[Music] [Music] her s remained calm as the judge read the sentence death by execution hosway Flores was murdered last Tuesday on his way home from school the men confessed to shooting the team execution style there was some uh satanic type activity taking [Music] place officers tell us tro stabbed her boyfriend with stiletto heels shoes [Music] 2-year-old Riley an Sawyer's brutal killing shocked the nation she was beaten to death stuffed in a plastic box found by a fisherman in Galveston Bay former NFL player Antonio Armstrong senior and his wife Dawn Armstrong were murdered we the jury find the defendant Antonio Armstrong Jr [Music] guilty one by one they describe the deaths of the alleged other eight victims of the convicted rail Park [Music] [Applause] [Music] killer Belinda Temple was a loved and respected teacher in kisd in January of 1999 while eight and a half months pregnant she was murdered inside her own home it would take 24 years and three trials to finally bring the case to an [Music] end in the end this needs to be about Belinda and that baby that's the story right there and how their lives were taken that's what this needs to be about this was about as coldblooded and diabolical as you can imagine I'll never get rid of that and the autopsy the next morning I'll never forget that she was that little girl was perfect perfect and this was like y she was about to be born folks out here talk tonight about a friend a school teacher pregnant mother a woman who kept a nice house in a nice neighborhood but even in this place the unthinkable has happened haris County 911 police fire ambulance yes uh somebody's broken into my house in my wife has been shocked stay on the line for the ambulance sir oh my oh my just walked in my wife I believe she's been shot it's got blood everywhere okay sir is she breathing no I believe her brain is on the floor I think she's already dead she's eight months pregnant Sergeant Mark Schmidt Harris County Sheriff's Office when we arrived Mr Temple was sitting on a bench inside the backyard when was the last time you saw her oh it's been several hours several hours yes sir was there anybody around when you walked in no I was with my son I ran him across the street the back window on my back door been busted out I think one of the things that that jumped out walking up to that back door was the glass the glass was going in the wrong direction what was developed as the theory as to why the glass went the direction that it did that the door was open the door was not closed or the glass would have been going that way but it's going primarily that way does this look like someone maybe entered into your house yeah somebody's entered in my house the back window is broken and my back door is still wide open Mr Temple and called 911 um when they got there I believe there was a neighbor from across the street that was out in the driveway they encountered him he's trying to get into the backyard uh but of course there was a dog in the backyard that did not allow them to enter the backyard they came close to possibly shooting the dog because they couldn't make entry into the yard the people that lived in that neighborhood pretty much they were like you don't get near that fence when that dogs in the backyard everyone that we spoke with the dog was very protective of her of the family of his territory what do I need to do tell me I can do it I don't you know how to do CPR yes okay I want you to do CPR for that baby okay okay yes are you doing CPR for me I can't her head is just gone okay well let's see if we can use her okay for the baby Jesus Christ oh is there any way that you can do this she's there it's just no way she's got her her brain and just blood is just covered on the floor anything else jump out to you the television set was still plugged in and it's laid over in front of a table but it's still plugged in to the wall it appeared in our opinion that the TV had been like slid off the top of this table and just laid on the floor but it was still plugged in a burglar is going to rans sack uh it's not his drawers pulled open the drawers are going to be ransacked they're going to be looking for things in the drawers and we didn't have that the main bedroom what was that like on top of the dresser was a jewelry box that certainly appeared to be intact as opposed to having been like turned over or gone through the chest of drawers and that is of course where the tray was that had Mr Temple watch and uh some other jewelry and all that was still there yes sir if this was a true burglar just take the whole box we found her purse and it again appeared all indications were it was intact he's come back on the phone we're just talking about the call she's saying that the neighbor lives around around the block so he walked around the block and told them that someone's broken into his house then came back and called us through 911 what was your gut telling you as you were processing that crime scene the night that if Belinda was killed I I think our gut was telling us we we have an issue here um with the information as we had received it up to that point but as a detective as an investigator on any case you've got to check all the possibilities what was the crime weight in that neighborhood at that time we actually had pulled the records for that neighborhood and at that point it was relatively low very much out of the norm for a burglar to be coming into your home later in the afternoon they're going to be coming in during daytime hours when they feel pretty good that people are gone to work and now further more a burglar carrying a shotgun in daylight okay and nobody in the neighborhood saw this no as Belinda Temple was laid to rest her students remember the lesson of kindness she taught inside and outside the classroom she is someone to talk to if you need someone to talk to she just had I mean making you like a way of making you feel cheerful you know she's always real bubbly but like real friendly person to be around for the past 3 years Temple was a popular special education teacher at Katie high school at her funeral the school band played a special tribute not just for her but also for the unborn baby she had been carrying for the past eight months family's got to be going through a lot we need to show that we support the family and that we respected her and that it's really just a sad thing to happen teachers and students are wearing ribbons one for Belinda and one for the baby it's just so much of a shock you just don't really want to believe it you know so it's just been hard on all of us this week what did David Temple relay to police exactly he received a phone call from Belinda earlier that day because their son Evan had become sick at daycare she asked him requested that he come home because she needed to go back to work what he said was when she got home from work after having her meeting Evan was feeling better and wanted to go to a park she was going to take a nap and he left to take the boy to a park and then he made a couple of stops to pick up some items that they needed he went to Home Depot down here in alongside I 10 how did that statement strike detectives at the time so I think what kind of struck us as odd is that we'd go to a park that's seven or eight miles from home and then go to the Brookshire Brothers that's right here behind us took a picture of his truck and had some of our investigators go out to a couple different parks in the KD area and in the subdivision that park right there did you see this truck here last Monday night did anybody last Monday evening no what added more to it was the later reports that came up of him being cited out here in this area it disrupts his accounting of his whereabouts how much time does it take to commit this offense and then stage what I believe my opinion stage this burglary we're not talking about something that took several minutes this was very quickly staged in the days and weeks that followed how was David temple with answering follow-up questions from detectives um did not he had obtained a lawyer did he the very the very next day those people lied to him manipulated him attempted to turn him inside out but the one thing he did do is tell them absolutely everything attorney Paul Looney is lashing out at Sheriff's investigators after what he calls a vicious interrogation of David Temple the husband of murder victim Belinda Temple I can't imagine anything more Despicable or disgusting the problem according to detectives is they believe Temple is not fully cooperating he's been somewhat Cooperative as Cooperative as as you would like well obviously uh probably not Temple told police he left the house to run an errand Monday afternoon and came back home to find the door bashed in and his wife shot to death upstairs in the bedroom closet he's witnessed that he's seen it probably smelled smells and within 2 hours he's being yelled at he's being cajoled and told that he's a murderer so far though investigators say no one's been named a suspect despite a dozen detectives still working the case today they were talking to Belinda's workmates at Katie high school as well as David's Associates at aaf's 9th Grade Center where he's a coach but his attorney says don't expect any further cooperation until I see a little bit of good faith on their part I would advise him to stay as far away from those vicious people as he can possibly get we received a letter from the temple family there was an incident where the parents next door had been out of town the young man next door had some kind of apartment party and a broken beer bottle ended up in the temple yard and it's our understanding that Belinda actually met with the parents next door and told them about the party that was a point that came up more than once um from the defense that this was retaliation because you ratted me out as a detective an experienced detective did that fly to you not and again you got to stay open-minded so you're going to consider these things and those youngsters he and his close friends were talk to more than once they were followed around so you put real effort into exploring that theory oh yes if you've got one or more youngsters there's a pretty high probability at some point they're going to talk about it they're going to tell somebody about it in other words there was no way that many teenagers were going to be able to keep a secret especially one of that magnitude yeah I just yeah it it didn't make sense none of it panned out from anybody looking at this on an objective level so you're telling me a 16year old old kid managed to elude an attack dog go upstairs with a shotgun shoot Belinda in the back of the head and then leave without taking anything come on none of that made a lick of sense I've been with the Belinda's family like the next the day after she was murdered so I represent their family I speak on behalf of their family and I've been doing that since January 11th 19 1999 what did you learn from their coworker their respective co-workers Belinda was very devoted very dedicated to her profession there at Katie high school she loved her kids her kids loved her David's co-workers over at aaf learned about some of the other things that had been going on I got a phone call from an officer in the AL FD system and he basically said hey I can't confirm any of this at this point but rumors going around that he may be involved with somebody [Music] else my first distinct memory of actually meeting with Belinda's family was not far from where we are here off of I 10 when we put up a billboard uh Shep's Dairy had donated additional funds and we put up a billboard a reward at that time which was $10,000 and I went to that unveiling with them and my first impression was where's David and the temple family I got to know uh Belinda's twin sister Brenda and her brother Brian very well throughout the years and of course her parents her late parents now Tom and Carol and at first they thought this was a storybook you know marriage I mean Belinda met David and they both were at stepen F Austin David was a you know Big Time football star at Katie high school you know he had this quote nickname the Temple of Doom on that he went on to play football at Stephen F Austin and Belinda was also an athlete too she played volleyball so they had a lot in common when they met Brenda had confided that she had had conversations with Belinda and Belinda was sharing with her her thoughts on David and her thoughts were this quote so-called perfect marriage was not perfect at all and she had suspected him of having an affair the Belinda calls Brenda it was like New Year's Eve and said David's gone for the weekend the holiday New Year's she like what do you do you mean it's new years's you're 8 and 1/2 months pregnant where did he go well she said you know he said he was going hunting none of that made a lick of sense why was that unusual it was unusual because there was no plan or preparations there was it just came out of the blue and then 10 days later she's murdered someone asked him at the funeral well don't you want to know who killed your wife and he responded would it matter she's dead that's an actual quote we did learn of that from one of his co-workers he told us the response was from David what difference does it make it's not going to bring her back yeah when did the family find out about the affair very soon because keep in mind that Belinda had already spoken about her concerns to her twin sister Brenda and as soon as I found out that her concerns were real and legitimate whatever little shred of doubt they had about who killed Belinda ended when they found out about the affair with the other teacher from Hastings Heather Scott at the time of blind's death did you know anything about David's relationship with any other women no when did you find out about that about that relationship uh Belinda died on Monday and it was Wednesday when Morin and I learned that there had been an affair okay did um did David spend New Years with Belinda no he did not um and just to to refer back Belinda was her birthday was December 30th is that correct of uh 1998 yes that was a uh significant birthday for her would have been her 30th birthday would you say that was a significant birthday yes okay and then that would have been just before the New Year's Eve and New Year's Day correct correct correct but David left New Year's Eve is that correct correct I'm going to go back in put one of a point in so Belinda and her unborn daughter were murdered January 11th funeral takes place February 14th Valentine's Day a dozen roses are delivered to Heather Scott from David Temple that's a little over a month that your wife an unborn child are murdered and you're delivering a dozen roses and then two years later they do get married just because a spouse has an affair does not mean you killed your wife or or your husband or wife but in this case that that Affair had gotten very serious but at some point during that New Year's Eve holiday when he was actually over at her town home and not hunting um she had related to us that she told him I hope you realize I am falling in love with you do you think that was the moment he decided well what am I going to do about Belinda yeah and then at the funeral one of the individuals there testified at the funeral that David asked him how was Heather doing not only did he keep that from you am I correct correct that he came to your home before the New Year's Day New Year's Eve for the purpose of gathering hunting gear yes and you wouldn't need hunting gear to be with Heather Scott is that correct yes and so not only did he by not saying anything to you he also created the illusion that he was going to be hunting New Year's even New Year's Day correct and he created that illusion in your mind that's where I thought he was yes but the gun was never found right the gun was never found and the case had in all honesty it it had gone cold is it fair to say it's some Point everybody's like okay everything's pointing back to David because none of these other possibilities are panning out absolutely yes it it and and admittedly so it it's been called a circumstantial case it was the old adage of knowing who did it and proving who did it and a grand jury actually did not charge him on the first go around the second time time you had a very seasoned prosecutor Kelly seagler that was brought in to take a second look at this and seagler and her team felt at that time that they had enough to bring it to another grand jury and this time the grand jury indicted him for murder it was a murder that stunned the community Katie High School teacher Belinda Temple was found dead in her own home Temple was 8 months pregnant with her second child for nearly six years the murder has remained a mystery and David Temple has been the main suspect in his wife's death today Harris County sheriff's deputies had enough information to arrest David Temple for his wife's murder he was cooperative he did not resist arrest he was completely Cooperative uh I would say he was probably surprised David Temple initially called police to report a burglary inside his home police found Belinda Temple hiding in a closet dead from an at close range shotgun blast to the Head the shotgun was never found and these two detectives never gave up we want to solve all of our cases they're all important to us and we want all of them solved but we got one like this with pregnant female and it made it tough Belinda Temple's brutal death never left the minds of these detectives the team spent hours investigating her murder and admit it was a relief to finally solve the crime everybody you talk to seems to know that what happened but why haven't we done anything about it yet so it feels good when we finally had what we needed to put the put the puzzle together so to speak on that first trial I was at that trial with Belinda's family and that courtroom was packed the big matchup of course was prosecutor Kelly seagler versus well-known attorney dick dearin and it was a battle of the Titans there in an almost month trial that jury deliberated for about what 4 hours there were 4 hours they came back with a guilty verdict there was no one else who had the means David Temple the motive David Temple and a desire to see Belinda Temple and his unborn daughter dead it all LED you to David Temple we the jury find the defendant David Mark Temple guilty of murder 2007 he sends to life in prison and you think that's the end of the story Sheriff's van after Sheriff's van rolled into the inmate processing facility throughout the day at the Harris County Jail in downtown Houston it was impossible to see which one convicted murderer David Temple was inside just after one came confirmation that Temple had been moved to the Harris County Jail from the state penitentiary in Huntsville this is a day his defense attorney never expected it's surreal you know you you wonder you work for on a case and represent someone for 9 years like I have uh you never think that you're really going to win or you always think that something can happen um once judge G ruled it was we were hopeful this they would happen quickly in 2007 he was convicted of killing his pregnant wife Belinda Temple the former a Hastings football coach was serving a life sentence Temple could get a new trial after a Court of Criminal Appeals ruling in November last year a judge agreed that important evidence was withheld in his trial the evidence withheld included phone records defense attorney said would have proven Temple's innocence the higher courts reversed the conviction and remanded it back to trial nine years later I mean we knew we're going to do this again and it's like we got to do it it's if for nobody else for Belinda her family and her baby after 9 years in prison for his wife's murder David Temple was released on bond because an appeals court ruled he did not get a fair trial since then the Harris County DA recused used itself from the case and the State Attorney General took over due to a conflict of interest we had a big sigh of relief when that happened and we felt like they're going to retry the case but we still didn't know was and then finally we were told in 2018 that the Attorney General's office agreed to retry the case David Temple walked into court this morning flanked by members of his legal team team the former football coach was convicted and sentenced to life in prison for the murder of his pregnant wife Belinda back in 1999 but in 2016 a judge overturned that conviction ruling prosecutors in the first trial withheld crucial evidence the special prosecutor from the Texas Attorney General's office telling the jury today in her opening statements this case is a lot like a puzzle and that there are many pieces to it when we put all the pieces together it's going to be real clear to you there is only one person on this Earth who could have done this and when we're all done when it's over we're going to come back here and we're going to ask you to find this defendant guilty in his opening statements defense attorney Stanley Schneider argued the timeline of the killing is flawed saying the temple may have betrayed his wife but that he could not have killed her prosecutors say Temple was having an affair and claim he killed his wife because he wanted out of his marriage were you nervous about the outcome of the second trial oh I'm I think you always are you can't don't get too unless you got video evidence a witness and a confession don't get too overconfident with a case I was in the courtroom when the the verdict came back it was overwhelming it's like yeah it was absolutely overwhelming that okay we did it again heavy emphasis on WE but then another bit of a gut punch the jury Deadlocks on punishment in the punishment phase was the testimony of Evan Evan is now a grown man family of his own and they put Evan on the stand and you had a very emotional son who believed still at that time of his dad's innocence and he made a very compelling testimony the jury deadlocked and they could not come to an agreement 10 jurors opted for Life two were holding out one of them wanted this absurd number of 1 years one of them wouldn't even speak it's now 20 years because you were in 2019 it's 20 years plus since Belinda and eron were murdered and we still don't have a resolution so at that point there has to be an entire retrial of the punishment pH we were actually scheduled to go to trial in April April of 20 what happens in March and April of 20 Co yep Co hits nothing's happening so we go back finally to trial in April of 23 we're back again keep in mind even though David Temple is now a two-time convicted murder cuz he was convicted the second time based on the laws when the murder took place which was 1999 David Temple believe it or not was eligible from anywhere from probation all the way up to life in prison we were sitting in the in the witness room we were sitting there it was a Friday afternoon and we're thinking it's going to be a long time and I remember you all of a sudden you you looked at me cuz I was sitting right across from you we were just sitting there and you said verdict and I went what 2 24 years later the right thing happened for Belinda and that baby and her family absolutely the right thing people involved in this case are never going to escape the damage that he did but between his family her family the teachers that worked with her and loved her and it's still to this day get emotional over her and the baby I've never seen a case like this in my career and I hope to God I never see a case like this ever again you came out here a lot during the investigation yes um as often as I could when when the investigation was ongoing I'd stop by and visit the grave site say a prayer for her and Aaron and pray that we would someday get a conclusion and get Justice for them when you were out here what did you feel did it help centering you y exactly exactly needed that that occasional reminder and come out here and just just be here for a few minutes does it feel different being out here now I'll I'll admit it it's been a long time since I've been here but we got closure to a degree it'll never go away we're never going to forget this and as Andy was saying nobody's going to ever forget this but at least we got the closure for Belinda and Aaron David Temple's second wife Heather Scott testified during the trials that she and David never discussed Belinda's murder throughout their marriage Scott divorced David Temple during the second trial thank you for
