who targeted the marginalized and the voiceless how do we call the police on the police Oklahoma City veterans sex crimes detective Kim Davis now lauded as a tireless warrior for bringing down the 240 pound six-foot-two I'm not a hero I just did my job it was June 2014 holtzclaw headed home in his patrol car but he had turned off his computer and GPS and it's against protocol to shut down those functions holtzclaw pulled over 57 year-old Janie Liggins a daycare worker who said she had been playing cards with friends he said he stopped me because he thought was swerving and she was patting me down he said let me know if you got any illegal drugs on you what law says she admitted to having taken a puffer to have weed and he found hydrocodone pills in her purse I say what do we pull my pants down he took his flashlight and shine it between my legs and I'm like oh sorry you're not going to do this there's 20 mg up his pants and took his gentle chill out and he put his hands on top of his car and he said come on I don't got all night and I kind of gave him just a little bit of what he wanted what's claw finding no cause for a rest let her go I just thank God I will to tell the story Janie immediately went to police and submitted to a sexual-assault exam she had no reason to make it up there was no motive she wasn't getting out of a ticket she wasn't getting out of an arrest when he stopped me he just made a big big mistake the grainy surveillance video shows holtzclaw's patrol car lights flashing behind liggins red car I just went with my gut when holtzclaw reporter for duty the next day yeah the right to remain silent detectives were waiting for him in the interrogation room telling Holdsclaw they had incriminating video and DNA linking him to the crimes holtzclaw flatly denied the allegations but the detectives kept the pressure on confident they had a bad cop in the crosshairs on the video are we gonna see her babies soon see your boobs out of Seir boobs okay are we gonna see her pull her pants down I don't see your boyfriend sir when you see your penis out no we're gonna see your we're gonna get any DNA to that no they asked holtzclaw for a DNA sample then they told him to strip down and give them his uniform for testing the same one he wore on the night in question bang Davis a cop for 28 years was shocked by what she called holtzclaw's cool demeanor it was kind of like interviewing a robot there was no emotion from him at all you would think if you were being accused of something so heinous your voice might raise a little bit your eyebrows might raise a little bit going what nothing that and the surveillance tape sealed the deal for the Oklahoma City Police Department Daniel holtzclaw was relieved of duty his badge and gun were taken away but even more frightening detective Kim Davis was convinced where there was smoke there was fire there had to be more detective Davis in partner rocky Gregory fear they've got a serial predator on their hands in his mind they're throwaways nobody believes them and if they do believe him who cares detectives re-examine the case of 43 year old Terry Morris who told police a month earlier that holtzclaw had found her with a crack pipe threatened her with jail and told her to expose herself and give him oral sex Terry Morris told detectives the incident happened downtown out of holtzclaw's patrol area another story holtzclaw denied did you offer and then stunning new evidence that would kick the holtzclaw investigation into overdrive DNA found on the inside and outside of the five holtzclaw's uniform pants and it didn't belong to Jeannie Liggins Terry Morris or even Daniels own girlfriend from that point on Kim Davis's mission was to find who was the pattern of the DNA who matched that DNA police officer she claims raped while handcuffed it's private is about the worst conduct that I have ever seen tell me about that stop the Daniel holtzclaw case touched down with the force of an Oklahoma tornado awarding for our viewers the content of this report is graphic the sensational story of a sex-crazed cop screams sizzling headlines and journalist Ali Meyer of our affiliate Kiev Oh our was reporting from the very beginning this was a fascinating case for this community in almost every way really devastating for parts of this community that felt targeted by the accused - alleged victims had come forward to horrifying just to rehash all those memories to build a street I don't know what was in the other amazing like Ali in the most damning evidence so far unidentified female DNA was found on the outside and inside of the zipper of holtzclaw's uniform pants the first thing Kim Davis thought is a cup doesn't just wake up and start raping women one day detectives worked furiously to find other victims the victims didn't come forward because they didn't think we'd believe him fearing Daniel holtzclaw was a sex predator who intimidated his victims into keeping quiet detective Kim Davis had to find a way to help others come forward without fear we pulled all the crime information logs we went through him by hand looking for his unit number and we wrote down everybody here am pouring literally thousands of holtzclaw's records detectives made note of women who fit the profile of someone they thought holtzclaw would consider easy prey poor black and in trouble with the law we just got together and beat on doors some of them as soon as I knocked on the door and they knew what we were investigating and that was enough for them to go somebody believes me like Shar Darien Hill who said when holtzclaw stopped her she crushed a vial of PCP in her mouth he took her to the hospital where she says the officer assaulted her while she was handcuffed to the bed his private is out I started to do him and I mean I didn't at this moment I'm thinking like I don't have a choice squad leader friended her on Facebook he asked me to come to his house a few times the trail of accusers was drawing Sherri Ellis says she was taken to an abandoned school and raped Timothy Barnes says she was touched inappropriately and stalked by holtzclaw Adira Gardner then only 17 accused holtzclaw of rape on her own front porch kale allows said she too was taken to an abandoned school and raped he took in the beauty of my soul how do you get that back detectives believes holtzclaw was so brazen he assaulted three women during one shift we still have these ideas of women deserving it so if something happens to you while you're in the process of living a certain lifestyle that's your fault and and you should just suck it up and be quiet shut up with a total of 13 accusers who didn't shut up this policeman turned alleged pariah had been formally fired the chiefs could by letter calling it the greatest abuse of police authority I have witnessed in my 37 years as a member of this agency he may have dressed like us and he may have called himself one of us but one of us doesn't do that holtzclaw's future was looking bleak and that was before the biggest bombshell had been dropped it was a shocking moment the DNA tested on the fly and holtzclaw's uniform pants had a match and who it matched was even more shocking then seventeen-year-old Dara Gardner her DNA was found on the inside of his uniform pants the former cop now himself restrained and arrested his five million dollar bail was eventually reduced in holtzclaw was free pending trial facing 36 felony charges including eight counts of rape the Union didn't support this individual the police department didn't support this individual we were mad too we wanted a conviction - in November 2015 an all-white jury of eight men and four women got their first face-to-face look at the beleaguered former cop but the image prosecutor wanted indelibly linked in the jurors minds was the army of accusers seated in the courtroom there were a whole lot of women who all looked a certain way who were accusing Dan Ewell holtzclaw of terrible crimes while he was on duty but assistant district attorney Galen Geiger was well aware of his challenges their greatest challenges were the victims credibility the prosecution needed the jury to see past their histories that doesn't make somebody unravel because they're poor and they're black what you heard over and over again in Oklahoma City from people all around town is how could so many women be lying I think it had a lot of weight with the jurors - but why would hold squad risk his career his family and his girlfriend have victimized troubled women rape is power and because you have a gun on your hip and because there are so many things that you can change in my life that's all the thrill and the excitement of predator needs there was circumstantial evidence they relied a lot on the GPS of his Oklahoma City police patrol car and it shows the officers were out we work that's his unit number right there so it was very it was actually very easy for us to cooperate the stories of the victims detectives say Holdsclaw could be tracked to every location on the date the women said they were assaulted every girl that we talked to we would full-blown interview them first they would tell us he stopped me here he assaulted me here he drove me here then he drove me over here and dropped me off I would go pull there AVL and it was dead on every time for prosecutors the bulletproof evidence was the speck of skin cell DNA found on holtzclaw's pants that match then 17-year old Adira Gardner prosecutors would tell the jury in closing arguments that the DNA came from vaginal fluid and prosecutors were convinced Daniel holtzclaw would burn and we're gonna ask the judge to make sure that this defendant never sees a lot of day everything people think they know about the Daniel holtzclaw case is wrong Daniel holtzclaw was cut from law-enforcement cloth both parents career cops described her brother McKevitt eyes he's very open very honest person his father's a pillar in the community his mother is a sweetest pie Daniel was a big boy with big ambition who nearly made it to the NFL when that didn't happen the badge was his destiny what was it like to see your son graduate from the Academy himself it was a very proud moment for me Daniel had a beautiful girlfriend whom he often quoted the Bible hey Dan it's Chris Hansen how are you in my own conversation with Daniel he made an impassioned plea what's the single biggest thing you can tell people that in your mind proves your innocence now for the first time I'm watch daily breaks down the defense teams case which it says proves Daniel holtzclaw deserves a new trial I'm not going to allow Daniel holtzclaw to become the poster child for four cops who have gone bad this is a textbook case of grave miscarriages of justice they've got to fight this battle in two courts the courtroom of law and the courtroom of public opinion the police chief announced it was the worst case of abuse of authority he'd seen the investigation isn't even complete and people say oh we must have been guilty in the beginning there were 21 accusers including one man but cops dropped eight including Shanice Barksdale who was even prosecuted for lying you're probably getting ready to have to say you're sorry to hold the prosecution had no corroborating witnesses and not a single piece of direct evidence the defense says holtzclaw showed he had nothing to hide in his interrogation any questions I'm like god bless I want everything done he's like take my clothes take my computer take my phone give me a lie detector the defense challenged the many accusers who said holtzclaw's genitals suddenly appeared even though he wore compression underwear with no opening anyone with any common sense knows that you're just not gonna be hanging there when you're wearing compression shorts they have no front it takes several minutes for him to untangle all of the suspenders and the extenders the defense argues that detectives stuck with a weak case went on a witch-hunt they went out and found women that he had stopped and said oh by the way we have a bad police officer that we're looking at and that we need your help it was a pretty bad guy to 7 women do different things we'll take care of these warrants and we'll take care of issues that you have and if you work with us did this officer sexually assault you take the case of Carla Raines who accused holtzclaw of making her exposure breasts in this police audio interview provided by a former member of the defense team she first denies multiple times have you ever come to any contact where an officer has been inappropriate you know you ever had to expose yourself to him but you you hasn't asked if he had any drugs on you anything like that and [Music] after seven denials Carla rains changed her tune so I had to raise my shirt up raise my bra up or take it out then Raines says that you did and when asked to describe Holdsclaw light-brown school like a mixed camper 34 claw is half white half Japanese and was 27 at the time Shar Darien hill accused holtzclaw of rape listen to what she said to detective Gregory when the police interview was over but the camera was still rolling well you tell me I think so because I mean yeah even if even if he didn't even write know about it I think there couldn't be a clear example of how coached these women were and how they were playing a game with these detectives Cherie Ellis accused his holtzclaw of forced oral sex and vaginal rape but here's how she describes Holdsclaw tell me your description of him how could you tell Tabitha Barnes claims holtzclaw touched her inappropriately and stalked her and incredibly Barnes was permitted by the judge to testify under the influence of drugs she comes back positive for PCP she would be asked very specific questions and her answer would be I'll take a pass on that one I'll take a pass jeanny Liggins claims holtzclaw had his hands on top of his patrol car while she performed oral sex and that her hands were on top of the car while he patted her down holtzclaw's defense insists her story doesn't add up with this there were no fingerprints of hoes clause or Liggins found on the car Liggins told police holtzclaw had blonde hair was five seven two five nine and did not have a smooth face Liggins sex assault test showed no DNA but one question looms remember Daniel was on his way home that night and had turned off his computer and GPS you did violate policy and procedure that night did you sexually assault that woman Daniel holtzclaw's defense team is drilling deep holes in the claims of many of his 13 accusers there are so many incentives to make up a story and accuse a law enforcement officer of inappropriate illegal or monstrous behaviors holtzclaw himself telling me he was set up holding out several women had changed their stories and given an inaccurate description of it [Music] another accuser testified under the influence of PCP and yet the judge allowed this how is this possible he was branded a predator by prosecutors but Daniel holtzclaw prided himself on being a good cop I'm here as his brother saying that that is not the way that he operates what about Daniel friending an accuser on Facebook vigorously challenged the prosecution's GPS link to holtzclaw he was there he was doing his job it wasn't a case where they were able to track him around doing a sinister behavior he was patrolling he never denied any of the locations that they say they ran it oftentimes the defense claims the GPS was inaccurate it can be off by as much as 1,200 feet take the case of Sherri Ellis the woman who claimed her rapist was a shorter black man not only is he not a short black man but his own GPS shows that he did drive through that area but it shows he never stopped his car the defense pointed out how was he supposed to be sexually assaulting a victim in the backseat when the vehicle is moving the entire time the defense knew it's toughest challenge however was that speck of skin cell DNA inside and out of Daniel holtzclaw is uniform zipper area when they found a match and it was a 17 year old girl it was a shocking moment Adira gardner claims she was raped on her mother's front porch but listen to what Garner's mother told Paul doesn't deny questioning a dara gardner but his team insists there was no sexual contact so how do they explain the skin cell DNA match the amount of these skin cells are completely consistent with transfer secondary touch transfer it's called transfer or touch DNA ryan bates explains if daniel pat somebody down especially young lady who's wearing a midriff shirt then he goes through her purse where her combs are where all these things are her DNA gets on his hands then at any point during a 14-hour shift if he uses the restroom if he adjusts himself if he changes clothes he's gonna come into contact with his fly which would explain according to the defense how gardeners DNA transferred to holtzclaw's pants but here is where the defense believes it has its best chance of Appeal in closing arguments holtzclaw's team accused the prosecutor of making a glaring error of fact detrimental to a host clause case he asserts that the DNA came from quote-unquote vaginal fluid from adara and that it could only have gotten there by a sexual assault holtzclaw's defense team claims that was never proven I think that's gonna be a major contention point for the appellate process he absolutely said vaginal discharge or vaginal fluid in court and the bottom line is there's not much of a test for that sort of fluid and even if there is a test it wasn't done in this case the other glaring proof of an unfair trial according to the defense jury intimidation what was the biggest injustice at trial the biggest ones that I saw was the circus type atmosphere and trial they're chanting out in the hallways they down below poor squaws team denounced the public spectacle of high-profile lawyers descending on Oklahoma City in the summer of Ferguson civil rights lawsuits in hand michelle malkin says money is an incentive this is a lottery and they're waiting for their jackpot there was absolute jury intimidation and we don't have to guess that finally after six grueling weeks of testimony the jury went into four days of intense and often heated deliberation I was fined as follows defendant is guilty of the crime of sexual battery and set punishment at eight years in the end finding the former officer guilty of exactly half of the 36 charges in recommending in astounding 263 years behind bars it happened also to be Daniel's birthday [Applause] while supporters of the victims rejoiced holtzclaw cried in mouths to jurors in his anguish family I didn't do this despite the verdict his family members tell me they have not lost faith what has this done to your family I mean it's worn as a part I mean we're still fighting together but has torn us up in our hearts because we know that Daniel is innocent the jury acquitted Daniel in five of the 13 cases including char Darian Hill who said she was raped in a hospital bed in Carla Raines who's seven times denied she had been assaulted before changing her story the jury did convict holtzclaw in eight cases including Jeanie Liggins where the only evidence was her word in a greeny visual of the traffic stop they also believes 17 year-old adara Gardner whose DNA was on Daniels fly well I mean I'm not a DNA expert they told us it was a DNA from the vaginal fluid from a 17 year old DNA people are pretty boring in the case of sharee Ellis who said her attacker was short and black and the GPS did not match her story holtzclaw was convicted on all counts on Ellis's case alone Holsclaw got 63 years Tabitha Barnes who testified on PCP holtzclaw was convicted on three of five counts sometimes you wonder I mean but it's a stuff you hear did we get it right I mean honestly I think we did is this how the criminal justice system is supposed to work in America why is it that they just sort of picked and chose who to believe not based on the evidence or the facts we took it count by count went over disgusted guilty or not guilty and put it in a pile we didn't split the baby some jurors admitted they were concerned by the outside disruptions but Speaks insists it did not impact their verdict the subject was never breached that if we don't find him guilty there's gonna be riots like person for Daniel holtzclaw his only hope is a favorable appeal one based on a number of issues including the subject of misrepresented DNA what they call the circus atmosphere and disruptions that pervaded throughout the trial an unconstitutionally excessive sentence in a jury that the defense says didn't look at each count on its separate merit how far will you go to get your brother a new trial I always said I will not give up and until the whole world hears my outcry I will keep on going I will never give up fighting for Daniel
