And when I see her ex-boyfriend, he tells me she's been tryin'... She's been tryin' to hook-up with him. So you've got all these... All these things goin' on and you're like, "Okay. I know she's cheating." This has been thrown in your face. Yes, Your Honor. How does that make you feel? It makes me feel terrible. And I don't wanna be with somebody who's deceptive and can't... We had a fight and I leave, and she leaves and then she contacts me on Facebook and says, "Oh, by the way, you know, uh, "back two and a half years ago..." BLAKELY: No. You asked me... Hold on. CANDELARIA: ..."I messed around with this guy, "but it was only two times." And that's how she told you? CANDELARIA: That's how I found out. That's how you tell him, via Facebook, two and a half years later. He wouldn't let me tell him in person. JUDGE DANA: (STAMMERING) I don't... I don't understand it. I... I can't get my arms around the notion of waiting two and a half years. And then... And then when you decide to do it... (TAPPING FINGERS) ...just... You know, I mean... You text... You know, you text, "Hey, pick me up some bananas at the grocery store." You... You text, "Hey, don't forget my dry cleanin'." You don't text, "By the way, that thing two years ago... I didn't wanna tell him in a message. "Oh, and by the way, it was only two times." Only two times. Okay. It was only two times, so don't... (STAMMERING) I don't know, Ms. Blakely. That's rough. It is rough. JUDGE DANA: And this probably is the foundation of why you have no trust. Right. Because you saw all those warning signs back at the time, and she denied it, and denied it, and denied it. And then it turned out to be true. And now you're seeing all the same warning signs again. Oh, yes. Oh, yes. Okay. I've seen it several times. All right. Tell us what you're seeing now that makes you believe she's cheating. CANDELARIA: Okay. So, we're at... We're at a friend's house, right. And, it's kind of a party goin' on there that night. And she... She decides to go upstairs with her friend. Female friend. Because you was treating me like crap. Okay. Well, three hours later she comes back downstairs. Well, uh, I'd come to find out there was another dude up there in another room, supposedly. I was not messin' around with him. I was up there with my friend. When she comes back downstairs, her whole demeanor done changed, right. So, she ain't actin' the same way she went up, as she was. Like, she's tryin' to hide somethin', right. So, I said, "Okay. All right. "If you ain't been doin' nothin', prove it to me." I take her in another room and tell her to show me her panties. Well, she pulls her panties down and it looks like she'd been havin' sex the whole time up there. I mean, really? I was... Okay. So, you were at somebody's... At a... At a friend's house for a party. She goes upstairs for three hours... Mmm-hmm. ...disappears for three hours... CANDELARIA: Mmm-hmm. ...comes back downstairs... Yes, Your Honor. ...and her whole demeanor's changed. Mmm-hmm. And then he said, "I wanna see your panties." I'mma let you talk. (AUDIENCE LAUGHING) That does not mean I was messin' around on you up there. I mean, we kinda work the room. You talk to people... Yeah, I mean, but I've never been to a party and been away from you for three hours. I'm like, 30 minutes, 15 minutes... Three hours is the party. At some point, I'm like, "Where is she?" So, I kinda look around and I might see you. You've got a group of people you're talking to, and okay. She's fine. I go on about my business. So, yeah, I'm not sure I'd spend three hours. And, if I suspected she was cheating, I wouldn't wait three hours. I'd be like, "Oh wait. Where is she?" You know? If I had that suspicion. (AUDIENCE APPLAUDING) It's because he was guilty of doin' somethin'. Whatever you were doin'. And you wanted to accuse me of sleepin' around. I was down there alone. Not doin' nothin' Whatever. Knowing that she's just supposed to be up there talkin' to her friend. So is there anything else that you've seen that makes you think she's cheating? CANDELARIA: Yes, Your Honor. Yes. There was time and time again that I kept finding these weird bruises on her inner thighs. It dawns on me that she'd been having sex with somebody and they're leavin' these bruises on her. How are you sure that those aren't your fingerprints? CANDELARIA: I know, because I'd been askin' her about these fingerprints and we weren't havin' sex that certain way. It had to be in that same certain position. And we hadn't been having sex... I have a bruise on me right now that he forgot that he even done it. I'm not cheating on him. So, you're sure those aren't your fingerprints. I'm positive. I'm positive those... Let me grab you this way and put you this way." No. No, see that... I don't know how we got worked into that position. Him. I mean, really? The good ones don't. (LAUGHS) CANDELARIA: I'm pretty sure that we'd never done that position before, at all, whatsoever. JUDGE KEITH: So, Ms. Blakely, you don't deny that the bruises were there. You're just saying he put 'em there. No, Your Honor. I don't. But, I just know it wasn't from havin' sex by another guy. JUDGE DANA: All right. Okay. I think we've heard enough testimony. Yeah. And a doozy it's been Mr. Cutler. Yes, it has. Here's what we're lookin' at. JUDGE KEITH: Mr. Candelaria found fingerprints on her thighs that he says he didn't put there from the sexual position. Mmm-hmm. She disappeared for three hours while at a party. Upstairs. He couldn't find her. Didn't know where she was. And there was another man up there. And he believes that she was with that other man. Um, he's found her on dating apps. And she's secretive with her phone. All right. Well, because there were questions regarding Ms. Blakely's activities on the phone, the Court would like to call digital forensic consultant, Patrick Siewert, who has done a full investigation to determine, "Is she cheating?" That might be relevant. Mr. Candelaria has a concern regarding Ms. Blakely's ex. Did you find any communications between Ms. Blakely and this ex? So, I did. I was able to recover about 71 deleted... Seventy-one deleted text messages. Uh... What? PATRICK: Some of those deleted messages were exchanges between Ms. Blakely and an ex. Um, the most was, uh... The most recent was ten months ago. All right. (AUDIENCE EXCLAIMING) Did you find anything else on Ms. Blakely's phone? It appears that Ms. Blakely had an account, uh, for a dating or hook-up app... JUDGE DANA: Mmm-hmm. ...uh, that's where she's been in communication with other people. Really? PATRICK: I was able to recover 804 deleted emails. (AUDIENCE EXCLAIMING) A hundred and seven of those emails contained explicit photos and videos and messages like this. "Looking for some great sex." BLAKELY: (NERVOUSLY)<i> Those are those... No.</i> That's not from me. No, no. It's to you. No, no. It's not from you. These are<i> to</i> you. BLAKELY: Right. But, it's not me sending any out. Did you find any other? Yeah. There were additional ones, uh, such as this one. <i> "Seeking a discreet, intimate encounter ASAP."</i> Look. He would get on these sites... Come on, now. (AUDIENCE EXCLAIMING) But, these are messages you've received, correct? But, I have not made any outgoing. Like, I have not been chattin' with these people. But, these are from websites that you were on. BLAKELY: I ain't been on no websites. Ooh. But, it says, to you. It doesn't say to somebody else. That's my email, right. JUDGE DANA: To your email. Yes, to my email. Which we've had this... Let me just point-blank ask you this. You're denying that you have had contact or tried to contact anyone on the... On these sites and have not responded to them. Is that your testimony? Yes? (VOICE SHAKING) Yes, Your Honor. (AUDIENCE EXCLAIMING) Well, to further investigate this matter, the Court ordered a polygraph examination of Ms. Blakely, and we have those results. Ron, would you please escort our private investigator and polygraph examiner, Michael Williams, into the courtroom? RON: Yes, Your Honor. (AUDIENCE APPLAUDING) JUDGE KEITH: Mr. Williams, you asked Ms. Blakely "Did the handprints Mr. Candelaria saw "on your inner thigh, "come from having physical, sexual contact "with a man other than Mr. Candelaria?" What was her response to that question? She said, "No." What did the lie detector determine? "come from having physical, sexual contact..." What was her response to that question? What was her response? She said, "No." What did the lie detector determine? On this question, there was no significant physiological responses that I could determine which indicated to me she was being truthful. Thank you, very much. (AUDIENCE APPLAUDING) All right. JUDGE KEITH: So, you think she's cheating with men and women? Men and women. JUDGE DANA: Wow! JOHNSON: Your Honors. I'm gonna turn to you. Are you cheating with men and or women? See the problem is Your Honor is that, I'm not like a player and I'm just his. When I said 'I do', I meant it. I meant that I'm gonna be with him and only him. But then when you have a husband like Larry, who be on the phone texting people and doing all this nonsense. It's kinda hard so, but I did what I did was, it might be wrong, Your Honor. But I start agreeing to what he tells me. "Oh, you cheating." Absolutely. "Oh, you with a guy." Absolutely. Because he wants to hear this. Mr. George, okay, you say she's cheating. Why do you think she's cheating now? Listen, I went through her Facebook, right? Her Gmail, right? I see messages between her and her friends talking about inviting some guy over to have sex. And all this other stuff. So, I'm like... You submitted a recollection of that text message, is that correct? GEORGE: Yes, yes. And here it is. And this is the other man. When we going to blank? Hey... JUDGES: Have sex. JUDGE KEITH: The blank is have sex? Yeah. Basically. JUDGE DANA: And they support your position that she is in fact cheating on you? Yes. I was home alone. There was one incident, right, when we just moved into this neighborhood and then she met this girl that was there. She started hanging around us. And then they wanted to go to the store, at it was, like, 11 o'clock at night, so I was like, all right, they had to go to the store. She left at 11:00, all right... JUDGE DANA: 11:00 p.m. At night and came back... It was daytime. It was 7 o'clock in the morning. I'm waiting in the parking lot for her. They pulling up. You waited for me 11:00 to 7:00 in the parking lot? GEORGE: Well, first I was up, you know, just watching TV and I notice... I'm, like, it was 2:00, 3 o'clock. Where they at? Then I started calling her phone. She not picking up. Then I call her friend's phone. They both not picking up. And so she shows up at 7:00 in the morning with a woman. GEORGE: 7:00 in the morning like everything is cool. And you believe... She's probably doing something with her or some guys, or having groups... I don't know what was going on. JUDGE DANA: But you think that sex was definitely involved that you weren't there for. That's a whole shift. That's eight hours. He wanted to be a part of it. He wanted to be a part of it, but there was nothing to be a part of. You Honor, I have a friend. We women, we talk. You know, we just running our mouths. We shopping it up together. Yeah, all right. JOHNSON: The store was 24-hours. And next thing I know, the birds were chirping, the sun was coming up. It was innocent, Your Honor. I was at a 24-hour store. I was amazed. And it was Father's Day. I was just gonna get stuffing. JUDGE DANA: You were gonna get stuffing? Yes. She's getting something stuffing. Booty call hour. Your Honor, it wasn't even at 11:00 at night. Exactly, and then, mind you, her friend and her, it made me feel uncomfortable. When I left, right, I just packed up all my stuff and left, I was homeless for, like, four, five months, living in my car, sleeping house to house with friends, people I met, stuff like that. Oh, boy. JUDGE DANA: And she continued to live with this woman. I sure did. She laid up comfortably in that house... Very. Right, and had sex with whoever she had sex with while I was on the streets homeless. JOHNSON: Ooh. We're not sleeping together, so this is the point. You never slept with your best friend? Then my homeboy, he pulls up, right. He's like, "Yo, what's going on with you and shorty?" He say, "Yo, look, I'm a hook up with her, right, "I'm a find out what's going on." So, he asks her, "What's your problem with my boy, you know, Larry?" (SIGHS) So, then she was like, "I don't know how to tell him, "but when she was living here with me... Oh! but... (LAUGHS) GEORGE: "We was having sex. We was using toys. "All kinds of stuff." Oh, my goodness. JUDGE DANA: Hold on, Miss Johnson. My best friend told him that she does not like Larry, and this friend needed a ride, so he made that story up to make Larry get off the bed and go with him. There's his side, there's her side, and there's a best friend side, and he is here to testify. Ron, would you bring him in? RON: Yes, Your Honor. You can go right up to the witness stand there. JOHNSON: This liar? GEORGE: My boy, what's up? JUDGE KEITH: Good day sir, how are you? AUSTIN JOHNSON: Doing fine. State your name please, for the court. Austin Johnson. And once you know, then you all can figure out how to move forward. But let's handle the allegations in this case first. JOHNSON: Okay. And here's what we got, Mr. Cutler. Come on. You lie. We found an explicit Facebook message with another gentlemen asking her when she was coming to have sex. He thinks she is sleeping with men and women. He also had his best friend find out and get out of the purported lovers mouth that in fact they were having sex together. And he says, if all of this is true, you're done. I am completely done. JUDGE KEITH: Out of the picture. Out the picture. JUDGE DANA: All right. JUDGE KEITH: Well, this court has done a full and complete investigation. At this time, we would like to hear from certified polygraph examiner, Tommy Platt, to determine is she cheating. (CHEERING) Ron, will you please escort Mr. Platt in? JOHNSON: Come on, Tommy. Come on, Tommy. Here we go. JUDGE DANA: How are you Mr. Platt? PLATT: Good, Your Honor. Glad to have you here. Now, you conducted a polygraph examination of Miss Johnson. Is that correct? Yes, ma'am. JUDGE DANA: All right. So, the first question, Miss Johnson was asked, "When you went to the store with your friend "and did not come back until 7:00 a.m. "Did you have physical, sexual contact "with anyone other than Mr. Johnson?" What was her response? PLATT: She stated "no". JUDGE DANA: What did the lie detector determine? The lie detector determined that she was being truthful. Hey! Let's get it! Let's get it. Come on, Tommy. JUDGE DANA: All right. GEORGE: That's fine. Miss Johnson was asked, (READING) (CHUCKLES) JUDGE KEITH: What was her response? PLATT: She stated "no". JUDGE KEITH: What did the polygraph determine? The polygraph determined that she was telling the truth. Ooh! I am not gay, honey. Abso... Liar. JUDGE KEITH: Well, we still have another question. JOHNSON: It's okay, Your Honor. I'm so confident, I already know what Tommy gonna say. (AUDIENCE LAUGHING) JUDGE DANA: All right. Come on, Tommy. AUSTIN JOHNSON: Oh, man. Miss Johnson was asked, (READING) "with a man or woman?" What was her response? PLATT: She stated "no". JUDGE KEITH: What did the polygraph determine? The polygraph determined that she was being truthful. (EXCLAIMS) Ha! He has a mental issue, Your Honor. He needs help, H-E-L-P. All right, Mr. George, it comes out. What do you have to say to your wife? JOHNSON: He can't say nothing to me. She got a bad attitude problem. (SARCASTICALLY) Aw. JUDGE DANA: Really, Mr. George? Mr. George, do you think you the source of her bad attitude since you been accusing her of that? GEORGE: No. JUDGE DANA: Are you source of her bad attitude 'cause you cheating? JOHNSON: Yes, Your Honor. GEORGE: Now, listen, listen, I don't be cheating. JOHNSON: Cheating. He a player. JUDGE DANA: All right. Well, we gonna find out. We gonna find out. How are you feeling, Miss Johnson? JOHNSON: I feel, Your Honor, honestly I don't want to be with Larry no more. I'm gonna be honest with you. The reason why I don't wanna be with him no more is because I gave him 10 years, okay. I did everything I needed to do for him. I just want to know if... Is he cheating on me. Like, I wanna know the truth from Tom. I wanna know the truth. Like, I proved my point. But my question is, what if it comes out he's not been cheating? If you found out otherwise, it might change your heart. JOHNSON: If he's not cheating on me, it might change my heart.
