hello my friends I hope you're having a wonderful day today and welcome back to another episode of our slash Pro revenge there's two stories in this episode the first story Opie reports her ex to the FBI and the second story is a little bit longer where Opie goes into a two-year long battle with a horrible landlord over six hundred dollars I hope you guys stay for the stories today and please hit tabs on him rumors hearsay friendly whispers and public social media posts alike due to the threat of violence he'd occasionally post something about burning down my house or he texts a mutual friend to try to figure out where I'd moved to and we live in a very small town so gossip flowed like honey at the time friendly custody talks had broken down into we need attorneys to mediate and due to the fact that I wouldn't release my daughter into his care without a custody agreement I started to receive threats from both him and his family mostly along the lines of if you're gone the baby will be ours one specific threat that still sticks with me was to burn down my apartment building prompting me to move my social worker slash court-appointed attorney never received the request documents for custody so my concerns went from legal issues to my own physical safety rather quickly after a while it went from so-and-so is threatening you online to did you hear that so-and-so got kicked out of where he was staying for trying to sleep with his roommates underaged cousin I heard about three different younger girls who had possibly been victimized by this dude which was believable he had pursued me when I was 19 and he was 26 and I looked very young for my age we broke up in part due to him being arrested for minor sexual crimes since he was sending me threats I wanted revenge and to get him off the streets like it's sleep better at night so I reported him and all of his online handles and usernames that I knew to the FBI and went to the center of Missing and explore children to report him not two months later I get a message from someone saying did you hear that so-and-so got arrested in a sting it turns out that he's been trying to meet up with his 12 year old kid online and it ended up being setup with the state police or something he caught extra charges thanks to the whips and handcuffs he had in his backpack and now he's in jail if he hadn't sent threats to me I never would have paid attention to gossip concerning him and he probably would have gotten away for years I wonder if that sting that Opie talked about involved the chat with Chris Hanson another freaking creep off the streets and I'm sure Opie can sleep easier after that this story's titled when trying to get your deposit back from your landlord is like drawing blood from a stone back in 2018 I had a temporary internship in California at a large tech company so I took a recommendation from a friend about a room for rent it would be living with five other people but otherwise it looked fantastic with spacious common areas it had multiple huge TVs full amenities a community center with a rec pool and was a short drive to multiple places of interest all for $650 a month utilities included so I contacted the landlord whom I'll refer to as shitty landlord or SL for short he seemed fine on the phone so I sent to my security deposit to move in a month later when it came time to move in I discover a few caveats that came with this low-rent place the common areas were all dusty none of the three large TVs worked properly and if we wanted access to the rec center in Poole we need to pay 80 bucks a month and oh yeah and all of the short drive times to the places of interest were exaggerated unless you were speeding at two to three times the speed limit whatever it's not the end of the world especially at a relatively low price I'll survive in the upcoming months things got worse ASL decided to charge us an extra $20 a month for paper towels and cleaning supplies and only checked the community mailbox once a week when he was in town as he refused to trust anybody with a mailbox key as it starts to roll into summer he decided that air conditioning cost too much and that we were using too much so he removed the thermostat from the wall um okay one day some of us tenants confronted him when he was at the house and I'll never forget his words as he rushed out the front door he said it's legal for me to do it and I don't care since I don't live here well sir screw you I'm tilted at this guy's obvious money grab from six tenants but it turns out he's rights he legally doesn't need to provide air-conditioning to the tenants so the next day I purchased a high BTU free-standing portable air conditioner that exhausts out the window of course I pump my room to the lowest setting we have a couple of other minor disagreements that wind up with SL texting me that it's fine if I wanted to break my lease and move out early when he finally gets a whiff of my a/c setup he comes up to my room to complain about my a/c unit and I reply curtly this is 100% legal for me to do since you said electricity was covered in the rent he leaves and later sends me a text that says about the a/c unit you have in your room if you choose to run the a/c in your room at 50 degrees because your computer generates so much heat then that's your choice but you'll need to pay an additional 100 dollars per month for the additional electricity you've been spending and that's going from the time you installed it in the room without my permission thank you so much unbeknownst to him I'm taking this move out offer seriously and this whole time I've been rallying the troops all the tenants have been upset about everyone's living situation so with some minor encouragement I managed to convince two of the other six tenants to move out at the same time as me since they were on a month-to-month arrangement I finally submit all of our notices to vacate at the same time barely a week before my previous conversation with him and he's pissed he was just trying to get me out of the house but now he has three rooms to fill instead of just one I asked about my legally mandated move out inspection and he said he's too busy to perform an inspection and for me to just get out well that's illegal but okay so time comes to move out we all move out and I text him about my security deposit no response i text again no response oh okay I see where this is going I spend days in days reading the law compiling evidence and screenshots and listing the laws that were broken The Smoking Gun was the statute that requires a pre move-out inspection and a list of things to fix and an itemized list of deductions within 21 days or else the landlord loses the right to withhold any of the deposit in addition he would be subject to treble damages if he's found to be acting in bad faith hi text again and again I give him plenty of leniency and I even cite the laws so I can prove in court that I'm acting in good faith and that he intentionally ignored all the laws that I made him aware about the guy probably thinks I'm a young pushover college students who won't follow through with legal threats well sir we are going to court because I'm petty as hell when it comes to people trying to take advantage of me and screw me over I file in small claims court for $650 plus treble damages plus court costs and he files a counterclaim of $2,000 for damages to the property claiming that I caused flooding and I broke the microwave okay buddy game on in response I gather three testimonies from the three other tenants and build my case into a 40 page packet of evidence complete with page numbers a table of contents and descriptions for every screenshot and photo I make three copies of everything and submit it to the courts and the defendant landlord the court date is set for November and I leave the state just before Christmas so just in time to appear in person since my internship ends and I fly home in December he starts filing request to postpone the trial he cites a doctor's appointment and the motion is granted court date is rescheduled for a month later it's in December but still before I fly home new court date approaches and he files another request to postpone citing another doctor's appointment somehow that motion is granted as well and we're rescheduled yet again to January darn January rolls around and surprise surprise guess who's got another doctor's appointment conveniently on the exact same day of the trial and this time it's denied the court finally got tired of his excuses and denied the motion because he can't prove he scheduled the doctor's appointment prior to the court date being moved I'm not in California anymore I am across the country on the East Coast he thinks if I'm no longer in the States he'll automatically win since I'm not willing to fly back for the trial well unbeknownst to him California courts offer an option to appear by telephone court day comes and I get the call I'm sworn in and then connected to the court I'm given time to present my case unfortunately I didn't prepare a script so I kind of summarized the events and explained why I deserved the money then landlord gets time to defend himself and explain his counterclaim he doesn't prepare anything either and he ends up rambling about some random things that doesn't help his case at all for example he spends a lot of the time complaining how another one of the tenants was so shitty and so his behavior was justified he doesn't have a sliver of evidence for his counterclaim when the judge asked for it the judge asked a few more questions and announces that he'll review the evidence and we'll get the decision in the mail a couple of weeks later I get the judgment saying that I'm owed $650 and that the landlord gets nothing well damn no trouble damages for me however it's just my luck that this guy is a real piece of crap that won't accept defeat he files an appeal for who knows what and it's granted the redo trial is scheduled for May this time I'm ten times more prepared once again I'm sworn in and they connect me to the courtroom speaker this time I have a hashed out script that I read making sure to emphasize how often I informed him of the law how often he knowingly broke the law and how I offered so much leniency and so many opportunities to do the right thing and once again he doesn't prepare anything but instead rambles on so much that even the judge tells him to get back on track multiple times the guy claims that I caused water damage and had to replace all the carpets the judge asked for an invoice or a seat and he has none he then claims that I broke the microwave so the judge reads him the three witness statements that all state that I didn't break the microwave and he accuses us of lying at this point the judge clearly sounds done with him and says we'll get his decision in the mail and the call ends a couple of weeks later I get the judgment I'm owed eighteen hundred dollars and the landlord still gets nothing well damn would you look at that his appeal did not quite work out well for him so he goes from owing $650 to owing me eighteen hundred dollars being the idiot he is he files for a mistrial claiming that I was not sworn in and that I lied in my testimony and it's denied outside of courts he calls me and offers a payment plan of $20 a month which will take seven and a half years to pay back or in other words he's still refusing to pay up okay I see how collecting my money is gonna be I figure out that he banks at the Bank of America by looking up the checks I gave him for rent and seeing where they got cashed I file for a writ of execution that will allow me to perform a bank levy it's granted so I prepare a packet for the Los Angeles County Sheriff's Department to go to the Bank of America and take his money they serve him with papers and orders the Bank of America to freeze his account after his allotted time of 30 days to contest the seizure they seize his money plus 10% of interest plus sheriff fees I finally get the glorious check in the mail 20 months after moving out I'll probably frame it the total is 1893 dollars and 91 cents a lot of landlords try shady things on renters to keep the deposits I'm glad Opie was super determined to not let
