I just got Sued by Tesla.

state of California summons to the above named defendants the paffrath organization doing business as meet Kevin you are hereby summoned and required to serve upon the Tesla Motor Corp an answer to the complaint which is here with served upon you within 30 days after service of the summons upon you gosh come on I just can't get ahead like oh I'm sorry this is gonna be really ramp T because I've been down this road before and it just okay look I made a joke of a video and the video bombed it didn't even do well like you might not know this but on YouTube YouTube as this toxic feature that ranks your video so 30 minutes after you post a video you get a little badge and it's a ranking one out of ten is the best it means you have the best performing video in the last ten videos you posted ten out of ten any youtuber who gets a ten out of ten post is drinking that day well that joke I made ten out of ten a few hours later Graham Steffen posts his joke Graham Stefan posts his video Graham Stefan texts me goes dude I'm getting five comments a second bro look at how many views I'm getting I'm getting 1500 views of it they can't even speak correctly he's getting 1500 views a minute I can't even get 1500 views an hour on my joke and on top of that I now get slapped with this a heads-up of not a cease and desist letter no no pansy crap his cease and desist letters are optional the Lanham Act the Lanham Act is probably the most powerful and most difficult to litigate federal statute that exists if designed to protect against trademark infringement against trademark dilution basically somebody else using your trademark inappropriately and false advertising that is really really hard to fight I mean this is a three year lawsuit to battle and I've in in a lawsuit before and I've done things to protect myself in worst case scenarios like this let me tell you about those because the legal system sucks balls and if you've never been involved in it you might have the attitude that I used to have old Kevin was like don't sue me bro I just I'll just throw your lawsuit up in the air and make fun of it because I'll go to court and prove that I'm right lawsuits don't work that way lawsuits suck here's why they suck when I get served the papers for the lawsuit against Grant Cardone I didn't get an email heads up like hey you're being sued these are the papers on the way for you I've been sued before a different time and I got an email heads-up like usually attorneys do a courtesy like hey just want to let you know this is coming down the pike Grant Cardone it's people ah no heads up you know what kind of heads up I got when I got served papers by Grant Cardone staff I go in my alley to drop off groceries and all of a sudden a blacked-out SUV comes tiing right in front of me to block my path out comes a sheriff go on you've been served yeah like that actually happens and when I got that lawsuit I'm like oh my gosh guess what I have to do though because I'm a corporation that's a corporation I can't represent myself in court so you have to have somebody whose bar license everybody's like oh start an S corporation you'll save money on taxes nobody tells you that now you need an attorney to represent yourself even against a BS lawsuit Here I am thinking I never stalked Grant Cardone are you kidding me so I had to call an attorney in Florida to defend me guess how much money they want before they even look at your case $10,000 retainer wired to their bank account before they even start and guess how many $10,000 checks I had to write for that case well let me tell you this first and think about it for that case because this sets up how I protect myself from garbage like this ha ha this this just ah I'm sorry like this is not gonna be a very well edited video I mixed ah okay look when I hired the attorney in the Florida case to defend me you have to know that I was defending myself against a stalking lawsuit that I was somehow stalking Grant Cardone and the two stalking incidents he cited he was only there for one of them which you have to be present in two instances to have a stalking case like ah it's a slam-dunk case to defend but I can't defend myself so I hire the attorney I give him a ten thousand dollar check a long story short I have to go to Florida once to prepare for the case I go to Florida for our preliminary hearing on the case this is just like the beginning of the case we take grant cardones deposition we prepare we go to the preliminary hearing the evidentiary hearing they call it go to the the court and then grant is on vacation somewhere else doesn't even show up to court judge is like dude where's your client you're suing for stalking and grant cardones not even here case dismissed yeah great I win right no because guess how much grants had to pay for that lawsuit because it was filed in domestic violence court $0 and he has a staff attorney so his attorney cost zero dollars guess how much money it cost me to fight that lawsuit that got dismissed $47,000 yeah corporation lawsuit sucks that was for a slam dunk case that the dude didn't even show up for this is the Lanham Act this is Tesla and this is Tesla filing a lawsuit not a cease and desist letter at lawsuit the same day oh my gosh now initially when I got it my heart sank but I'm like oh thank gosh though I got insurance when you're a youtuber I recommend this for anybody who by the way who makes videos or YouTube or anything if you're a youtuber or anybody's making public comments you should have something called media insurance media insurance protects you in the event that you get sued for statements that you make on YouTube so I contacted my surance company immediately that's a requirement by the way like if you ever get sued and you have insurance they will loophole out of covering you if you don't let them know like instantly as soon as practically possible I believe is the verbage anyway so I call them my help like I'll send you the stuff I'll send you what I got right now like oh my gosh like please just like I just need an initial adjustment like I'll recover so they transferred me to a claims adjuster who said look these take time to determine if you're covered but Kevin just a heads up Lanham Act claims and the video you made 99% chance we are denying your coverage you can't make a joke about somebody else's trademark and they go haha just kidding yeah and we're not covering jokes dude so insurance not happening that was the short of it the guy was a little more professional than that but that's I'm just trying to bottom line y'all here I'm a little heated i I'm so frustrated because I mean think about this you you go this is America freedom of speech yeah hoorah I'm gonna defend myself oh yeah i'ma save on taxes I'm gonna open an S corporation oh yeah I got insurance and then you start realizing legal system man forty seven thousand dollars to defend a case that's a joke can't defend yourself in court if you're an S corporation screwed again insurance have you ever heard of a loophole let me get into the meat of the matter here so here's the thing I've made a video where I went around waving a Geiger counter at I'm sorry I just scrolled to the temporary restraining order the Tesla motor Corp has filed a verified complaint and an application for temporary restraining order after reviewing the papers on filing and hearing the exigent arguments of counsel despite lockdown telephonically the Court concludes that the Tesla motor corpse rights are being and will be violated by the defendants Kevin helmet paffrath the paffrath organization doing business as meek heaven collectively the defendants and that the Tesla motor Corp will suffer immediate and Repp irreparable injury loss or damage before notice can be served and a hearing can be had on relief requested by the Tesla motor motor Corp accordingly it is hereby ordered adjudged and decreed that the defendants their officers agents attorneys and all persons an active concert or participation with them immediately refrain from publishing videos through any online platform including but not limited to YouTube Instagram Facebook Twitter etc referenced in the verified complaint any reference to Tesla's being radioactive as this is a violation of the Landman Act as provided in the verified complaint this is really really bad first of all Florida attorneys cost like $300 an hour California attorneys do I need to go further they're like 550 to 600 for a good one per hour to imagine that $600 an hour so here's how this broke apparently somebody sent the link to my video to Larry Ellison that dudes like 75 years old okay right now he's trying to stay away from that thing that's going around that shall remain unmentioned kiss he's 75 years old gets an email and he's like this is no time for jokes this guy is an ass we pay okay no immediately gets his chief counsel involved on this and they send me this email at 5:59 p.m. which what's really frustrating like tomorrow nah sorry again inner inner German here German stop I could say that because that was born in Germany okay ah mmm Laura Laura and I we met in 2008 today is our 12th year anniversary and we were going to celebrate after we put the kids down the kids go down at 7:00 I got the email at 5:50 9 p.m. you have got to be kidding me this is so ah frustrating as if it couldn't get any worse though my dream came true at the same time as my nightmare came true I got a Twitter direct message which I almost never check Twitter mostly because I meet Kevin on Instagram and on Twitter I'm real meet Kevin that's lame oh oh and get this I own the trademark for meet Kevin and the person who has at meet Kevin on Twitter has like zero posts and I'm like yo Twitter I have the trademark give me the meet Kevin username and they're like yep sorry I'm like the guy doesn't even use his account it totally just named squatting and he doesn't respond to my emails what I'm offering to buy the name off of them and they're like yeah not our problem we can't even pass the message like Twitter y'all suck y'all suck worse than Tesla now but this this is where it gets real real ugly right here okay because again dream nightmare in one so try to cheers to that one because you can because it sucks I got a message on Twitter from Elon musk Kevin your video is stupid we have filed a lawsuit against you we will not drop it unless you agree to remove the video and immediately relinquish the 657 shares of Tesla that you own back to the corporation as compensation the only requirement is that you tell your audience this the entire video is a second April Fool's joke
