I get asked all the time about what type of non lethal defensive weapons can I have in the state of California so in this video we're gonna be covering primarily two things we're gonna be covering you can have your stun gun or you can have pepper spray and we'll be talking about the California law surrounding those two non-lethal options so real quick if you are considering some sort of defensive options even if they are non-lethal I always recommend you have some sort of legal protection to go along with that you can't just think about the type of weapon you're going to carry but you also have to think beyond the maybe defensive or offensive actions that you have to take with whatever type of weapon whether it is lethal or non-lethal and because of this I always recommend you SCCA as a put a link to us CCA in the details if you would like to take a look for yourself so the first weapon or the first option we're gonna be talking about today are stun guns so stun guns are also known as tasers I'm sure a lot of you are familiar with them and a lot of people wonder are normal residents normal individuals in the state of California like me and you are we able to have stun guns or tasers and so the quick answer is yes in the state of California you can have stun guns or tasers and when I'm saying stun guns or tasers those terms are almost used interchangeably in the state of California one is usually referred to as the other there's not a whole lot of distinction so California law defines a stun gun as a device which emits an electrical charge which is capable of immobilizing an individual and these sorts of devices are primarily used for defensive but also offensive options and if you are curious about looking at the language surrounding stun guns or tasers you can look at California Penal Code seventeen to 3-0 and also california penal code 1 6 7 8 0 these are the penal codes which address stun guns in the state of California now the great thing and why a stun gun is good for a non-lethal option in the state of California first is because to get a stun gun or for you to obtain a stun gun or a Taser you don't have to have a permit and you don't have to go through a background check which is a lot different from you being able to carry a firearm the state of California or for you being able to purchase a firearm the state of California almost anybody is able to buy possess and use a stun gun or a Taser here but there are some exceptions so let's talk about those if you're convicted of a felony or assault you cannot legally possess buy or use a stun gun here also if you are addicted to drugs narcotics anything of that nature you cannot have a stun gun use possess buy etc also if you're younger than 16 you also cannot have a stun gun or taser here a 16 or a 17 year old can get their hands on a stun gun but they have to have parental consent but if you're younger than 16 it's a no-go you cannot have a stun gun or taser but if you're 16 or 17 and you have parental consent you can have it if you're 18 or older if you're considered an adult you can have it in generally violations of breaking one of these restrictions maybe being a prohibited person who has a stun gun or taser or your possession maybe you buy or use that is considered a misdemeanor any of you would like to look at the misdemeanor language here you can see it in California Penal Code two two six one zero now one last thing that I want to cover as far as the laws surrounding stun guns and tasers is there are some prohibited places in which you can be in possession of these items and they're very traditional places that you considered they usually apply to firearms as well we're talking about schools we're talking about like airports federal buildings or local government buildings stuff like that you are prohibited from having or possessing a stun gun taser and the punishment for having a stun gun or taser in these primitive areas can land you up to one year in jail and/or a fine of $1,000 now of course like usual when it comes to firearms and other sort of things police officers are exempt from this language so they can possess you know stun guns and tasers in these prohibited areas so that is our first non-lethal option is to have a stun gun or taser now it's not as good as a firearm or a in my opinion I always recommend that if you are considering seriously some sort of defensive option I always think that you want to have the best equipment possible and so in my opinion that is a handgun that you should have a concealed carry you should be trained confident of having a handgun on you and use that as your defensive option but I know some people don't feel comfortable handguns or maybe they can't get their hands on one right now and so you're looking for some other options and so the first really good option is a stun gun or taser now another great option is to have pepper spray I know a lot of people who even carry handguns concealed also have a non-lethal form or a non-lethal defensive option in the form of pepper spray I know a lot of people consider maybe having levels of escalation in their defensive carries and pepper spray is one of those so pepper spray is regulated in the state of California it's use possession and purchase etcetera is regulated here under California Penal Code sections two to eight one zero following after that if you look at that section there will be all the language concerning pepper spray now one of the important distinctions with pepper spray which is a little bit different than using stun guns or tasers where stanza guns and tasers are considered to be defensive and offensive options here in the state of California pepper spray is supposed to be used primarily only for self-defense it's only for the use of self-defense so here in this state the use language is not limited just to the spraying of the aerosol in the can use extends also to the mere display of the can or of the pepper spray so even if you were to show someone they can but not spray that is considered use and it can only be used in self-defense purposes the non self-defense use of pepper spray can subject you to a misdemeanor charge and also a fine up to a thousand dollars and the real kicker with this use or even just showing it in California the defense of like saying you know my pepper spray can it doesn't have anything even in it like even though I showed it someone there was nothing in it or even just saying that you know it doesn't work it's inoperable it's broken so I couldn't even sprayed it at someone I just showed it to them that is not considered defense in the state of California so let's talk about some of the restrictions surrounding pepper spray here if you're considering picking up a can of pepper spray it cannot be more than 2.5 ounces if it is more than 2.5 ounces you are violating California law and they will likely try to bring a charge against you also something to keep in mind is the pepper spray has to be in aerosol form it cannot be in any other form so there may be other types of pepper spray out on the market that are non aerosol you cannot have those make sure it is in aerosol form now again like I mentioned with stun guns a great thing about this and why it is a great non-lethal option is because you don't have to have a permit to carry it and you don't have to go through a background check to obtain it now again there are some restrictions like we saw with stun guns or prohibited persons cannot have pepper spray so people convicted of felonies or assault crimes and also the language mentions if you are convicted of some way of misusing pepper spray where you use the pepper spray for non defensive uses these individuals cannot possess or use pepper spray you are prohibited minors under the age of 16 are also prohibited from the possession the purchase the sell etc of pepper spray again this language comes plates that kind of wobbler in between of 16 and 17 with parental consent they can possess and use pepper spray and lastly the language contemplates you know individuals who are addicted to drugs narcotics etc cannot be in possession of pepper spray they cannot buy sell etc now with all these things you need to make sure you're checking your local laws your county laws and your city laws they may have ordinances in place which prohibit your possession use may be carrying it concealed on you something like that there may be a local law which affects the state law generally also another great non-lethal kind of lethal option that you should probably consider if you're not comfortable with getting pepper spray or stun guns is carrying some sort of pocketknife or defensive knife now I'm not going to talk about California knife comprehensively here because to have another video on my channel that covers that comprehensively and you can go ahead and click this tab right here and it will take you to that video with California knife laws you have to also take into consideration your county laws and your city laws because they can also with California knife laws put further restrictions on what you're allowed to carry and how you're allowed to carry it things like that so just keep that in mind as well but that video will generally just give you the information you need to know about California knife laws and carrying knives here in this state but like for me I always carry a defensive knife on me as well as my concealed carry handgun so maybe if you can't have a firearm on you
