welcome once again to lato's law here's steve leto crazy story out of florida sent me by a lot of people aaron michael keith nathan duane and elliott all sent it thank you very much florida car dealer mistakenly sells manafort bronco display model and demands its return did the story not too long ago about the dealership down in texas that sold a woman's corvette that wasn't theirs to sell and that caused all kinds of issues and so here the question is they sold something that was theirs but they say it was a mistake they want it back so action news wfts out of tampa bay uh call for action covered the story jackie callaway wrote it uh for the internet version and it's a great crazy story we like the crazy stories uh out of tampa nostalgia and the need to unload an old sedan sent adam sedoji on the hunt for the newly released ford bronco and you know car companies come out with new vehicles i'm talking about you know an updated vehicle or a new vehicle every so often where you look at it and go wow that's a home run that's a home run the bronco which was unveiled about last year sometime um is such a home run uh it's for recent model launches it's the one that i go wow that right there is a hit it's gonna be a hit and it is a hit it's selling like hot cakes as they say if you wanted to order one right now get in line i've spoken to a lot of people uh even people who aren't necessarily ford fans who look and go that's a nice looking vehicle um you know there's always a thing about you don't want to buy a car in its first year because they're working a lot of bugs out of it especially ford but the car is going to be a huge success they are hard to get your hands on i brought my explorer into the dealership for an oil change about a month ago and i talked to a salesman there and i said i'm curious uh ford bronco and the guy goes like don't even don't even ask they they could not they couldn't tell me when one would be available if i ordered one and uh so there you go so sodory said it's just a unique look and i fell in love with it when they released it so the day after he purchased his 2021 bronco uh he told the television station that the dealership called him and asked him to return it they wanted it back so he went to the dealership buys a bronco drives it home next day they call him go hey we need it back we want that car back now i've talked before about yo-yo sales and spot deliveries and in some states some states uh there's a scam where you put someone into a car and you call them a day or two later oh we made a mistake in the paperwork uh you can't afford that car you got to bring it back or bring us more money and um now this is not a spot to prevent it reminds me of that so when they call you and tell you to bring back the car that is now legally yours um it should set up a red flag he said they wanted me to bring it in by 3 p.m on christmas eve so this is all happening in the days preceding christmas and they actually said you better have it here by 3 p.m christmas eve or you know you're in trouble sedona's contract showed he traded in his other vehicle put 2 500 in cash down and then financed the rest of the vehicle before driving off the lot december 22nd so this of course is in the hubbub preceding christmas and um one of the interesting things about this is that to go through all of that he went in traded in a vehicle so that means they did the whole thing well we can only give you this they walked around it they dickered on the price of the trade-in and then they said how much can he put down he actually went in the range to get you know bring down 25 bucks and then he applied for and got financing and so it's not like this was a spur of the moment where he just says i'll take that car and boom five minutes later he's driving off the lot this was a full-blown this was the this was the full monty his transaction he was in that dealership for some time we all know what that's like you do not get in and out of dealership quickly sudoty said he spoke to sales manager and even wrote a letter to customer service the dealer admitted they had accidentally sold him a demo or mannequin model that was supposed to sit on display i've never heard of the phrase mannequin model i've heard of demo or floor model but i've never heard of mannequin model um so doti said it was a mannequin or demo model that ford had sent them when the car lot refused to back down sadoty made a call for action to jackie callaway she contacted the dealer's parents company to find out what was going on a spokesperson explained that the broncos sport that sedodi had bought was supposed to be on display in the showroom for four months before being sold and so [Laughter] who owned it did the dealership own it the dealership owned it they can sell it they shouldn't have sold it ford released a statement in an email after speaking with our team as soon as we were made aware of the situation we made sure the customer is able to keep the vehicle and they sent that note on december 29th so mr sudoti who is an american hero got the vehicle on the 22nd spent about a week wrangling with ford the dealership and call for action and he did eventually get his vehicle so now they closed the article that is called for action action news wfts tampa bay and jackie callaway by saying here's the good news for other car buyers what happened to adam sedouti is rare it is rare it is rare but it's a crazy case and this is the kind of example where we can look at this and deconstruct this perfectly there's there's no gray areas here we're not going to be i wonder what happened we know what happened we know what happened so the guy walks in the dealership and sees the car on the showroom floor let's assume it's actually on the showroom floor literally he looks at the car and goes i want to buy that car a salesman responding to instinct so deep in his brain stem that he probably can't even consciously think about it says i want to sell you that car you want to buy it i want to sell it and now here's the thing that salesman did not sell the car by himself we've all seen how car dealerships behave every sales transaction involves several people okay the salesman is there the sales manager is there the finance manager is there all of these people touch this transaction one time or another and presumably there's a bunch of stuff going on behind the scenes that you might not even be aware of so for instance you sit down you sign a bunch of documents you sign a purchase agreement that's got the vin of the vehicle on it and somebody's got a certificate of orange in their statement of origin which is like the birth certificate for the car but that came with the car from the manufacturer that shows that officially the dealership can sell this car and so when he signs documents gives this trade-in signs over the trade-in gives them down payment and all that somebody takes those papers and there's a person in the back or maybe people in the back who do the transaction of all the paperwork and they have to do the stuff that generates an application for title and a registration so you can drive the vehicle whether it's a temp or not it's another thing all together and some dealerships nowadays can actually give you an actual registration some dealership's going to give you the temp and the real one comes to the dmv but the point is that this transaction gets touched by like eight different people in four different departments and so somewhere along the line they walk on the congratulations here's your car and drop the keys in his hands they also put a license plate on it for him or a temporary license plate in the window and said there you go go off and drive have a good time enjoy your ford enjoy your bronco so he gets his car and he drives off and somebody then walked out and goes hey what happened to our demo what happened what happened to our floor model and some salesman probably goes i sold it and the problem is probably twofold that the dealership has a limited amount of inventory they can deal with because this car right now the bronco is so hot they're sold out into the future dealerships can get premiums for them and there are limited allotments going to each dealership so in a situation like that most dealers are going to say if you want one you're going to pay and if you want when you have to get in line and pay meaning that you aren't going to get it today you're going to get it three weeks from now so there's a sales manager who's looking at his sales person going you sold that vehicle for sticker you could have gotten more and the salesman who's just trying to make a sale because it's a couple days before christmas is is up until that point thinking he'd done a good job now he realizes he screws he could have gotten more but the transaction should have ended right there as far as the car buyer was concerned okay there's no need to call the car buyer we have the car back you can't have the car back you sold it legally this is there was no mistake here going back to the corvette case where the woman bought the corvette at a dealership in california had it delivered as a courtesy to a dealer in texas and before she showed up to get it they sold the vehicle they can't do that they can't sell what's not theirs you cannot sell something that's not yours so they're a mistake was made where they have to either get that car back or do something to fix that problem the problem at the dealership in florida is their problem and their problem alone they have no remedy here that deals with mr cedoti they should have called up mr sidodi and just said hey just just to let you know you got a good deal my friend because that wasn't supposed to be sold but we sold it so just merry christmas and remember us in the future because we sold you a vehicle that wasn't supposed to be released for four more months from our inventory so what should have happened is the general manager should have called everybody back in the conference room with bad coffee and said guys we have to talk about something here yesterday we accidentally sold a vehicle off our showroom floor just because someone walks and offers to buy something doesn't mean it's for sale you've got to ask run to find out and in case you didn't know we do get vehicles sometimes that we cannot sell right away for whatever reason one of the stories i read on this suggested that ford had actually put a restriction on the vehicle saying that we're going to give you this vehicle but you have to park it for four months before you sell it simply because we don't want you selling and we need another we need all of our dealerships to have at least one of these on the showroom floor so i can show it to people because they're so hot right now that we cannot meet demand okay so the general manager should have brought the entire sales staff in including the paperwork people and they should say by the way in the future we need a system in place to flag a vehicle that cannot be sold so it doesn't accidentally happen again and that's the solution so the solution is yeah you guys screwed up fix it amongst yourselves don't take it out of the consumer so the good news is they let the guy keep the vehicle i'm going to tell you right now though if they had sued him i would suspect they'd lose on that one it's a question of whether it'd be worth the money to defend it and so on uh on principle yeah all day long i'd fight that one um but the sad part is that anybody can sue anybody i suspect however that a good attorney who deals with automobile law many of these car dealers have got their own attorneys uh their attorney would say guys you sold the car legally it's his car now sorry you made a mistake i suggest you fix your systems i suggest that is probably what you should do here and chalk it up and maybe it's a learning experience for all of us it's a learnative experience for all of us so aaron michael keith nathan dwayne and elliot all sent it action news broadcasting on wfts tampa bay jackie
