[Music] as part of the fact-finding portion of your case you may be required to sit for a deposition a deposition is an opportunity for the other party's attorney to ask you questions under oath it will be in front of a court reporter and not a judge your attorney will be there with you here are a few tips and things to remember in preparing for a deposition but this video is not a substitute for meeting with your attorney prior to deposition the number one thing to remember is to tell the truth second be courteous and respectful to the other attorney even if he or she is not being nice to you don't try to outwit the other attorney or argue with them remember that they have been paid to do a job don't take their jabs or snide comments personally think of it as theatre they are acting a part for which they have been paid paid handsomely their role is to elicit behavior and/or answers from you that conform to the narrative they and their client want to be true and to present to the judge a deposition is primarily for fact-finding but the other attorney as well as your own are watching you to determine how you handle questioning and the pressure and thus how you will be as a witness in front of the judge if you are just respectful to the other attorney or lose your cool you could seriously jeopardize your case I've seen cases won and lost at deposition listen carefully to the question you are asking answer only what you are asked and stop talking never volunteer an answer don't answer before the attorney has finished asking the question answer quickly and succinctly though you can take a little time to think on the question that was asked don't take too much time answer the question and as few words as possible if it can be answered with a short yes or no that is all you need to say if you don't understand the question you need to say you don't understand and ask for clarification if you don't know the meaning of a word and the question you need to ask the attorney to define that word for you there's a lot at stake at deposition make sure you know and understand what you are being asked don't be afraid to say I don't know or I don't remember if that is the truth you will be able to consult with your attorney during depositions this is to be done occasionally and not after every question this is an informal setting dress conservatively no need to wear a suit but do dress neatly and to make a good impression relax if you begin to get frustrated pause to take a deep breath and slowly let it out don't be rushed or hurried remain calm don't behave in such a way that proves to the other attorney all of the bad stuff they've been hearing from the other side relax and good look at your deposition if you're facing divorce or other family law matters such as child support child custody adoption or more we want to help you
