WATCHING TONIGHT STORMS KEEP COMING >>> NEXT, WE ARE LIVE WITH THIS ANGLE IF MR. TRUMP WHEELS BACK THE WHIT HOUSE, COULD HE PARDON HIMSELF >>> SOME OTHER NEWS TO GET T INCLUDING SOME OPTIMISM ON WAL STREET TONIGHT THE MARKETS TOUCHING THE SO-CALLED SKINNY BILL MARKET GOOD NEWS FOR INVESTORS, MAYBE BUT THAT'S GOOD NEWS FOR YOU MONEY. NOW THE DANGEROUS SMOKE FROM THE WILDFIRES ARE STARTING TO CLEA UP IN THE NORTHEAST. WE'LL EXPLAIN WHEN TENS OF MILLIONS OF US MIGHT BE ABLE T GET OUT FROM THE ALERTS. >>> WE WILL TAKE YOU TO OREGON WITH THE NEW LAW DESIGNED TO CRACK DOWN ON HOMELESSNESS HOW THEY ARE TRYING TO SOLVE THEIR CRISIS LATER ON IN THE SHOW I'M HALLIE JACKSON, AND RIGH OUT OF THE GATE HERE THE DOCUMENTS THAT'S AT TH HEART OF THE 37 COUNTS THEY NO FACE AS A PART OF THAT INDICTMENT AGAINST HIM WE WANT TO SHOW YOU THE BOXE THAT ARE STACKED UP ON THE STAGE, RIGHT IN ONE INSTANCE RIGHT NEXT TO SHOWER APPARENTLY FILLED WITH DOZEN UPON DOZENS OF CLASSIFIE DOCUMENTS INCLUDING VERY SENSITIVE LEGIT SENSITIV NATIONAL SECURITY INFORMATION. THESE DOCUMENTS ARE NOT SUPPOS TO BE THERE. MR TRUMP'S PERSONAL HOME IN FLORIDA. THE BIG QUESTION, DID HE KNOW HE SHOULDN'T HAVE HAD THEM? EXPLOSIVE NEW EVIDENCE SUGGEST HE KNEW WHAT HE WAS DOING. TELLING MULTIPLE PEOPLE AT HIS NEW JERSEY GOLF CLUB, A HIGHLY CONCENTRATION PLAN THAT HE COULD DECLASSIFY AS PRESIDENT, BUT NOW HE CAN'T HE SAYS EVEN THOUGH IT IS STIL A SECRET AND NOWAY CAN'T, IT IS STILL A SECRET ONE OF HIS ATTORNEYS REMEMBERE THIS MOMENT WHEN THEY SAID ACCORDING TO THIS INDICTMENT WOULDN'T IT BE BETTER IF WE TOLD THEM WE DIDN'T HAVE ANYTHING HERE THAN THE FEDERA INVESTIGATORS? AN ATTORNEY REMEMBERS MAKING THE CLUCKING MOTION TO THE FUL CLASSIFIED DOCUMENTS SAYING HEY, PULL SOME OF THAT STUFF OU BEFORE YOU HAND IT OVER. HEAR FROM THE SPECIAL COUNSE TONIGHT WHO IS SPEAKING FOR TH FIRST TIME HE WAS CRYSTAL CLEAR LISTEN >> AND HE HAS ONE SET OF LAWS IN THE COUNTRY AS HE APPLIED TO EVERYONE >> AND HE IS NOW PERSONALL ATTACKING SMITH, CALLING HIM A DERANGED CYCLE, DONALD TRUMP'S WORDS. REMEMBER THE OPPONENT HERE RUNNING FOR ANOTHER THREE YEAR IN THE WHITE HOUSE HE'S RAISING MONEY AND SELLING SHIRTS THAT SAY I STAND WITH TRUMP IN THE DAY THESE THING CAME OUT SOME ARE SAYING LISTEN INCLUDING SOME OPPONENTS, A LO OF THEM HAVE CRITICIZED TH JUSTICE DEPARTMENT AT LEAST ON SAYS THEY MIGHT PARDON TRUMP ONE CONGRESSMAN SAYING HE HA REACHED A WAR PHASE. AN EYE FOR ANNOYER WE KNOW YOU HAVE BIG QUESTIONS AS OUR TEAM LOOKS AT WHA QUESTIONS YOU HAVE THAT YOU'RE LOOKING UP WE E ARE ALL TRYING TO PROCESS THIS HISTORIC MOMENT SOME OF WHICH YOU WANT TO KNOW YOU JUST LAID OUT WHAT THAT IS AND THE CHARGES IN JUST A SECOND AND HIS RESPONSE TO TH INDICTMENT AS YOU JUST HEARD THAT IS TRUMP GOING TO JAIL WE WON'T KNOW FOR A WHILE. OUR PANEL WILL BREAK IT DOWN AND WE HAVE KEN IN MIAMI WE'RE STARTING WITH KEN. AND THINGS THAT CONNECT THE DOTS AS TO HOW THE DOJ IS MAKING THIS CASE AGAINST THE FORME PRESIDENT IS PRESUMED INNOCENT UNTIL PROVEN GUILTY. WALK US THROUGH SOME OF THE KE REVELATIONS BECAUSE THERE AR SEVERAL IMPORTANT ONES PEOPL SHOULD KNOW ABOUT? >> Reporter: WELL, LET'S START WITH THIS, HALLIE. AND LOOK, IT'S NOT LIKE TH PRESIDENT PACKED HIS OWN BOXES TURNS OUT ACCORDING TO THE INDICTMENT, HE DID, IN PART. THAT'S ONE OF THE SURPRISES HERE THAT THE INDICTMENT SAYS MR. TRUMP, HIMSELF, PARTICIPATED I THE PACKING OF THE BOXES, SOME OF THE BOXES THAT WEREN'T FROM THE WHITE HOUSE TO MAR-A-LAGO, WITH AN INTIMATE KNOWLEDGE O WHERE THEY WERE INSIDE THE COMPOUND BUT LOOK, BIG PICTURE HERE THERE IS A LOT OF REALLY GOO JOURNALISM ABOUT THIS CASE OVE THE MONTH. IT'S EVEN MORE DEVASTATING THA NIGHT WORSE PORTRAYALS IN TH PRESS. TALKING ABOUT THE CLASSIFIED PLAN THAT WE KNOW AS IRAN AN SHARING IT WITH PEOPLE NOT AUTHORIZED TO SEE IT AND THAT ALLEGES MR. TRUMP, HE SHARED CLASSIFIE INFORMATION WITH PEOPLE WH DIDN'T HAVE A CLEARANCE. THAT'S A BIG DEAL. HE'S NOT CHARGED WITH THE CRIM FOR SOME TECHNICAL REASONS, BU IT IS A THRESHOLD QUESTION FOR SOME REPUBLICANS AND WHO MIGHT SAY IT IS ONE THING TO HAV CLASSIFIED DOCUMENTS IN TH HOUSE. AND IT IS ANOTHER THING ON SHOWING IT TO PEOPLE WHO SHOULDN'T HAVE SEEN IT THIS INDICTMENT LAYS OUT THE DOCUMENTS THAT WERE SENSITIV INFORMATION AND THINK ABOUT IT ON THE NUCLEAR PROGRAM AND ABOUT THE INFORMED WEAPONS AND ABOUT SENSITIVE INTELLIGENCE SOURCES AND METHODS. THE KINDS OF THINGS IF TAY ARE DISCLOSED THAT COULD THREATE THE NATIONAL SECURITY. AND THEY WOULD GET TO TH CONSPIRACY, WHICH IS A SEPARAT THING. ONCE CAUGHT WITH THE DOCUMENT, THEY WOULD TAKE STEPS TO HID THE BALL AND TO KEEP THA JUSTICE DEPARTMENT FROM FINDIN THEM, AND TO LIE TO THE JUSTIC DEPARTMENT TAKING IT TOGETHER HAS BEE INCREDIBLE OF THE MISCONDUCT AGAIN, INNOCENT UNTIL PROVEN GUILTY >> YOU KNOW, YOU LAY OUT SOME OF THE NEW REVELATIONS HERE FOR EXAMPLE, DONALD TRUMP, H APPARENTLY HAD ACCORDING TO THIS INDICTMENT, FROM HIS PAST, AFFILIATED WITH THE CAMPAIGN T THIS MAP, RIGHT? IT IS ALSO IMPORTANT TO TALK ABOUT THE BIG PICTURE FROM THI INDICTMENT ARE THE DOCUMENTS, THEMSELVES, WHAT DONALD TRUMP HAD, LIKE TH INFORMATION ABOUT THE UNITED STATES NUCLEAR MATERIALS INFORMATION ABOUT OUR MILITARY VULNERABILITIES AND TH VULNERABILITIES OF OUR ALLIE HERE MULTIPLE AGENCIES THAT WE'VE BEEN SHOWN HERE. THE CIA, THE DEPARTMENT OF DEFENSE, THAT WERE EFFECTIVE WITH THE DOCUMENTS CAUGHT UP AND THEY GOT CAUGHT UP IN THIS YOU'VE COVERED A LOT OF NATIONAL SECURITY EVENTS OVER THE LAS MANY YEARS THAT YOU'VE BEE DOING THIS WHERE DID THIS GO? >> LOOK, ON THE ONE HAND, IT I NOT AS BAD AS IT COULD HAV BEEN, RIGHT? AND NO ALLEGATION THAT HE WA SELLING INFORMATION TO THE SAUDI AND NO ALLEGATION THAT ANY O THIS INFORMATION WOULD GET INT THE HANDS OF THE ADVERSARIES AND GIVEN THEY WERE STORED INSECURELY OF MAR-A-LAGO AND IN THE MANY CASES THAT I HAVE COVERED OVER THE YEARS FROM MISHANDLING THE CLASSIFIED DOCUMENTS. THIS IS ONE OF THE WORST FAC PATTERN I'VE EVER SEEN JUST LAST WEEK, THE AIR FORC WAS SENTENCED TO THREE YEARS I PRISON FOR TAKING HOME THE DOCUMENTS OVER THE YEARS NO ALLEGATION THAT HE SHARED THEM WITH ANYONE OR HE OBSTRUCTED JUSTICE AS HE GOT THREE YEARS IN PRISON. >> AND WHAT ABOUT WALT THE OTHER PERSON INDICTED IN THIS DOCUMENT WE'RE FINDING OU ABOUT? >> AND IT IS A BIT OF A SA STORY. THE LOYAL TRUMP AIDE IN TH WHITE HOUSE WENT WITH HIM TO MAR-A-LAGO AND BECAME HIS BUTLER AND BODY MAN CAUGHT UP IN THIS ALLEGEDLY MOVED DOCUMENTS, HELPING TRUMP OBSTRUCT JUSTICE OFFERING HIM A DEAL TO COOPERATE, IN EXCHANGE FOR A REDUCED SENTENCE OR IMMUNITY AND HE DECLINED. SO NOW HE'S FACING YEARS I PRISON CHARGED WITH CONSPIRACY FOR FORMER PRESIDENT TRUMP T OBSTRUCT JUSTICE >> LIVE IN MIAMI, WHER OBVIOUSLY THE SPOTLIGHT IS TURNING AHEAD OF THE ARRAIGNMENT SCHEDULED FOR TUESDAY, AFTERNOON 3:00 P.M EASTERN. I'M SURE WE WILL SEE YOU THERE THANK YOU. SO DANNY, HE HAS LAID OUT TH SIGNIFICANT PIECES AND THE REVELATIONS FROM THI INDICTMENT THE FIRST TIME WE'VE SEEN THEM IN THIS PROCESS IN A SHORT BRIEF SENSE OF THE CHARGES BEING TAUGHT >> HE SPOKE IN HIS TEAM' INDICTMENT THE ONLY REAL PURPOSE WA PUTTING WHAT WORKED WITH HIM I THESE PRESS CONFERENCES. HE SAID IN SO MANY WORDS, THIS DOESN'T ALWAYS HAPPEN, BUT H WAS VERY DIRECT. READ THE INDICTMENT. IT'S IN THE FOUR CORNERS WHEN SOMEONE LIKE JACK SMITH GIVES A PRESS CONFERENCE LIK THIS, I DID NOT EXPECT ANY QUESTIONS. I EXPECTED IT TO BE BRIEF, I WAS BRIEF AND BY THE BOOK. WHY NOT? AND HE IS PRODUCING THE TEAM THAT WILL PRODUCE THAT INDICTMENT THAT IS FULL OF FACTS. ONE THING HE DIDN'T SAY THAT YOU COULD BE ASSURED IS THAT HE AN A VERY LARGE TEAM OF FOLKS HAV GONE OVER THE INDICTMENT WIT THE FINE COMB AS THEY BELIEV THEY COULD PROVE EVERY SINGL FACT IN THERE AND THEY BELIEVE THEY HAVE DOCUMENTS SUPPORTING EACH EVIDENCE IN THA INDICTMENT >> AND THERE IS ALSO JUDGE EILEEN CANON WHO WILL BE OVERSEEING THIS CASE HOW SHOULD WE BE THINKING ABOU HER? >> AND JUST BECAUSE A PRESIDEN APPOINTED THE FEDERAL JUDG BECAUSE THEY ARE ALL APPOINTED BY ONE PRESIDENT OR THE OTHE THAT SOMEHOW THAT ALONE COUL AFFECT THE ABILITY OF THE JUDG TO HEAR A CASE IT HAS KIND OF HAPPENED IN THE PAST IT WOULD BE A DANGEROU PRECEDENT TO SAY SOMEONE WAS AUTOMATICALLY DISQUALIFIED BECAUSE THE DEFENSE WOULD HAVE AN ARGUMENT LIKE WAIT A MINUTE I APPOINTED A NUMBER OF JUDGES WHY SHOULD THEY BE DISQUALIFIE IF I HAPPEN TO BY THE SPIN O THE WHEEL IN THE COURTHOUSE EN UP WITH THIS JUDGE AND THEN WHAT DO YOU DO IF THE CASE GOES ON APPEAL? A LOT OF APPELLATE CASES IS IT THE SAME RULE OF DISQUALIFICATION A HARDER RULE THAT A JUDGE WHO WAS APPOINTED BY THEM INVOLVIN THE PRESIDENT. I THINK THAT WOULD CREATE A LO OF PROBLEMS. IF THERE IS ADDITIONAL EVIDENC OF SOME KIND OF BIAS, THEN THA SHOULD BE BROUGHT TO THE FLOOR GENERALLY SPEAKING, I DON' THINK IT SHOULD BE A HARD AN FAST RULE. ALL DEFENDANTS HAVE A RIGHT TO THE JURY TRIAL AS MUCH AS THEY WOULD WANT THE JUDGE ONLY TRIAL WITH HER THAT DEFENDANTS DO NOT HAVE A RIGHT TO EJECT THE JUDGE ONLY TRIAL AS THEY ALSO HAVE TO AGREE. THE GOVERNMENT WILL NOT AGREE. >> AT LEAST PARTIAL NEW LEGA TEAM THAT WILL BE IN PLACE THA THEY MIGHT KNOW AS HE HAS MORE ON THE TODAY SHOW TALKING TO CRAIG IS OUT >> CANDIDLY I WAS VERY SURPRISED BY THIS. HE ACQUITTED HIMSELF VERY WELL WITH CRAIG MELVIN. AND I THOUGHT IT WAS A GOO ASSET FOR THE TEAM AS HE HAS DONE VERY WELL IN INTERVIEWS SOUNDING AT LEAST REASONABLE AND ARTICULATING A, THE BEST DEFENSE THEY COULD I'M SURPRISED THOSE FOLKS AR GONE BUT THAT'S NOT TO SAY THEY ASSEMBLED A GOOD TEAM IN THEIR ABSENCE. >> DANNY CEVALLOS, THANK YOU FOR THIS THE LEGAL LANDSCAPE HERE AS WE WILL TALK ABOUT THE POLITICA LANDSCAPE AND HOW THEY COVER ALL STATES AND EVERYTHING ACCORDIN TO WASHINGTON. ONE OF THE THINGS WE'VE BEEN HEARING THAT UNFOLDED TODAY FROM THE RIVAL CAMPAIGNS OF DONAL TRUMP. IT'S A BIT OF A SPECTRUM ON THE ONE HAND, IT'S CALLED POTENTIALLY DISRUPTIVE, SERIOU ON THE OTHER HAND. PEOPLE ARE CAUTIONING THAT THERE IS STILL A LONG WAYS TO GO HERE SOME THAT ARE HESITANT TO GE LOCKED UP AT THIS POINT AN SOMETHING THAT MIGHT BE COMING IN, FOR EXAMPLE. A LITTLE BIT BEHIND THE TEAM PUBLICLY YOU ARE SEEING SOME CANDIDATES OPPOSING DONALD TRUMP IN THEIR FIGHT TO THE WHIT HOUSE TO COME BACK AND UP HI ACCUSATION OF THE DOJ THAT I SORT OF PUSHING THE PARTISAN WITCH HUNT THEN YOU HAVE SOMEBODY LIKE MIKE PENCE WHO IS HAVING ANOTHE SUBTLE TAKE. HERE IS WHAT HE'S SAYING >> THE INDICTMENT AGAINST TH FORMER PRESIDENT WHO IS NARROWLY DIVISIVE AND A VERY CHALLENGIN TIME FOR THE AMERICAN FAMILIES AND I ALSO BELIEVE THA MESSAGE. >> I MEAN THAT I THOUGHT WAS ONE OF THE MORE NUANCED REACTION THAT I'VE SEEN FROM ANYBODY TO ALLOW PENCE THE ABILITY TO PIVOT WHEREVER THIS STORY GOES NEXT. MOST OF THE PEOPLE WHO HAV RESPONDED, THEY DID SO BEFOR THEY WERE ABLE TO READ THA INDICTMENT I'M WONDERING IF THAT WILL CHANGE FOR ANYBODY ESPECIALLY AS THEY LAY IT OUT THAT THEY WILL SEEM TO HAVE THE FORME PRESIDENT NOT JUST HAVING TH DOCUMENTS, BUT DETAILING WHA DOCUMENTS THEY WERE AND WHAT WERE IMPACTED. BY THE WAY, IT IS ALSO ON TAKE APPARENTLY AND THEY ARE ARGUING WITH THAT WAY. >> AND SAYING ON TAPE, SAYIN WELL, I'M PARAPHRASING WHEN YOU LOOK AT HOW PEOPLE AR RALLYING AROUND THEM, YOU WOUL LOOK AT THE OTHER COMPONENT, BUBBLING IN THE LAST FEW HOURS HERE THE PUSHBACKS FOR THE NUMBER O CONGRESS TO A TWEET REFERENCIN THE MILITARY MAPS THAT CAME OU AFTER THE CHARGES WERE REVEALED WE SAW THEM TALK ABOUT EYE FOR AN EYE AND THIS IS A PHRAS HERE AND I HEARD THAT PIECE O IT AND YOU MUST BE DOWN TH ROAD HOW COULD YOU NOT HAVE THA ESPECIALLY BECAUSE OF JANU 6? I THINK THAT EVERYTHING THAT WE'VE SEEN FROM THE FORMER PRESIDENT AS WE WOULD HAVE THA CONVERSATION IN THE AFTERMATH. I CAN'T BELIEVE WE'RE TALKIN ABOUT THAT, BUT HERE THEY AR AND ALWAYS THAT CONVERSATION O THIS IS A MAN WHO HAS BEEN A THE CENTER OF THE VIOLENCE IN LARGE SCALE THAT WE SAW ON CAPITOL HILL ON JANUARY 6. NOW THERE'S A QUESTION OF IF THAT FOLLOWS THEM AT EACH OF THEIR INDICTMENT BECAUSE THAT' ONE AND THERE ARE PROBABLY TWO MORE THAT COULD COME DOWN. >> THANK YOU SO MUCH I APPRECIATE IT. >>> AND SO WE WILL HAVE MORE O THE DONALD TRUMP ININDICTMEN COMING UP ON THE SHOW. BUT FOR NOW, MORE BIG NEWS TODAY. THAT'S THE APPEARANCE OF JORAN VAN DER SLOOT, THE MAN SUSPECTED OF HAVING SOMETHING TO DO WITH NATALEE HOLLOWAY'S DISAPPEARANCE. TODAY HE'S IN AN AMERICA COURTROOM FOR THE VERY FIRST TIME VAN DER SLOOT IS NOT BEING HEL FOR ANY CHARGES RELATED TO THE MURDER OF HOLLOWAY OR HER DEATH, BUT INSTEAD HER EXTORTION AN WIRE FRAUD FOR ALLEGEDLY CONNING HER MOTHER INTO SENDING $25,00 FOR INFORMATION FROM HIM ABOUT THE LOCATION OF HOLLOWAY'S BODY IT'S COMING AFTER HE HAS BEE EXTRADITED ABOUT 24 HOURS AGO. REMEMBER THIS VIDEO, THE ABSOLUTE SCENE THERE AND HOW MUCH THE SPOTLIGHT IS ON HIM I THIS CASE. SERVING THE DIFFERENT WOMAN IN PERU ON TRIAL FOR ANYTHING HAVING T DO WITH NATALEE HOLLOWAY'S DEATH, THE FULL CIRCLE MOMENT. HE'S BEEN DIRECTED TWICE REMEMBER, FOR THE MURDER ON TH LACK OF EVIDENCE THEY STILL BELIEVE HE'S THE ON RESPONSIBLE. SAM BROCK IS JOINING US FROM BIRMINGHAM >> THERE HAVE SOME SURPRISIN DEVELOPMENTS STARTING WITH THE FACT THE HEARINGS ONLY LASTE THREE TO FOUR MINUTES, WHICH INCLUDED THE EXTORTION AND WIR FRAUD. AND ON VAN DER SLOOT'S BEHALF. AND IT'S THE WEIRD DYNAMIC BETWEEN THE FAMILY MEMBER OF NATALEE HOLLOWAY AND WE AR TALKING ABOUT THE BROTHE MATTHEW. AND JORAN VAN DE SLOOT, YOU HAVE TO WONDER WHAT IS GOING ON IN THEIR MIND? THEY ARE GOING AWAY FROM THOSE GUYS WHO HAVE BEEN CONNECTED T THE DISAPPEARANCE OF THE DEATH OF THE LOVED ONES FOR DECADE NOW. AND THE HANDCUFFS. THEY ONLY STACKED OUT AS THE WERE ASKED ABOUT THE QUESTIONS TO THE DUTCH TRANSLATOR AND TH STYLUS IN THAT HAD ROOM. I CAN SPEAK PERFECT ENGLISH, THAT'S FINE. AND WE WOULD TALK ABOUT WHAT I MEANT. AT LEAST THEY WOULD HAVE THA HAPPEN AND THEY NEVER GAVE UP HOPE THAT THIS DAY WOULD BE POSSIBLE, SO WE'RE HOPING THAT THE PROCESS WILL BE MOR AND MORE INFORMATION AND LOOKING AT THE ADJUSTMENTS. >> Reporter: AS WE TALK ABOU THE TWO CHARGES, EACH ONE WILL CARRY THE 20-YEAR PRISON SENTENCE AS THEY ARE DEPICTED. THE REACTION IS INTERESTING AS YOU WOULD TALK ABOUT THE MIXED FEELINGS RIGHT NOW THE WHEELS OF THE JUSTICE AR BEGINNING TO GRIND, BUT THEY'R CONFIDENT THAT TOWARDS ACCOUNTABILITY AND HOPEFULLY THEY WOULD TRUST THE PROSECUTION WILL LEAD US TO THE TRUTH ABOU NATALIE AND THAT IS REALLY THE BOTTOM LINE HERE AS I SPOKE TO MATT, HIS BROTHER. HE SAID YES, IT FEELS LIKE ASSEMBLY OF JUSTICE. WE ALL WANT THAT CONVICTION AN WHAT WE WANT IS CANCER AS WE WANT TO KNOW WHERE HER REMAINS ARE. >> THAT'S THE VERY LATEST. LET ME SEND IT BACK TO YOU >> OUR THANKS TO SAM BROCK FOR THAT REPORTING AND HAVING A BIG REBOUND, ENDING THE WEEK ON THE HIGH NOTE. IT'S NOT A FULL BLOWN MARKET BUT A SKINNY ONE EVEN THOUGH WE KNOW TH MARKETS ARE NOT THE ECONOMY THAT IT SEEMS LIKE THEY HAVE THAT OPTIMISM OF WHERE THINGS ARE GOING. YOU HAVE ALL THE NUMBERS IN TH GREEN HERE WITH THE NASDAQ AND IT IS THE S&P THAT IS HAVING A MOMENT TO GO TO A FULL WIN WINNING STREAK, THE LONGEST IT'S HAD IN A YEAR, CLOSING UP 20 ABOVE ITS LOWEST LEVEL OF 2022 THE EDITOR AND CHIEF JOINS U NOW. IT IS NOT CALLS TO BUST OUT TH CHAMPAGNE YET, BUT A SIGN FO OPTIMISM, EVEN THOUGH TH NUMBERS ARE NOT UP THAT MUCH >> ABSOLUTELY. YOU CAN CALL IT A HALF TACKLE, AND BECAUSE THAT IS ONE OF THE STOCKS THAT'S DRIVING TH GAINS. AND THE BIGGEST STOCK THAT'S OUT THERE, DRIVING THE GAMES IN TH S&P 500. BUT YOU CAN'T DENY THE FACT THEY WILL HAVE 20% BACK IN OCTOBER. AND THAT IS A BIG DEAL FOR US. AMERICANS, THE AVERAGE 401K WA AROUND $130,000 BEFORE LAS YEAR WENT ALL THE WAY DOWN TO LES THAN $100,000. WE'VE HAD A NICE REBOUND PEOPLE ARE FEELING IT IN THEIR 401Ks, PRODUCING THE WEALT AFFECT TO GIVE THEM MORE CONFIDENCE POTENTIALLY TO SPEN TO MAKE A BIG PURCHASE AND MAYBE NOT GET SO CONCERNED ABOUT THE POTEEN IT ISSUE RECESSION. >> WHAT DOES IT MEAN FOR OUR MONEY? WE OFTEN TALK ABOUT MARKETS AN NOT THE ECONOMY. WHAT DOES IT MEAN FO PEOPLE WHO DO HAVE 401Ks O CARE ABOUT HOW FAR THEIR DOLLARS CAN STRETCH AT THE SUPERMARKET >> WELL, LET ME PUT THIS I PERSPECTIVE. THE BULL MARKETS LAST YEAR, TH BARE MARKETS THAN WHAT WE HA LAST YEAR WILL LAST AROUND 1 MONTHS, GOING ON FOR A WHILE IT DOESN'T MEAN WE'RE OFF TH RACES, BUT IT DOES MEAN THAT STOCKS ARE RUNNING HIGHER AN MORE MONEY IS GOING INTO THE STOCKS THEY COULD CARRY AND IT DOESN' MEAN IT WILL BE A 20% TO 30% YEAR, BUT WE DO HAVE A NIC RECOVERY AND HOPEFULLY SOM MOMENTUM BEHIND IT >> CALEB SILVER, THANK YOU SO MUCH. >>> THE SMOKY SKIES ARE STARTING TO CLEAR UP. THEY'RE NOT TOTALLY GONE YET BUT THINGS ARE SOMEWHAT GETTIN BETTER FOR 80 MILLION PEOPLE UNDER QUALITY ALERTS LET ME SHOW YOU BALTIMORE HERE NOT 100% THOUGH, BUT THE SMOKE SHOULD BE FURTHER WEST INTO TH GREAT LAKES. YES, HAVING AN IMPACT ON LIFE IN THE CITY, RIGHT? AND SPILLING THE NEW YORK PUBLIC SCHOOLS, BOTH REMOTE TODAY SLIGHT DELAYS FROM THE AIRPORT AND THAT IS AN IMPROVEMENT FEWER OF THOSE TAKE A LOOK AT THE MAP AS TH AIR QUALITY IS IN THAT MODERAT RANGE. YELLOW IS NOT GREAT, BUT BETTE THAN THE REDS AND PURPLES WE'V BEEN SEEING FOR THE PAST 4 HOURS OR SO. LIVE FOR US IN PHILADELPHI TONIGHT. GEORGE, OBVIOUSLY THINGS HAV IMPROVED, BUT KIDS ARE STILL REMOTE WITH THAT IMPACT ON THEIR DAILY LIVES? >> Reporter: YEAH, THAT'S RIGHT, HALLIE WHAT A DIFFERENCE A DAY MAKES, RIGHT? AND THAT IS THE APP THAT A LOT OF US HAVE BEEN USING AND ONE OF THE MORE POPULAR APPS. RIGHT NOW THEY ACTUALLY SA GOOD, WHICH IS SUCH A DRAMATIC IMPROVEMENT AS YOU SAW IN TH 300 TO 400 WORST AIR IN TH WORLD. I MEAN IT FEELS SO MUCH BETTER YOU CAN FEEL IT IS JUST TH ATMOSPHERE WITH PEOPLE NOT WEARING AS MANY MASKS AS WE SA YESTERDAY AT THE AIRPORT OVERALL A SIGH OF RELIEF I HATE LEAVING PUNS LIKE THAT, THAT PEOPLE FEEL LIKE THEY COULD GO OUT IT'S NOT SAFE FOR EVERYONE, BU BEST TO TREAD CAREFULLY WITH A LOT OF PEOPLE TAKING SOM PRECAUTIONS AS YOU MENTIONED THE PHILADELPHIA SCHOOLS AND ACTUALLY PLAYING OUT, SAYING THAT IS ALL GOING TO GO BACK T IN-PERSON LEARNING ON MONDAY AND OF COURSE, EVERYONE IS CLEARLY AWARE OF THE CANADIA WILDFIRES THAT ARE OUT IT IS A CONCERN. BUT FOR NOW, MANY RELISHING TH FACT THEY LIKE TO GO OUTSIDE AND ACTUALLY ENJOY THE WEATHER O THE WEEKEND. >> THAT'S A NICE FEATURE FOR THEM THANK YOU SO MUCH. WE APPRECIATE IT >>> MUCH MORE TO GET T INCLUDING HUNDREDS OF THOUSAND OF UPS WORKERS ABOUT THE VOT NEEDING TO STRIKE. WHAT THEY WANT AND WHAT IT MEANS FOR YOUR PACKAGES. >>> AND THOUSANDS OF PEOPL EVACUATING THEIR HOMES I >>> HUNDREDS OF THOUSANDS OF UPS VOTERS ARE WORKING RIGHT NOW T STRIKE THAT'S THE POTENTIAL IF THEY DID, THEY WOULD BRIN THE BIGGEST PACKET CARRIER T THE TOTAL STANDSTILL WE WON'T KNOW THE RESULT OF TH VOTE UNTIL NEXT FRIDAY AS THEY WANT MORE MONEY, BETTER WORKIN CONDITIONS THE LAST TIME WE SAW UPS WORKERS STRIKE WAS BACK IN 1997. THE YEAR AMAZON WENT PUBLIC. THINK ABOUT THAT LIFE BEFORE AMAZON THE WAY WE SHOPPED WAS VER DIFFERENT. AND A LOT OF YOU HAVE SWAPPE THE STORE VISITS FOR THE DELIVERIES INSTEAD ESPECIALL OVER THE LAST FEW YEARS. THINK ABOUT HOW MUCH ONLIN SHOPPING YOU DO AND HOW THEY HAVE CHANGED OUR SHOPPIN HABIT. THEY SAY RIGHT NOW THEY'RE SHIPPING ABOUT 24 MILLIO PACKAGES A DAY AND A QUARTER O ALL THE DELIVERIES IN TH COUNTRY. PER YEAR GLOBALLY, YOU DON'T HAVE A STRIKE THAT'S HAPPENING YET, BUT TALK ABOUT WHAT THE WANT AND WHAT REPERCUSSIONS THEY WANT IF THEY DID DECIDE TO STRIKE >> Reporter: YES, WE WILL GET TO THE REPERCUSSIONS IN A MOMENT, BUT THE GOAL POINTS OF WHA THEY'RE ASKING FOR AS WE TALK ABOUT THE UNION WORKERRERS, TAKE A LOOK AT THA END. THESE ARE NOT THE WHOL CONCEPTS WE'VE GOT THAT STRIKE THAT'S HAPPENING RIGHT NOW IN HOLLYWOOD. UPS AND ALL KINDS OF SERVICES, THEY SAW THAT SURGE IN DEMAND AS THEY WOULD PROFIT FROM IT. THE PEOPLE WHO WILL SORT THROUGHOUT THE PACKAGES, THEY'RE SAYING THEY ARE NOT SEEING THE SHARE OF THOSE PROFITS HOWEVER, THEY'RE FEELING THE BRUNT OF ALL THE ADDED STRESS. SO WHEN WE WOULD TALK ABOUT TH STATUS IT OF THE NEGOTIATIONS, SAYING IN A STATEMENT BACK I APRIL, WE ARE COMMITTED TO REACHING AN AGREEMENT THAT WIL PROVIDE THE WINS FOR OUR EMPLOYEES, THE TEAMSTER, UPS THE CUSTOMERS, TAKING CARE O OUR PEOPLE AND DELIVERING FO OUR CUSTOMERS IS OUR TOP PRIORITY KIND OF SIMILAR WITH WHAT WE'R SEEING WITH THE RIDERS STRIKE. THEY WILL GET TOGETHER AND THE DECIDE WHETHER OR NOT THEY WIL AUTHORIZE THE STRIKE MOST OF THE TIME THEY DO AUTHORIZE THAT AND THAT VOTE WILL BE OFFICIAL COME THIS TIM NEXT WEEK NEXT FRIDAY. THEN WHAT HAPPENS? THE NEGOTIATIONS OF THE CONTRACT THAT WILL EXPIRE ON AUGUST 1 WHEN WE WOULD SEE THE IMPACT A THEY WOULD GO ON STRIKE. >> THAT'S THE TIMING OF IT RIGHT? NOT JUST REGULAR PEOPLE LIKE YOU WHO WOULD ORGANIZE THINGS, BUT THE SMALL BUSINESSES THAT'S A BIG BUSINESS THAT WOULD USE THE COMPANY TOO? >> EXACTLY, YEAH WHEN YOU THINK OF THEIR IMPACT HERE OVER THAT HAD, YOU WOUL THINK OF THE GLOBAL. IT IS NOT JUST DELIVERY TO THE HOMES FOR THE PIZZA OR NOT JUS GROCERIES. BUT ALL THE BUSINESSES THAT YO WOULD FREQUENT EVERY SINGL DAY. NOW REMEMBER THIS, IT'S TH WORLD'S BIGGEST COURIER. THIS WOULD BE THE LARGEST WORK STOPPAGE THAT WE WOULD SEE I THE COUNTRY. 340,000 UPS WORKERS WOULD BE IMPACTED OF THEIR DAY-TO-DAY LIFE THERE IS A LOT TO LOOK AT WHEN IT COMES TO THEIR IMPACT AS THEY STILL HAVE A COUPLE OF MONTHS TO GET EVERYTHING SORTED OUT. >> LIVE FOR US ON THAT THANK YOU VERY MUCH. >>> OVER TO THE FIVE THINGS WE THINK YOU NEED TO KNOW ABOUT TONIGHT. THE FORMER U.K PRIME MINISTER BORIS JOHNSON, RESIGNED AS A MEMBER OF PARLIAMENT AFTER THEIR INVESTIGATION WAS MISLEADING THE STATEMENTS HE MADE ABOUT THE SO-CALLED PARTY GATE SCANDAL REMEMBER THAT? A SERIES OF PARTIES THAT BROKE THE PANDEMIC LOCKDOWN RULE OVERSEAS AND TRYING TO FORCE THEM OUT >>> THOUSANDS OF PEOPLE HAVE BEEN FORCED TO EVACUATE TH HIGH-RISES IN NORTHERN CHINA BECAUSE OF THE BIG CRACKS THAT WOULD OPEN UP NEARBY AND IT LOOKED LIKE A MILE UNDE THE GROUND THAT OPENED UP. THE SUDDEN DISASTER EXPANDING THE PHARMACY PROGRAM AS THEY TRAINED PHARMACISTS ON THE TREATMENTS OF HALF A DOZEN INFECTED COMMUNITIES IT WILL BE AVAILABLE IN MORE THAN 80 LOCATIONS BY THE END O THE YEAR >>> PAYING OFF AT LEAST FO NETFLIX. THAT'S BECAUSE THEY GOT ABOU 100,000 NEW DAILY SUBSCRIPTION RIGHT AFTER TELLING PEOPLE NO, YOU CANNOT FREE LOAD LIKE YOUR EX, EX, EXNETWORK ACCOUN ACCORDING TO ONE FIRM. AND NOT BY AS MUCH THAT HAS GONE UP >>> THE BIGGEST DINOSAUR BON THAT'S BEEN DISPLAYED. LOOK AT THIS, THE BIG MACHINER FOR A PIECE OF THAT. AND IT'S 70 MILLION YEARS AG AND ABOUT TEN FEET LONG. WHEN WE COME BACK, MUCH MORE T GET TO INCLUDING THE TOP STORY FOR THE INDICTMENT ON TH CHARGES. BUT REMEMBER, HE IS ALSO RUNNING FOR THE WHITE HOUSE. SO IF HE WINS, COULD HE PARDON HIMSELF? WE ARE GETTING INT >>> BACK TO THE TOP STORY NOW, THE ALLEGED MISHANDLING. NOW REMEMBER THAT MATTERS NO JUST BECAUSE HE WILL BECOME TH FIRST PRESIDENT TO FACE TH PRESIDENT. THAT'S BECAUSE HE IS ALSO TH FRONT RUNNER AND IF THAT HAPPENS, ONE OF TH POWERS TO GET BACK IS TH ABILITY TO PARDON SOMEBODY AND SO DOES THAT INCLUDE THEMSELVES HERE IS THE BREAKDOWN. >> Reporter: AND IT IS A QUESTION THAT HAS NEVER BEEN ASKED BEFORE, PARDONIN THEMSELVES FOR THEIR OWN PRIME AND THEY THOUGHT SO BACK I 2018, TALKING ABOUT TH ALLEGATIONS THAT HE COLLUDED WITH RUSSIA. >> I DO HAVE AN ABSOLUTE RIGHT TO PARDON MYSELF, BUT I WILL NEVER HAVE TO DO IT BECAUSE HAVE NEVER DONE ANYTHING WRONG AND EVERYBODY KNOWS THAT >> Reporter: BUT THE POTENTIAL IS NOT SO CLEAR. >> WE JUST HAVE TO WAIT AN SEE. >> Reporter: AND THEY DO NOT SPECIFICALLY GET INTO WHETHER IT IS ALLOWED, SAYING THEY SHAL HAVE PARTIES TO GRANT THEM THAT'S IT. NOTHING ON THE SELF-PARDONS. BUT THEY WOULD TRY TO CLEA THINGS UP IN 1974 BEFORE THE GOT IMPEACHED. IN THE MEMO, THEY DETERMINED BASICALLY THEY CANNO SELF-PARDON BECAUSE THEY WIL NOT BE A JUDGE IN THEIR OW CASE >> JUST LIKE WE DON'T LET THEM BE THE PROSECUTOR OR THE JUDGE OR THE JURY IN THAT CASE, YO CAN'T BE THE PARDONER IN YOU OWN CASE >> Reporter: SINCE THEN, THA LEGAL OPINION HAS NEVER BEEN TESTED UNTIL NOW AS THEY WOULD WI THE WHITE HOUSE IN 2024, H COULD TRY TO PARDON HIMSELF ON THE NEW FEDERAL CHARGES WITHIN MINUTES. AND EXPERTS SAY IT WILL LIKELY GO TO THE SUPREME COURT TO DECIDE IF THEY WOULD HOLD AN REMEMBER IT IS A COURT WITH CONSERVATIVE MAJORITY BECAUSE OF THE NOMINATIONS OF MR. TRUMP HIMSELF. >> AND IT IS ONE AND IT IS VER RECEPTIVE IN THE PROSPECT OF THE POWER. >> Reporter: KEEP IN MIND, THEY'RE NOT THE ONLY LEGAL ISSUES THAT ARE FACED BY TRUMP HE'S BEEN CHARGED IN NEW YOR RELATED TO THE HUSH PAYMEN MONEY AND THOSE ARE THE STAT LEVEL CRIMES SO THE PARDONS ARE OFF THE TABLE THERE. >> AND THEY WILL MIMIC THE POWERS TO OFFENSE AVENUELY AGAINST THE UNITED STATES, COMMONLY UNDERSCORING TH FEDERAL OFFENSIVE. >> Reporter: DOWN IN GEORGIA, HE ALSO FACES THE INVESTIGATION THAT BUILT AROUND HIS 2020 ELECTION FRAUD HE DENIES ANY WRONG DOIN THERE. BUT THE POTENTIAL TO PARDO HIMSELF WOULD DEPEND ON TH SPECIFIC CHARGES THEY MIGH BRING AND WHETHER THEY WERE TO INVOLVE THE MULTIPLE STATES OR THE JURISDICTIONS. SAY GEORGIA ALONG WITH DC. AGAIN, IT'S THE STAT DIFFERENCE >> ONCE IT BECOMES FEDERAL AND THERE IS THAT POSSIBILITY OF THE PARDON SO THAT IS A RULE TO KEEP THINGS IF YOU'RE THE STATE PROSECUTOR >> Reporter: COULD HE PARDON HIMSELF AT LEAST ON SOME COUNT IF HE ENDS UP IN THE WHITE HOUSE? HE COULD TRY BUT WHETHER IT STICKS, IT WILL CERTAINLY DEPEND ON WHAT THE SAY. OF COURSE, IF HE DOESN'T WIN WHOEVER IS IN THE WHITE HOUSE, THEY COULD SIMPLY PARDON MR. TRUMP HIMSELF ON THE FEDERAL CHARGES, AT LEAST ONE CURREN COMPETITOR IS SUGGESTING THE ARE OPEN TO IT >> DID YOU LOOK AT POTENTIALLY PARDONING TRAMPLES HAD BASED O THE EVIDENCE THAT MIGHT EMERGE OF THOSE CHARGES >> AND THE DOJ AND FBI HAVE BEEN WEAPONIZED ANY EXAMPLE OF THE DISFAVORE TREATMENT BASED ON THE POLITIC OR THE WEAPONNATION WOULD BE INCLUDED IN THAT REVIEW NO MATTER HOW SMALL OR HOW BIG. >> IT IS DONALD TRUMP WITH A LOT OF HYPOTHETICAL AND IF THEY WERE TO ISSUE THAT. THEY WOULDN'T AUTOMATICALLY GO TO THE SUPREME COURT WITH SOME KIND OF A TRIGGER OR A CHALLENGE ESSENTIALLY IN ORDER FOR THAT TO HAPPEN AND THEY WOULD NEED T STAND OVER THAT AND HOW THAT WOULD UNFOLD THAT WILL REMAIN TO BE SEEN. THAT'S IF HE MAKES IT TO THE WHITE HOUSE TO GET ENOUG SUPPORT FROM VOTERS IN IOWA. SO WHAT DOES IT MEAN IT MIGHT NOT BE SO BAD FOR THEM CHECK OUT THE POLL NUMBERS U AROUND 7% IN AVERAGE ON TH WEEKS AFTER THAT INDICTMENT. DOES THAT TELL US ANYTHING ABOUT THIS ONE AND TALKING TO FOLKS OUT I PELLA, IOWA, JOINING US NOW. AND WILL THEY PUT THEM IN TH WHITE HOUSE OR NOT WHAT ARE THEY TELLING YOU? >> AND OBVIOUSLY WE'RE TRYING TO FIND PEOPLE WHO ARE TRYING T SHOW YOU THE CAUCUS AS IT WILL BE THE FIRST NOMINATING CONTES FOR THE REPUBLICANS WHEN ALL THAT RAMPS UP. IT'S NOT THE REMINDER FOR PEOPLE WHO WENT ON TO BECOME TH NOMINEE AND TO WIN THE PRESIDENCY IN 2016 HE CAME IN SECOND. OBVIOUSLY IT HAS THE POTENTIAL TO CREATE THE MOMENTUM SHIFT FOR THE VARIOUS CAMPAIGNS. WE HAVE BEEN ASKING VOTERS TODAY HOW THEY FEEL ABOUT THE NEWS AND WE SPOKE TO THE VOTERS WHETHER THEY LIKE THE FORMER PRESIDENT OR MOVED ON FROM HIM THIS DOESN'T REALLY MOVE THE NEEDLE THEY'VE ALREADY MADE UP THEI MINDS ABOUT HIM AND THERE AR SOME THINGS THEY SAID DOWN THE LINE COULD HAPPEN THAT MIGHT INFLUENCE THE DECISION IN TERM OF HOW THEY PLAY OUT SOME COULDN'T PINPOINT WHAT THAT MIGHT LOOK LIKE. BUT THE HEADLINE OF THE DAY IS NOT CHANGING THE MINDS OF PEOPLE WE SPOKE WITH. >> I DON'T KNOW IF I TRUST THE AGAIN. >> AND THEY WILL SAY NO TO THAT >> DONALD TRUMP WHO HE WAS BEFORE THE INDICTMENT AND COUL BE THE SAME AFTER. THAT DOESN'T HAVE ANY AFFECT O MY OPINION ABOUT HIM, POSITIVE OR NEGATIVE. I WON'T VOTE FOR HIM >> Reporter: AND THE GENTLEMAN WHO YOU JUST HEARD SAYING THAT HE THINKS THIS MIGHT HURT THEM IN THE NOMINATING CONTEST WITH THE VARIOUS ISSUES HE'S STILL IN THE FORMER PRESIDENT'S CAMP AS THEY STAND RIGHT NOW, THE ARE NOT PLANNING TO BE A PARTICIPANT IN THE UPCOMIN CAUCUS A WHOLE MIX OF PEOPLE AN VARIABLES AS ALWAYS AS WE DIDN'T THINK ABOUT THESE THINGS UNTIL WE SEE THE RESULTS IT'S A GUESSING GAME BUT I CAN TELL YOU THE PEOPLE WE SPOKE WITH, THIS WASN'T LIKE SOME MOMENT THAT CHANGED THE MINDS OF THE PEOPLE WE SPOKE WITH >> JESSE KIRSCH, THANK YOU FOR THAT >>> THE TWO MEN ACCUSED OF A AWFUL CRIME IN CALIFORNIA. WHY? BECAUSE OF THE TEXTING SCANDAL THAT'S INSIDE THE POLICE DEPARTMENT WE WILL EXPLAIN WHERE THAT INVESTIGATION WILL FALL NEXT >>> A BIG DEBATE IN FLORIDA OVER THE CONTROVERSIAL BAN. HOW THIS FIGHT COULD BE COMING TO WHERE YOU LIVE LATER IN THE ORIGINALS. >>> NEW FALLOUT TONIGHT FROM THE RACIST TEXTING SCANDAL THAT HA ABSOLUTELY ROCKED THE CALIFORNIA POLICE DEPARTMENT. ACCUSED OF THE DISTURBING CRIM NOW GETTING THEIR CHARGE DROPPED. THE PARENTS ARRESTED FOR THE BURNING AND THE MUTILATION O THE CORPSE BACK IN 2022. THE LOCAL D.A. NOW SAYING THAT THEY NO LONGER HAVE THE CONFIDENCE IN THE INTEGRITY OF THE CASE SO MUCH OF IT BASED ON THE WOR OF TWO POLICE OFFICERS WHO ARE ASSOCIATED WITH THE SERIES O RACIST IN THE TEXT CONVERSATIO UNCOVERED EARLIER THIS YEAR. SOME OF THE MESSAGES ARE JUS DISTURBING THE OFFICER REFERRED TO GEORGE FLOYD KILLED IN THE HANDS OF POLICE IN 2020 AS A GROWN UP THEY REFERENCE THE FOODS WIT THE RACIST STEREOTYPES ASSOCIATED WITH THE BLAC PEOPLE AND TH WATERMELON, ETC. AND THE LOCAL STATE AND FEDERA INVESTIGATION BECAUSE OF THE FBI. COVERING THE STORIES FOR US. THE HORRIFIC SERIES OF TEXTS, RACIST IN EVERY WAY AND PROBLEMATIC IN EVERY WAY. AND THE CONCERN THAT WE HAVE BEEN COVERING THIS STORY FROM JUMP HERE ON THE SHOW. AND ALL ALONG, COULD IT AFFECT ANY ACTUAL CASES AND IT APPEARS NOW THAT IT HAS IT HAS, HALLIE >> IT IS CONCERNING BECAUSE IT IS NOT JUST THIS CASE, BUT FOR THEIR FAMILY THESE ARE VERY SERIOUS CHARGES YOU'VE GOT TWO FELONY SUSPECTS THAT ARE NOW NOT GOING TO FACE THE CHARGES AT LEAST FOR NOW AND THE PROSECUTION, THEY SAID ON WEDNESDAY THAT THIS CAS COULD NOT PROCEED IN GOOD FAIT BECAUSE A LOT OF THE INVESTIGATION HEAVILY RELIED O THE OFFICERS THAT WERE CAUGHT UP IN THE SCANDAL THE D.A. ACTUALLY PUT OUT A STATEMENT THAT SAID THE OFFICE HAS THE ABILITY TO REFILE THES CHARGES AGAINST MONTAVO IF NEW EVIDENCE IS PRESENTED. NOW THE FAMILY IS RIGHTFULLY S VERY FRUSTRATED OVER THI BECAUSE THEY SAY THE EVIDENC THAT THEY SAW DURING THESE PRELIMINARY HEARINGS WERE ENOUGH TO SHOW THAT THESE TWO MEN WER INVOLVED AND THAT DEATH. SO THEY OBVIOUSLY WANT THE OFFICERS TO BE HELD ACCOUNTABLE, BUT NOT AT THE EXPENSE OF THEI DAUGHTER NOT RECEIVING JUSTICE AND HER MOM ACTUALLY TALKE ABOUT THE DAY THAT THE DISCOVERED HER BODY. THOSE TWO BILLS YOU'RE TALKING ABOUT IN IOWA, ONE IS TH CONSTITUTIONAL AMENDMENT, AND IT WOULD ACTUALLY CHANGE TH CONSTITUTION HERE IN IOWA TO MAKE THE MARRIAGES BETWEEN ONE BIOLOGICAL MALE. THAT'S THE ACTUAL WORDING THAT IT WILL HAVE IN THAT MEASURE THE OTHER ONE, IT WILL GO ON T MAKE THE PEOPLE WHO US RELIGIOUS GROUNDS. INDIVIDUALS WHO COULD DENY RECOGNIZING THE MARRIAGE DO TO JUST RELIGIOUS GROUND. THAT'S SIMILAR TO MANY OTHER MEASURES THAT ARE ON THE BOOKS IN SEVERAL OF THE STATES THAT WE HAVE TALKED ABOUT, THERE IS LAW PASSED RECENTLY IN MARCH WHERE THEY WERE ACTUALLY PASSE TO LIMIT THINGS IN SCHOOLS THE DISCUSSIONS OF THE COMMUNITY AND ALSO FOR TRANSGENDER STUDENTS IN THE ACCOMMODATIONS FOR THEM AND LIKE WE MENTIONED, EVE SINCE JUSTICE CLARENCE THOMAS IN THAT OCCURRING OPINION SAYS HE WOULD USE THE TERM TO RAIS QUESTIONS SAYING IT SHOULD B RECONSIDERED THAT FEAR HAS BECOME MUCH MORE REAL >> AND THERE ARE APPROXIMATELY 500 BILLS TARGETING THE LGBTQ+ COMMUNITY AROUND THE COUNTRY ACCORDING TO THE HUMAN RIGHT CAMPAIGN I THINK THAT WILL LEAD INTO WHAT YOU'RE SORT OF TALKING ABOUT PEOPLE TELL ME THIS IS JUST THREAT HERE? >> RIGHT FOR YOUNG PEOPLE IT FEELS MUCH MORE THEORETICAL AS WE HAVE BEEN TALKING TO PEOPLE WHO HAVE BEEN FIGHTIN THIS FOR A LONG TIME AND THEIR CASE BACK IN 200 ACTUALLY LEGALIZED SAME-SE MARRIAGE IN IOWA BUT THEN OF COURSE WHEN THEY CROSSED OVER THE STATE LINES THEY WERE NO LONGER MARRIED. WHAT IT COULD MEAN FOR YOU AND SMALL BUSINESSES. >>> I WANT TO SHOW YOU RIGHT OUT THE GATE DOCUMENTS AT THE HEART OF THOSE 37 FEDERAL CHARGES FORMER PRESIDENT TRUMP NOW FACES AS PART OF THAT INDICTMENT THAT HAS BEEN UNSEALED AGAINST HIM. THESE BOXES ARE STACKED UP, AT ONE POINT IN THE BATHROOM RIGHT NEXT TO A SHOWER. BOXES FILLED WITH HUNDREDS OF DOCUMENTS, DOZENS AND DOZENS OF THEM CLASSIFIED WITH SERIOUSLY SENSITIVE NATIONAL SECURITY INFORMATION, SOME OF IT LITERALLY SPILLING OUT ONTO THE FLOOR. THE DOJ SAYS THESE DOCUMENTS AREN'T SUPPOSED TO BE THERE AND MR. TRUMP'S PERSONAL HOME IN FLORIDA. THE DONALD TRUMP NO HE SHOULD NOT HAVE HAD THEM? THAT IS AT THE CENTER OF THIS. NOW TONIGHT SOME EXPLOSIVE NEW EVIDENCE FROM THIS INDICTMENT SUGGESTS DONALD TRUMP KNEW EXACTLY WHAT HE WAS DOING. ACCORDING TO DOCUMENTS, MR. TRUMP TOLD MULTIPLE INDIVIDUALS IN NEW JERSEY ABOUT A PENTAGON PLAN THAT WAS HIGHLY CONFIDENTIAL AND SECRET. HE SAID AS PRESIDENT I COULD HAVE DECLASSIFIED IT, BUT NOW I CAN'T, YOU KNOW, BUT THIS IS STILL A SECRET. SPEAKS TO HIS MINDSET, DID HE KNOWINGLY TAKE THIS A STEP UNDERSTANDING THAT IT WAS NOT CLASSIFIED. AFTER A SUBPOENA WHEN MR. TRUMP ASKED OUT LOUD, WOULDN'T IT BE BETTER IF WE JUST TOLD HIM WE DON'T HAVE ANYTHING HERE, THEN BEING FEDERAL INVESTIGATORS, AND AN ATTORNEY REMEMBERS HIM SAYING TO ONE AIDE DOES ANYTHING BAD IN THIS FOLDER, REFERENCING DOCUMENTS, MAKING A MOTION WITH HIS HANDS, BUT YOU INFER THE MEANING. THIS IS WHAT IS LAID OUT IN THE INDICTMENT BY THIS GUY, JACK SMITH. WE ARE HEARING FROM HIM SINCE THE FIRST TIME HE GOT THAT JOB AS SPECIAL COUNSEL BACK IN NOVEMBER. >> WE HAVE ONE SET OF LAWS IN THIS COUNTRY AND THEY APPLY TO EVERYONE. >> MR. TRUMP DENIES HE DID ANYTHING WRONG AND IS NOW PERSONALLY ATTACKING SMITH, CALLING HIM A DERANGED PSYCHO. REMEMBER THERE IS A POLITICAL CONTEXT. DONALD TRUMP IS STILL RUNNING FOR ANOTHER FOUR YEARS IN THE WHITE HOUSE. HE'S RAISING MONEY. YOU SELLING SHIRTS THAT SAY "I STAND WITH TRUMP." HE'S PUTTING OFF OF MURCH OFF OF THIS INDICTMENT AND SOME REPUBLICANS ARE STANDING WITH THEM, INCLUDING SOME 2024 OPPONENTS. YOU CAN SEE THE RANGE OF RESPONSES TO SOME OF THEM ARE CRITICIZING THE JUSTICE DEPARTMENT. ONE SUGGESTS HE WOULD PARDON TRUMP IF ELECTED, BUT SOME ARE GOING A STEP FURTHER SOME CAN BE INTERPRETED AS CALLS TO VIOLENCE, WHICH SOME SAYING THEY HAVE NOW REACHED A WAR PHASE, AN EYE FOR AN EYE. LET'S BREAK IT DOWN. I WANT TO START IN MIAMI. I THINK THE IMPORTANT THING HERE, BIG PICTURE, ARE THE NEW REVELATIONS COME OF THE THINGS WE DID NOT KNOW BEFORE THAT WE NOW KNOW FROM THIS INDICTMENT AS IT RELATES TO THE CHARGES THAT DONALD TRUMP NOW FACES HERE , MEETINGS THAT HE HAD INCLUDING MUNLEY DID NOT KNOW ABOUT BEFORE WHERE HE SHOWED SENSITIVE INFORMATION TO SOMEBODY ELSE, HIM ON TAPE, AS WE JUST LAID OUT, ACKNOWLEDGING THAT SOME OF THE STUFF HE HAD HE KNEW WAS SECRET AND HAD NOT BEEN DECLASSIFIED. >> Reporter: IMAGINE THAT HE IS ALLEGED TO HAVE SHOWN A CLASSIFIED MAP TO AN UNCLEARED EMPLOYEE OF ONE OF HIS POLITICAL ATTACHES. IT'S INCREDIBLE AND SO TAWDRY. THERE WAS A TIME WE HELD PRESIDENTS TO A HIGHER STANDARD. ON THE CONTRARY, THE BEHAVIOR DESCRIBED IN THIS INDICTMENT, AND DONALD TRUMP IS INNOCENT UNTIL PROVEN GUILTY, THE BEHAVIOR DESCRIBED HERE IS UNLIKE ANYTHING I'VE EVER SEEN IN YEARS OF COVERING CASES OF MISHANDLING CLASSIFIED DOCUMENTS. IT'S NOT JUST ABOUT THE MISHANDLING OF THE CLASSIFIED INFORMATION AND THE TAKING OF IT AND SHOWING IT TO OTHER PEOPLE. THEY ALSO ALLEGE THIS AMAZING OBSTRUCTION OF JUSTICE CONSPIRACY BETWEEN TRUMP AND HIS BUTLER TO DECEIVE THE JUSTICE DEPARTMENT, AND THE INCREDIBLE THING ABOUT IT ALL IS THAT THE MOTIVE SEEMS TO BE THAT HE WAS STUBBORN. HE JUST BELIEVES HE WANTED THESE DOCUMENTS AND THAT THE JUSTICE DEPARTMENT WASN'T ENTITLED TO THEM. HE WANTED TO KEEP THEM. ONE OF THE THINGS WE DID NOT KNOW FOR EXAMPLE IS THAT ALL ALONG, MANY MR. TRUMP'S DEFENDERS HEADSET IS NOT LIKE THE PRESIDENT PACKED HIS OWN BOXES. HOW CAN HE BE BLAMED IF CLASSIFIED DOCUMENTS REGARDING BOXES AND MOVED OUT OF THE WAY. THIS INDICTMENT ALLEGES THAT DONALD TRUMP DID PACK SOME OF HIS OWN BOXES, AND HE KNEW THAT THERE WERE MANY CLASSIFIED DOCUMENTS THAT HE TOOK ACTIVE STEPS TO MAKE SURE THOSE DOCUMENTS WERE MOVED OUT OF THE WAY OF JUSTICE DEPARTMENT PROSECUTORS BEFORE THEY CAME DOWN TO TRY TO RETRIEVE THEM, AND THEN AFTER THE GOVERNMENT SERVED HIM WITH A GRAND JURY SUBPOENA, HE PLOTTED WITH HIS LAWYERS TO TRY TO LIE AND HIDE THOSE DOCUMENTS. IT IS JUST INCREDIBLE AS A SET OF ALLEGATIONS TO THE PERSON WHO HELD THE HIGHEST OFFICE IN THE UNITED STATES. >> I WAS TALKING WITH REPUBLICANS TONIGHT, INCLUDING SOME WHO SUGGEST THIS IS VERY SERIOUS WHEN YOU LOOK AT THE NATIONAL SECURITY IMPACT. WHAT WE ARE LEARNING NOW OFFICIALLY FROM THIS INDICTMENT, THESE AGENCIES, THE CIA, THE PENTAGON, ET CETERA, CUT UP IN THIS, AND HIS DOCUMENT RELATED TO THINGS LIKE NUCLEAR MATERIALS FOR THE UNITED STATES, OUR MILITARY VULNERABILITIES, THE MILITARY VULNERABILITIES OF OUR ALLIES. THIS IS SOME OF THE STUFF THAT WAS OUT AT MAR-A-LAGO AND SOME OF THOSE BOXES THAT WE JUST SHOWED APPEAR >> Reporter: WEAPONS SYSTEMS, INFORMATION ABOUT CIA SOURCES, BUT HUMAN SOURCES MY INTELLIGENCE COLLECTION METHODS. BECAUSE OF COURSE, THE PRESIDENT IS THE ULTIMATE CUSTOMER OF ALL OF THESE INTELLIGENCE AGENCIES, SO OF COURSE HE HAS ACCESS TO THE BIGGEST SECRET IN THE GOVERNMENT. THE IDEA HE DECIDED TO TAKE SOME OF THAT HOME WITH HIM AFTER HE LEFT THE WHITE HOUSE AND THEN HIDE IT, IT IS A REAL THREAT TO NATIONAL SECURITY. THAT IS WHAT JACK SMITH SAID. HE TRIED TO EMPHASIZE THAT MEMBERS OF THIS INTELLIGENCE COMMUNITY, THEY RISK THEIR LIVES TO PROTECT THESE SECRETS, AND HERE YOU HAVE THE FORMER PRESIDENT JUST STORING THEM WILLY-NILLY IN HIS PRIVATE CLUB HERE GETS REMARKABLE. THAT IS ONE OF THE THINGS WE LEARNED FROM THIS INVESTIGATION, JUST THE LEVEL OF SERIOUSNESS WE ARE TALKING ABOUT WITH THESE CLASSIFIED DOCUMENTS. >> 37 COUNTS AGAINST THE DONALD TRUMP, ONE COUNT AGAINST HIS FORMER VALID, WHO WAS PACKING UP SOME OF THE BOXES AS WELL. THANK YOU VERY MUCH. I WANT TO BRING IN NOW GARRETT HAKE WHO IS LIVE IN BEDMINSTER. A COUPLE THINGS. LET'S START WITH WHAT CAN TOUCHED ON WAGES THE LEVEL OF PERSONAL INVOLVEMENT THAT THE INDICTMENT LEAVES OUT OF DONALD TRUMP HIMSELF, TO THE POINT WHERE HE CHANGED HIS TRAVEL, INSTEAD OF GOING TO BEDMINSTER WHERE YOU ARE LIKE HE DOES EVERY SUMMER, HE STAYED AT MAR A-LAGO LONGER TO BE ABLE TO GREET THESE INVESTIGATORS AS THEY SHOWED UP AND MAR-A-LAGO TO BE ABLE TO TELL THEM, THIS INDICTMENT SAID, THAT HE WAS AN OPEN BOOK, THAT THERE WAS A LOT OF MATERIAL IN THESE DOCUMENTS THAT SHOW THAT DONALD TRUMP WAS ON THE SIDE MOVING AROUND HERE >> Reporter: NONE OF THAT SHOULD BE SURPRISING TO PEOPLE WHO FOLLOWED DONALD TRUMP'S CAREER IN PUBLIC LIFE. IT'S VERY CONSISTENT WITH SOMEONE WHO BELIEVED THAT HE CAN BASICALLY TALK HIS AY THROUGH OR AROUND ANYTHING IF SOMEBODY CONSIDERS HIMSELF A MASTER NEGOTIATOR AND SOMEONE WHO HAS BEEN ABLE TO AVOID THE LEGAL CONSEQUENCES OF BEHAVIOR THAT WOULD TAKE DOWN OTHER PEOPLE ALONG THE WAY. YOU SOUGHT HERE WITH THE CONVERSATIONS HE WAS HAVING WITH HIS FAMILY AS YOU DESCRIBED, AND THE DECISIONS SAY RIGHT AROUND THIS TIME ABOUT TWO YEARS AGO BEHIND AT MAR-A-LAGO TO PERSONALLY OVERSEE THE START OF THIS JUSTICE DEPARTMENT SEARCH. ADD A BIT OF CHARM ON THE TOP AND THE DOCUMENTS THAT HE DID RETAIN ARE LOADED UP ON AN AIRPLANE AND BROUGHT HERE TO NEW JERSEY WHERE THE INCIDENTS CAN WAS DESCRIBING, IT FINALLY OCCURRED. IT'S PART OF A FACT PATTERN WE'VE SEEN TIME AND TIME AGAIN WITH PRESIDENT TRUMP AND THE PUBLIC EXECUTIVE TRUMP'S BEFORE THAT. >> WHEN YOU LOOK AT THE REACTION FROM THE POLITICAL SPHERE, WE ARE HEARING FROM FOR EXAMPLE SENATOR LISA MURKOWSKI WHO SAYS THESE ARE QUITE SERIOUS AND CANNOT BE CASUALLY DISMISSED. IT'S NOT SURPRISING THAT THERE MIGHT BE A DIFFERENT TONE FROM SOME REPUBLICANS IN THE SENATE VERSUS SOME IN THE HOUSE WHERE YOU HAVE SPEAKER McCARTHY NOW SUGGESTING HE BACKS JIM JORDAN, AND ALLY PRESIDENT TRUMP, TO INVESTIGATE MERRICK GARLAND AS THIS INDICTMENT HAS COME OUT. TALK TO US ABOUT THE COMPONENTS OF THAT, WHAT YOU ARE HEARING FROM REPUBLICANS ON THIS? >> THAT'S EXACTLY RIGHT. WE TALKED A LOT ABOUT MAY BE THE 35% OF VOTERS IN THE REPUBLICAN PARTY WHO ARE HARD- CORE PRO-TRUMP. ABOUT 20% OF SENATORS AND VOTERS IN THE PARTY WHO ARE KIND OF HARD-CORE POST-TRUMP. I THINK SOMEBODY LIKE A LISA MURKOWSKI OR MITT ROMNEY, PEOPLE WHO VOTED FOR MR. TRUMP'S CONVENTION IN HIS SECOND IMPEACHMENT TRIAL FALL INTO THAT CATEGORY. WHEN YOU HAVE PEOPLE IN THE MIDDLE, WHICH A MAJORITY OF OTHER REPUBLICAN SENATORS WHO WOULD PROBABLY LIKE TO MOVE ON FROM THE FORMER PRESIDENT. MANY OF THEM HAVE BEEN SILENT IN THE WAKE OF THIS INDICTMENT. THEY ARE NOT IN WASHINGTON, D.C. THEY ARE NOT GETTING QUESTIONS IN THEIR FACE EVERY DAY. MITCH McCONNELL IS SOMEBODY WHO'S PROBABLY GOING TO WAIT UNTIL HE'S ASKED A SPECIFIC QUESTION ABOUT DONALD TRUMP BEFORE HE RESPONDS. THAT'S NOT THE DYNAMIC IN THE HOUSE THERE IS REALLY A MINORITY OF HOUSE REPUBLICANS WHO EITHER ENDORSE OR KIND OF OPENLY WANT ANOTHER CANDIDATE. IN THE MAJORITY ARE EITHER OUTWARDLY FOR TRUMPER IN THE CATEGORY OF SOME OF THE KEVIN McCARTHY WHO IT HAS BEEN PUBLICLY ENDORSED BUT IS DURING HIS SUPPORT BEHIND DONALD TRUMP AND USING THE HOUSE AS A VEHICLE TO RUN INTERFERENCE FOR THE FORMER PRESIDENT AND NOW BOTH OF THESE SETS OF CRIMINAL INDICTMENTS, THE NEW YORK CASE AND NOW THE DOCUMENTS CASE. KIND OF A TALE OF TWO REPUBLICAN PARTIES BACK IN WASHINGTON. I IMAGINE, THOUGH I HAVE NOT HAD THE CHANCE, THAT THE OPINIONS OF REPUBLICAN VOTERS WILL BE FAR MORE NUANCED EVEN THAN THAT. >> I THINK THAT'S RIGHT. GARRETT, I'M SORRY. I PROMOTED YOU. GARRETT. IT IS A SPECTRUM. I THINK THAT'S PART OF IT. IT'S A REAL SPECTRUM HERE THERE ARE A LOT OF THINGS THAT FALL ON THAT SPECTRUM. ONE OF THE THINGS THAT WE'VE SEEN ON THE FAR END OF THE SPECTRUM HAVE BEEN A COUPLE OF CONSERVATIVE HARDLINERS USING PHRASES LIKE REFERENCING MILITARY MAPS, LIKE WE SAW LAST NIGHT, SAYING THINGS LIKE WE ARE ENTERING A WAR PHASE, AN EYE FOR AN EYE, GETTING SOME PUSHBACK FROM OTHERS THAT THIS IS A POTENTIAL INCITEMENT TO VIOLENCE. >> Reporter: THAT'S RIGHT. WE PROBABLY SHOULD NOT BE THAT SURPRISED THAT WE'VE GOTTEN TO THAT POINT. WHEN YOU KIND OF TAKE THE WAR AND REVOLUTION METAPHORS THAT HAVE BEEN SO PREVALENT ON THE FAR RIGHT SINCE THE STOP THE STEEL MOVEMENT BACK IN LATE 2020 , THIS IS THE LOGICAL CONCLUSION OF THAT. IF YOU BELIEVE YOUR COUNTRY HAS BEEN STOLEN, IF YOU BELIEVE THAT THERE IS A REGIME THAT IS USING THE APPARATUS OF JUSTICE, THE POLICE AND LAW ENFORCEMENT AND COURTS, TO SUPPRESS A POLITICAL PARTY, THAT IS WHERE YOU END UP HERE THEY HEATED RHETORICAL OVER-THE-TOP TWEETS OR ACTUAL VIOLENCE, IT IS SOMETHING WE WILL WATCH VERY CLOSELY. IT DOESN'T TAKE A LOT TO PUSH PEOPLE FROM ONE TO THE OTHER IS WE'VE SEEN TIME AND TIME AGAIN WITH INSTANCES OF POLITICAL VIOLENCE. IT IS SOMETHING WE WILL BE WATCHING IN THE DAYS AND WEEKS TO COME. >> TANK YOU VERY MUCH. WE WILL SEE DONALD TRUMP TUESDAY AFTERNOON. HE WILL BE THERE IN MIAMI WE ARE TOLD BY HIS NOW FORMER ATTORNEYS. HE WILL SHOW UP FOR THIS ARRAIGNMENT TUESDAY AFTERNOON AT 3:00 P.M. EAST COAST TIME. WHAT IS NEXT FOR HIM? >> Reporter: EXACTLY THAT. THE ARRAIGNMENT WHICH IS A SHORT AFFAIR AND NOT A LOT IN SUBSTANCE. IMPORTANT PROCEEDINGS, BUT NOT TO THE OUTWARD I ANYTHING VERY SIGNIFICANT HAPPENING. YES YOU GET THE CHARGES, YOU GET YOUR RIGHTS READ TO YOU. YOU MAY WAIVE THE READING OF AN INDICTMENT, BUT THIS IS THE FORMAL KICKOFF OF THE CASE. WHAT IS PERHAPS MORE SIGNIFICANT THAN THE ARRAIGNMENT IS THE CLOCK. IT'S DARTS THE SPEEDY TRIAL CLOCK IN WHICH THE GOVERNMENT MUST BRING THE CASE TO TRIAL WITHIN 70 DAYS. THAT IS SUPPOSED TO BENEFIT THE DEFENDANT, BUT IN A CASE LIKE THIS, A SPEEDY TRIAL WOULD REALLY ONLY BENEFIT THE GOVERNMENT. THAT'S WHY WASN'T SURPRISED TO HEAR JACK SMITH SAY WE WILL ENFORCE THE SPEEDY TRIAL RIGHTS IN THE INTEREST OF THE DEFENDANT. STRATEGICALLY IT'S REALLY PROBABLY BEST FOR THE GOVERNMENT THE SOONER THIS CASE COMES ABOUT, BECAUSE AFTER THIS MANY MONTHS, THEIR CASE IN THEIR MIND IS AIRTIGHT. IT IS NOW THE DEFENDANT WHO WILL PROBABLY HAVE TO WAIVE SPEEDY TRIAL, AND THIS CASE WILL CERTAINLY NOT GO TO TRIAL AND 70 DAYS. THERE WILL BE MOTIONS. THERE MAY BE APPEALS. THIS CASE WILL MOVE SLOWER THAN THAT. >> POTENTIALLY PUTTING IT IN THE THICK OF THE ELECTION IF YOU LOOK AT HOW THAT CLOCK RUNS. ALONG DONALD TRUMP HAS SUGGESTED THAT HIS DEFENSE IF HE CAN DECLASSIFY ANYTHING HE WANTS. WHAT WOULD YOU IMAGINE WOULD BE A DEFENSIVE STRATEGY NOW THAT THE INDICTMENT IS HERE IN THE CHARGES ARE OUT? >> I THINK TRUMP'S DEFENSE TEAM IS NOT TAKING ITS CUES FROM TRUMP'S RANDOM OUT-OF-THE-BOX COMMENTS THAT HE'S MAKING IN PUBLIC, WHETHER IT BE IN TOWN HALLS ARE AT RALLIES. THE DEFENSE TEAM HAS A MUCH MORE SUBDUED PLAN. IT'S A RARE CASE WHERE WE'VE GOTTEN A GLIMPSE INTO THEIR IDEAS, THROUGH THE LETTER TO CONGRESS OR THEIR APPEARANCES ON TV. WHAT I WOULD EXPECT IS SOMETHING MORE ALONG THE LINES OF SAYING LOOK, WE TRIED TO WORK WITH THE AGENCY, WE TRIED TO WORK WITH THE NATIONAL ARCHIVES. THE NATIONAL ARCHIVES ESCALATED THIS TO DOJ. DOJ ESCALATED THIS WHEN WE TRIED TO WORK WITH THEM. THIS IS NOT THE WAY THESE AGENCIES SHOULD HAVE HANDLED THIS. TAKE A LOOK OVER HERE, AND THIS IS WHERE THE DEFENSE IS GOING TO COME INTO PLAY, THEY WILL POINTED OTHER PAST PRESIDENTS WHO LEFT OFFICE AND ALL KINDS OF RESOURCES FROM THE NATIONAL ARCHIVES THAT TRUMP THEY WILL SAY DIDN'T GET, AND WILL IT WORK? HARD TO SAY. >> THAT IS WHAT WE ARE GOING TO BE LOOKING AT NOW JUST OVER THE NEXT 72 HOURS, BUT AS YOU POINT OUT, FAR BEYOND THAT AS WELL. IT'S AN EXTRAORDINARY MOMENT IN AMERICAN HISTORY WITH NEVER BEFORE SEEN A FORMER PRESIDENT INDICTED ON FEDERAL CHARGES. THANK YOU. >>> WE WILL HAVE MORE ON THE DONALD TRUMP INDICTMENT COMING UP LATER IN THE SHOW, BUT FOR NOW I WANT TO TALK ABOUT SOMETHING ELSE MAKING BIG NEWS TODAY, AND THAT IS THE REAPPEARANCE OF JORAN VAN DER SLOOT THE MAN LINUX ASSISTED HAVING SOMETHING TO DO WITH NATALEE HOLLOWAY'S DISAPPEARANCE. TODAY HE'S IN AN AMERICAN COURTROOM FOR THE VERY FIRST TIME PLEADING NOT GUILTY TO THE CHARGES HE FACES. VAN DER SLOOT IS NOT BEING HELD FOR ANY CHARGES RELATED TO THE MURDER OF NATALEE HOLLOWAY OR HER DEATH, BUT INSTEAD FOR EXTORTION AND WIRE FRAUD FOR ALLEGEDLY CONNING HER MOTHER INTO SENDING $25,000 FOR INFORMATION FROM HIM ABOUT THE LOCATION OF HOLLOWAY'S BODY. THE COURT APPEARANCE CAME AFTER HE WAS EXTRADITED FROM PERU ABOUT 24 HOURS AGO. MEMBER THIS VIDEO? IT GIVES YOU A SENSE OF HOW MUCH THE SPOTLIGHT IS ON HIM AND THIS CASE. KEEP IN SERVING A 28 YEAR SENTENCE FOR THE MURDER OF A DIFFERENT WOMAN IN PERU. VAN DER SLOOT IS ON TRIAL FOR ANYTHING HAVING TO DO WITH HOLLOWAY'S DEATH MAY BE A FULL CIRCLE MOMENT FOR HER FAMILY AND SUPPORTERS. HE WAS ARRESTED TWICE FOR HER MURDER BUT WAS RELEASED TWICE FOR LACK OF EVIDENCE. THE FAMILY BELIEVES HE IS THE ONE RESPONSIBLE. SAM BROCK IS JOINING US NOW FROM BIRMINGHAM. >> Reporter: AS FAR AS WHAT IT WAS LIKE INSIDE THE COURTROOM TODAY, THERE WAS SOME SURPRISING DEVELOPMENTS, STARTING WITH THE FACT THAT THE ENTIRE HEARING ONLY LASTED ABOUT 3 TO 4 MINUTES. THE JUDGE CAME IN, READ OFF THE CHARGES FOR VAN DER SLOOT WHICH INCLUDED EXTORTION AND WIRE FRAUD , ASSIGNED HIM TO A FEDERAL DEFENDER IN HIS CASE, AND THEY PLED NOT GUILTY ON VAN DER SLOOT'S BEHALF. THEN THERE WAS A WEIRD DYNAMIC BETWEEN THE FAMILY MEMBERS OF NATALEE HOLLOWAY . WE ARE TALKING THAT HER MOM, FATHER, BROTHER, AND HIS WIFE, ALL SEATED THREE ROWS BACK FROM WHERE THIS WAS HAPPENING, AND YOU HAVE TO WONDER WHAT'S GOING ON IN THEIR MINDS. THEY ARE AN ARMS LENGTH AWAY FROM THE GUY WHO HAS BEEN CONNECTED TO THE DISAPPEARANCE AND DEATH OF THEIR LOVED ONE WHO LITERALLY FOR LITERALLY DECADES NOW. WHEN HE WALKED IN HE WAS WEARING A T-SHIRT AND JEANS AND HANDCUFFS. HE IMMEDIATELY SAT DOWN AND WAS ASKED ABOUT A CONNECTION TO A DUTCH TRANSLATOR AND THERE WAS A SILENCE AND THEY PIERCED THE SILENCE BY SAYING I CAN SPEAK PERFECT ENGLISH IT'S FINE. JUST THAT ATTITUDE AND HIS VOICE, HAVING NOT SEEN HIM OVER THE COURSE OF ALL OF THESE YEARS, IT WAS A LOT TO DIGEST. THE FAMILY SPOKESPERSON TALKED ABOUT WHAT IT MEANT TO FINALLY HAVE THIS OPPORTUNITY. >> WE ARE HAPPY FOR THE OPPORTUNITY AND TO HAVE HIM HERE ON U.S. SOIL. WE NEVER GAVE UP HOPE THAT THIS WOULD BE POSSIBLE, SO WE ARE HOPEFUL THAT THIS WILL BRING FORWARD MORE LITIGATION AND GET JUSTICE AS DESIRED. >> Reporter: AS WE TALK ABOUT THESE TWO CHARGES FOR WIRE FRAUD AND EXTORTION, EACH ONE CARRIES A 20 YEAR PRISON SENTENCE IF VAN DER SLOOT IS CONVICTED. THE REACTION OF DAVE HOLLOWAY IS INTERESTING. MIXED FEELINGS, THE WHEELS OF JUSTICE ARE BEGINNING TO GRIND. HE SAID, QUOTE, I'M CONFIDENT TODAY WAS A STEP TOWARDS ACCOUNTABILITY AND HOPEFULLY JUSTICE. I'M TRUSTING THAT THIS PROSECUTION WILL LEAD US TO THE TRUTH ABOUT NATALEE. I SPOKE WITH MATT HER BROTHER AND HE SAID YES, THIS FEELS LIKE A SEMBLANCE OF JUSTICE, BUT THEN HIS WIFE SPOKE TO ME AND SAID WE ALL WANT A CONVICTION THEM ABOUT WHAT WE WANT IS ANSWERS. WE WANT TO KNOW WHERE NATALIE'S REMAINS ARE. THAT'S THE LATEST HERE. BACK TO YOU. >> THANK YOU FOR THAT REPORTING. >> Reporter: SOME STOCKS ARE HAVING A REBOUND, ENDING THE WEEK ON A HIGH NOTE FOR INVESTORS. THEY CALL IT A SKINNY BULL MARKET, NOT A FULL BULL MARKET, BUT A SKINNY ONE. EVEN THOUGH WE KNOW THE MARKETS AREN'T THE ECONOMY, BUT INVESTORS HAVE OPTIMISM ABOUT WHERE THINGS ARE GOING. ALL THESE NUMBERS ARE IN THE GREEN, AND IT IS THE S&P 500 THAT'S HAVING A MOMENT GOING INTO A FOUR-WEEK WINNING STREA , THE LONGEST IT HAS HAD IN ABOUT A YEAR, CLOSING UP 20% YESTERDAY ABOVE ITS LOWEST LEVEL OF 2022. IT IS NOT CAUSED A BUST OUT THE CHAMPAGNE JUST YET, BUT IT IS A SIGN FOR OPTIMISM. THE NUMBER OF STOCKS UP ARE NOT THAT MANY. >> Reporter: YOU COULD CALL IT A SKINNY BULL HALF CALF WITH A SHOT OF SOY. ABOUT SEVEN OR EIGHT STOCKS DRIVING THE GAINS OF THE S&P 500, BUT YOU CAN'T DENY THE FACT THAT WE ARE UP 20% FROM THE LOWS BACK IN OCTOBER. THIS IS A BIG DEAL BECAUSE AMERICANS, THE AVERAGE 401(K) WAS AROUND $130,000 BEFORE LAST YEAR, WENT ALL THE WAY DOWN TO LESS THAN $100,000. WE HAD A NICE REBOUND. PEOPLE ARE FEELING IT IN THEIR 401(K)s, AND THAT PRODUCES A WEALTH EFFECT, GIVING THEM MORE CONFIDENCE TO SPEND OR MAKE A BIG PURCHASE AND MAYBE NOT GET SO CONCERNED ABOUT A POTENTIAL RECESSION. >> WHAT DOES IT MEAN FOR UR MONEY? WE OFTEN TALK ABOUT MARKETS ARE NOT THE ECONOMY AND ECONOMIES ARE NOT THE MARKET. WHAT DOES IT MEAN FOR PEOPLE WHO HAVE A 401(K) OR WHO CARE ABOUT HOW FAR THEIR DOLLAR CAN STRETCH AT THE SUPERMARKET? >> Reporter: BULL MARKETS ON AVERAGE LAST AROUND 5.5 YEARS. THIS COULD GO ON FOR A WHILE. IT DOES NOT MEAN WE ARE OFF TO THE RACES, BUT IT DOES MEAN THAT STOCKS ARE WRITING HIGHER AND MORE MONEY IS GOING INTO STOCKS. THE MOMENTUM COULD CARRY. IT DOESN'T MEAN IT'S A 20 TO 30% OF YEAR, BUT WE HAVE A NICE RECOVERY WITH SOME MOMENTUM BEHIND IT. >> THANK YOU VERY MUCH. >>> THOSE SMOKY SKIES ARE STARTING TO CLEAR UP. THEY AREN'T TOTALLY GONE YET, BUT THINGS ARE GETTING SOMEWHAT BETTER FOR NEARLY 80 MILLION PEOPLE WHO ARE STILL UNDER SOME AIR-QUALITY ALERTS. LET ME SHOW YOU BALTIMORE AND PHILLY. NOT 100%, WITH THE SMOKE SHIFTING FURTHER WEST INTO THE MID-ATLANTIC AND GREAT LAKES. IT IS STILL HAVING AN IMPACT ON LIFE IN THE CITY. PHILLY, NEW YORK CITY PUBLIC SCHOOLS, THEY ARE BOTH REMOTE TODAY. FLIGHT DELAYS FROM BIG AIRPORTS. THAT IS AN IMPROVEMENT, FEWER OF THOSE. AIR-QUALITY IS IN THE MODERATE RANGE. THE YELLOW, NOT GREAT, BUT DEFINITELY BETTER THAN THE REDS AND PURPLES WE HAVE BEEN SEEING THEM PAST 48 HOURS OR SO. GEORGE, OBVIOUSLY THINGS HAVE IMPROVED, BUT KIDS ARE STILL REMOTE FOR SCHOOL. THERE IS AN IMPACT ON DAILY LIFE. >> Reporter: WHAT A DIFFERENCE A DAY MAKES. A LOT OF US HAVE BEEN USING THE EPA AIR NOW APP, IT NOW ACTUALLY SAYS GOOD WHICH IS A DRAMATIC IMPROVEMENT FROM WHAT WE SAW IN THE 300 TO 400 WORST AIR IN THE WORLD. I MEAN, IT FEELS SO MUCH BETTER. YOU CAN FEEL IT IN THE ATMOSPHERE WITH PEOPLE NOT WEARING AS MANY MASKS, AND OVERALL THERE IS A SIGH OF RELIEF, BUT PEOPLE DO FEEL THEY CAN GO OUT NOW. LIKE YOU SAID, IT'S NOT SAFE FOR EVERYONE. IT IS BEST TO TREAD CAREFULLY. A LOT OF PEOPLE TAKING SOME PRECAUTIONS. PHILADELPHIA SCHOOLS ALL VIRTUAL TODAY. IT'S ALL GOING TO GO BACK TO IN PERSON LEARNING ON MONDAY, BUT OF COURSE EVERYONE IS CLEARLY AWARE OF THE CANADIAN WILDFIRES THAT AREN'T OUT AND THAT THIS COULD BE A RECURRING PROBLEM. FOR NOW MANY ARE RELISHING THE FACT THEY MIGHT BE ABLE TO GO OUTSIDE AND ACTUALLY ENJOY THE WEATHER THIS WEEKEND. >> THAT'S A NICE FEATURE FOR THEM. THANK YOU. >>> COMING UP, MUCH MORE TO GET TO. HUNDREDS OF THOUSANDS OF U.P.S. WORKERS PODCASTS. >>> HUNDREDS OF THOUSANDS OF U.P.S. WORKERS ARE VOTING RIGHT NOW TO MAYBE STRIKE. THAT IS THE POTENTIAL. IF THEY DID IT WOULD BRING THE WORLD'S BIGGEST PACKAGE CARRIER TO A TOTAL STANDSTILL. WE WON'T KNOW THE RESULTS UNTIL NEXT FRIDAY. THE WORKERS SAY THEY WANT MORE MONEY, BETTER WORKING CONDITIONS. THE LAST TIME WE SAW U.P.S. WORKERS STRIKE WAS BACK IN 1997, THE YEAR AMAZON WENT PUBLIC. THINK ABOUT THAT HERE LIFE BEFORE AMAZON. THE WAY WE SHOPPED WAS VERY DIFFERENT. I BET A LOT OF YOU HAVE SWAPPED THE STORE VISITS FOR DELIVERY INSTEAD. THINK ABOUT HOW MUCH ONLINE SHOPPING WE DO. THINK ABOUT HOW THE PANDEMIC CHANGED OUR SHOPPING HABITS. U.P.S. SAYS IT'S SHIPPING ABOUT 24 MILLION PACKAGES PER DAY, A QUARTER OF ALL DELIVERIES IN THIS COUNTRY. PER YEAR GLOBALLY IT IS SOMETHING LIKE 6 BILLION. WE DON'T KNOW THAT A STRIKE IS HAPPENING YET. A VOTE IS OCCURRING AS WE SPEAK. TALK ABOUT WHAT THEY WANTED THE REPERCUSSIONS IF THEY DO DECIDE TO STRIKE. >> Reporter: WE WOULD GET TO THE REPERCUSSIONS IN A MOMENT, BUT LET'S TALK ABOUT THE BULLET POINTS OF WHAT THEY ARE ASKING FOR. WHEN WE TALK ABOUT THESE UNION WORKERS THAT ARE PART OF THE TEAMSTERS UNION. TAKE A LOOK AT THEIR DEMANDS. THESE ARE SOME OF THEM. THEY HAVE SOME DEMANDS INCLUDING ADDING AIR CONDITIONING INTO ALL OF THEIR DELIVERY FLEET. THE BOTTOM LINE, THEY ARE ASKING FOR BETTER BENEFITS, IMPROVED WORKING CONDITIONS, SOMETHING THAT THE AIR CONDITIONING WOULD FALL UNDER, AND BETTER PAY. THESE AREN'T NOVEL CONCEPTS. WE HAVA WRITER'S STRIKE HAPPENING NOW IN HOLLYWOOD, AND IT'S THE SAME ACROSS THE BOARD. THEY ARE SAYING THAT ESPECIALLY DURING THE PANDEMIC U.P.S. AND ALL KINDS OF DELIVERY SERVICES SAW A SURGE IN DEMAND, AND THEY PROFITED FROM IT. PEOPLE WHO DRIVE THESE TRUCKS, PEOPLE WHO SORT THOSE PACKAGES THEY ARE SAYING THAT THEY AREN'T SEEING THE LION'S SHARE OF THOSE PROFITS, BUT THEY ARE FEELING THE BRUNT OF THE EXTRA ADDED STRESS BECAUSE WE KNOW HOW MUCH THE DEMAND HAS GONE U . WHEN WE TALK ABOUT THE STATUS OF THOSE NEGOTIATIONS, U.P.S. SAID IN A STATEMENT BACK IN APRIL, QUOTE, WE ARE COMMITTED TO REACHING AN AGREEMENT THAT PROVIDES TWINS FOR THE EMPLOYEES, THE TEAMSTERS, U.P.S., AND OUR CUSTOMERS, TAKING CARE OF OUR PEOPLE, AND DELIVERING TO CUSTOMERS IS OUR TOP PRIORITIES. KIND OF SIMILAR TO THE WRITERS STRIKE, FIRST WHAT HAPPENED IS THE TEAMSTERS, THE UNION GETS TOGETHER AND THEY DECIDE WHETHER OR NOT THEY WILL AUTHORIZE A STRIKE. MOST OF THE TIME THEY DO AUTHORIZE THAT. IT WILL BE OFFICIAL COME THIS TIME NEXT WEEK, AND THEN WHAT HAPPENS IS THE ACTUAL NEGOTIATION, THAT CONTRACT THAT EXPIRES AUGUST 1st, AND THAT IS WHEN WE WOULD SEE THE IMPACT IF THEY GO ON STRIKE. >> THAT IS THE TIMING OF IT. NOT JUST REGULAR PEOPLE LIKE ME AND YOU, CUSTOMERS WHO ORDER THINGS, BUT SMALL BUSINESSES, AND BIG BUSINESSES THAT USE THE COMPANY. >> Reporter: EXACTLY. WHEN YOU THINK ABOUT THE IMPACT, 24 MILLION PACKAGES, OVER THAT. THE GLOBAL IMPACT, IS NOT JUST DELIVERY TO OUR HOMES FOR PIZZA. IT'S NOT JUST MEDICINE OR CLOTHES OR GROCERIES. IT'S ALL OF THESE BUSINESSES YOU FREQUENT EVERY SINGLE DAY. THERE'S NOT A CORNER OF THIS WORLD OUR COUNTRY THAT WOULD NOT BE IMPACTED. U.P.S. IS THE WORLD'S BIGGEST CAREER. IF THIS HAPPENS, THIS WOULD BE THE LARGEST WORK STOPPAGE IN U.S. HISTORY. WHEN WE LOOK AT THE AMOUNT OF WORKERS, 340,000 U.P.S. WORKERS THAT WOULD ALSO BE IMPACTED IN THEIR DAY-TO-DAY LIFE. IT'S A LOT TO LOOK AT WHEN IT COMES TO THE IMPACTS, BUT FIRST WE HAVE TO SEE WHAT HAPPENS WITH THE NEGOTIATIONS. >> THANK YOU VERY MUCH. >>> LET'S GET OVER TO THE FIVE THINGS OUR TEAM THINGS YOU SHOULD KNOW ABOUT TONIGHT. NUMBER ONE, THE FORMER UK PRIME MINISTER BORIS JOHNSON HAS RESIGNED AS A MEMBER OF PARLIAMENT, AFTER AN INVESTIGATION INTO MISLEADING STATEMENTS HE MADE TO PARLIAMENT ABOUT THAT SO-CALLED PARTY GATE SCANDAL. IT WAS PARTIES THAT BROKE THE PANDEMIC LOCKDOWN RULES OVERSEAS . IN A STATEMENT, HE ACCUSED POLITICAL PUNDITS OF TRYING TO FORCE HIM OUT. >>> NUMBER TWO, THOUSANDS OF PEOPLE HAVE BEEN FORCED TO EVACUATE FROM HIGH-RISES IN NORTHERN CHINA BECAUSE OF BIG CRACKS THAT OPENED UP ON THE STREET NEARBY. EXPERTS SAY THE CRACKS CAME FROM THE POLLS BURIED A MILE UNDERGROUND, JUST OPENED UP, UNDERGROUND HOLES, A SUDDEN GEOLOGICAL DISASTER. NO WORD YET ON WHEN PEOPLE CAN GET BACK HOME. >>> NUMBER THREE, WALMART SAYS IT WILL EXPANDED HIV FOCUSED PHARMACY PROGRAM. THE RETAILER HAS TREATMENTS AND A HALF DOZEN HIGHLY AFFECTED COMMUNITIES BUT NOW WALMART SAYS THAT PROGRAM WILL BE AVAILABLE IN MORE THAN 80 LOCATIONS BY THE END OF THE YEAR. >>> NUMBER FOUR, NETFLIX IS BIG CRACKDOWN ON PASSWORD SHARING IS PAYING OFF AT LEAST FOR NETFLIX, BECAUSE THEY GOT ABOUT 100,000 NEW DAILY SUBSCRIPTIONS RIGHT AFTER TELLING PEOPLE YOU CANNOT FREELOAD OFF OF YOUR EX, X, X ROOMIES NETFLIX ACCOUNT. CANCELLATIONS HAVE ALSO GONE U , BUT NOT BY AS MUCH AS SIGN UPS. >>> NUMBER FIVE, THE BIGGEST DINOSAUR SKULL EVER DISCOVERED A SET TO GO ON DISPLAY IN A MUSEUM OVER IN DENMARK LAST WEEK. THEY HAD TO USE BIG MACHINERY TO PLACE EACH PIECE OF THAT SKULL. THEY NICKNAMED THE SKULL ADAM. THE DINA STORE LIVED IN NORTH AMERICA ABOUT 70 MILLION YEARS AGO. >>> WE COME BACK, OUR TOP STORY, FORMER PRESIDENT TRUMP'S HISTORIC INDICTMENT ON FEDERAL CHARGES, BUT REMEMBER HE'S ALSO RUNNING FOR THW ON APPLE PODCASTS. >>> BACK TO OUR TOP STORY TONIGHT, FORMER PRESIDENT TRAVELED NEARLY 3 DOZEN FEDERAL COUNTS CONNECTED TO STORING MORE THAN THOUSANDS OF CLASSIFIED DOCUMENT AT MAR-A LAGO. HE NEVER COMES THE FIRST FORMER PRESIDENT TO FACE FEDERAL CHARGES, BECAUSE HE IS ALSO THE 2024 REPUBLICAN FRONT RUNNER. HE HAS A SHOT OF WINNING THE WHITE HOUSE IN ABOUT 18 MONTHS. AND IF THAT HAPPENS, ONE OF THE POWERS HE MAY GET BACK IS THE ABILITY TO PARDON SOMEBODY, SO DOES THAT INCLUDE HIMSELF? HERE IS THE BREAKDOWN. >> Reporter: IT'S A QUESTION THAT HAS NEVER BEEN ASKED BEFORE BECAUSE IT HASN'T HAPPENED BEFORE. CAN A PRESIDENT PARDON THEMSELVES FOR THEIR OWN CRIMES? FORMER PRESIDENT TRUMP THOUGHT SO. BACK IN 2018, TALKING ABOUT ALLEGATIONS HE COLLUDED WITH RUSSIA. >> I DO HAVE AN ABSOLUTE RIGHT TO PARDON MYSELF BUT I'LL NEVER HAVE TO DO IT BECAUSE I DIDN'T DO ANYTHING WRONG, AND EVERYBODY KNOWS IT. >> Reporter: EXPERTS SAY THE POTENTIAL FOR A SELF PARDON IS NOT SO CLEAR. >> A LOT IS LEFT OPEN TO INTERPRETATION. >> WE JUST HAVE TO WAIT AND SEE. >> Reporter: HERE IS MY IT IS SUCH A COMPLICATED QUESTION. THE CONSTITUTION DOES NOT SPECIFICALLY GET INTO WHETHER IT IS ALLOWED, SAYING ONLY THE PRESIDENT SHALL HAVE POWER TO GRANT PARDONS, EXCEPT IN CASES OF IMPEACHMENT. THAT IS IT. NOTHING ON CELL PARDONS. THE JUSTICE DEPARTMENT TRIED TO CLEAR THINGS UP BACK IN 1974, RIGHT BEFORE RICHARD NIXON GOT IMPEACHED. IN A MEMO THE DOJ DETERMINED BASICALLY A PRESIDENT CANNOT SELF PARDON BECAUSE NO ONE CAN BE A JUDGE IN THEIR OWN CASE. >> JUST LIKE WE DON'T LET PEOPLE BE THE PROSECUTOR OR THE JUDGE OR THE JURY IN THEIR OWN CASE, THE ARGUMENT GOES, YOU CAN'T PARDON YOUR OWN CASE. >> Reporter: SINCE THEN THAT LEGAL OPINION HAS NEVER BEEN TESTED UNTIL MAYBE NOW HERE GIVE MR. TRUMP WERE TO WIN THE WHITE HOUSE IN 2024, HE COULD TRY TO PARDON HIMSELF ON THESE NEW FEDERAL CHARGES WITHIN MINUTES OF INAUGURATION, BUT EXPERTS SAY IT WOULD VERY LIKELY GO TO THE SUPREME COURT TO DECIDE WHETHER THE SELF PARDON WOULD HOLD, AND IT IS A COURT THAT HAS A CONSERVATIVE MAJORITY BECAUSE OF NOMINATIONS FROM MR. TRUMP HIMSELF. >> IT'S ONE THAT I THINK IS VERY PERCEPTIVE TO THE PROSPECT OF BROAD PRESIDENTIAL POWER. >> Reporter: THE EW FEDERAL CHARGES AREN'T THE ONLY LEGAL ISSUES FACED BY MR. TRUMP. HE'S BEEN CHARGED IN NEW YORK RELATED TO HUSH MANY PAYMENTS AS AND HAS PLEADED NOT GUILTY, BUT THOSE ARE STATE-LEVEL CRIMES. A PRESIDENTIAL PARDON IS OFF THE TABLE WITH THAT. >> THE CLAUSE IN THE CONSTITUTION SAYS IT IS TO OFFENSES AGAINST THE UNITED STATES AND IS COMMONLY UNDERSTOOD TO MEAN FEDERAL OFFENSES. BACK IN GEORGIA, MR. TRUMP ALSO FACES AN INVESTIGATION BUILT AROUND HIS 2020 ELECTION FRAUD LIES. HE DENIES ANY WRONGDOING, BUT THE POTENTIAL TO PARDON HIMSELF WOULD DEPEND ON THE SPECIFIC CHARGES THE DISTRICT ATTORNEY MIGHT BRING, AND WHETHER THEY WERE TO INVOLVE MULTIPLE STATES OR JURISDICTIONS, SAY GEORGIA ALONG WITH DC. AGAIN IT'S THE FEDERAL VERSUS STATE DIFFERENCE. >> ONCE IT BECOMES FEDERAL, THEN THERE IS THAT POSSIBILITY OF A PRESIDENTIAL PARDON. THAT IS A REASON TO KEEP THINGS IN STATE COURT IF YOU ARE A STATE PROSECUTOR. >> Reporter: COULD MR. TRUMP PARDON HIMSELF ON AT LEAST SOME COUNTS IF HE ENDS UP IN THE WHITE HOUSE? HE COULD TRY, BUT WHETHER IT STICKS WOULD ALMOST CERTAINLY DEPEND ON WHAT THE SUPREME COURT SAYS. OF COURSE, IF HE DOESN'T WIN, WHOEVER IS IN THE WHITE HOUSE COULD PARDON MR. TRUMP HIMSELF ON THOSE FEDERAL CHARGES. ONE CURRENT COMPETITOR SUGGESTING THEY ARE OPEN TO IT. >> WOULD YOU LOOK AT PARDONING TRUMP HIMSELF BASED ON THE EVIDENCE THAT MIGHT EMERGE FROM THOSE CHARGES? >> THE DOJ AND FBI HAVE BEEN WEAPONIZE. ANY EXAMPLE OF DISFAVORED TREATMENT BASED ON POLITICS OR WEAPONIZATION WOULD BE INCLUDED IN THAT REVIEW, NO MATTER HOW SMALL OR HOW BIG. >> IF DONALD TRUMP, AGAIN, A LOT OF HYPOTHETICALS, IF HE MAKES IT TO THE WHITE HOUSE AND WORD TO TRY TO ISSUE A SELF PARDON, IT WOULDN'T AUTOMATICALLY GO TO THE SUPREME COURT. THERE WOULD HAVE TO BE SOME KIND OF TRIGGER OR CHALLENGE IN ORDER FOR THAT TO HAPPEN. WHO WOULD HAVE STANDING OVER THAT, HOW THAT WOULD UNFOLD, AGAIN, STILL REMAINS TO BE SEEN. THAT IS BASED ON HYPOTHETICALS IF DONALD TRUMP MAKES IT TO THE WHITE HOUSE. TO DO THAT HE'D HAVE TO GET SUPPORT FROM ENOUGH VOTERS IN PLACES LIKE IOWA, RIGHT? WHAT DOES TODAY'S INDICTMENT MEAN TO THOSE VOTERS? WE DON'T KNOW, BUT IT MAY NOT BE SO BAD FOR HIM. CHECK OUT THESE POLLING NUMBERS FROM AROUND THE TIME HE WAS CHARGED UP IN NEW YORK. UP AROUND 7% ON AVERAGE IN THE WEEKS AFTER THAT INDICTMENT. DOES THAT TELL US ANYTHING ABOUT THIS ONE? LET'S GET TO JESSE KURTZ IS TALKING TO FOLKS IN IOWA. YOU ARE DOING IT. YOU ARE TALKING TO PEOPLE WHO WILL PUT DONALD TRUMP IN THE WHITE HOUSE ARE NOT. WHAT ARE THEY TELLING YOU? BACK OBVIOUSLY PACIFICALLY WE ARE TRYING TO FIND PEOPLE WHO ARE PLANNING TO PURCHASE PAID IN THE UPCOMING IOWA CAUCUS. IF YOU ARE UNFAMILIAR, THAT WILL BE THE FIRST NOMINATING CONTEST FOR REPUBLICANS WHEN ALL OF THAT RAMPS UP. OBVIOUSLY IT IS A MUST WIN. FORMER PRESIDENT DONALD TRUMP WHO WENT ON TO BECOME THE NOMINEE AND TO WIN THE PRESIDENCY IN 2016, HE CAME IN SECOND IN IOWA, BUT IT OBVIOUSLY HAS THE POTENTIAL TO CREATE MOMENTUM SHIFTS IN STRATEGY CHANGES FOR VARIOUS CAMPAIGNS. WE'VE BEEN ASKING VOTERS HERE TODAY HOW THEY FEEL ABOUT THIS NEWS. THE OVERALL SENTIMENT FROM VOTERS WE SPOKE WITH WHETHER THEY LIKED THE FORMER PRESIDENT OR HAVE MOVED ON FROM HIM IS THAT THIS DOESN'T REALLY MOVE THE NEEDLE. I'VE ALREADY MADE UP THEIR MINDS ABOUT HIM. THERE ARE SOME THINGS THAT SOME VOTERS SAID DOWN THE LINE COULD HAPPEN THAT MIGHT INFLUENCE THEIR DECISION, MIGHT CHANGE THEIR MIND IN TERMS OF HOW CASES PLAY OUT. SOME COULD NOT SPECIFICALLY PINPOINT WHAT THAT MIGHT LOOK LIKE, BUT THE HEADLINE OF THE DAY IS NOT CHANGING THE MINDS OF THE PEOPLE WE SPOKE WITH WITH SOME OF WHAT WE HEARD FROM VOTERS ON THE GROUND. >> I DON'T KNOW THAT I CAN TRUST HIM AGAIN. >> THE PARTY IS GOING TO TAKE NOTE OF THAT. >> DONALD TRUMP WAS WHO HE IS BEFORE THE INDICTMENT, AND HE'LL BE THE SAME AFTER. THE INDICTMENT DOESN'T HAVE ANY EFFECT ON MY OPINION ABOUT HIM, POSITIVE OR NEGATIVE. I'M NOT GOING TO VOTE FOR HIM. >> Reporter: THE GENTLEMAN YOU JUST HEARD SAYING THAT HE THINKS THIS MIGHT HURT HIM IN THE NOMINATING CONTEST, THAT GENTLEMAN IS STILL IN THE FORMER PRESIDENT CAN'T, HE TOLD ME, AND HE'S NOT PLANNING TO BE A PARTICIPANT IN THE UPCOMING IOWA CAUCUS. THERE IS A WHOLE MIX OF PEOPLE, A LOT OF VARIABLES AS ALWAYS. WE CAN THINK ABOUT THINGS AND TALK ABOUT THEM AND LISTEN TO VOTERS ALL WE WANT, BUT UNTIL WE SEE THE RESULTS IT'S A GUESSING GAME, UP UNTIL THAT TIME. SOME PEOPLE WHO WE SPOKE WITH, THIS WASN'T SOME MOMENT THAT CHANGED THE MINDS OF THE PEOPLE WE SPOKE WITH. >> THANK YOU FOR THAT. >>> CHARGES DROPPED AGAINST THE TWO MEN ACCUSED OF AN AWFUL CRIME IN CALIFORNIA. WHY? BECAUSE OF A TEXTING SCANDAL INSIDE OF A POLICE DEPARTMENT. WE WILL TELL YOU WHERE THAT INVESTIGATION IS GOING NEXT. >>> A BIG DEBATE OVER A CONTROVERSIAL BAN TARGETING HOMELESS ENCAMPMENTS. HOW THIS COULD BE COMING TO WHERE YOU LIVE, LATER IN >>> NEW FALLOUT TONIGHT FROM A RACIST TEXTING SCANDAL THAT HAS ROCKED THE CALIFORNIA POLICE DEPARTMENT, WITH TWO MEN ACCUSED OF CRIMES NOW GETTING THERE CHARGES DROPPED. THEY WERE ARRESTED FOR THE BURNING AND MUTILATION OF A CORPSE BACK IN 2022, BUT THE LOCAL DA SAYS THEY HAVE TO CUT THE MEN LOOSE, SAYING THEY NO LONGER HAVE CONFIDENCE IN THE INTEGRITY OF THE CASE AS SO MUCH OF IT WAS BASED ON THE WORK OF TWO POLICE OFFICERS ASSOCIATED WITH A SERIES OF RACIST AND MISOGYNISTIC TEXT CONVERSATIONS EARLIER THIS YEAR. SOME OF THE MESSAGES ARE JUST DISTURBING. AND ONE AN OFFICER REFERS TO GEORGE FLOYD, KILLED AT THE HANDS OF POLICE IN 2020, AS A GORILLA. IN ANOTHER , THERE IS A SLEW OF RACIST STEREOTYPES ASSOCIATED WITH BLACK PEOPLE. IT LAUNCHED INVESTIGATIONS FROM MULTIPLE STATE, LOCAL, AND FEDERAL ORGANIZATIONS INCLUDING THE FBI. THESE ARE A HORRIFIC SERIES OF TEXTS, RACIST AND PROBLEMATIC IN EVERY WAY. THE CONCERN ALL ALONG HAS BEEN COULD IT AFFECT ANY ACTUAL CASES , AND IT APPEARS NOW THAT IT HAS. >> Reporter: IT HAS. AND IT IS CONCERNING, BECAUSE IT ISN'T JUST THIS CASE. THESE ARE VERY SERIOUS CHARGES AND YOU HAVE TWO FELONY SUSPECT THAT ARE NOW NOT GOING TO FACE CHARGES AT LEAST FOR NOW. IN THE PROSECUTION SAID THIS CASE COULD NOT PROCEED IN GOOD FAITH, BECAUSE A LOT OF THE INVESTIGATION HEAVILY RELIED ON THE OFFICERS THAT WERE CAUGHT UP IN THE SCANDAL, AND THE DA PUT OUT A STATEMENT THAT SAYS THE OFFICE HAS THE ABILITY TO REFILE THESE CHARGES IF NEW EVIDENCE IS PRESENTED. NOW THE FAMILY IS RIGHTFULLY SO VERY FRUSTRATED OVER THIS, BECAUSE THEY SAY THAT THE EVIDENCE THAT THEY SAW DURING THE PRELIMINARY HEARINGS WAS ENOUGH TO SHOW THAT THESE TWO MEN WERE INVOLVED WITH MICHAELA'S DEATH. THE FAMILIES WANT THE OFFICERS TO BE HELD ACCOUNTABLE, BUT NOT AT THE EXPENSE OF THEIR DAUGHTER NOT RECEIVING JUSTICE, AND MICHAELA'S MOM ACTUALLY TALKED ABOUT THE DAY THEY DISCOVERED HER BODY. LISTEN. >> I WILL NEVER GET OVER THEM, PICKING MY CHILD UP, OUT OF THAT THING, AND I DIDN'T EVEN KNOW THAT WAS HER. >> IT'S UNEXPLAINABLE. WHO WOULD DO SOMETHING LIKE THIS? AND THIS IS THE WAY IT IS. >> Reporter: THE TWO SUSPECTS WERE FACING FELONY MUTILATION AND ARSON CHARGES. THEY ARE NO LONGER IN CUSTODY. >> CAN YOU PULL BACK BIG PICTURE, BECAUSE THIS POLICE DEPARTMENT IS UNDER INVESTIGATION FOR MULTIPLE ANGLES. CAN YOU GIVE US AN UPDATE ON WHERE THOSE THINGS STAND, WITH THE CONSEQUENCES COULD BE FOR THE OFFICERS INVOLVED? >> Reporter: RIGHT NOW THOSE OFFICES ARE ON ADMINISTRATIVE LEAVE. THEY COULD BE FIRED AND COULD ALSO BE PROSECUTED BECAUSE IN SOME OF THESE TEXT MESSAGES THEY BRAGGED ABOUT ASSAULTING SOME OF THE SUSPECTS. NOT ONLY IS THE FBI, THE CONTRA COSTA COUNTY DISTRICT ATTORNEY INVESTIGATING, BUT THE CITY COUNCIL UNANIMOUSLY APPROVED FOR AN AUDIT TO TAKE PLACE, SO THEY ARE NOW GOING BACK AND THEY ARE LOOKING NOW AT THE DEPARTMENT'S INTERNAL AFFAIRS UNIT. THEY ARE ALSO LOOKING AT ITS HIRING AND PROMOTIONAL PRACTICES , AND THE DEPARTMENTAL CULTURE. 17 OFFICERS HAVE BEEN NAMED IN THIS SCANDAL, INCLUDING THE ANTIOCH POLICE UNION PRESIDENT, AND THIS INVOLVES RACIST, HOMOPHOBIC TEXT MESSAGES. AGAIN THEY KIND OF GLORIFIED BRUTALIZING SOME OF THESE PEOPLE , AND THESE IMAGES THAT WERE REALLY HORRIFIC AND NOT SOMETHING THAT YOU WOULD WANT SOMEONE WHO WAS SWORN TO PROTECT AND DEFEND TO BE JOKING ABOUT BACK AND FORTH. THE MOST TROUBLING PART IS THAT THESE CASES COULD GET OVERTURNED , BECAUSE ONE OF THE MOST DAMNING PARTS OF THIS INVESTIGATION, ONE POLICE OFFICER WROTE TO ANOTHER ONE, WE'VE GOT THE GRAPHIC, HE SAID PRETTY MUCH ESSENTIALLY BECAUSE THEY DON'T HAVE VIDEO, THIS OFFICER SOMETIMES WILL SAY THAT PEOPLE CONFESSED WHEN THEY DIDN'T, AND LITERALLY SAID, QUOTE, GET FILED EASIER. RIGHT NOW THE POLICE CHIEF SAYS THERE COULD BE MORE FELONY CHARGES DROPPED JUST BECAUSE OF WHAT THESE OFFICERS SAID. OBVIOUSLY THEY'VE BEEN EXPOSED AND IS HOPING TO WEED OUT THE BAD OFFICERS, BUT IT IS IMPACTING IMPORTANT CASES AND JUSTICE FOR FAMILIES THAT REALLY NEED IT. >> DANA GRIFFIN, THANK YOU SO MUCH. >>> TO TONIGHT'S ORIGINAL WITH IN-DEPTH REPORTING ON A TOPIC WE'VE BEEN WATCHING. IS TAKEN US TO PORTLAND, OREGON WHERE THE CITY COUNCIL HAS PASSED A CONTROVERSIAL BAN TARGETING HOMELESS ENCAMPMENTS THAT BASICALLY FORBID THEM FROM BEING ANYWHERE ON PUBLIC PROPERTY DURING THE DAY. YOU CAN'T HAVE WHAT YOU ARE SEEING HERE. COMES AS A LOT OF CITIES ACROSS THE COUNTRY ARE SEEING MORE AND MORE PEOPLE WHO ARE UNHOUSED ON THEIR STREETS. AARON GILCHRIST HAS MORE. >> Reporter: EVERY DAY IN PORTLAND, OREGON'S MULTNOMAH COUNTY, MORE THAN 6000 PEOPLE ARE EXPERIENCING HOMELESSNESS. NOW AS CALLS FROM SOME RESIDENTS AND BUSINESS OWNERS TO CLEAR ENCAMPMENTS AND TESTIFY, THE CITY HAS PASSED A LAW MAKING CAMPING DURING THE DAYTIME ILLEGAL AND PUTTING EXTENSIVE NEW RESTRICTIONS ON NIGHTTIME CAMPING. >> THESE CHANGES ARE VITAL TO OUR COMMUNITY'S ABILITY TO RETURN TO THE VIBRANT PLACE THAT WE ALL LOVE. >> THE PRIMARY CONCERN WE HAVE FROM SMALL BUSINESSES IS A LACK OF SAFETY ON THE STREET, RESULTING IN EMPLOYEES AND CUSTOMERS NOT FEELING SAFE COMING TO THE DISTRICT. >> Reporter: BUT THE LAWS CRITICS WARY THAT REQUIRING PEOPLE TO PACK UP EVERY MORNING WILL DESTABILIZE THEIR LIVES FURTHER. >> WHEN WE THINK OF PEOPLE HAVING TO PACK UP THEIR BELONGINGS, AND CARRY THAT AROUND ALL DAY IS UNREALISTIC. >> Reporter: THIS MAN HAS LIVED OUTSIDE FOR 10 YEARS. HE HAS ASKED NOT TO BE IDENTIFIED FOR HIS SAFETY. >> PEOPLE WON'T BE ABLE TO KEEP UP WITH THEIR PROPERTY, AND THEY WILL END UP LOSING SOME OF THE BASIC THINGS THAT PEOPLE NEED TO LIVE COMFORTABLY. >> Reporter: HE HAS SAID HE HAS HAD TROUBLE FINDING OPEN SHELTER BEDS. >> SOME PLACES HAVE ABOUT A SIX MONTH WAITING LIST, SO THAT RIGHT THERE WILL LEAVE PEOPLE IN A VULNERABLE PLACE. >> Reporter: THOSE WHO REPEATEDLY VIOLATE THE LAW WILL FACE A $100 FINE OR UP TO 30 DAYS IN JAIL. EAGLE ADVOCATES FOR THE UNHOUSED DATA FINES AND THE AMBIGUOUS OVERNIGHT CAMPING RESTRICTIONS COULD HELP RENDER IT UNCONSTITUTIONAL. >> HERE INSTEAD OF HELPING THEM AFTER THEY'VE BEEN FORCED TO LIVE OUTSIDE, WE ARE LITERALLY TRYING TO EITHER RUN THEM OUT OF TOWN, OR CRIMINALIZE THEM. FOR MAC IT IS NOT JUST IN OREGON. AFTER HOMELESSNESS RATES FELL INTO NATIONALLY IN 2010, THEY STARTED GOING UP AGAIN, OF 18% THIS YEAR COMPARED TO LAST IN THE WASHINGTON, D.C. REGION, UP 7% IN THE PHOENIX AREA, AND UP A WHOPPING 139% IN METRO LOUISVILLE. >> THERE IS NO PLACE IN THIS COUNTRY THAT PEOPLE CAN HAVE A MINIMUM WAGE JOB WHERE YOU CAN AFFORD A TWO BEDROOM HOUSING UNIT, AND ONLY 10% OF THE COUNTRY CAN AFFORD A ONE BEDROOM UNIT MAKING MINIMUM WAGE. >> Reporter: DEBATES OVER WHETHER CITIES SHOULD CRACKDOWN ON ENCAMPMENTS ARE ALSO BUBBLING UP FROM COAST TO COAST. >> IN MANY COMMUNITIES ACROSS THE COUNTRY IT HAS BECOME ILLEGAL TO BE HOMELESS. >> Reporter: NUMEROUS STUDIES NOW SUGGEST CRIMINALIZATION IS MORE EXPENSIVE THAN PROVIDING PEOPLE WITH HOUSING. IN CALIFORNIA, ONE STUDY PREDICTS FOCUSING ON HOUSING COULD SAVE ORANGE COUNTY $42 MILLION PER YEAR. BACK IN PORTLAND, ADVOCATES FOR PEOPLE ASKED PARENTING HOMELESSNESS ASKED THE RESIDENTS, BUSINESS OWNERS, AND POLICYMAKERS TO FOCUS ON THE COMMUNITIES SHARED GOALS. >> WE ALL WANT THE SAME THING. WE ALL WANT TO SEE SAFER STREETS. >> Reporter: WE DID REACH OUT TO THE PORTLAND MAYOR BEFORE THE VOTE ON THIS BAN. THE CITY DOES HAVE A PLAN TO CREATE A FEW CENTRALIZED CAMPING SITES FOR UNHOUSED PEOPLE TO USE AS THIS BAN COMES INTO EFFECT IN JULY. >> THANK YOU VERY MUCH. >>> NBC NEWS COVERS HUNDREDS OF STORIES EVERY DAY, AND BECAUSE YOU COULD NOT POSSIBLY GET TO THEM ALL, OUR BUREAU TEAMS HAVE DONE THEM FOR YOU. THIS IS WHAT THEY TELL US IS GOING ON IN THEIR REGIONS IN A SEGMENT WE CALL THE LOCAL. OUT OF OUR SOUTHERN BUREAU, A FLORIDA MAN ALMOST DIED FROM A RARE FLESH EATING BACTERIA AFTER HE WAS BITTEN BY A FAMILY MEMBER. HE WAS TRYING TO BREAK UP A FIGHT WHEN THIS HAPPENED. THE BITE AREA KEPT SWELLING AND SWELLING. DOCTORS IF HE WAITED A COUPLE MORE DAYS, IT COULD HAVE COST HIM HIS LEG OR HIS LIFE. AFTER TWO SURGERIES, DOCTORS THEY STOPPED THE INFECTION AND HE WAS ABLE TO GO HOME. >>> IN MINNESOTA HIGHWAY HAD TO BE SHUT DOWN AFTER A TRUCK CARRYING 50 PIGS ROLLED OVER. YES. YOU HURT ME. THE PIGS GOT OUT, STARTED WANDERING AROUND THE HIGHWAY. IT TOOK A LITTLE WHILE TO GET THE PIGS BACK INTO THE TRUCK. THEY ULTIMATELY DID GET THE PIGS BACK INTO THE TRUCK. THE DRIVER WAS NOT INJURED. >>> OUT OF THE WASHINGTON, D.C. BUREAU, LOOK AT THIS BLACK THERE. YOU KNOW WHERE THIS WAS? IN BROOKLYN, SECONDS AWAY FROM WHERE OUR BUREAU IS FINALLY CAPTURED AND EVENTUALLY CAME DOWN AND STARTED EXPLORING PEOPLE'S BACKYARDS, INCLUDING PEOPLE WHO WE KNOW HERE WHO WORK WITH US. ANIMAL CONTROL WAS EVENTUALLY CALLED. THEY SEDATED THE BEAR AND WILL RELEASE HIM IN MARYLAND WHERE THEY CAN LIVE OUT THEIR DAYS NOT IN CLOSE PROXIMITY TO HUMANS AND CHILDREN. >>> STILL TO COME, EIGHT YEARS AFTER SAME-SEX MARRIAGE BECAME LEGAL EVERYWHERE IN AMERICA, PEOPLE ARE BURIED THERE RIGHTS ARE AT >>> THE CITY OF DES MOINES IS KICKING OFF ITS ANNUAL PRIDE CELEBRATION TONIGHT, BUT THE SHADOW OVER THE EVENT, NEW THREATS TO SAME-SEX MARRIAGE. THAT IS BECAUSE TWO NEW BILLS ARE TAKING AIM AT THAT LEGALITY HAVE BEEN PROPOSED IN IOWA. THE RECENT ANNOUNCEMENT SHOWS 35 STATES THAT HAVE SOME KIND OF A BAN ON SAME-SEX MARRIAGE, THAT ARE DORMANT FOR NOW, BUT IF THE LANDMARK OBERGEFELL SUPREME COURT RULING FALLS, THE RULING THAT LEGALIZED GAY MARRIAGE NATIONWIDE, IF THAT GETS UP RETURNED , WELL, THAT COULD PUT ALL OF THIS AT RISK. WHEN IOWA COUPLE TELLS NBC NEWS THAT HAVING THESE LEGAL CHALLENGES FEELS LIKE WE ARE UNDER ATTACK AGAIN, AND EVEN MORE SO THAN BEFORE. EXPLAIN THE NEW BILL AND THE IMPACT IT'S HAVING AN IOWA, AND MORE IMPORTANTLY, A REALITY CHECK ON HOW REAL THE THREAT IS TO SAME-SEX MARRIAGE. THE SUPREME COURT SOFAR OBVIOUSLY HAS NOT OVERTURNED OBERGEFELL . >> Reporter: THAT IS CERTAINLY TRUE, BUT EVER SINCE DOBBS WAS OVERTURNED, OR DOBBS WAS DECIDED, OVERTURNING ROE V. WADE, THE FEAR HAS BECOME MUCH MORE REAL. THOSE TWO BILLS YOU WERE TALKING ABOUT IN IOWA, ONE OF THEM IS A CONSTITUTIONAL AMENDMENT, AND IT WOULD ACTUALLY CHANGE THE CONSTITUTION HERE AND I WANT TO MAKE MARRIAGE BE BETWEEN ONE BIOLOGICAL MALE AND ONE BIOLOGICAL FEMALE, THAT IS THE ACTUAL WORDING THAT IT HAS IN THAT MEASURE. THE OTHER ONE WOULD GO ON TO MAKE PEOPLE WOULD USE RELIGIOUS GROUNDS, INDIVIDUALS COULD DENY RECOGNIZING A MARRIAGE DUE TO JUST RELIGIOUS GROUNDS. THAT'S SIMILAR TO MANY OTHER MEASURES THAT ARE ON THE BOOKS IN SEVERAL OF THESE STATES THAT WE TALKED ABOUT. THERE ARE ALSO LAWS HERE IN IOWA PASSED JUST RECENTLY, LIMITING THINGS IN SCHOOLS, THE DISCUSSION OF THE LGBTQ COMMUNITY , AND ALSO FOR TRANSGENDER STUDENTS, ANY ACCOMMODATIONS FOR THEM LIKE WE MENTIONED, EVER SINCE JUSTICE CLARENCE THOMAS IN HIS CONCURRING OPINION SAID HE USED THE TERM OBERGEFELL TO RAISE QUESTIONS, SAYING IT SHOULD BE RECONSIDERED. THAT FEAR HAS BECOME MUCH MORE REAL. >> THERE ARE APPROXIMATELY 500 BILLS TARGETING THE LGBTQ+ COMMUNITY ACROSS THE COUNTRY ACCORDING TO THE HUMAN RIGHTS CAMPAIGN . I THINK THAT PLAYS INTO WHAT YOU ARE TALKING ABOUT, WHICH I HEAR AS PEOPLE TELLING ME THAT THEY FEEL LIKE THERE IS AN EXISTENTIAL THREAT. >> Reporter: RIGHT. FOR YOUNG PEOPLE, IT FEELS MUCH MORE THEORETICAL, BUT WE'VE TALKED TO PEOPLE WHO'VE BEEN FIGHTING THIS FOR A LONG TIME, INCLUDING KATE AND TRICIA BARNUM. THEIR CASE BACK IN 2009 ACTUALLY LEGALIZED SAME-SEX MARRIAGE IN IOWA, BUT THEN OF COURSE WHEN THEY CROSS OVER STATE LINES, THEY WERE NO LONGER MARRIED. THEY HAVE BEEN FIGHTING THIS FOR SO LONG THAT THEY HAVE SEEN IT COME AND GO IN WAVES, AND WITH THIS LATEST RESURGENCE, THE LATEST ROUNDS OF ANTI-LGBTQ BILLS AND LAWS THAT HAVE BEEN PASSED, THEY SAY THERE IS PLENTY OF REASON TO BE CONCERNED. >> WHAT ARE THE RIGHTS THAT COULD BE TAKEN AWAY, AND WHY WOULD THEY DO THAT AFTER 14 YEARS, AND NOTHING IN IOWA HAS BURNED TO THE GROUND? >> I GO BACKWARDS AFTER 14 YEARS? THERE IS NO NEED FOR IT. >> Reporter: THERE IS HOPE. A NEW GALLUP POLL SHOWS 71% OF AMERICANS DO APPROVE OF SAME
