STORY TONIGHT. STAY RIGHT THERE BECAUSE MORE NEWS IS ON THE WAY. >> GOOD EVENING AND THANK YOU FOR TUNING IN. COMING TO YOU FROM NEW YORK HERE'S A LOOK AT THE STORIES WE ARE WATCHING TONIGHT. STARTING WITH GRAND JURY TESTIMONY FROM A FORMER AIDE TO DONALD TRUMP WHO WAS BOOKED IN ON JANUARY 6. THE YEARS WORTH OF WORK AND THE SPECIAL COUNSEL'S OFFICE. >>> ONE REPUBLICAN WANTS TO THROW AWAY DONALD TRUMP'S IMPEACHMENT. AND THE DETAILS THAT ARE EVEN POSSIBLE. >>> NORTH KOREA REMAINS VIOLENCE ABOUT THE U.S. SOLDIER IN THEIR CUSTODY BUT THE SOLDIER'S FAMILY IS SPEAKING OUT. >>> IT SOUNDS LIKE A NO- BRAINER, CARS CAPABLE OF HARNESSING ENERGY FROM THE SUN. >> IS THIS THE FORCED SOLAR PRODUCED VEHICLE ON THE MARKET? >> IT SHOULD BE THE FIRST MASS PRODUCE SOLAR ELECTRIC CAR. YES. FOR DEVELOPMENTS IN THE DOJ'S PROBE OF THE 2020 ELECTION MEDDLING AND JANUARY 6 RIOTS. A FORMER WHITE HOUSE AIDE TESTIFYING IN FRONT OF THE FEDERAL GRAND JURY IN WASHINGTON DC. HE WAS WITH FROM FOR MOST OF THE DAY ON JANUARY 6 AND WORKS FOR THE TRUMP PRESIDENTIAL CAMPAIGN AND RUSSELL WAS NOT THE ONLY TRUMP AIDE INVOLVED WITH THE INVESTIGATION. LEARNING TODAY THE FORMER TRUMP ATTORNEY RUDY GIULIANI WAS ON THE SPECIAL COUNSEL JACK SMITH TEAM EARLIER THIS YEAR. HE HAS NOT RECEIVED A TARGET LETTER. THAT'S SOMETHING TRUMP SAYS HE RECEIVED FROM THE DEPARTMENT OF JUSTICE ON SUNDAY GIVING HIM UNTIL TODAY TO TESTIFY IN FRONT OF A GRAND JURY WHICH HE DID NOT DO. >>> RYAN RILEY JOINS ME NOW. RYAN, WILLIAM RUSSELL IS THE NAME ONE OF US HAD NEVER HEARD OF UNTIL TODAY. WHO IS HE? DO WE KNOW ANYTHING OF HIS TESTIMONY? >> Reporter: A TRUMP AIDE FOR THE PRESIDENT FOR AT LEAST PART OF THE DAY ON JANUARY 6, THERE ARE NUMEROUS INVESTIGATIONS. IT'S ABOUT THE ENTIRE TIME AFTER THE ELECTION AND INVOLVES POTENTIALLY A FAKE ELECTION SCHEME AND A LOT OF THE FUNDRAISING METHODS THAT THE TRUMP CAMPAIGN HAD DONE TELLING SUPPORTERS THEY ARE PUTTING MONEY INTO THIS WHEN IT WAS JUST GOING BACK TO THE CAMPAIGN. SO I THINK THAT IS SOMEONE WHO COULD GIVE A LOT OF INSIGHT, POTENTIALLY TO WHAT THE PRESIDENT WAS THINKING WHETHER OR NOT HE ACTUALLY BELIEVES IT'S ABOUT THE 2020 ELECTION. IT DOESN'T MATTER IN THE END IF HE ACTUALLY BELIEVES THESE LIES AS LONG AS THERE IS EVIDENCE THAT HE SHOULDN'T HAVE BELIEVED THE INFORMATION AND HE HAD ENOUGH INFORMATION BEFORE HIM BUT KNOWING THAT THE LIES WERE NOT ACTUALLY TRUE, THIS IS SOMEONE OBVIOUSLY THAT THE SPECIAL COUNSEL HAS SHOWN INTEREST IN GIVEN THERE'S BEEN MULTIPLE TIMES HE'S COME INTO THE GRAND JURY AT THIS POINT. TALKING ABOUT HIS EXPERIENCE DURING THAT TIME LEADING UP TO JANUARY 5. >> IS THERE ANY INSIGHT INTO THE TIMING OF THIS TESTIMONY WAS HE CALLED BEFORE OR AFTER TRUMP RECEIVED THE TARGET LETTER? >> BASED ON THIS. THERE'S A CERTAIN AMOUNT OF WARNING BEFORE PEOPLE HAVE TO COME IN. WE KNOW THAT BECAUSE THE FACT HIS LAWYER STAN WOODWARD WAS IN TRIAL LAST WEEK AND THE VERDICT CAME BACK. THERE WAS A LOT OF COURT ROOM DRAMA. THE AID OF COURSE IN ANOTHER CASE. REPRESENTING ANOTHER OF THOSE IN THE TRUMP WORLD. REPRESENTING AN ADMINISTRATION PHYSICALLY STORM IN THE CAPITAL ON JANUARY 6. THIS INDIVIDUAL GOT THE TRIAL. THE VERDICT CAME BACK. THERE WAS A MOMENT WHERE WOODWARD WAS 25 MINUTES LATE FOR THE HEARING HE WAS SUPPOSED TO BE IN AT 2:00 PM. HE HAD TO EXPLAIN TO THE JUDGE AND TALKED TO THE JUDGE. HE HAD HIM EXPLAIN THIS PUBLICLY SAYING THAT THERE WAS THIS GRAND JURY MATTER THAT WAS TAKING UP A LOT OF TIME. IT GOT INTO THE QUESTIONS OF THE EXECUTIVE PRIVILEGE. AND AFTER THAT THE JUDGE IN THAT CASE CALLED THEM. FROM THE SPECIAL COUNSEL OFFICE, EXPLAINING EXACTLY WHAT HAPPENED. WOODWARD WAS UNDER THE IMPRESSION HE WOULD BE ABLE TO BE RELEASED. THEY WOULD BE QUESTIONING HIM BECAUSE HE HAD A PRIOR COMMITMENT TO GET THE VERDICT IN THIS CASE. A LOT OF DRAMA WITH ANOTHER JUDGE PULLING DOWN PROSECUTORS FROM THE GRAND JURY DURING THE PROCEEDINGS. I DON'T KNOW IF THAT WILL DELAY OR IF THERE WERE PLANS FOR THE INDICTMENT TODAY OR IF THIS WOULD BE SOMETHING THAT WOULD CAUSE DELAYS. WE WILL HAVE TO BRING HIM BACK TO FINISH TESTIMONY AT SOME POINT. >> ALL RIGHT WE WILL CATCH UP WITH YOU WHEN WE FIGURE THIS OUT. >>> ON CAPITOL HILL LAWMAKERS SPENDING ALL DAY RESPONDING TO REPORTING THAT HELPED SPEAKER KEVIN McCARTHY PROMISED TO HOLD A VOTE THROUGH EXPUNGED TRUMP TO IMPEACHMENT. THE FORMER PRESIDENT HAD BEEN UPSET McCARTHY HAD NOT ENDORSED HIS CAMPAIGN SO THE DEAL WAS REPORTEDLY ON THE TABLE TO TRY TO EXCLUDE HIM OVER THAT RELATIONSHIP. McCARTHY SAYS NO SUCH DEAL EXISTS. >> THIS COULD BE PURELY FOR POLITICAL PURPOSES. THERE'S NO DEAL OUT THERE. >> NBC NEWS LEGAL ANALYST JOINS ME NOW. LET'S TALK ABOUT THIS EXPUNGEMENT. HOW WOULD THIS EVEN WORK? THE VOTES EXIST IN THE CONGRESSIONAL RECORD. COULD THOMAS GO BACK AND WIPE SOMETHING FROM THE CONGRESSIONAL RECORD? >> ON THE PHILOSOPHICAL PARADOX OF EXPUNGEMENT. I HANDLE A LOT OF THESE, THEY ARE TYPICALLY CREATED BY STATUTES. LOW-LEVEL CRIME. THEY ARE CREATURE OF STATE LAW BUT BASICALLY YOUR QUESTION IS PROBABLY THE PROBLEM WITH EXPUNGEMENT. ERASING A RECORD, HOW DO YOU KNOW WHATEVER HAPPENED. A COMMON THING WHEN PEOPLE GET A DUI EXPUNGED, THEY GO THROUGH LIFE WONDERING TECHNICALLY THE RECORD COULD BE OUT THERE, COULD I SAY HAVE BEEN ARRESTED OR HAVE I NOT BEEN ARRESTED? IN THIS CASE THERE IS PROBABLY NOT AN OPTION FOR EXPUNGEMENT BECAUSE EXPUNGEMENT'S ARE CREATED BY LAW, SPECIFIC LAWS ALLOWING YOU TO EXPUNGE A RECORD . IN THIS CASE IT'S SOMETHING WITH A CREATIVE IDEA. MAYBE THE HOUSE COULD VOTE FOR IT. IT DOESN'T MATTER BECAUSE IT WILL EXIST IN THE CONGRESSIONAL RECORD WHETHER OR NOT THEY VOTE FOR IT. >> THERE WERE TWO PIECES OF LEGISLATION INTRODUCED BY HOUSE REPUBLICANS. THEY WERE ABOUT THIS IDEA OF CLEARING THE RECORD. EVEN IF IT PASSED THROUGH THE HOUSE THERE IS NO WAY THIS WOULD GET THROUGH THE DEMOCRATIC-CONTROLLED SENATE BECAUSE THEY HAVEN'T VOTED ON THIS JUST YET IF THERE WAS A SCENARIO THAT UNIVERSALLY IT PASSES ONE OF THOSE RESOLUTIONS, ARE THERE LEGAL AVENUES CONGRESS COULD TAKE TO TRY TO DO THIS? IS THIS SOMETHING THAT USUALLY HAPPENS? >> IMPEACHMENT EXISTS BY VIRTUE OF THE CONSTITUTION. THE CONSTITUTION SAYS NOTHING ABOUT EXPUNGEMENT PROCEDURES. THE ONLY EXPUNGEMENT'S ARE ALLOWED WHERE THEY ARE PROVIDED FOR BY STATUTE. IT DOESN'T SPEAK TO EXPUNGEMENT. THE HOUSE COULD VOTE ON IT AND AGREE ON IT AND COULD VOTE ON IT 100% IN FAVOR OF EXPUNGING THE RECORD BUT IF THEY CAN'T DO IT THEN THEY CAN'T DO IT. BRINGING UP ANOTHER GOOD POINT, THIS PROCEDURE EXISTED IN THE SENATE AS WELL WHERE THE TRIAL WAS SET UP SO IT DOESN'T MATTER IF THE HOUSE COULD EXPUNGE ITS RECORD BECAUSE THERE'S NO CONTROL OVER THE SENATE BECAUSE THEY CAN'T EXPUNGE THE TRIAL AND RECORD OF THE TRIAL IN THE SENATE HOUSE. THIS IS A CREATIVE IDEA. AS CRIMINAL DEFENSE ATTORNEY I FILED THESE INSTITUTIONS ALL THE TIME. THEY ARE GREAT FOR SOMEONE TRYING TO GET RID OF A DUI ON THEIR RECORD BUT THIS ISN'T A DUI ON SOMEONE'S RECORD, IT'S A CONST THE TWO SHUTTLE IMPEACHMENT PROCEDURE WHICH EXISTS FOR POSTERITY. YOU DON'T WANT TO TRY AND EXPUNGE IT. >> I FEEL LIKE I'M AN ILLEGAL CLASS. YOU MENTIONED THE ROLE OF THE HOUSE AND THE SENATE IN IMPEACHMENT AND HOW IT'S DESCRIBED, THOSE PROVISIONS, I THINK THEY'RE THE ONLY PLACE WHERE THE USE THE SOLE RESPONSIBILITY FOR IMPEACHMENT OF THE TRIAL. THE HOUSE IN THE SENATE, THE SUPREME COURT NOTORIOUSLY ISN'T INVOLVED AS MORE THAN A FIGUREHEAD TO PROVIDE PRESIDE OVER THE TRIAL. >> IT WOULD BE A SEPARATION OF POWERS ISSUE. THE CONSTITUTION IS BASED ON THE IDEA THAT THE SUPREME COURT COULD INTERFERE WITH CONGRESS AND CONGRESS COULD INTERFERE WITH THE EXECUTIVE. THEY HAVE CHECKS AND BALANCES BUT AS YOU SAID, WHEN IT COMES TO IMPEACHMENT, THERE IS NO QUESTION BUT THAT IT EXISTS AS A CREATURE OF CONGRESS. A TRIAL THAT GOES ON IN THE CONGRESSIONAL BODIES IN THE HOUSE AND IN THE SENATE. THE HOUSE ACCUSES THE SENATE TRIES. THE PRESIDENT CANNOT PARDON HIMSELF AND THERE'S NEVER BEEN AN OPTION FOR GOING TO THE SUPREME COURT THROUGH THE JEWISH INITIATORY THROUGH THE JUDICIARY. IT LOOKS LIKE A JUDICIAL TRIAL THAT'S JUST COSMETIC. IT'S A CREATURE ENTIRELY OF CONGRESS CREATED BY THE CONSTITUTION. THEREFORE THE JUDICIARY HAD VIRTUALLY NO CONTROL OVER IT OTHER THAN THE SYMBOLIC PRESIDING OVER THE PRESIDENTIAL IMPEACHMENT BY THE CHIEF JUSTICE BUT THAT IS SYMBOLIC ONLY. PROBABLY MORE CONFUSING THAN ANYTHING ELSE. >> THANKS FOR BREAKING THAT DOWN FOR US. WE APPRECIATE IT. >>> LEARNING MORE ABOUT THE DETAINED AMERICAN SOLDIER IN NORTH KOREA. WE ARE HEARING FROM THE FAMILY OF TRAVIS KING WHO SAYS HIS BEHAVIOR IS OUT OF CHARACTER. HIS UNCLE SAID HE'S BEEN GRIEVING THE DEATH OF HIS COUSIN SINCE FEBRUARY. >> I THINK HE NEEDS HELP. THAT'S NOT TRAVIS. IT'S OUT OF HIS CHARACTER. HE WAS NOT LIKE THAT EVER. SOMETHING'S GOING ON. >> THIS ISN'T HIM. >> IT'S NOT HIS PERSONALITY. >> FOR MORE I'M JOINED BY NBC'S MATT BRADLEY. >> Reporter: TROUBLING DETAILS ABOUT THE EVENT THAT LED TO THIS YOUNG PRIVATES MAD DASH ACROSS THE BORDER INTO NORTH KOREA. HE IS ACCUSED OF AT LEAST TWO DIFFERENT ASSAULTS AT TWO DIFFERENT NIGHT CLUBS OR BARS. WE KNOW HE WAS SERVING DETENTION IN A SOUTH KOREAN PRISON WHILE HE WAS WORKING OR WHILE HE WAS ENLISTED IN THE U.S. MILITARY HERE IN SOUTH KOREA. HE DECIDED TO SPEND 48 DAYS AND AFTER THAT HE DECIDED TO MAKE A MAD DASH ACROSS THE BORDER. THAT WAS NOT A SEPARATES OR THIRD ASSAULT. HE MADE A CHOICE TO GO TO PRISON AND SPENT 48 DAYS THERE. THIS WAS IN LIEU OF PAYING A FINE FOR DAMAGING A POLICE CAR AND THIS WAS AN ALTERCATION THAT OCCURRED WHILE HE WAS DETAINED BY POLICE DURING ONE OF THE TWO PREVIOUS ASSAULTS. THE FACT IS WE WON'T KNOW ANYTHING MORE ABOUT THE FATE OF THIS SOLDIER, PRIVATE TRAVIS KING, BEFORE WE HEAR FROM THE NORTH KOREANS RIGHT NOW. IT WAS SET IN MOTION DAYS EARLIER IN A HIGH- STAKES MISSION TO INTERCEPT IT OVER ALASKA. >> WE SENT IN A PACKAGE THAT INCLUDED F-16S AT A SUPPORT PACKAGE WITH TANKER SUPPORT. >> Reporter: DID YOU KNOW WHAT THE MISSION WAS? >> WE WORKED WITH THE INTELLIGENCE COMMITTEE AND HAD A GOOD IDEA OF WHAT THE MISSION ACTUALLY WOULD BE. WHEN WE INTERCEPTED THE HIGH ALTITUDE BALLOON OFF THE COURSE OF ALASKA I MADE THE ASSESSMENT THAT IT DIDN'T DEMONSTRATE HOSTILE INTENT. >> Reporter: THE BALLOON SAILED OVER CANADA AND THEN INTO THE U.S. AND TOWARD SENSITIVE MILITARY SITES. >> IT WAS A GREAT POLITICAL DEBATE OVER THE TIMING OF THE SHOOTDOWN.
