at the age of 41 kirsty mccall was happier than she'd ever been a new album released to rave reviews a new lover and as she put it the second part of my life to look forward to [Music] pop singer kirsty mccall has been killed in an accident in mexico she was just 41. louise and i was swimming in mummy's blood kirstie was run over by a speedboat and killed in front of her two teenage sons all i want is justice a life has been taken it was hardly an accident when someone dies there's a need to know everything about their final moments a need to understand how and why they died and for a parent the death of a child is a terrible and painful reversal of the natural order of events and so hardest of all to accept [Music] every year at kirsty's house a party is held for jean's birthday it's a chance to gather together many of those who knew and loved kirsty it's also a reminder of a life lived a life abruptly interrupted and the house reverberates with memories of the past family gatherings and shared [Music] celebrations kirsty mccall was born on october the 10th 1959 the second child of jean newlove a dancer and choreographer and british folk singer ewan mccall ewan left jean for american folk singer peggy sega when kirsty was very young well i had a very close relationship with kirsty because when she was young she suffered from asthma quite badly and so in the first few years of her schooling she was hardly ever at school kirsty's brother hamish was nine years older than her we got on very well but um she was very bossy and she needed to be the boss and it was very hard for me not to let her be the boss because she'd been so ill when she was young it was several times she nearly died you just felt very supportive of her you just couldn't help it even as a child kirsty had a reputation for being feisty and outspoken you couldn't [ __ ] her at all she was she was very much on the ball i would read something to her you know before i thought she could read and i would leave it at the most exciting part hoping that she would want me to teach her to read you see and i'd come back and um i remember one day coming back and saying well if you like now i'll finish that story and she looked at me well i've read it haven't i and of course i didn't know she could read despite her lack of formal education jeanne soon realized that kirstie was highly intelligent and at the age of seven she was chosen to participate in a bbc program about gifted children while her reading and her arithmetic apparently are that of a nine to nine and a half year old child this in spite of the fact of course that she's hardly had any schooling because of her asthma yes what about your other school i'm telling you didn't like that very much no why not [Music] they were rather strict which is horrible as her asthma improved kirsty had to settle in a mainstream school there was a kind of huge pressure to be like everybody else and i wasn't like everybody else i was always a bit of a rank outsider really so that just stayed it was perhaps because of these feelings of alienation that kirsty soon found her form of expression and wrote and performed her first song at the age of 11 for a school play [Music] i remember consciously as a teenager and from the ages of like 12 onwards thinking right if i can get through to being an adult without killing myself then everything will be all right you know i used to think that all the time having survived to the age of 16 kirsty briefly became mandy doubt i left school and joined a punk band and uh i never really had any intention of um doing anything else if i could possibly help what was the band it was just a dreadful band but which i tried nah come on they were the subtly named drug addicts oh i remember you guys how are you done you had a little indie single out what about 12 15 years ago that's right yeah yeah see i've been here for a while too i was very young then it wasn't all my fault oh how young um 17. stiff records hated the band but loved her she joined their stable of iconoclasts which numbered ian jury and elvis costello it was a very exciting time you know this is 1979. it was sort of post-punk and it wasn't just about making money um or being famous you know it's about trying to do something original and certainly kirsty had a really original voice something that he still hasn't been equaled or matched she was very driven but without any obvious sense of ego in 1979 stiff released her first solo single they don't know but a distribution strike prevented it from becoming a hit for kirsty you couldn't actually buy it in the shops even if you wanted to but every time you turned on the radio it was on you know on any station a few years later tracy ullman covered it with kirsty not only singing backing vocals but also hitting the high notes that tracy allman couldn't reach it was a big hit reaching number two in the uk charts and number eight in the states where it launched tracy ullman's american career but kirsty's next inspiration was to put her in the top 20. she rang me up and she said look i've got an idea for a song i said what's that and she said there's a guy works down the chip shop swears his elvis i said that's great i said let me work on it for a while i'll call you back so i hung up the phone and i was i was in the middle of playing my guitar anyway and so i just uh fooled around i think in half an hour i rang her back and said look i've got something you know that's obviously the chorus and there's a guy works down the chip shop swears [Music] [Music] kirsty's first album hardly dented the charts but she was universally admired by other musicians and in demand as a backing singer while singing backing vocals for simple minds kirsty met top record producer steve lillywhite i remember seeing her and as she was singing going oh she's a bit of all right and um getting her phone number afterwards now she thought the phone number was just to you know because i was interested in working with her but it wasn't uh it was to take her out and and it was a pretty much a whirlwind romance first thing i said in 1984 was will you marry me it was very romantic i mean the reality of our marriage is something else but it started off very nice in august 1984 kirsty mccall and steve lillywhite married kirsty's dad gave her away at the wedding which was deemed a very significant thing because he doesn't do that sort of thing for the next 10 years steve was to be not only her husband but also her producer we never argued once when we worked together uh it was a pretty good working relationship i think i was good at getting her vocals i was good with her as a singer within months of their marriage kirsty had her first top 10 hit who is celebrating the biggest hit record ever the biggest stomach ever as well good luck with the baby kirsty kirsty mcconnell i can always date a new england her single because she was pregnant in the video and we play our eldest son jamie [Music] jamie's birth was followed 18 months later by louise and kirsty disappeared from the public eye well after i got married and got pregnant and had a couple of kids i wasn't really sort of writing that much at the time and i didn't want to put out a load of cover records so i sort of took a bit of time off and did some backing vocals for other people but it wasn't just motherhood keeping her out of the limelight she'd become increasingly reluctant to perform live or on television i didn't have any confidence at all as a performing artist you know because i think an audience goes in expecting some kind of you know bravado which i didn't have you know i never went in to the music business thinking i really want to be on tv i want everyone to know who i am she liked her privacy very much and um she thought a lot of it was total [ __ ] but at the same time she liked the glamour you like being recognized a little bit you know like everyone does when it doesn't intrude on your lifestyle maybe that was subconsciously why she didn't want to to play the game and and and have that killer thing that say madonna has got but everyone was about to know kirsty's name and voice steve took the song back to her to play it to her just simply i think to get some kind of idea of how it would sound you know how you know trying to sort of figure out the way it was going to go and um and she sang it like she was born to sing it tell of new york not only put kirsty back in the charts but also back on stage always got such a huge welcome when she when she came out you know from the fans i think she also found you know that we were pretty easy to to work with contrary to what people might might think we're actually we were you know quite sort of quite a friendly approachable bunch really school fairy tale in new york it was great when she when we used to do the song live um and there's that line where um shane goes um you know i could have been someone and kirsty sings back well so could anyone and the whole crowd used to sort of sing that with her [Music] she really was like a sort of ninth poet really a ninth member of the band over the next two years kirsty released two albums and traveled the world to promote them steve was incredibly busy at the time was the record producer she was having her career he was having his and my relationship with kirsty i've always described was i was probably everything but her lover i was her chaperone and her driver and her pa and her photographer i mean she'd take me on shoot sometimes just to keep her company charles dickens a r man ice photographer man about town there he is just perusing the charts over there his central park looking mighty nice today my time with kirsty was was was spent around making a painless photography session so i'd spend two weeks with her somewhere in france or in america or something during which we would shoot a lot if she could have been an anonymous superstar she would have been her new fan success didn't make her any more comfortable with public exposure it never came across as a big plan to be you know like a superstar or you know that they were her songs usually and you know they came from within her i was deeply depressed as an adolescent and a child really and and for a lot later on as well and you know the one thing that made me feel like a whole person was listening to music i think all people who have any kind of intellect get depressed it's inevitable it's like you can't stop thinking and the more you think about things the more depressed you get so it's she did get very depressed at times and that was just too much thinking not enough doing they smile the busy nature of their respective lives was taking its toll on kirsty and steve's relationship had such a biting wit about her lyrics she always claimed they were never about me uh and then i remember having a conversation he said oh i think some of these songs were about you pretty much 10 years to the day we decided to call it quits and it was pretty amicable which it always has to be of course when you have children marriages fail you know there's nothing wrong with that but the records live and that's the main thing newly single kirsty asked hamish to move in i ended up staying for about a year and a half and looking after the kids and taking them to school and making their lunches and breakfasts and all the other things oh it's uncle hey mitchell over there hello how old are you today 16. permission to pass okay agent jamie lillywhite decide permission granted permission granted thank you [Music] kirsty used her newfound freedom to explore a new musical style i did this song called my affair and i recorded it in new york with a bunch of latin musicians who were all fantastic and it was such a lot of fun um it was the most fun i'd ever had in the studio really [Applause] this was the start of kirsty's love affair with latin america her frequent visits to cuba and brazil provided her with fresh musical inspiration while her personal life continued to feed her often intensely autobiographical lyrics she's been on her own for a little while and then i mean i think it's probably quite public knowledge about the um brazil song the football song yes when she'd been out on a date with this guy and it all went tits up you lied about your stature you lied about your life [Music] i knew perfectly well and i kind of felt that from her that as long as i was there she wasn't going to find a boyfriend you know that was basically it so um when i did move out that's when she met james she was looking for a saxophonist for one of her songs and i'd just taken up the sax and so i was like yeah hmm i know this great guy he's he's fantastic you know he's really really cool really funny and amazing at the sax and so she goes up maybe i'll give the school a call okay let's have it [Music] [Music] we're gonna go out and see a latin show over here wasn't it um and it was supposedly going to be like five of us and it just ended up being me and kirsty and i'm pretty sure she hadn't planned that but if she had it you know it was very well done but i'm sure she hadn't done and uh and that that was it really after that i was sort of pretty much inseparable i guess after that she didn't tell me till about six months after they started going out but in fact i knew from really soon because i remember she gave me this it was a waterproof radio for the shower and i managed to pick up the frequency of the phone and um i remember hearing a conversation between these two ladies yeah it was kind of uh not a secret but i think she was a little bit apprehensive because james was quite a bit younger she was pretty militant from the outset about how it was going to be and where but that suited me anyway she's sort of like well you know you're not going to mess me about it's like no i'm not going to miss you about and um and uh and i think once i proved that pretty quickly that that that wasn't going to be the case then she was you know she was that was fine everything worked out really well you know she asked me to move in fairly quickly and so i did and i loved it you know she loved me too everything was going right for her it was just such a tragedy really because she was the happiest which is nice in a way to know that that she was one of the happiest that she'd been in you know for years yeah it was just i think for her that initial thing you know of going you know i've got a toy boy we were like yeah go for it it was good now we welcome back to the show uh with a new and exciting cuban sound a very talented woman indeed i speak of kirsty mccull she ended up enjoying performing more than she ever had done before she knew that if she did feel nervous or whatever she only had to look across and i'd be standing next to her so i think that bastard her confidence probably quite a lot [Music] i mean she always had fantastic bands i'm not getting anything away from that because that'd be ludicrous but i think having having me there as well probably made a difference [Applause] [Music] let's do it here in march 2000 kirsty released a new album tropical brainstorm she was happy successful and embarking on the second part of her life he said she wanted to take the boys on this holiday uh and introduce them to scuba diving and she'd just come back from cuba and this was the end of the year when it was a holiday to be remembered she did have these kind of moments of of doubt about her own you know how long she was going to live and stuff she was convinced she was going to die young kirsty james jamie and louis arrived in cozumel in december 2000 planning to be home in time for christmas on december the 18th kirsty took her two sons for their first dive i had this this feeling that something was going to happen i i thought it was something to do with jamie i thought i had the feeling that jamie was gonna hit his head or something just this really strong feeling but i ignored it it's just the most incredible dive we saw everything's just an amazing amazing experience when you're underwater and you look at someone all the colors taken out of their skin and i remember looking at her and all the colors taken out of her face and that kind of that kind of linked in with the feeling that i got um when we got on we came up from the dive i was the first one up and then i heard i heard the dive master ivan say watch out and i i looked behind me and there was this boat coming at some considerable speed and i managed to get out the way i think she pushed me and jamie out of the way pushing her sons to safety was to be kirsty's last action a moment later the boat hit her mutilating and killing her in front of her teenage sons i wanted to do was swim over to the boat that actually come across and you know show them what i felt but i mean what can a 13 year old 0.2 really back on land james was quickly brought to a nearby beach but no one was willing to break the news to him i found out from jamie and louie not from anybody else because no one would tell me because i guess no one wanted responsibility of telling me which is pretty pathetic to leave it to to leave it to you know two children we just ran into his arms like telling him what happened and then he sort of took over from there um but yeah i think that's probably memory that's not going to go away quickly i got flown straight down to mexico it was such a third world sort of situation [Music] that it was all a bit of a blur and really all we wanted to do was to get out of there because there was nothing going to bring their mum back the phone rang and it was james cursed his partner and he said there's been an accident they said and i'm afraid kirsty's dead and i just couldn't believe this i thought this is not happening is it you know hurt maybe how why whatever it was a boating accident the boys are all right but kirsty is dead and that was so final it's so unexpected so shocking in that moment everything changed and jean found herself facing what every mother fears most i went into this empty house with parcels partially wrapped for christmas everything just as it had been left [Music] i didn't want them to come back to an empty house and then the bell rang and i saw these figures at the door we ate i guess something but i don't again i don't i don't remember a massive amount about it i mean your brain just blocks those things out i think you know but um yeah it was really difficult my dad was saying you know do you want uh do you want a counselor because it may help with later and i was just like no i don't want to do this and he goes well just try once and so i did and you can't really talk to someone you don't know about things like that their whole thing was we're fine dad um you know louis did say that he got closure they did get immediate closure they know what happened they know that's it you know i've lost somebody that um that i was completely in love with and i obviously always will be to a certain extent i don't regret a minute of the time that i spent with her at all it's far better to have loved and lost and not so loved at all [Music] but jean's grief was irreconcilable with her daughter's body still in mexico she was left waiting for more information we weren't told anything we never heard anything from the foreign office we didn't hear anything from anybody we didn't hear anything from the the the mexicans you know i expected when the news came through i thought well the foreign office of course will will be up in arms about a citizen of theirs being killed in mexico uh i mean it could be an accident it could be murder and one expected them to investigate two weeks later kirsty's body was flown home and a funeral held jean felt certain there must be more to the accident than simple misadventure so she hired a private investigator and in cozumel he found that those involved disagreed witnesses to the accident said the boat was traveling at a speed of 15 to 20 knots in a protected area but the owner of the boat guillermo gonzalez nova said he was outside the protected area traveling at less than two knots it appeared that an unqualified 26 year old boat hand who didn't know his left from his right was at the helm at the time of the accident at the trial in march 2003 the diving company kirstie had used was found guilty of failing to display the correct flag and marker boys no charges were brought against senor gonzalez nova but his boat hand juan jose senia was found guilty of culpable homicide [Music] good evening the heartbroken mother of singer kirsty mccoll has reacted furiously after the man convicted of causing her daughter's death was fined just 61 pounds i had to tell my grandchildren on mother's day that their mother's life was worth 61 pounds i found it really hard i went through a bad stage i got quite depressed but you know my friends really helped me out of that we were absolutely outraged and i said to gene this cannot be allowed to pass we will fight this no we wanted justice and so jeanne devoted herself to setting up the justice for kirsty campaign although a civil case had been settled with the boat's insurers it did not answer her questions she discovered that much of the evidence that the private investigator had uncovered had not been presented at the criminal trial she engaged the services of a lawyer in mexico and realized that the campaign would need expert help at home it became very clear to me at an early stage that this this case was not properly investigated the investigators didn't investigate the prosecutor didn't prosecute and the judge didn't sentence in an appropriate manner the boat that killed kirsty is owned by a wealthy and influential mexican businessman guillermo gonzalez nova the truth has not come out yet i'm going back to cozumel yes and i'm going to make more inquiries because we know that there were people there who were willing to give statements who were never asked and there are many many discrepancies and we want to try and sort these out she's here with so many of her questions still unanswered jean finds it impossible to let go of the past for a mother to feel that she can get some closure and some justice for the tragic premature death of her daughter is something that everybody can relate to jean wants to do it you know it's jean's thing she's her mom and it's not appropriate necessarily for her sons to want to do it or for james or for other people but it's appropriate for her you know to put some closure onto it and to try to get some some sense of satisfaction some justice i have i can't have the luxury of tears that's just i have to keep focused tears don't get you anywhere at all it's just self-indulgence i am focused on finding out the truth and in the people i believe are really responsible to trial [Music] in march of 2004 jean now 81 and with failing eyesight travels 6000 miles to cozumel cozumel two hours flight from mexico city has a population of just over seventy five thousand most of whom are entirely dependent on the millions of tourists who visit each year drawn just as kirsty was by the island's spectacular snorkeling and diving [Music] we went to a corona beach which is where kirstie's body was brought to the shore and i was looking around at the sea and the sun set and half of me was understanding how she loved it there the other half so angry so mad that the person who perpetrated this had done nothing or said nothing to in a way make any closure had not expressed any regret and his sadness for us and had not been charged with anything [Music] over the next few days jean and her campaign members will gather testimonies in order to file papers with the federal prosecutor in the hope of persuading him to review the evidence we have serious questions about due process questions about how witness statements were taken questions about how the prosecutor prosecuted questions about gonzalez nova using undue influence to affect the outcome of the proceedings even though we have those reservations and concerns what what can we do about that can we do anything right the matter cannot be reopened however new facts can be tried as per the findings that we for you have in the private investigation that we have conducted we're very fortunate in that we have very good legal team who have been with gene from day one during the investigations and they're the new breed of lawyers that care about justice and are prepared to go that extra mile prepared to cross that line prepared to stick their necks out prepared to challenge the authorities from a legal basis gene believes that there are witnesses whose testimonies were never properly presented in court in england she received a letter from ivan diaz kirsty's dive master in it he made a number of new and shocking allegations [Music] i've heard a lot of rumors and i want you to take me through exactly what happened when we get to the surface uh koski was facing me and the two boys were kind of facing each other i noticed that the percolito was coming and the closer it was getting to us i thought there was no way yeah was it coming it was coming very fast my personal opinion has minimum 16 80 knots an hour felipe put is another important witness as the captain of nearby diving vessel the nazarino he got hit in the chest and i was pushed away and i heard like a something hitting the uh the plastic equipment i just heard it crack and then i saw the bloody all around us and the boat didn't stop at that point the boat is they didn't stop at first it tried to continue going continue with her body yes yeah well actually the body was already there laying the chopped up practically and it was chopped up yes yes i'm sorry it's all right go on tell me i looked around and i noticed that the nazarena boat was closer to us so i asked the nazarino don't let these guys get away from they came around and they stayed at as close as 15 yards away from us they never got closer to us to at least they provide some help or anything they could see my daughter's body in the water and they did nothing to help right they didn't do anything they didn't do anything [Music] [Music] [Music] kirsty's body was brought to the beach and investigations began corona authorities asked who was driving the boat or who's responsible of the boat i am mr gonzalez said i am the owner and i was driving the boat at the moment of the accident but a few hours after the accident the boathand juan jose sanyam stated in his testimony that he was the driver of the boat and not gonzales nova there has consistently been confusion over who was actually driving the boat the spanish word gonzalez nova used tiripular is ambiguous and can mean in command or at the helm the day after the accident captain of court sent somebody to call mr gonzalez to come in to give his testimony yes and his yeah this person whoever he was i assumed that he was one of the employees at house yes he said that mr gonzalez can't come right now because he's arresting me so he doesn't want to be disturbed as the day wore on and ivan waited to give his statement he became increasingly bewildered and concerned by the port authority's casual response to the accident they were telling me why don't you sign up this piece of paper and we will fill it out later on it was blank was it it was blank yes and i said no no way i will sign something i cannot read no so i don't care how long it will take but i must read it before i signed it so i waited the whole day from eight o'clock in the morning until seven all day all day yes the whole day i was expanded at the office without giving my testimony yet are you afraid of the consequences for yourself most of the times i think i'm not afraid i'm not afraid ivan's experiences that day destroyed his confidence and led him to abandon his 30-year career as a dive master you've been a very brave man thank you i've been trying to hold your hand yeah i know you have sometimes i feel like i'm about ready to crack down we went and saw the percolito the damned boat that had killed kirsty [Music] it was moored looking very new very pristine in every way and we think that somewhere behind that boat was the house that gonzalez kept for the summer guillermo gonzalez nova is chairman of a largely family-owned business ccm controlladora commercial mexicana it's mexico's second largest retailer and its revenues from food retailing alone came to 3.1 billion dollars in 2002. ricardo velazquez is a director of channel 10 cozumel's local tv station response el capitan gene's presence on the island has not gone unnoticed we've had an article in the local newspaper and that's been well received there are a few inaccuracies in it but um as a result of that that's created awareness and that awareness has reached state governor level his office contacts gene hello i just uh wanted to speak to you mr mccoll on behalf of the governor of the state and just to say that well we regret deeply the problem with your daughter okay we want to uh provide you all the support that you are looking for i will attend if you need something and if it is necessary this is the very first time that anyone has offered any sympathy or regret for this accident so that was very warming to me i mentioned that i would like to speak to mr guillermo gonzalez nova and inquire about the accident i was not asking for anything else but the simple facts regarding the accident the account of the accident that gonzalez nova gave in december 2000 differs from ivan's version of events jean is taking ivan to meet dimitrio and fred her application will be asking the federal prosecutor to examine the discrepancies in people's statements and try and clear up just who should be considered responsible in law for having control of the boat you met samyam again when you were waiting to give you a witness statement yes yes yes i met him at the public ministry office so at that moment he said that he was driving the boat and i turned around and i told you in a private no he told me at the uh a public minister then i turned around and i grabbed his shirt and i shook him up and i asked him why are you changing the story now when mr gonzalez nova already admitted at play corona he was driving the boat and now you're saying that you are you were driving the boat when i saw you jumping from the back forward so that means you weren't driving the boat did you uh testify on that did you clarify that yes i did tell these guys and they said it's none of your business it's our problem we will take care of that i i believe it i believe ivan dear so i've had the opportunity and the privilege to meet him he's a man of integrity and i do believe him within hours of the accident gonzalez nova had flown his lawyers in from mexico city they were received immediately by the authorities and he and his party gave their statements first whilst other key witnesses were kept waiting is [Music] fine for culpable homicide was 61 pounds additionally he was ordered to pay 1 450 pounds compensation to kirsty's sons a sum calculated on the basis of his small salary gonzalez nova as captain of the vessel where was his responsibility that his his fine had he had been found responsible his fine would be would have been commuted in some way related to his salary that would have left a significant hole in his pocket none of the officials involved in the original investigation were available for comment jean was told they were all in new postings outside cozumel [Music] but she did find gonzales nova's beachfront holiday home and the team went to ask him for his comments [Music] hello [Music] [Music] his son didn't contact jean and mr gonzalez nova has never responded to any of her numerous attempts to make contact with him i am so mad i am so focused on getting this this man to admit guilt as he should how he can live with himself i don't know i couldn't do that and i think [Music] he's got to admit his guilt but he hasn't done it i don't know if he ever will today jean will file her dossier with the federal prosecutor she has clear witness statements about the speed and location of the boat and who was driving it at the time of the accident she's also asking the prosecutor to examine whether there may be grounds to bring charges of perjury how are you okay because of the investigations that we completed this week and the talks conversations we had with ivan and with with you as well and the people that we have met i think that we should go and push harder for the memorandum that will have the most important impact which is the memorandum at the federal level and mexico already has federal laws to protect divers in restricted areas gene wants to ensure that the violation of these laws which resulted in kirsty's death does not go unpunished the prosecutor at the federal level should be advised that this is a crime that should also be considered a crime of federal nature okay supposing they take time and they study it do you think there is a uh there's any likelihood then that they might say no it's closed well we are prepared to face that if they reject the documents once they receive the documents they have to render at least a preliminary conclusion and either reject or or go for the process of retrying the facts this is a mother's quest for justice for her daughter's untimely death but it has far-reaching implications for cozumel's thriving tourist industry and for mexico's international reputation if we do not get this issue properly addressed if there are any irregularities with this new case if they fail to take it up then the next court case will be against the state of mexico in the inter-american commission of human rights when kirsty died jean embarked on a journey a journey that was to take over three years to bring her here to this first opportunity to confront the mexican authorities with what she believes to be the truth [Music] [Music] remedy but the prosecutor doesn't want to get involved [Music] i believe he was either in a hurry or not willing to take a case which has already been tried at some point with facts that have already been tried at some point at the at the state level well it's always been like this from day one hasn't it one step forward two steps back but we're getting there you know who said it was going to be easy no we'll be there we'll get we'll get there although the prosecutor is reluctant to examine the papers they decide to wait outside until he does i will not recommend that we leave or that we leave this unattended they need to know that we are here and they need to to have pressure on us aware that they're outside his office the prosecutor reads the papers and after a two-hour wait they're called back in finally the prosecutor has
