It is when you're in the heat of passion in your of unable to think clearly and you act out and kill someone and that's something that could happen if you unexpectedly walk and do your own house and see your wife with another man. The problem with this case is that he didn't just walk in randomly he hits you know figure out what was going on and deliberately went over there with a loaded fire. >> to deal with the situation. I think his behavior in court that we saw in that interview as well as it previous hearing a jury is going to be watching that and thinking that this man is just unhinged and that is not going to help his heat of passion argument at all. >> A murder to California Brian Watkins if he's convicted of of that and not the premeditation doesn't have a chance to ever get out of prison. >> Yes the guys, yeah, you know the murder to you're going to 15 years to life in prison that's a mandatory sentence and that means you have to do 15 years and then you'll be eligible for parole, but the problem with that is he's also charged with a gun enhancement by using my killing someone by the use of a firearm and that is a 50 year enhance meant. So that really hurts him you know he went in there and just beat him to death. You look at 15 to live with the fact that he used a firearm is is going to be a huge problem because that becomes on top of the 15. >> Ben I don't see a jury. With these facts saying you know not guilty have a nice day it is time for you to move on. So everything Brian is telling us is this guy looks like he's facing the potential of the rest of his life in prison. >> When you do the math no I agree and saying it's not yelling at the judge and saying my life is ruined well.
