and I got a call.</i> <i> It was someone close
to the investigation</i> <i> that said, "You gotta
go to the San Francisco Bay</i> right now.
And I'm like, "Oh, my God, oh, my God, did they find her?
What did they find? Did--" "You gotta go there. Now." <i> [edgy music]</i> As I'm driving, I'm now
getting more information <i> on the phone with a source</i> <i> who is
giving me a play-by-play</i> <i> on what they're finding</i> and then reporting it as it's
being told to me literally. I'm having a person on hold... <i> as I'm reporting it.</i> And every time I'm going live,
I'm reporting something new. They found a body. They found a torso. They don't know yet
if it's male or female. Just a torso. <i> Okay, so at this point
I get chills...</i> <i> my adrenaline,
my heart's pumping.</i> This is big.
This is finally... the body.
We're--we-- This is what
we've been waiting for. <i> [dark music swells]</i> <i> ♪ </i> <i> [edgy music]</i> <i> ♪ </i> <i> - Police in Modesto,
California,</i> <i> continue searching for
27-year-old Laci Peterson</i> <i> but there is still
no sign of her.</i> - In mid-January,
Scott Peterson was still the focus
of everybody's attention <i> but there was a real sense
of frustration,</i> <i> because there were
no answers.</i> <i> And then...</i> <i> - If you already dislike
Scott,</i> Amber was the nail you needed
to finish the coffin. - Really drew the line
in the sand. - Throwing gas
on a huge bonfire. - Total game changer. - That's when all
h-e-double-l broke loose. <i> [dark music]</i> - Scott told me
he was not married. We did have
a romantic relationship. I am very sorry
for Laci's family. <i> Even after coming out in
the press conference,</i> <i> I still wasn't able
to be open</i> as far what I knew and working with the
Modesto Police Department. - It was really, um,
a very well-kept secret by the Modesto
Police Department. <i> [line ringing]</i> <i> - Hello.</i> <i> - It was so hard to--</i> <i> -</i> Up to--Until that point
in time, <i> you had a husband who claimed
to be a grieved husband</i> <i> who is at most a suspect</i> and who has the right
to remain silent and not go out
and talk to the media. <i> Amber Frey changed that.</i> <i> - Scott's attorney
Kirk McAllister and I</i> <i> tried to talk him out of</i> his appearance on camera, and he said... "I have to do it. I have to do whatever I can
to help find my wife." - There was nothing
more exciting to me than the day
that Scott called me to say he wanted to give me
"a little interview." And I just remember screaming.
I was like-- I just couldn't believe it. This is like the biggest
interview right now in the country,
and I'm gonna get to sit down with him and ask him
everything I want. - Scott agreed to do
four separate interviews, one with "Good Morning America"
and Diane Sawyer and then three local interviews
that were at his house. <i> - I'm gonna get
to go inside the house.</i> This is potentially
where the crime scene is. <i> [edgy music]</i> <i> I'm trying to observe
everything</i> <i> as I'm walking
through that gate</i> <i> that nobody's
ever walked through.</i> <i> I'm looking around to see</i> <i> just if anything
looks off-place,</i> anything looks suspicious--
anything. <i> - It was a bizarre scene</i> because all of the other
reporters in the media were camped out
outside his house <i> waiting for the end
of the interview</i> <i> so that they could
find out what he said.</i> - Clip this baby on ya.
- Yeah, I guess right there. - How long you been in
this house? - Uh...two years now. - This is a big interview, and I'm just thinking,
"Okay, just...remain calm. You're gonna be fine.
Just listen to what he says." And you can even see
in that interview, I'm constantly like this. <i> Because at some moment,
he could say something,</i> he could do something
that could break this case. And I was gonna be there
to witness it. And I wasn't going to miss it. <i> You mentioned that you
haven't been in the media.</i> <i>- No. But unfortunately now,</i> <i>the suspicions of me
have grown so great,</i> <i>due to, um, the, you know,</i> <i>inappropriate relationship
that I had with Amber Frey</i> <i>that it's necessary, um...</i> <i>to speak.
It's an appropriate time to,</i> <i>in order to ask people
to keep looking for Laci,</i> <i>because they're not looking
for Laci</i> <i>as much as they
should be right now.</i> - He was not ready for the media
to attack him. <i> - Nancy, if you watch him,</i> <i> his eyes bounce back and
forth on certain questions.</i> <i> - He is being shifty-eyed,</i> <i> and even in the interview,
is caught in an untruth</i> <i> regarding when he came
forward to police</i> <i> about Amber Frey.</i> <i> - Did you tell police?
- I told the police immediately.</i> <i> - When?
- That was, uh,</i> <i> the first night
we were together--</i> <i> the police. I spent,
uh, with the police from...</i> <i> - You told them about her?
- Yeah.</i> <i> From December 24th on.</i> <i> - Number one rule--</i> <i> When you're in a hole,
Larry, stop digging.</i> <i>- Did your wife
find out about it?</i> <i> - I told my wife.</i> <i> - When?
- In early December.</i> <i>- Did it cause a rupture?</i> <i> - It was not, um...</i> <i> a positive, obviously.</i> <i> - A lot of arguing?

on cross-examination.</i> <i>- You can't just say
that this slip of the tongue</i> <i>means that he's guilty.</i> - There's not really
anything he could have done or said
that would have... made anybody feel
differently about him at that point, because
after Amber Frey showed up, people wanted to see him
pay for his wife's murder even though, at this point,
the only evidence against him was that he was a liar
and a cheat. <i> - It's the most self-serving
interview I've ever seen.</i> <i>- Just because he's a narcissist</i> <i>doesn't mean that
this guy is a murderer.</i> - The Diane Sawyer interview
didn't... didn't work out for him. <i> You know, you don't
walk your client</i> <i> into a nationally televised
interview</i> with one, you know, of the best-known
news anchors in the world. He was woefully represented and not properly prepped
for that. <i> - I think it's just
all the stuff that was fed</i> through the media that just
really got people riled up. We knew we were in
for a big, big battle. <i> [dramatic music]</i> <i> - That's motive!</i> I mean, you know,
to a lot of people, they kinda painted a picture of somebody who just
wanted to be <i> a single guy.</i> <i> - The media had
something else</i> to put their claws into, and it made for great TV. - People were just
chomping at the bit to get the next piece. <i> - He couldn't even
step outside his door</i> <i> without being harassed.</i> I was just--
I was afraid for him. - Why don't you tell the truth?<i>
- He was absolutely</i> the most-hated man in Modesto. <i> But there was nothing
about Amber Frey</i> that tied him
to his wife's disappearance. <i> - When that body is found,
and it will be found,</i> <i> I think that will absolutely
crack this case wide open.</i> <i> [line ringing]</i> <i> - Good afternoon.
Joe Aja.</i> <i> - Hi, Lieutenant.
Scott Person here.</i> <i> ♪ </i> <i> - It's supposed to be
a once-in-a-lifetime moment,</i> <i> the birth of your first
child.</i> <i> The Petersons
will never know that.</i> <i> Laci Peterson, missing
tonight on her due date.</i> - During this period of time,
people still wanted information, but there was no big break
since Amber Frey. <i> As we got into March,</i> <i> everyone was waiting
for something to break</i> <i> in this case.</i> <i> - My fellow citizens,</i> <i> at this hour,
American and coalition forces</i> <i> are in the early stages
of military operations</i> <i> to disarm Iraq,
to free its people,</i> <i> and to defend the world
from grave danger.</i> <i> [mellow guitar]</i> <i> - We were almost
four months into it</i> <i> by that time,
and we had investigated</i> <i> pretty much all of
the likely leads</i> <i> and the likely scenarios,
and we were just still</i> working it as a "no body"
case at that time. I wasn't too optimistic
that we were gonna find her, although I was pretty
confident that she was in
San Francisco Bay just based on
all the things that we had. <i> Now, James Brazelton was the
district attorney at the time.</i> He had told me that,
"If you don't have a body, "you'd better have
a pretty good case, <i> because otherwise I'm
not gonna go to trial."</i> And we would've had to
have a lot more than we had because we weren't there yet. [thunder rumbles] -<i> As we look across
the country tonight,</i> <i> we're noticing a storm
system coming</i> <i> here into
the Pacific Northwest,</i> <i> heavier rain
moving into San Francisco,</i> <i> and the wind is starting
to pick up here as well.</i> <i> [edgy music]</i> <i> - At about 11:43 a.m.
this morning,</i> <i> a little bit before 12:00,
we got the report</i> <i> from a dog walker</i> <i> of a pretty badly decomposed
body that washed ashore.</i> <i> So what we've done
as a precaution</i> <i> is we've notified
Modesto Police Department,</i> <i> and they should be here
within about 30 minutes.</i> <i> [tense music]</i> - When I heard about
that body, I just thought, "That's got
nothing to do with us." <i> It's like...no, I mean,
there's a lot of people</i> <i> that could be tossed
in San Francisco Bay.</i> We can't be that lucky. There's just no way
we're gonna be that lucky. <i> [dark music]</i> <i> ♪ </i> <i> - The coroner has arrived
at the scene</i> <i> and has now recovered
the victim.</i> <i> We believe the gender
of the victim is female.</i> <i> [dark music]</i> <i> ♪ </i> <i> [poignant music]</i> <i> ♪ </i> <i> - We get to the scene.</i> <i> First person I call</i> is Brent Rocha. I said, "Hey...did you hear?" He says,
"Yeah. It's her." <i> - I think we found out
on a Sunday</i> <i> the body of an infant
had been found.</i> <i> 12 to 18 hours later,</i> <i> news came
that the body of a woman,</i> uh, had been found on the shore
of the San Francisco Bay. And, um... For me, personally, I, um... I think I knew.
I knew it was Laci and Conner. <i> We were told it was
gonna be...</i> <i> a while before they could
confirm the identities.</i> <i> So we did a lot of praying,</i> <i> we spent a lot of time
together.</i> You just didn't want to accept
that she could be gone. <i> - Laci, this has
been the most disturbing</i> <i> and emotional time
in my life.</i> <i> As your older brother,</i> <i> I only wish
that I had the opportunity</i> <i> to be there to defend you
from the person</i> <i> that decided
to take you away from me.</i> We talked about our children
growing up together and spending summers
at each other's house. <i> Now that you and Conner have
been taken away from me,</i> <i> I realize that my children</i> <i> will not have cousins
to grow up with.</i> <i> I hope you know
how much I love you</i> <i> and how important
you are to me.</i> <i> - This extraordinary case,
which got so much attention</i> <i> and then seemed to
be lost in the news...</i> <i> in fact, it had gone
dead as they say, right?</i> <i> Until, of course, this
body recovery, and it happens</i> <i> almost right at the end
of the Iraqi war.</i> <i> If you're looking
at news timing,</i> <i> it's kinda weird,
like it waited.</i> <i> - It is.
It's almost unbelievable</i> <i> in terms of the news cycle...
- Larry.</i> <i> - That the bodies wash ashore.
- All right, hold on.</i> <i> - There's still a lot
of work to be done.</i> <i> There are still things
that we need to complete.</i> <i> We will be doing additional
work out in the area.</i> - I think behind the scenes,
man, the cops and the D.A.s are
giving each other high fives. 'Cause it made their jobs
so much easier because now you
don't have to prosecute a no-body homicide case. -<i> The big question now is:
where is Scott Peterson?</i> <i> No one seems
to know that answer.</i> <i> Neighbors haven't
seen him in weeks.</i> <i> -</i> People were hounding
Scott a lot in Modesto. <i> So at this point,</i> <i> Scott's primarily
staying in San Diego.</i> <i> This is gonna be
a trying time</i> <i> if this DNA evidence
does turn out to be Laci.</i> We wanted him close with us. <i> - Craig Grogan had prepared
an arrest warrant for Scott,</i> <i> and the judge said,</i> "Do not serve the warrant
unless absolutely necessary "before the DNA results confirm that the bodies
are Laci and Conner." - The day before the arrest
I got a call saying, "It's gonna happen
tomorrow." I knew that
they were heading to San Diego. <i> I knew that it was just
a matter of time</i> <i> before they made the arrest.</i> <i> - Lee made plans on Friday,</i> which would have
been Good Friday, to golf with Scott
and my husband Joe <i> and my brother-in-law Mark.</i> And I think my father-in-law
was just longing for a little bit of that normalcy
that we hadn't had in over four months. <i> - I left that morning
to join them...</i> - We had a foursome,
but Scott called, uh, Joe, one of my boys, and said,
"I can't make it "because, uh, the media
is following me, and I don't want--
want them bugging you." <i> [line ringing]</i> <i> - He thought he was being
followed by media,</i> <i> but it turned out
they were law enforcement.</i> - We started following him
around. Scott was a pretty aggressive
driver on the freeways there. <i> - Erratic driving
and the speed</i> <i> in which he was driving
finally put us in a position</i> <i> where we thought it was too
risky to continue this,</i> <i> and so even though
we didn't have</i> the DNA results yet,
the decision was made that Scott would be stopped
and we'd take him into custody. [sirens wailing] <i> - When, I found out that
Scott had been arrested</i> <i> at the golf course,</i> and that was, uh... a real shocking development,
of course. [sighs] - Once the arrest was made,
we went through his car. <i> There was camping gear</i> <i> and nearly $15,000 in cash,</i> <i> his brother's identification,</i> <i> four cell phones--
just all sorts of stuff</i> if you were
living out of your car, which would be consistent
with what he was doing. <i> - We have an arrest
in the Laci Peterson case.</i> <i> - Scott Peterson
is in custody...</i> <i> - 30-year-old
fertilizer salesman...</i> <i> - And are driving back</i> <i> from San Diego by vehicle,</i> <i> so it will be some time
late this evening.</i> <i> [dramatic music]</i> <i> - Craig Grogan received a
call about the DNA results</i> <i> when we were coming back
from San Diego.</i> The bodies were
both Laci and Conner. <i> He told Scott.</i> <i> Very little reaction
on Scott's part,</i> and in my view, because he
was the one who killed Laci, there was no reason for him
to have a lot of emotion because he knew what
the results were gonna be. <i> - Murder suspect
Scott Peterson...</i> <i> - He will go into the
Stanislaus County jail.</i> <i> - We started to worry
that he might try to run.</i> <i> - Police worried
he would run to Mexico.</i> <i> - Driving up and down
the freeway</i> <i> taunting the chase
team...</i> <i> - Why was Scott Peterson
down by the border</i> <i> with 10,000 in cash,
dyed hair, and a fake I.D.?</i> [overlapping chatter,
crowd noise] <i> - Look at this--
all the people who have</i> <i> gathered to catch a glimpse
of Peterson</i> <i> as he was driven here
from San Diego by detectives.</i> - He killed his wife
and his baby. I mean,
there's no doubt about it. <i> I have no doubt about it.</i> - Murderer!
- Murderer! Murderer! <i> - It's almost like
they wanted to lynch him.</i> <i> - I could not believe</i> <i> that that was my little
brother in that car</i> and that this was
happening to him. - I-it's like
the Roman Coliseum. [crowd commotion] - He was convicted
in the public's eye long before we hit the trial. <i> [soft music]</i> <i> - Our other big story
this morning,</i> <i> the arrest of
Scott Peterson.</i> <i> - Murder suspect
Scott Peterson</i> <i> had $10,000 in cash</i> <i> when he was arrested
near the Mexican border.</i> - To me, this is the same
old story. The facts didn't make any
difference ever in this case. - Circumstances surrounding
Scott's arrest were... just so...distorted. - He can't get away
from the flight evidence. He wanted to go on the run
to Mexico! <i> - Torrey Pines golf course</i> is 30 miles
from the Mexican border. <i> - He had dyed his hair</i> and his facial hair blond. <i> - Basically, a disguise
with a beard</i> is how I was told. <i> - There's a picture of him</i> <i> meeting
with the lead detective,</i> <i> Steve Grogan,
looking like that.</i> It wouldn't be
the smartest thing if you're trying to
disguise yourself to get the disguise and then go
meet with the police. - Scott had packed
his brother's driver's license. - To get a discount
at Torrey Pines Golf Course. - Nearly $15,000 in cash. <i> - Jackie accidentally
had taken $10,000</i> <i> from their joint
checking account</i> and she returned it to him
in cash so that there wouldn't be
a hold to put on it. - All the things
that showed to me that he was about to
skip town. <i> - If Scott is guilty,
the time he's gonna flee</i> is when the bodies are found.
He's not gonna need to wait <i> a couple days later
until they're identified.</i> <i> - They would have accepted
that he was Satan's son.</i> If it had been printed,
they were willing to believe anything about him.
Anything. - There was nobody.
After he was arrested, nobody was standing up
thinking, "Oh, boy. I wonder if they've arrested
the wrong person here." Everybody thought that
Scott Peterson was guilty, and people figured that it was
gonna be a slam-dunk at trial. <i> - It's gonna result
in a conviction. Slam dunk.</i> -<i> Scott Peterson is being held
under maximum security</i> <i> pending his arraignment
for the deaths</i> <i> of his wife and unborn son,</i> <i> his arraignment tentatively
scheduled for this afternoon.</i> <i> [dark music]</i> <i> - When we arrived at court,
I remember we were kinda</i> peeking around the corner. There's this throng
of cameras. <i> We knew we had to
go through it.</i> We kinda just started
walking up the sidewalk and then at some point you kinda
hear, "There they are!" <i> You can't even see where your
foot's gonna hit the ground.</i> <i> There's cameramen going
backwards that are tripping.</i> <i> I had an umbrella,
and I just hit the button</i> <i> on the umbrella, and it
shot out and popped open,</i> <i> and I just stuck it into
the crowd and forged a path</i> <i> with my arm around Jackie.</i> <i> ♪ </i> - Remain seated.

now in session. <i> [tentative music]</i> - They said,
"Bring the defendant in." <i> They have his arms shackled
and, you know,</i> <i> he's trying to shuffle
into position.</i> The wind just kinda
came outta me. <i> - Sharon Rocha's body
rocked with sobs</i> <i> as each charge
was read by the judge.</i> <i> Two counts of murder--
Laci and her unborn child--</i> <i> and that the murders
were done intentionally</i> <i> and with premeditation.</i> - I mean, he just had this... so scared look on his face. <i> [intense music]</i> He said, "Not guilty,
Your Honor," and that was that
for the day. <i> ♪ </i> <i> - At the home of Laci
and Scott,</i> <i> a massive memorial
to Laci</i> <i> and her unborn baby
continues to grow.</i> <i> - I literally get sick
to my stomach</i> <i> when I allow
myself to think about</i> <i> what may have happened
to them.</i> In my mind I keep hearing
Laci say to me, "Mom, please find me
and Conner and bring us home. "I'm scared. Please don't leave us
out here all alone." I can only hope that
the sound of Laci's voice is heard over and over
and over again in the mind of that person
every day <i> the rest of his life.
[sniffles]</i> <i> [tense music]</i> <i> - Just my decision,</i> I would no doubt
seek the death penalty. <i> - But Brazelton
wanted family input,</i> <i> and after a meeting
with the family,</i> <i> the DA decides
to seek the death penalty</i> <i> for Scott Peterson.</i> - I think this is
the kind of case that should be presented
to a jury as a death penalty case, if you're gonna have
the death penalty at all. You kill a pregnant mom
and her unborn child <i> so you can go out
with your girlfriend?</i> Yeah. That smells like
a death penalty case. - Two people died,
Laci and Conner. <i> So did the district attorney
do the right thing</i> <i> and charge the death penalty?</i> Yes, they did.
But when they charged it, I thought they had a lot
more evidence than they did. <i> - Kirk McAllister, the
attorney that we had retained</i> <i> while Laci was missing</i> pretty quickly
told our family that, <i> "You can't afford this,</i> <i> "and I don't have
the resources</i> <i> "to handle a case
of this size.</i> "You need to get
a public defender. This is what public
defenders are for." <i> - As for Scott Peterson,</i> <i> he remains here
at the Stanislaus County Jail</i> <i> while three public defenders</i> <i> are set to take on his case.</i> <i> - We had people calling us,</i> <i> friends that we hadn't
heard from in years.</i> They were just like,
"You sell the farm. You do whatever you have to do,
you do-- you need to hire yourself
an attorney." <i> - His attorney has got a--
a long row to hoe here.</i> <i> - That's not exactly
a position that, uh,</i> <i> a lotta guys are gonna
run and volunteer for.</i> - We contacted Mark Geragos because, uh,
he was on Larry King's show just about every night,
and he was defending Scott. <i>- You said he's the only source.
He's not the only source.</i> - The rest of the panel
was trying to lynch him. <i> - So far, this guy
may be phony, stupid,</i> <i> and may have a giant black
hole in his character,</i> <i> but I just don't get
the impression</i> <i> that he's this kind of
sociopath</i> <i> that it would be required
to do this kind of an act.</i> <i> - It made a lot of sense
to us.</i> <i> We all felt that
he would be able</i> to weather this media storm
that we were in and navigate us through it. <i> [quiet music]</i> <i> - Jackie, Lee, and myself
drove up to Los Angeles,</i> and we met Mark
and some of his staff. <i> - I finally said,
"Well, what, you know,</i> <i> what's it gonna cost, Mark?"</i> <i> And he said,
"A million bucks."</i> And I said, "Wow,"
you know? But we decided Mark
would be our best... hope. <i> - Mark called me in the office
and said,</i> <i> "We've been offered
the Peterson trial."</i> And I said "Mark, you are
a very popular attorney. "That's all gonna end, "'cause Scott Peterson's the
most hated man in America, "and if you take this case
you're gonna be the second most hated man
in America." <i> [mellow music]</i> -<i> He's one of the most well
known attorneys in America.</i> <i> It's a position he earned
by taking on</i> <i> some of the highest
profile cases--</i> <i> former congressman
Gary Condit</i> <i> in the wake
of the Chandra Levy case.</i> <i> Whitewater figure
Susan McDougal, acquitted.</i> <i> Alcohol-related charges</i> <i> against President Clinton's
brother Roger dismissed.</i> <i> - He was just this hotshot
L.A. attorney.</i> <i> He's used to cameras,</i> <i> so he would kind of
ham it up.</i> It was a perfect stage.
The whole world is watching. Why wouldn't you want
to represent Scott Peterson? <i> - You mean to tell me
that the media lies?</i> - Having Mark jump into the case
changed things dramatically. <i> Before Mark entered the case
we didn't know</i> what the defense was doing
on a day-to-day basis, but because everyone
in the media knew Mark and had his cell phone,
it was easy to get information. So we knew that he was
pursuing different angles. <i> - We've set the bar
extremely high,</i> <i> and that's to prove
that Scott is not only</i> <i> factually innocent
but to figure out</i> <i> exactly who it is did this
horrible thing</i> <i> to Scott's wife.</i> - He had a lead attorney
that was living in Modesto, a man by the name of
Matt Dalton, <i> who immersed himself
in the case</i> and was chasing down
every lead that he could. <i> [soft music]</i> <i> ♪ </i> <i> - Immediately after Scott's
arrest,</i> <i> I came up to Modesto.</i> <i> I lived here full time
for six months</i> investigating
the disappearance of Laci on behalf of Scott Peterson. I thought, you know,
watching it on the news it sounded like
this guy was done. This--this was a sealed deal, and the Attorney General
Lockyer made that statement publically,
that this was a slam-dunk case. <i> One of the first things
that I did</i> <i> was go through
the discovery.</i> <i> [dark music]</i> <i> Pursuant to California
discovery law,</i> <i> police had to hand over
everything they had</i> <i> related to the case.</i> <i> - Every police report
that's written,</i> <i> every witness
that's questioned,</i> every cell phone record
that's subpoenaed-- it all gets compiled. <i> - I had 30,000 pages
of documents</i> <i> and went through
every single document.</i> - Our family didn't have access
to any of this until Scott's arrested. - This is the door I would go
in to visit Scott each time. I spent over 100 hours in the
jail here with Scott Peterson. It was really just me and him. We were the only ones
up here in Modesto with the parents
occasionally visiting, and so I got to know him very,
very, very well. <i> Going through
the police discovery,</i> <i> all the police reports,</i> <i> they looked into
everything in his background,</i> <i> went all the way back
to his elementary school.</i> <i> They couldn't find a single
act of violence</i> <i> anywhere at any time
by this guy...</i> <i> and that was my
impression of him</i> <i> when I went into the jail.</i> Here I am going to see
this kid every day, this baby of a mama's boy. The media had created this
monster that didn't exist out of these shots of him
not crying. Just clips. <i> One point in all these
visits I said,</i> "Listen, if she hit her head "or she slipped or,
you know, "there was an accident
or, you know, "this could be
a manslaughter, you know, "and you could be out of here
in six years, you can negotiate
some sort of deal." And he says back to me,
"I didn't do it." <i> - Matt Dalton
and Gary Ermoian,</i> <i> who'd already been working
on the case,</i> uh, they began
to comb over the discovery. So you kinda had this next
phase in the investigation where we were able to work
with a lot more information. <i> - The defense will now
have to review</i> <i> 30,000 documents
on this case.</i> <i> - Scott looks forward
to proving his innocence</i> in this matter
and looks forward to finding out who did this
to his wife and to his child Conner. <i> [dark music]</i> <i> - The police theory was</i> that Scott
had killed his wife the night of December 23rd... <i> [dark music]</i> <i> ♪ </i> Attaching 8-pound anchors
to each of her limbs and one around her neck... <i> ♪ </i> And dumping her body
into the San Francisco Bay. - As my investigation
progressed, I discovered witnesses
at the Berkeley Marina who had observed Scott there, people who actually
had saw Scott launch the boat, had looked inside the boat
and saw nothing. <i> - At 12:54 p.m.,
we know that Scott</i> <i> is at the Berkeley Marina
parking lot</i> because he has a receipt <i> which indicates
which time he was there.</i> <i> I spoke with Michael Vestra,
David Johnson,</i> <i> and Uri Feria.</i> <i> They saw Scott's truck
or his boat</i> <i> at the marina that day.</i> <i> - Uri Feria, who was
working on a boat</i> which was moored
right near the launch-- <i> Mr. Feria did not necessarily
recall Scott's face,</i> <i> but he very specifically
recalled the boat</i> <i> driving right by him.</i> <i> He recalled seeing
some camouflage clothing.</i> <i> He looked right down
into the boat,</i> <i> and he saw
nothing at all unusual.</i> Mr. Johnson commented to me that it would have been
impossible for anyone <i> to conceal a large object</i> <i> in a small aluminum boat
like Scott's</i> <i> because that boat
would have to pass</i> <i> in front of
all the other residences</i> <i> that are living on their
boats in the marina.</i> <i> [edgy music]</i> <i> - Uri went down to
Puerto Vallarta.</i> <i> I got an email from Uri.</i> <i> Uri said he read an article
about the case.</i> "Do you think
you're gonna need me?" Mr. Geragos did not want to
bring him back. So, I told Uri,
"Go on with your trip." <i> I'm of the opinion
that Uri's testimony</i> <i> would have been quite
important</i> <i> because he saw nothing
in the boat,</i> which would be contrary to what
has been alleged in this case by the prosecution,
in that Scott took Laci's body in the boat out into the ocean
and dumped it. <i> [ominous music]</i> <i> ♪ </i> <i> [heavy chords]</i> <i> ♪ </i> <i> - It took a month, but
the autopsy reports are in.</i> <i> - The report will be
in the hands</i> <i> of the prosecutors
and the defense team today.</i> <i> - I show Scott a picture
of the baby.</i> There--there are points where he
just wanted to die, you know? And it was a sad thing,
you know. His family was gone,
they had done this to his child. <i> [solemn music]</i> And he stopped eating
and he wouldn't eat, and he got really skinny
and I remember thinking, "He didn't do this, man.
He didn't do this." <i> [heavy chords]</i> <i> ♪ </i> Every single time I went
in here to visit Scott, they put us in a line-up room
with a one-way mirror. So Scott and I
got to a point where all communication
was written 'cause we were afraid
that a detective or somebody was listening on the other side
of the one-way mirror. One of the visits
I told the detective, assuming he was there
on the other side of the mirror, that he blew the case,
and I started showing him <i> police reports
that he had missed,</i> and I told the detective
that he blew it-- he blew the case. When I came out
after that visit, my tires had been slashed. <i> ♪ </i> -<i> The prosecution is floating</i> <i> their own new theories</i> <i> on a regular basis
and, you know,</i> <i> the leaks are not, uh,
a sliver here and there,</i> <i> as Nancy says.</i> <i> I mean, we've got two leaks
in the past week.</i> After Mark Geragos was hired as the defense attorney
for Scott Peterson, <i> I took Mark Geragos' chair
on "Larry King Live."</i> I enjoyed the opportunity
to go and feel like you're educating
people, um, you know, and try to balance the scales
a little bit in the process. <i>They haven't come up with</i> <i> any of the missing body parts.
- They don't have to...</i> - My foil was Nancy Grace, who has spent a lifetime,
you know, convicting anyone
and everyone with five minutes' worth
of information and just, you know,
her own wits. <i> - He was fishing
on top of her body,</i> <i> all right? You wanna
call that a coincidence?</i> <i> Fine. Have at it.</i> - I--Nancy Grace purports to be a journalist, uh, but she acts like
a prosecutor. And journalists are not
supposed to be prosecutors. <i> - The system is
presumption of innocence.</i> <i> - Yeah, but we're not...
- You're not presuming</i> <i> innocence.
- We're not in court now.</i> - Are there bad people
who do bad things? Yes. You know,
should there be consequences for our crimes and misconduct?
Absolutely. But those are things
that should be resolved in the courtroom
and--and when you-- Television gets a hold of it and
the media gets a hold of it, especially the 24/7 media,
that's not what happens. <i> - I arrived in Modesto
right in time</i> <i> for the Laci Peterson
memorial service</i> <i> to do a story.</i> I had a feel for California
'cause that's where I was born and grew up
and I knew that Modesto was a sleepy
agricultural town. When I got there within two
blocks of the downtown area, you could
start hearing the whir of all the satellite trucks
that were parked there <i> that were broadcasting.</i> <i> It was sort of like
the staging</i> <i> of some major battle in
the middle of the desert.</i> I had covered
the Elvis Presley funeral way back in 1977 when
I first started at "Newsweek", and there were more
white limousines at the Laci Peterson
memorial than there were at
Elvis Presley's funeral. <i> - She mentioned,
"Well, you know, when I die</i> <i>"I don't want people to be sad.</i> <i> "I don't want people
to be missing me.</i> <i> I want people to be happy."</i> <i> - But one family
that won't be attending</i> <i> are the Petersons.</i> <i> In a statement released
by Jackie Peterson,</i> <i> she explains their absence
by saying, quote,</i> <i> "For the dignity
of the memorial service</i> <i> and out of respect to
Sharon and her family..."</i> - Someone at the jail
allowed our family to have time
in a room with Scott where we could hug him
and, um, I think six
or eight of us went up there. Um, they took us into a room. There was a deputy
in there with us. It was a woman and, um, they gave us I think
about 20 to 30 minutes. And, uh, he was still, uh... he was still handcuffed
but they, um, they just allowed us
to sit together and share memories
about Laci. That was kind of
our only opportunity. <i> [somber music]</i> <i> ♪ </i> And we just had
to change gears, and then we were in a fight
for Scott's life. <i> - Opening statements
begin today</i> <i> in the double murder trial
of Scott Peterson.</i> - The first day of trail,
it was mind-blowing. <i> Cameras were everywhere.</i> <i> There was probably
100 tents set up.</i> <i> - You don't make
a mistake like that</i> <i> in your opening statement.
- That was a tremendous error.</i> <i> - We walked away that day
thinking,</i> <i> "Wow, how can they
possibly convict now?"</i> We now have what would be
the closest thing to a smoking gun that
Laci was alive that morning. <i> [dramatic musical sting]</i>
