don't recall where I was on on that particular evening I I might have well I I could have left my beeper off you know by accident no further questions Kathy did there come a point in time when you had a discussion with your husband about how all of this the internal affairs investigation and so on was affecting him at work he was taking a lot of retaliation for my having filed this lawsuit objection your honor hearsay that's true go on to another issue please did your relationship with your husband suffer as a result of the incidents that you have testified about our relationship deteriorated from that point what happened it resulted in us being divorced what led to the divorce well she just said it was a factor I mean we're not trying a divorce case your honor I'm aware of that and I'll be brief what was it that affected your marriage when you went on leave it changed my personality I was withdrawn and depressed all the time there wasn't much of a wife it was hard for me to talk with him about police work about his police work there was just so much pressure on him it were objection your honor this is classic hearsay sustained the plaintiffs call Rob Arnold to the stand when was the first time you ever heard Kathie express any of the concerns that she had about the treatment she was receiving as a member of the k-9 unit from the beginning they treated her like she was dog crap they worked on her and worked on her until they just wore her down when you say they worked on her what do you mean by that the attitudes the isolation the language they used the jokes and the crudeness it was like she wasn't even there did the problems Kathie was having with the unit affect your marriage she started getting stomach aches and headaches she needed a lot more sleep limits used to be a very outgoing person she turned into a different person we still do a lot of things together we used to hike used to backpack a lot of things all that stuff is gone and our son as our little boys to be able to kiss us both good night it's never gonna happen for him again did you and Kathy have any marital problems before she went with the canine detail no none at all they were like the golden couple like we would still be together what happened to her hadn't happened to her I loved her I still love her but you know she's never gonna be the person that she was they damaged her when she can't even work she's such a mess no further questions we'll take a 10-minute recess thank you it's no big deal no sure it was you didn't say you were going to testify Louis seems like a pretty good lawyer it wasn't my idea to call you I know that you should have told me you were going to testify remember that for the next time how are you fine you seeing anyone [Music] how can the jury take three hours after five weeks of testimony Illya we're so convincing is that bad fast verdicts tend to go for the defense three hours I think that's a personal record well I won't tell anybody if you don't in the case of Cathy Arnall and Miranda Berkeley versus the city of Long Beach do you find that the defendant violated the plaintiffs constitutional rights under 42 USC 1983 yes do you find that the defendant violated the California fair employment and Housing Act yes was the defendants conduct approximate cause of damage yes what is the amount of damages you find for the
