The selling of Puma Path home

a lot of things have happened in the last few weeks regarding suzanne morphew her home in maysville colorado has sold even though she remains a missing person and her body has not been recovered let's go over how suzanne's husband barry was able to sell their home without suzanne's consent [Music] i want to preface that i am not an attorney just a reporter digging into some of the court documents that i have found these are my understanding of the court documents i think it's important to explain how the property could sell and the process barry went through to make it happen if you remember barry filed for guardianship june 1st less than a month after suzanne went missing the court granted him temporary guardianship on june 5th so that he could sell two properties with suzanne's name on them one was a vacant lot and the other was suzanne's and barry's former home a property which barry told me was already under contract before suzanne went missing on may 10th of 2020. on july 9th barry sold their indiana home it appears that when guardianship is granted the indiana court issues letters of guardianship which is the legal document giving the guardian barry official authority to do business for their ward suzanne barry's case summary shows that the process was completed and the letters were issued immediately for the temporary guardianship but things look a bit different for the permanent guardianship that was granted in hamilton county indiana on september 2nd 2020 when it took months before the letters were finally issued on january 20th 2021 just one day before berry petitioned the court for another approval for real estate transactions presumably submitting at that time his intent to sell the puma path home in maysville colorado what follows is what appears to be the process used to transfer barry's authority from indiana to colorado the colorado courts require that a foreign conservator like barry register his letters of guardianship from another state in order for colorado to recognize his authority without those letters barry couldn't sell their home in colorado on february 23 2021 the combined courts of chaffey county in colorado filed barry's indiana letters of guardianship stating that barry morphew had the authority of the guardian of suzanne morphy in the state of indiana two days later chaffey county district court issued a certificate of registration and recognition which appears to reference the indiana letters of guardianship as evidence of barry's authority to act as suzanne's guardian it appears that this certificate gives barry the permission to exercise in colorado all the powers granted by the indiana court except actions prohibited by colorado law according to my understanding of colorado law suzanne will get at least half of the proceeds from the sale of puma path home which barry sold for a little more than 1.6 million dollars on march 3rd as for guardian barry has the legal duty to preserve suzanne's assets there should be nothing mysterious or secretive about the actions a guardian takes for his ward as a matter of fact indiana courts require a strict and thorough accountability by the guardian for their wards checking account payments from the checking account may include any valid claims against the wards such as medical bills taxes and could even reasonably cover the ward's dependence cost of living the court will hold the guardian personally liable for negligent payments of invalid claims any unordinary or outstanding amounts are required to be pre-approved by the court and all payments go through a strict accountability system submitted by the guardian to the court in mandatory reports in short it appears that barry chose to have his indiana guardianship registered and recognized in the state of colorado for the purpose of a real estate transaction presumably puma path and it's worth mentioning that it was all done in what appears to be a lawful and orderly manner it's easy to understand that some families are in great need of controlling their missing loved ones estate just to make ends meet but according to statements made by suzanne's family that need isn't evident in this case since suzanne didn't make an annual income and her family wasn't ever dependent on her financial contribution to make ends meet this begs the question why do all this now why not wait until suzanne has been declared deceased why get rid of everything and sell all your wife's assets if you want her to return why go through all this trouble just to have her portion of the sale tied up in what could become an accounting nightmare through the courts it seems to be so much extra work for the guardian and little to no benefits to the ward so who is actually benefiting from this process and how are they benefiting time will tell i remember speaking with jean morman suzanne's dad about barry filing for guardianship something he was in total shock that barry would be asking about when his wife hadn't been missing for that long at the time only a few weeks had passed since she was first reported missing jean told me that barry wanted him to sign off for suzanne so that they could initially sell the home in indiana you could say suzanne's family thought it was very inappropriate at the time to ask suzanne's sister melinda wanted me to share this statement quote my faith and my family's faith rests fully in the support and work of the law enforcement agencies assigned to find our sister suzanne we trust that god is using the full weight of these authorities to bring about justice for suzanne we hold them all in highest regard and continue to pray that god gives them strength and abilities beyond what is their own and finding suzanne we remain deeply
