HOA fining homeowners for not repainting homes

Motors in the North County contacted 10 News after they say their HOA is forcing them to make thousands of dollars in unnecessary repairs to their homes thousands of sandy Aegon's live in communities run by homeowners associations but these homeowners say their HOA is out of control new at 5:00 2 News reporter Craig Carrera has the battle that is underway yeah Steve a night Iike this is a look at the neighborhood and those are some of the homes now the owners are being told they need to repaint the exteriors or space fines up to $100 every month that's when those homeowners decided to call ten use done this group of people is upset with their homeowners association what's fair about punishing all of us 333 letters went out to homeowners at Heritage legends and Vista telling them they had to repaint their homes as you can see my house doesn't need to be painted it's in perfect condition but the HOA says otherwise and the bill to paint each single-family detached home is running about 2,500 bucks I'm not going to spend that kind of money on a house that doesn't need to be painted anyway I'm already in compliance with the CC NRS so this is my house these homes are less than 15 years old and the stucco is said to last longer from 30 to 40 years but that's not the only problem stucco shouldn't be painted anyway the reason paint suffocates the stucco and drives out the cement which causes it to pull away from the laughs resulting in bulging notices went out to each homeowner saying they had to repaint now the big question here is legally can the HOA ask and make the homeowner paint their home I find it very unusual that a board would determine that all the homes in the community have fallen below some standard married is an attorney who represents homeowners in these types of situations and tells 10 News this should be determined on a case-by-case basis this determine which homes within the community have fallen below what they determined to be an appropriate standard of appearance Hannibal and several of her neighbors say they will fight this all the way to the end our position is that trying to make someone repair and maintain something that doesn't need to be repair to maintain is outside the scope is therefore illegal now 10 years received this statement from the property communion community management and the we got that within the last hour they tell 10 News the duty of the Board of Directors is to protect the property values and they want to make sure the homeowners are properly maintaining their homes they say they plan to discuss these issues further with the homeowners craig herrera 10 news
