their undercover status and don't take any pictures for the state jail they were going to include on you I've already been down there took pictures they didn't seem to mind well if I didn't stay here first no they came out talk to me okay but make sure okay what is the purpose of what you're doing anyway you got some ID on you sir of course I'm gonna see it please look I've done something wrong yesterday on the side of the road here a penal institution and they're a Harris County firing range I want to identify you to make sure okay but this is public right away from public street didn't sir citizen this is my my area actually sir in order to take your pictures properly okay you need to be a little bit further back so that way some of these big trucks come by come down here don't need you are you refusing to identify yourself to me as in the state of Texas as a peace officer I'm requesting your identification I will need a lawful act all I have to do is have reasonable suspicion okay reasonable suspicion is just your presence alone okay so you're saying under 3802 that I have to identify myself sir let me finish my sentence others I didn't arrest you when you were speaking it I'll be fine okay so what I'm asking you are you refusing to identify yourself under the reasonable suspicion that I can't ask you for your identification it sounds like you're suspecting me of a crime so at this point I'm gonna say that I want to reign silent exercise my Fifth Amendment right to name silent exercise my Sixth Amendment right they have a pretty president you know reasonable suspicion means I can identify you if you want to try and quote the law you might want to double-check your login because a police officer does not have to suspect your view a crime he just has to have real suspicion but that crime is maybe a foot or could be a foot so me as a police officer I have the right to identify you at any time sir at any time to make sure respectfully I'm going to disagree with jail access road good argument except for one thing I looked at the County Maps up there where the little hump in the road is that's where the state jails maintenance runs this is the county maintained all the way to that point it is public roadway and if you have a public park that butts up to it we've been advised that we can't run any kind of traffic initiative or anything on that side road that's all I can tell you and deputy Brocket just reminded me Ignacio is not a public access road so that that's what we've been told it is not a public access road it's an access for the state jail now if you go in the park obviously you can film everything that you want well again I've already learned my research I did it before long before I came out here okay and that is public right-of-way up until you get to the county maintains the road as long as the county maintains the road is public access the state maintains it after that little hump down there by their brother state jail now I'm gonna do you a favor okay as a courtesy because you've been nice to me okay I'm gonna give you one business card okay okay that's who I am I'll give you where cheaters you're old like me understand this perspective where I'm coming from because we've been advised you know we run our cadets on that road all the time and there's a lot of people that speed through there yeah they're here County sheriff's deputies well I've gone through our appropriate chain of command to get our traffic units out there to run traffic and they have told me they cannot run traffic down there because it is not a public access roadway so well maybe I can help you with that you'll see a video of me running radar out in Fort Bend County look right by the Justice Center yeah I promise you I'm gonna come back out here and do that here and I would encourage you to well you say that now say that now but when I come back and embarrass all these deputies and their patrol cars you may feel a little different well yeah individual choice if they choose to exceed the speed limit you know but we don't want anyone getting hurt okay well I'm gonna call up to the pios I've got one in particular I deal with on a regular basis up there because he's only one that's worth a crap I'll give them a call and tell them I always alert them when I have a bad video that's gonna be going up and I can tell you something I'm allowed to do that's unacceptable and I'm just dumbfounded by that so you can call Sergeant Collier up the PIO section that's what I'm gonna call and I'll call them soon as I hit the road out here and I'll explain to him what's coming but I am going back down there okay and I will be there if you know one of you guys maybe lieutenant here wants to come down and arrest me ah ah
