Would Dooley, as the janitor, have keys for the offices so he could get inside to clean? He wouldn't have needed to try to force the door.

This was a tough one. I think Dateline or something covered it a long time ago, as it seemed familiar to me. I don't know what to think. Not enough physical evidence to convict, and who was the unknown guy??? That is key.

How in the world did they prove him guilty beyond a reasonable doubt? It's like they said "we have zero other suspects so this guy is it. yes, okay"

[Music] hey you and welcome my name is mike and in this whole video what we're going to examine is what david dooley john did or did he back to uh kentucky going there a lot lately huh and to the year 2012 when this all began in a sciencey sciency type building e look that's not important what is important is that this would end up going to the courts not just once but twice two times but would the correct decision be made in each in each case or like uh you know not or whatever like this is a crazy one let's get into it [Music] it was very early on the morning of the 29th of may 2012 that michelle mockbee rocked up to work that tuesday it was going to get hot hit about 27 degrees but before it will get there it will get ice cold god i hate that i just said that michelle mockbee worked at thermo fisher scientific it was located in an industrial park near florence north kentucky what do they do you know it's a good question uh kind of everything really it's just alphabet soup to me but like lab equipment that kind of stuff but that's not what michelle did there she was an office coordinator and head of payroll and well i guess she must have liked it because she worked there for 17 years at this stage she even met her husband dan mockbee there they started dating at an office christmas party michelle was 42 years old had two daughters with dan and was by all accounts a well-liked familiar figure in thermo fisher that morning michelle arrived at work just before six am about an hour later a nine or one call was made yes ma'am i'm calling for tunnel fishing scientific and i just walked in her office and i think somebody killed somebody upstairs in our office okay what makes you think somebody killed somebody she's laying there on the ground covered up and there's blood all over the floor in the office okay is it somebody that worked there or yeah it looks like her name is michelle maccabee and they got her like their whole body's covered with plastic in that so you can't see your head or anything and it is obvious he's dead right yes sir yes ma'am how many other office people are there now there's a maintenance a cleaning man he's the one with me when we find her what's the janitor's name and so the investigation began it appears that once she pulled into the building she popped by the warehouse clocking in and then went up to her office it was then roughly an hour later that a co-worker a supervisor who was walking by noticed something on the ground kind of hard to miss a big red stain on the carpet the supervisor then asked the janitor david dooley for help you know finding the source of um that and it led them to michelle now it was a uh very distressing scene what happened to michelle she had been beaten brutally tied up gagged and a plastic bag over her head it had been savage from where the blood was it seemed she had been attacked outside her office and then dragged to where her body lay her office door was still locked she had been attacked before she got in most likely so so she was attacked right after she arrived at work maybe somebody even waiting for her but like who could do something like this and for what reason at a lab equipment maker factory thingy everyone knew each other is a pretty close-knit uh you know place of work and there was only 13 people on the premises that morning it was in an industrial park so not like you know someone could just waltz in shooting the [ __ ] and there was security due to the nature of the items they'd produce so her office door was locked but what was interesting is that it seemed like someone had tried to break in there were markings all over it thing is there was nothing really inside the office she didn't payroll yeah sure but like it's not like she had cash in there you know what i mean like dollar bills just laying around why would somebody want to break in michelle's husband dan you know he was contacted then you know for what you you must imagine must have been like the worst phone call of his life but at the same time you know the detective's immediate question was where were you he was at home in bed he wasn't working that morning they made him take a polygraph he passed so the police swiftly moved on and so the focus then you know moved to who was in the building at that time now uh everybody who was in the building that morning you know as soon as the police arrived they were detained and questioned and none of them looked like they could have done this like what i mean by that is there was no evidence it was a bloody scene and there was no blood or anything like that on any of them it was a violent scene but none of them looked like they had just committed violence so next up there were security cameras that needed having a gu you know to see who was knocking around the building that morning and they saw something a vehicle leaving when all others were entering to start their shift was there a 14th person who disappeared before the police were called no because that vehicle belonged to somebody who had been there david dooley the janitor the footage was at 6 31 am just after the time it was believed michelle had been killed maybe half an hour before she was discovered and the police called then he returned around seven right before the 911 call was made time enough to go wash change you know go and make it look like you didn't do what you just did he also never mentioned it to the police that morning that he had left and then come back 30 minutes later so the police then went and followed up with old dave you know they went to speak with him at his home and they spoke to with david's uh wife janet who also worked a term a fisher everybody works in turmoil fisher apparently big employer i came back here and then i went back to officials we came back here i came back here yeah i couldn't get all of my wife and i won't make sure she was okay yesterday tell me what you think about that they then asked janet when did she see david as in did she see him that morning or sometime later after he first spoke to the police this would prove contentious as to what she said as the recording is bollocks essentially they were asking did he go home did he go home or did he go somewhere and um do some evidence tampering though detective would say she said no he never came home that morning though in another interview she would change that and say she did see him that morning she said he came home to change ripped pants he told the other detective that he didn't come home that day he said he ripped another pair of pants so he um had to come home and just you know grab a pair of pants i never said that okay you didn't wear your pants no okay regardless these discrepancies were drawing the police like a moth to uh you know and they weren't helping themselves they were digging a hole constantly the dooleys one they would never escape from david would say no he never ripped no pants he was worried about janet he thought she was unwell so he popped home to checking her simply that and she was grand so the police uh well you know executed search warrants on david dooley's his vehicle and their apartment and found nothing no blood no but that didn't stop him and almost four months to the day after michelle mockbee was murdered on the 27th of september david dooley was arrested for her murder details in the brutal murder of a northern kentucky mom according to documents 9 news obtained michelle mockbee had deep cuts to her wrists and blunt force trauma to her head mockby's alleged killer went before a boone county judge this morning david dooley worked with mockbee at thermo fisher scientific where the mother of two was found dead in may today dooley's attorney argued prosecutors have no evidence against him requesting dooley's bond be reduced nobody knows what it's like they sit at home and wait for it to get a phone call get to see your husband 45 minutes away through your last window and you know what michelle's family don't get to see her at all so i can only imagine how they feel but right now i can't worry about that anymore i gotta fight for a man that's innocent and i'm going to this would be a hard case for the prosecution to prove you know in court they had no dna no fingerprints no witnesses no slam dunk evidence just um discrepancies really and that's kind of it discrepancies mainly as to why he would have left very suspiciously that morning but that wouldn't stop them and by golly they would get her done it was a process of elimination that done duly all other employees would have been in the warehouse david the one not prosecutors said in opening statements every employee who was in the warehouse when mockbee was murdered could account for their time except david dooley i'd only seen him once and a motive for murder had been uncovered remember the marks on the door it appears that david and janet janet who worked as a cleaner in the thermo fisher plant they had been beefing up the hours they were working they were contract workers but they would also clock in to get some overtime so when david was working and janet was off david would bring janet's card clock her in janet would do the same for david they were actually triple dipping their hours that morning the prosecution said david had been trying to break into michelle's office as she handled payroll and he was gonna fiddle with the time cards see they said michelle had found out but she surprised him that morning and he ended up beating her to death the defense said this is some circumstantial [ __ ] and most importantly none of his dna was found at the scene in fact there was dna found that didn't match either david nor michelle the prosecution's answer was of course nothing was found you know who's the only person that always will have cleaning products on them the janitor what else might a janitor have medical examiner also testified that he believes the murder weapon was an industrial tape gun the medical examiner said michelle died of blunt force injuries it was tough the weapon used to attack her was likely a tape dispenser who had one the defense also noticed that the turmo fissure warehouse alarm had tripped three days earlier on the saturday had someone tried to break in you know gain entry into the into the the factory and then i don't know which way did it go you think will the jury find the defendant david guilty murder under instruction number five david dooley was found guilty and he was sentenced to life in prison courtroom it divided between the people who know i didn't do it and the people who think i did and i feel railroaded i've been run over multiple times in this courtroom in this very spot someone stood and lied and they got away with it it is totally unfair i wanted to treat it i did not kill michelle mockbee and i stand by that and i will continue fighting no matter what happens here today but that's not the end of the story obviously two years after david was sentenced to life thrown away the key you know a couple of things came out and david would appeal one was that there had been a secret romance not between who you think though between lead detective bruce mcvay and the prosecutor linda talley smith this clearly true the fairness of the conviction into disarray now they would say the relationship started after the trial did it though a new development in the david dooley murder case the kentucky attorney general's office acknowledges now that there is an open investigation into some of the players involved in his initial trial they were both called to testify for david dooley's hearing and both reamed by david's new lawyer did you establish a personal relationship with her after the trial or during the trial we were friends dana just friends are you telling me you didn't have a sexual relationship with her or we were friends but you're under oath we were friends did you have a sexual relationship with her are you denying that i think it's in your business i'm asking you to you're under oath this isn't game land here we're asking i'm asking you a question did you have a sexual relationship with linda talley smith yes or no and you're under oath cause she'll testify she'll say tell me what it is your answer is i just said yes was that sarcasm there i mean yeah maybe it is in case anybody missed it yeah also revealed was a letter linda had written to detective mcvay which didn't make them or the case against david look good now that i know what a complete liar you are i am going to grapple with ethical issues with every case in which you are involved and something else was revealed not to mention the fact that you allowed me to go through a complete effing murder trial without telling me the truth about that video and now that i know it what the f am i going to do now what the what the hell am i supposed to do now right see the prosecution were well or unethical and they had hidden evidence from the defense and this would all come up in david's second trial the key part being cctv footage of uh quote random dude the footage of god knows who he is only known by the radical nickname of random dude was at the thermo fisher plant the evening before michelle was killed why he was there no one knows but it's it is odd now of course it appears the prosecutor didn't know about this hence what she said in the letter about detective mcveigh being a bastard man only detective mcveigh then retired detective mcvay knew she learned of it after the trial but she never brought it to uh well anyone but she would say you know okay i didn't learn about it until after the trial i didn't tell anybody about it then but so what you know it's it's footage of a guy he could be taking a piss you know it's not like you see him looking at the camera winking with a [ __ ] knife or something would it have changed anything that about the case no absolutely not what else what about the discrepancy between david and janet about whether he actually was home i've been spending the last few days reviewing all of the interviews that we've done with you and i said when dave left for work that morning when is the very first time that you saw him after he left for work and you said when you guys let him go that afternoon that's how i remembered it well we still don't know if he actually was home but the discrepancy about the ripped pants david's wife janet was hard of hearing so that's what she would later say she thought he had said something about pants sauce and wrote pants and put two and two together all in all the judge tripped the conviction against david dooley he would have trial number two [Music] this went ahead in 2019 [Music] exactly one person was described by the people who worked there as being fidgety and nervous that versus david whoever did it would have had blood on them on their clothes and on the boots that they had to change and come back only one person left that's david dooley the one person with motive david dooley every arrow at the close of this case we're going to ask you return to verdict guilty for murder tantrum of physical the prosecution were once fully you know ready to go to bat against david this time they brought into evidence a screwdriver that was found amongst david dooley's things a screwdriver like it matched the the markings on the door pretty sure ninety percent of screwdrivers will match that another was that david and janet's time cards for that week they were never found so there's a theory that michelle maybe had the cards with her on her person david attacked her and took them and finally we still don't know if david even went home that day after he left the business and then came back early in the morning janet said he didn't then she said he did but for pants he said no pants maybe instead he drove off and got rid of bloody items but no blood was found in the car so and it was a violent scene her head had been uh smashed in so the defense went from it being a circumstantial case to pointing the finger at someone else that's someone else being dan mockbee the husband of michelle he was cleared like early on in the case but what if he wasn't the other one who got his hands dirty you know what i mean after michelle's death dan received 700 000 bucks in do i need to do the life insurance stunts again life insurance and he was withdrawing a lot in cash like payments maybe like paying a killer maybe no one said that no one could say that he was nobody actually saw him there um you know maybe he asked somebody else to do it but he was the only one the only one who knew exactly what time she was going to be coming in that morning the first year of her death two hundred and four thousand fifty eight dollars and nineteen cents i don't believe i'm on so let's just say it's two hundred thousand hash hash withdrawals we also checked his computer and ran a program on his computer he was in a program on his computer it's called cipher scrubbing his deleted files from his computer now i'm not going to get too far into this because honestly it's a ridiculous uh theory no one really believes that dan hired somebody to kill his wife he would have he was devastated when she died he would have no reason to want her dead i suppose seven hundred thousand dollars is a reason but it seemed kind of like the defense were just throwing as much [ __ ] as they possibly could against the wall hoping something would stick the defense also said that david wouldn't have killed michelle for the time card business of course he wouldn't he's a nice guy and no one even knows if she knew about it and if he had done it why tie her up and drag her in fact why move her at all blood gave it away and it wasn't like she was moved somewhere you know to be hidden so why even move her body at all it delayed her being found by like 30 seconds and it would have gotten a lot of blood on whoever did it david dooley's dna wasn't found on michelle's body dooley's dna was also not found on the packing tape that used that was used to bind michelle's wrists behind her back it's possible that julie's dna was found on two items two items only a yellow screwdriver and a plastic bag that was on michelle's head the crime tech explained that there was such a small amount of dna on those items that dooley's profile could not be included or excluded they also said that the shoes he wore that day no blood in them and it's not like he could wash them really there'd be stains once again they aimed to prove you know that there was reasonable doubt in this case and did they jurors could soon begin deliberations in the retrial of david dooley we the jury find the defendant david dooley guilty of murder under instruction number four now dooley became upset and even cried at one point shaking his head no when those verdicts were read you never get over anything like this there's no way you're gonna get over anything like this i mean it's the girl's mother it's my you know michelle was the love of my life i mean and i'm never gonna get past that and uh it's just great that it's over he was found guilty again he still maintains his innocence as to who the random dude is we don't know ditto the dna found on michelle that matched neither of them it's an interesting case uh one that really has me wondering if david dooley is the right guy it's not enough of a slam dunk in either case whether you believe he's guilty or innocent there's enough circumstantial evidence to say well it has to be him out of everybody who was there that day but then again at the same time process of elimination shouldn't be used in murder please let me know what you know you've got going on in the old noodle about this case regardless you won't be eligible for parole until 2032. oh but then in 2020 this happened so actually [ __ ] him [Music] thank you so much for watching i
