hello this is Dr Grande today's question is can I analyze the case of clay and Shannon Starbuck just a reminder I'm not diagnosing anybody in this video only speculating about what could be happening I'll look at the background of this case move to the timeline of the crime then offer my analysis clay Dwayne star was born in September 1964 and eventually lived in Alaska he was an oil worker there during a trip to Florida he met a woman named Shannon and they became romantically involved the couple married in 1990 and lived in Alaska they had two sons together in 2000 the couple divorced Shannon went on to have a son with a different Man 4 months after the divorce the couple reconciled clay and Shannon remarried in 20 0 6 they moved to Deer Park Washington which is 22 mil north of Spokane clay still worked in Alaska therefore he was away from the family quite a bit Shannon took care of the children after the reconciliation the couple had two girls bringing the total number of children in the family to five in 2010 the couple filed for divorce it was finalized in July 2011 by this time clay was not working because his back had been injured during the divorce wor proceedings Shannon was awarded primary custody of the two girls and the son she had with another man these children were under 18 the two older Sons live with Clay both clay and Shannon continued to live in Deer Park less than half a mile apart clay was ordered to pay both child support and maintenance to Shannon his payment was $4,700 a month there was a restraining order in place he was not permitted to go to Shannon's home or workplace despite the restraining order clay would go to Shannon's house on most mornings to pick up the children for school by October 2011 clay owed 9,166 in AAR for his support and maintenance obligations a judgment was ordered against him for this amount plus $500 in attorney fees clay wasn't too happy about this he sent his ex-wife text messages which contained a theme of anger he also asked for more time with their children during this time Shannon was regularly engaging in many short-term sexual relationships this is something that she had history of doing she found men online and a large quantity of explicit images were involved in November 2011 alone Shannon had dated at least 10 men and had sex with most of them she was also maintaining six email addresses for the purposes of communicating with men as far as her career aspirations Shannon was hoping to be a dental assistant and to become financially independent now moving to the timeline of the crime on December 1 2011 clay Starbuck texted his children just before 8: a.m. indicating that his car was not functioning and their mother Shannon would have to take them to school he sent a similar message to Shannon who then drove her children to school at 9:17 a.m. a call was placed from Shannon's cell phone to 911 during the 35 second call the operator did not hear anything intelligible when the operator dialed the number back the call went to voicemail Shannon failed to pick up her children from school that day one of her daughters sent a text message at 2:45 p.m. asking who was going to pick her up a text message came from Shannon's phone 20 minutes later which read dad I have a headache stay there 12 minutes later Shannon's phone sent a text message to clay with read I just woke up can you pick up the kids eventually one of the older Sons picked up the younger children and took them to Clay's residence on December 2 2011 clay called the police and requested a welfare check on his ex-wife Shannon because their children were not able to get into her house to obtain clothing the police responded to the house that Shannon rented and found the doors locked the lights off and a package sitting by the front door they left without doing anything on December 3 a friend of Shannon's called the police and requested a welfare check this time the police had Shannon's landlord unlocked the front door when they entered the residence they found that Shannon had been murdered here's what the police found during the course of their investigation Shannon's naked body was on her bed a sex toy was in her hand and was deployed in a manner consistent with its primary purpose there was an open gun safe near the bed which contained a large quantity of sex toys it looked as though somebody had tried to put them on display the cause of death was strangulation Shannon had injuries on her chest consistent with a stun gun and she had been severely beaten it appeared as though she had died on December 1 2011 the same day that her cell phone had called 911 the police spoke to Clay he told them that his wife was active with online dating and having sex with several different men the police believe that clay was working more diligently than expected to convey this point clay explained to the police what he was doing on December 1 he said that his vehicle had malfunctioned and it became disabled about a mile from his residence he walked back and forth to his residence for times to get tools in an effort to repair it the police found it curious that Clay's cell phone was off for several hours that day furthermore there was a camera mounted to a house along the route that clay would have walked but the camera never captured him the police investigated two of the men Shannon had been dating during the time of the murder Tom and John they were able to verify Tom's Alibi right away he was at work and at a funeral that day the police had to work a little bit to track JN down he made efforts to disguise his identity like communicating with Shannon from public places and using an alias he was a married High School teacher which may explain his furtive Behavior Behavior John told the police that he tried to connect with Shannon on December 1 but she did not respond to phone calls or knocking at the front door of a residence so John admitted to being at her house on the day police believe that Shannon was murdered when John left he received messages from Shannon's cell phone one message invited him to come by later that night he once again went to Shannon's house but there was still no answer at the door eventually the police were able to exclude on as a potential suspect because he was at a Starbucks restaurant around the time that Shannon's cell phone called 911 the police believed that when Jon stopped by Shannon's house later she was already dead in a strange twist paying for Starbucks prevented Jon from being accused of slaying a Starbuck for some reason which remains a mystery the police did not thoroughly investigate the other men who Shannon had been dating at that time DNA tests were conducted at the scene of the murder the results revealed that three unidentified males had contributed DNA found on Shannon's body DNA which could only be identified as coming from a male member of the starbu family was also recovered the DNA could have belonged to clay or his two older Sons Again Clay was not the biological father of the other son the police also found DNA from one unidentified male on Shannon's cell phone DNA from a male member of the Starbuck family was not found on her phone on February 6 2012 clay starbu was arrested and charged with first-degree murder the state's theory of the crime was that clay was waiting in Shannon's house for her to come back from dropping the children off at school he murdered her but did not realize that Shannon had called 911 clay then took the time to pose her body to embarrass her and sent text messages from her phone to make it seem like she was still alive in 2013 clay staruk was found guilty a first-degree murder and sentenced to life in prison without the possibility of parole now moving to my analysis clay starbook maintains his innocence and has a large number of supporters including his children one of his children his daughter Logan brought an end to her own life in December 2021 the four remaining children continued to support their father the state of course believes that Clay's conviction accurately reflected his behavior they argued that he had the motive and the opportunity to commit the murder this brings me to the question was Clay guilty of murder let's take a look at the evidence both fored against the idea that he was guilty starting with the inculpatory factors clay had a motive to murder his wife in the form of owing over $9,000 to her furthermore he may have been jealous that she was having sex with other men on the day of the murder clay said that his vehicle broke down but a camera along the Route he would have walked failed to capture him clay left his cell phone off for several hours that day which meant the phone could not be tracked this seems incredibly convenient under the circumstances the way that Shannon's body was posed after she was murdered suggested that her killer wanted to embarrass her why would a casual sexual partner have done that it is more consistent with a killer who had a long relationship with her DNA from a male member of the starbu family was found on Shannon's body specifically on her neck face and under her fingernails if Shannon was killed at the time she placed the 911 call then the killer must have sent the text messages from her phone one message which was sent at 3:6 p.m. contained a nickname for one of their children how would a casual lover have known about this nickname the only person with a motive to kill Shannon and knowledge of the nickname would have been clay after the murder clay seemed very eager to point out how Shannon was engaging in multiple sexual relationships in Clay's residence the police found Shannon's death certificate on the wall as if it was being displayed moving to the exculpatory factors DNA from three unidentified male contributors was found on Shannon's body some of the DNA was on her neck unidentified male DNA was also found on her cell phone Clay's DNA was not there the DNA from a male member of the Starbuck family on Shannon's body could be explained in many different ways clay and Sons visited the house often and had contact with Shannon around the time she was murdered Shannon was engaging in many different casual sexual encounters this lifestyle is not without risk strange men were frequently coming to her house considering how the primary motivation of the men was to have sex maybe one of them posed Shannon's body to embarrass her even though it is reasonable to believe that Shannon died at the time of the 911 call there is no way to know this for certain this call could have been unrelated to her murder it's also possible that she was in a heated argument with one of her casual lovers called 911 but then things calmed down several hours later this casual lover killed her this means that Shannon could have sent the messages from her phone one witness testified that they observed Clay's car on the side of the road which supports Clay's claim that he broke down the investigation of the murder was terribly mismanaged the police failed to collect evidence and did not test all the evidence which was collected one of Shannon's Sons said that he was the one responsible for the placement of the death certificate it had nothing to do with clay clay owed Shannon a lot of money but he said this was caused by him not being able to work due to his back injury when considering all the evidence in this case do I think that clay starbu was guilty of murder in my opinion he was guilty in reality but I am not convinced Beyond a reasonable out the DNA from unidentified male contributors cannot be dismissed as inconsequential especially considering how DNA was found on the victim's neck and on her phone two areas which the killer would have touched the jury was never allowed to hear the evidence about Shannon's vigorous romantic activity which doesn't make any sense considering one of those casual lovers could have killed her it is a reasonable alternate theory of the crime at the very least clay should receive a fair trial which involves all the evidence being presented what do I think happened in this case this is just a theory my opinion when clay and Shannon divorced for the second time Shannon Cut Loose a little bit as far as exploring sexual activity again she had a habit of doing this but perhaps on this last occasion she was even more energetic than usual clay became jealous and thought that Shannon was being hypocritical based on her strong religious beliefs when Shannon tried to get clay sent to jail based on the aages he decided to kill her he knew that he would be an obvious potential suspect but took comfort in the fact that Shannon had been involved with many different men all those men would be potential suspects along with Clay he wanted to leverage the behavior of Shannon which he objected to in order to conceal her murder during the commission of the murder clay never realized the Channon called 911 therefore instead of immediately fleeing he stayed in her house to her body and send messages from her phone Clay did not need to pose his ex-wife's body in order to highlight her multiple sexual encounters the police would have figured that out eventually Clay did this to be vindictive to him this was about revenge now everyone would know that his wife was living a risky lifestyle and not adhering to her religious values if clay had simply left Shannon's house after the murder he may not have been convicted the problem is he could not resist a chance to embarrass Shannon now moving to my final thoughts there's the sense that clay starbu overestimated how offended people would be by his ex-wife's romantic Behavior he thought that he could kill her and everyone would rally to his defense because his wife had casual sex with men she met online he was fully ready for all those men to be grilled by the police and accused of murder yet the police kept coming right back to Clay he didn't understand the strength and obviousness of his own motive and how murder is more offensive than an energetic
