hey everybody hope you're all doing well my name is steven and this is the story time channel today we have some malicious compliance stories and our first story of the day is by vizsla man only take breaks when i tell you to sure no problem i used to work at a call center where we would get flooded with calls constantly this is a story of how a busybody boss thought they understood everything since they were in charge at work we were given two 15-minute breaks and one 45-minute lunch break the breaks were scheduled into our day so you could see when they would be but this would change day by day my role was a bit different than the normal agents as i was specifically dealing with the higher issue calls these calls could take up to one hour to complete and the caller would need to stay on the line unless they were fine with a call back later but this was rarely the case since i never knew when i would be getting these calls my break times were a shot in the dark if i would or wouldn't be on a call i would just take them as soon as the call was done if they ever intersected which they did 99 of the time enter my boss during a performance review i hit all the marks except for attendance i asked about this as i know i missed a few days but always with a reasonable update for time frame and never had a no-show day where there is no warning that i'm not coming in my boss stated that attendance also applies to break and lunch times and since i rarely took them at the requested time i was getting written up i explained my role that they hired me for and the challenges involved they did not care and stated i needed to take breaks when i was told to i asked for them to send me an email so that i could print it out put it on my desk and never forget again my boss smiled ear to ear probably because they thought i was groveling at that point and sure enough they did stating in the email you must take your breaks only when the schedule tells you to no time else there is no excuse i saved it printed it out sent a copy to my own email and followed it to the letter next call that happened that same day of course had the long call crossing over with a break issue i asked the customer if it would be okay for a call back they said no i stated that unfortunately i cannot stay on the line as i am required to take my break they became enraged and demanded to speak with my boss i told my boss they said that i need to apologize and finish the call i showed them the email they just sent to me and said you told me to take my break at this time no matter what i'm just doing what you told me to do i'm taking my break would you like the customer transferred over or should i just hang up they took the call over and from that day on i never had a missed attendance mark god busy body bosses are the worst let me ask you guys in situations like this where it comes between your boss being upset at you and the customers being upset with their experience which side would you tend to lean towards do you think it's better to comply with the boss's demands to the letter and take the break even if it's in the middle of a call or do you think it's better to finish out that call make sure their experience is okay and try and explain it to the boss afterwards let me know in the comments down below our next story is by original deadly sin if only you hadn't argued working escalations complaints to a supervisor for internet tech support i have an agent send me an angry customer over because he needs a tech to his house but doesn't want to wait for our first available window that's not unusual what is unusual is that the window is 12-2 monday and it's currently 10 30 on monday yes that's an hour and a half from now that's insane for us we're usually about two days on average to have someone come out so the agent sends them over to me here's the high points i say this is only 90 minutes away that's extremely fast looking at the tech schedule this is my only appointment available today then there's one on wednesday 4-6 then pretty much anytime from thursday on even having this one available so close is highly unusual someone probably canceled their appointment a few minutes ago for this one to be here i definitely can't do better are you sure you don't want this one no do not book me that time you hear me an hour and a half is too long i want someone now this is ridiculous you people are awful this goes on for a good 20 minutes before they give in fine i'll take it i guess well i have bad news while we've been arguing someone else snapped up that appointment it's not there to give it to you anymore the first available now is that one from four to six wednesday what i want twelve to two today i'm sorry you wouldn't take it so we didn't book it and now someone else has now this goes on for another 20 minutes while they argue both about losing their option for today and how wednesday is too long of a wait fine i'll take four to six wednesday but i am not happy who wants to guess what happened next yup you're right well i have some bad news during that conversation someone booked that time as well we don't have any times until thursday customer hangs up disclaimer in the interest of customer service yes i could have booked the earlier appointments while letting them argue but with how adamantly and loudly they snapped at me when i offered to do so right off the start i was happy to comply and loki hoped for this exact thing to happen i don't know if they called back later or what i never heard about this customer again what did this guy think it was a pizza delivery 90 minutes is unheard of for a tech to come out to your house that's like magical levels of service that guy just had no idea of what's what this next story is by asgorio phones must be left in the office i work in a dental practice and over the christmas period we had too many staff and not enough patients this resulted in a lot of people using their phones during their shift as all of the things they could have done had been finished my manager wasn't happy with this so they sent out an email demanding all employees leave their phones in the office during the day and we can't have them on us i left my phone in my bag in my locker in a locked room i got pulled up for not putting my phone in the office it's one rule for everyone except the receptionist that watches tv shows on her phone all day she's exempt for some reason and if i didn't put my phone into the office i would get a written warning on my record day one i put my phone into the office even though it was safe in my locker but i must follow the rules day two i left my phone in my locker and put an old phone in the office i must follow the rules the rules didn't specify it has to be the phone i use daily just that it is a phone i own edit day three i've been caught out and now i have two phones in the office well now that op has two phones in the office time to get a new new phone and see if they call you out on it again see how many layers there are to this how deep the rabbit hole can go our next story is by jbane law manager says company policy is we do not pay for overtime tech says sure okay whatever sometimes as a consultant you get to see how an office functions from an outsider perspective since you are an independent contractor the company treats you differently than an employee also just due to the nature of the contract work your engagement is usually short term this makes you a temporary fixture and sometimes are just treated as the fly on the wall like you do not exist and this can lead to some interesting observations including seeing train wrecks in progress this is one of those tales not so much about the nuts and bolts of tech support but more about the people and some good old-fashioned just desserts background as a consultant you are always going to be the i.t guy whether you like it or not no matter how you market your services every single company is going to assume you can do anything with a computer and when business is slow this is not necessarily a bad thing if you just need work about 10 years ago i found myself in a situation i got an inquiry through my website asking about assistance deploying some workstations and other mundane tasks usually i would pass on this kind of work but it was winter and the other client work was dry that month a guy still has to pay the bills so i followed up and within a day the scope of work was signed easy stuff the company had its own i.t department but just needed some extra hands i was going to be one of three outside contractors that would deploy some workstations do some server admin work and set up some other equipment for a new department the money wasn't the best but it was time i had free and it was all swing shift work meaning no traffic and i get to sleep in not bad the first day i report as requested about 3 pm and talk to our contact he was a senior engineer in charge of part of the i.t department there seeing he really doesn't have time to do anything more than a quick introduction as they are slammed with work he shows us the ropes and leaves us to it between three of us we break down our specialties and parse out the work everyone knows this is a cakewalk of a job and wants to just get it done fast as the pay was flat rate i take the server work and see my contact who's the system administrator figuring he was probably gone for the day as it was mid-evening i was just going to leave him a note asking him to call me but to my surprise he is at his desk in fact just about everyone in the it department are milling around didn't think much of it at the time just that it was one busy department and the guys must be pulling double shifts he shows me the systems and i get to work around midnight we are wrapping up for the night and the three of us break down what we have left with a senior engineer who is still on site the plan is to wait until friday night to deploy the workstations and get everything in place the senior engineer says most of his team will probably be there all weekend anyhow so it doesn't matter to him i left thinking man that is a busy place those guys must be really pulling down the overtime i wonder what is going on they have so much work as i walked out the door that night soon enough i would find out the deal friday night head to the worksite a little early on friday figuring if we all pull a long night we should be able to wrap it up and i'll get our weekends back things are going great and we are ahead of schedule so the senior engineer offers to take us out to a local diner while we wait for the office to close up so we can deploy workstations without tripping over people at the diner senior engineer says i want to thank you guys for all your hard work we are all overworked and when we got approval to contract out this job everyone was excited i say hey glad to be a service looks like you guys are crazy busy is everyone pulling doubles in doing weekends to handle your ticket load senior engineer says oh we are understaffed so we all have to pull extra hours i say that sucks but must be some great overtime over time not really we are all salary some loophole or something we just put in the time because we all need the job right now the conversation trailed off from there but it left me thinking in this state most it workers are eligible for overtime as a matter of law there is no loophole like that something isn't right back at the worksite i'm in the network closet with the systems administrator hooking up some ports and finishing the server work he is a friendly guy so we start chatting i was talking to your buddy and it seems like you guys work insane hours here i ask trying to fish for a little information systems admin says oh yeah it's been like this for a year 60 hours is a light week these days it is bs yeah the other guy said you don't get overtime the system's admin laughs that is what the boss tells us let me show you something he pulls up an email exchange he had with his manager it is dated about 10 months ago and makes the very point i thought that the entire department should be getting overtime and the law requires it his boss's response in bold and caps was it is company policy to not pay any overtime working more than 40 hours is part of the job deal with it or find another place to work then the system admin smirks and shows me his response to the boss sure okay whatever his emphasis and that was the end of the exchange i say look i'm not a lawyer but you might want to call up the labor department i'm pretty sure it is illegal for you to not be getting overtime then to my surprise the system admin pulls up another email from his personal account oh it is blatantly illegal i asked a lawyer and this was his response he showed me a memo explaining the law and that most likely a lawsuit would be successful this was dated about nine months ago me confused so you guys know you should be getting overtime but not getting paid and everyone is okay with that we all make sure to log all of our hours and document the time me still confused but you still aren't getting actually paid overtime no but we will here's the kicker according to the lawyer the labor department will look back at the hours we put in for the last 12 months and award us retroactive overtime so all of us just log our time and keep records then in about a month we are going to file the claim all together the company is going to be on the hook for all that overtime and they won't be allowed to fire any of us for reporting them either then the coup de gras we all figured when this whole thing started if we pressed the point back then they would just figure out a way to screw us so we just all decided to stay quiet put in the time they tell us to work and we will get our bonus check when it is all said and done if this stuff is all backdated dang that is some cold stone strategizing how many hours do you think you guys have piled up hard to tell everyone keeps their own paper logs to keep it quiet we also don't talk about it too much so nothing gets out but last time we met outside of work it was a boatload of time i figure for myself they will owe me about 13 to 14 months of salary in overtime and when it is all said and done out of damages penalties interest it will probably total almost two years of pay holy so if the guys won't talk about it and seem eager to work all these long hours now you know why we finished up the job that night i exchanged contact information with a few guys and said if they had any other contract work to think about giving me a call that was it until three months later i am at another job and see an email come in from the systems administrator subject line overtime claim hey it guy hope you're doing well we all ended up filing a big overtime claim with the state and the company fired us for supposedly falsifying our timesheets the lawyer is sorting it all out but anyway i wanted to know if i could give your name to an investigator who was looking for witnesses to verify some of the extra hours we worked some details followed i agreed to talk to the investigator and got a call about a week later he asked me some routine questions about times and dates and wanted me to email him over some proof i did the job then he started going into the details of the case we got this company for probably a million in overtime and damages between all the guys in the department plus the firing is probably illegal so that is going to be another few hundred thousand on top of it the insurance company wants to settle and once we wrap up the due diligence work i think these guys are all going to make out rather nicely i didn't hear anything for a while until another email came in from the systems administrator subject line re overtime claim just wanted to let you know that we settled this whole thing company caved pretty quick once it was clear we kept honest logs of our time and the local management violated parent company regulations for the sake of making their site budget look better can't go into details but we all got sizable checks enough to pay off some loans and go back to school i'll have to find a new job but after i get my grad degree that shouldn't be an issue appreciate you talking to the investigators thanks i.t guy man i don't know if i would have the patience to play the long con game like that imagine spending a whole year working countless overtime and not getting compensated fairly for it all just for the idea that at the very end of that year you will get that money back it takes some hardcore people to stick that out and what about anybody that might have gotten fired along the way do they just kind of keep in touch and hop onto that when they can at the end of the year it's great that it worked out but there might have been a lot of stuff that could have gone wrong with that and our final story of the day is by green veins respect your privacy and don't contact you for anything no problem my mother-in-law offered to give us 10 000 for christmas for a house down payment low cost of living state plus we were going to do an fha loan we were elated and grateful christmas comes around and she tells us we can't have a check because it has to sit in her bank for seven days okay that's fine but sort of a bummer so the day after christmas comes and she doesn't even ask she just calls and starts with you can swing by any time and pick up my card for cigs and mountain dew sure i don't mind helping but the entire following week she has us run errands for her things she can do herself but refuses to husband tells her he's not getting out after it just leaded for eight hours straight and she decides to hold that check over our heads if you can't help me then i'm not giving you a darn thing husband tells her to take the money and shove it up her butt what was the task she wanted to sit at home while he drives an hour on icy roads to pick up a mattress and then drag her old one out of the house and discarded in a dumpster that's not even hers i get a text i'm done with you both don't ask me for a darn thing and respect my privacy and don't call me for nothing well i'll be darned if that same day she ran out of propane she wanted my brother-in-law to drive on icy roads to come get her she's been holding his check over his head too and he said he's not risking wrecking his only vehicle to come get her she ended up paying for an express order of propane but she called us that night i can't believe no one checked up on me husband said you told us to respect your privacy if it's a gift then gift it i don't blame anybody for wanting to just flat out give up on that if it's gonna be lorded over them like that they just think that they're better than you and they can get anything they want because they're gonna give you a big sum of money well that's not a gift that's just cruel i'd respect her privacy too but with that being said that's all the time we have for today
