it's our understanding that Nottingham Forest have been unsuccessful with their appeal against their four-point deduction due to financial breaches that means yep the fourpoint stands it leads the relegation situation in an AZ you Weare uh look to it if you like with notum Forest three points clear of luten if you're loen town all to play for uh Financial Fairplay expert and former adviser to Manchester City a good friend of this show a regular now Stephan Barson joins us live this lunchtime Stephan thanks for coming in uh are you hearing what we were hearing and various other um media journalists at at this time that Nan Forest have indeed been unsuccessful with the appeal top well respected journalist David orstein being one of them yeah I mean it's not on either the Premier League website or the forest website the last we looked but uh I think it it's uh it's pretty clear that it's going to be an unsuccessful appeal I mean it was always a long shot I think when we last spoke about it a couple of weeks ago um one of the things that I uh mentioned was the possibility of them pushing quite hard for fractional points because I felt it was unlikely that they had enough in their Armory to get a whole point back the the the Brennan Johnson argument looked unfortunately based on the facts quite weak to overturn um and they'd already had the most that they could probably expect from cooperation and early admission in that they got two points mitigation already for that so to have got more was always going to be challenging um the the only other thing that that may have been an error uh by the original independent commission was the approach that they took in respects of promotion bonuses uh which is quite a big point for for a number of clubs and really obviously any club that's coming up but effectively what they're saying is that promotion bonuses do count towards PSR and therefore not an allowance and you don't get to just deduct them and that hasn't been overturned if they've if they've been unsuccessful at appeal so that will be an interesting feature going forward that clubs that have big promotion bonuses are going to be at a major disadvantage when it comes to complying with PSR for the final couple of Seasons tman am I right in thinking you think this is unfair on naum Forest that they have been unsuccessful with their appeal no I think it reinforces the fact that the appeal uh the original panel got it right because the question was framed at the beginning the conversation uh who's who's determining the league table and who's determining outcomes is this is this a win for lawyers or is it a win for sporting merits that's right well the fact that the appeal back in the day you always have challenges and you get in front of dragged in front of the beak and you get adjudicated in this instance they've been they've been they've been consequen for their behavior and the appeal is upheld so it's not a case of the lawyers if Nick dearco whoever was representing nor forest and been able to find a technicality then it would have been a win for the lawyers the fact of the matter is the panel have adjudicated they've given them their consequence and they've dealt with it what I do feel is challenging is the blunt instrument of financial fair play that drags A team out of the Premier out of the championship after being outside of the Premier League for 23 years then carries two losses two years of 12 and a half million with of losses and then drops that into a situation where they go into a premier league where they've only got a certain amount of losses that they're able to have I I think that's unfair I I think that doesn't that doesn't weit the system in the way that the ridiculously entitled Financial fair play was post you're noding you're nodding stepan you're yeah I mean it's it's not the way it's meant to work really I mean you you need to make allowances for teams that are coming into a very competitive Premier League yeah yeah yeah um you know it goes without saying Nuno SP to Santo you you could second guess what his uh what his take on it would be at the weekend uh the forest manager of course he believes that the Integrity of the Premier League has been damaged due to the points deductions and the timing of the appeal I think they had time you know to avoid what might happen we we are waiting I'm I'm I'm personally wait for the final decisions to to realize now that we if we have 33 do we have 32 do we have 31 do we have 30 yeah because this is what we must realize and for our opponents also and you should have done before and um I think someone talk about about the Integrity of the league is not good for anyone they have to get it right Stephan I I think I know your area is finance but noo is right the situation the Premier League's got itself into is crazy points taken away points given back an appeal maybe points given back no Forest unsuccessful it's a revolving door we don't know what who's in it and who's coming out of it well to look to an extent I mean the bottom line is don't fail right if you don't want to be in the mix don't fail right everyone knows the rules and they've known them for a while and in the case of Nottingham Forest in particular they they failed quite recklessly so I I don't think we should go overboard with the sympathy in respect of Nottingham Forest directly I think the Premier League could Implement as part of the review of the system a slightly earlier cut off date to review the accounts for the prior season it seems to me there's little reason why they couldn't make clubs submit at least numbers pending final audit sign off before the end of October that would give the Premier League a little bit more time to get some processes underway but you do have to remember that this has been the first season of effectively these processes and now that we've gone through it I think that the system will be a bit quicker and more efficient going forward um that's not to defend the system but it is the reality in that you would expect decisions to be easier to come to in terms of whether it's three points six points eight points whatever it is because we've now got at least some uh authorities for how you adjudicate what those points might be so that's a that's going to be a bit of a quicker thing we've got some more data points in terms of how you come up with some of the mitigation say around cooperation and early admission so again that's going to help them it's going to mean that the decisions of each of the uh independent commissions that are held going forward because there will be more cases next season and we can talk about that in a minute but there will be more cases uh they can be decided on shorter hearings so maybe three days and not five days slimming down the number of issues that are in play uh getting more of the teams to cooperate fully as the Premier League wants them and that means turning up at the Premier League's offices in the case of Everton they ask them to bring all the laptops I mean completely ridiculous but that's the sort of position that they wanted to get to bring all bring your board bring all of your laptops and we'll have a a discussion to try and nail down all the outstanding matters which means that when we actually get to the independent commission there are less things flying around it means the independent commission can be quicker and it means the decisions of those independent commissions can come out sooner now if they can do all of that and they can bring all of the timetable forward then what we'll do is we'll start to have decisions way before the end of February and then people won't have the same complaints exactly the process has got to be more sophisticated you'd agree with that St it has to be to an extent yeah so so yes but let's also remember there may be a number of other clubs in the mix next season right we haven't even spoken about teams that probably have broke well we know Leicester have breached this year that's got to go into next season then you've got all of the adjudication of all of the current season breaches if there are any then there's also the outstanding situations of Chelsea and Manchester City and Chelsea is not finished yet even on the PSR side as we talked about last time because we still don't think that the hotel deal in relation to 2223 has yet been signed off and then you've got all the off book payments that we're talking about and of course we've got the Manchester City situation so they're a busy legal team at the Premier League you know you can't get around that it's quite incredible where we've got to Simon um as far as Forest are concerned unsuccessful we here with their appeal against four-o deduction due to financial breaches so they're going to have to take that on the chin from this point onwards until the end of the season what did you want to say off the back of what St was say that would have been the priced in perspective anyway anything else would have been a bonus yeah the the the clubs have to be complicit in in streamlining processes themselves because it probably has been a maneuver and an arduous task getting the clubs to concede that they want to provide their accounts by December um because ultimately the clubs have their own view on when account should be provided now that they've seen the outcomes of these situations and they see the ramifications of it the process becomes streamlined it becomes streamlined then you've got people like Leicester city that get relegated to the championship want to have an argument have an argument about whether they should submit accounts to the championship because they weren't under their jurisdiction in March and get underneath it with a technicality because they don't want to form part of a regime that can look at their accounts and tell them that actually in January there's a potential you're going to breach Financial fair play so we're going to take you make you sell players and they didn't want the do that so the clubs aren themselves complicit if the clubs are happy their accounts finish in June to produce accounts by the end of September or end of October to give this window of time so we don't have to listen to to a football manager tell us what his view on it is uh in April he'll complain about it in February still if he gets it in February you'll just move the complaint nearer to uh different part of the Season yeah as soon as we came on air this morning way back at 10: a.m. um we were telling you that notum Forest it was our understanding had been unsuccessful in their appeal against the fourpoint deduction uh due to financial breaches the Four Points stood and that indeed has proven to be correct we've been right all along Stephan what more have you gotten that uh We've now got the reasons so they published the reasons uh on the Premier League website uh the Nottingham Forest actually only appealed on two grounds uh one of them was that the the sanction was not suspended um um which I think it was always always going to be a weak argument based on the analysis of the independent commission and the need in its view for punishment to be immediate um so that was always going to was a bit of a flyer and then the other one was the one we knew which was to say that the original independent commission got the Brennan Johnson analysis wrong and that it should have been mitigation um and that's been rejected by the appeal uh the appeal seems to be saying actually some of the arguments were pretty tenuous from naum forest uh and focused on a minute examination of the words used by the commission uh and I don't think it really accepted those criticisms it said decisions such as these should not be subject to microscopic forensic examination and interpreted as if they were statutes which have been drafted by parliamentary Council uh so I think it's pretty dismissive of some of the approach of notingham forest I see San thanks for that not having a great time of it Simon
