you for that frustration tonight for an Oakland business owner who says his downtown restaurant has repeatedly been targeted by thieves our crime reporter Henry Lee tells us the owner has now considered moving out of town but says it's not that easy it's everything it's crying it's uh rage it's anger it's frustration it's uh defeat raw emotions for imman Greer the chef and owner of vegan restaurant roasted and raw at 14th in Jefferson in Downtown Oakland he's moved several times but for Greer this is the fourth time his business has been hit it's a very defeating feeling to just try so hard every day you know and um and even as a leader it's like you you don't have time to grieve the most recent Breakin happened at about 4:30 Monday morning a couple guys young guys broke broke in um they basically hit the glass and then they just go like same it's it's it's almost a routine a similar burglary happened in March just as the restaurant was celebrating record lunch sales and the restaurant's been hit twice before that the Common Thread unfortunately these are all four of our break-ins have been young black males they have my own my own people and it's heartbreaking Greer doesn't blame police or politicians but says it begins in the home and in the schools this is a Oakland problem it's not City Hall's fault it's everyone's fault we all need to step up and do something Greer says he has no choice but to stay put just because you get broken into a few times doesn't mean you can just up pack up and leave you're you're stuck into a lease that that if you leave you're going to have to deal with an eviction Court we all are implicated in society's fa failures right now either you're part of the problem or you're part of the solution we ran into Oakland city council member Carol f as she picked up a breakfast sandwich she's a regular customer and the restaurant is in her District California is a difficult state to live in but that does not give you the right to hurt other people to make sure your needs are met Brier had this message for the burglars hold yourself accountable grow just because you were raised a certain way or weren't rais a certain way just because you come from a certain area we can change we can improve there are jobs out here Oak please are asking anyone with information about any of these break-ins to give them a call in Oakland Henry Lee KTVU Fox Studios we're learning new information about how a former San Jose fire captain was caught in a child predator sting in the Central Valley Spencer Parker now faces three felony counts of loot a with a child following a broad-based investigation that netted as many as two dozen suspects ktvs Jesse Gary has more now on the operation this stuff goes on 247 365 and that's a big issue Sacramento investigators Monday releasing video from operation spring cleaning the three-day sweep at the end of March netting the arrest of two dozen accused child Predators including one connected to the city of San Jose we arrest a San Jose firefighter who lives here in Sacramento San Jose officials say captain Spencer Parker is no longer employed by the city he was put on administrative leave 11 days ago and resigned a ail 12th in court documents Parker is accused of three counts of trying to perform loot acts on a 13-year-old girl during the initial we were able to identify him and once he was arrested we confirmed that he is member of the San Jose Fire Department investigators say spring cleaning involved 21 local state and federal agencies and more than 100 officers all part of the internet crimes against children task force detectives posed as children on multiple social media platforms to lure child predator s to meet them at predetermined locations but there were no underage victims just law men and women and handcuffs this operation is the actual transition of sharing photos to actually trying to meet and molest and abuse children who they believed were under the age of 13 officials say suspects range in age from their 70s to their 20s and in occupations from a Sunday school teacher to a postal worker to a firefighter officials didn't elaborate on Parker's arrest San Jose mayor Matt Mayhan says his city is cooperating with the investigation we're collaborating with the Sacramento County Sheriff who is leading this investigation we want to make sure Justice is served I'm just completely disgusted by these allegations late Monday the San Jose Fire Department released a statement that says in part no criminal activity is tolerable in our service and the types of crimes described by the charges are Beyond a betrayal of public trust and are particularly reprehensible when committed by someone warn to Public Service Parker is due in court Wednesday in Sacramento County officials say subsequent arrests after the sweeps led to more suspects in Downtown San Jose Jesse Gary KTVU Fox 2 News KTVU Fox 2 News at 5 Starts Now now at 5 can a retail curfew help crack down on crime the controversy behind the latest proposal to help San Francisco's troubled tenderloin neighborhood it's up to the small businesses to you know to serve the community but then you know they coming up with these ideas to shut down small businesses too good evening I'm Julie Hanner and Mike meach the proposal by San Francisco mayor London breed would force some shops in the tenderloin to actually close after midnight ktvs Christian Captain live now in the city and Christian the goal here is to reduce crime in that neighborhood yeah that's right the move here is the latest effort from the mayor's office to try to curtail any open air drug markets particularly at night when it comes to Street conditions in the tenderloin San Francisco police say they've made a lot of progress particularly in the daylight hours but when night Falls Police say they still have a lot of work to do and that illicit activity often centers around businesses that operate overnight now the mayor's office is introducing new legislation that would close businesses that sell prepackaged food or tobacco products from Midnight to 5 a.m. police say they back the plan our challenges still occur at night CR of people that are there selling selling stolen property selling narcotics we have drug users all over and what the problem is is that when you have businesses that are open like liquor stores and smoke shops it just attracts more people the mayor's office says the idea has a lot of Grassroots support from residents and neighbors Tim Benson is a manager at azalina's restaurant in the tenderloin restaurants operate late into the evening and he says sometimes customers or workers feel threatened he says he hopes that the city could could step in and help businesses that have their hours cut but he says he thinks that shutting some of those businesses down where drug users and drug dealers congregate may help the neighborhood as a whole police have been much more active uh dpw's been out helping the the cleanup effort but it seems to be mostly a daytime issue and at night time it's sort of a still the Wild Wild West Plaza snacks in Delhi opened last year and operates 247 The Man Behind the Counter didn't want his name or face used but said that the business doesn't sell alcohol or tobacco and serves an important role in the neighborhood as one of the few locations to buy nutritious food he says cost to operate the business are high so he has to keep the doors open 24 hours the new legislation he said would hurt his business the reason why we wanted to stay open is because you know we have to make more money to pay rent to pay uh bills like bg& you know phone bills internet bills and we have employees I have like four employees at night time when I have extra because you know of the area some San Francisco residents say closing the shops won't make much of a difference in the end I don't think it's going to work at all because people are still homeless and they're still out here all night long so the markets don't really have anything to do with the crime if the Board of Supervisors approves this legislation the new hours wouldn't be enforced by police other than warnings any businesses that violate the proposed new hours would be fined up to $1,000 by the Department of Health police though would be the eyes and ears on the streets to see if those businesses are complying we're live in San Francisco Christian C and KTVU Fox 2 News all right Christian thank you police raided two Eastbay massage parlor as part of an identity we don't know what type of homicide or crime in the Sacramento area that person was accused of we're working to get more information from Oak Police Dave and Pam back to you okay Ally thank you now to San Jose where two housemates of the parents charged in the fenal poisoning death of their daughter have been charged with murder as well prosecutors say housemates Phil Ortega and Paige Vitali sold used and left fenel near the baby 18-month-old winter Ryo died last August investigators say she had 25 times the lethal amount of fenel in her system her parent parents are already charged with murder what the da is saying is that fentanyl is not a recreational drug it's poison and they're asking juries to treat it that way when they're seeking these types of murder convictions against people who are in the chain of custody that leads to a fentanyl death of a baby both Ortega and Vitali will be back in court for arraignment next Wednesday San Jose police say they have arrested a woman for stealing more than 400 $100,000 from a primary school organization officers say the arrest of 51-year-old Taisha Knight is part of an investigation into four years of suspicious transactions Knight is accused of writing 45 fraudulent reimbursement checks while serving as a president for an enrichment program called shenberger Elementary School now at the at that school she has been booked for grand theft and forgery Alam County district attorney Pamela price is accusing County Prosecutors in previous administrations of intentionally excluding black and Jewish jurors our crime reporter Henry Lee tells us a review of death penalty cases is now underway this is not about left or right or any kind of politics this is about ethics Alam County DA Pamela price says she has evidence showing former prosecutors illegally kicked off jurors from death penalty cases prosecutors in the Alama County District Attorney's Office may have intentionally appear to have intentionally excluded Jewish and black jurors from death penalty cases she says this has led a federal judge to order a review of about three dozen death penalty cases my office discovered evidence of a pattern of misconduct prosecutorial misconduct that may well impact all of the death penalty cases in Alama County the allegation surfaced during a review of the case against Ernest dyes who's on death row after being convicted of murdering 9-year-old Lance Clark in East Oakland in 1993 and injuring his grandmother during a robbery attempt price at her office found these handwritten notes which apparently show prosecutors purposefully excluding Jewish and black female jurors from the jury pool this is something that's been going on in Alama for for it's been it's been the worst kept secret Brian pomeran is an attorney representing Dykes he says those notes also included purportedly race neutral reasons as to why jurors were tossed so these aren't notes that just are showing we don't like this juror for this reason they it was a ski to be able to get away with it he provided at least one rationale as to why prosecutors may have chosen to exclude Jewish jurors there was a belief at the time that because the the gas chamber was what was used in California the Jewish jurors would not want to send people to the gas chamber pomeran said it took price a progressive da who ran on a platform to reform the criminal justice system to bring these allegations to light it took Pamela price to bring this back it should have happened in previous administrations the attorney tells me one of those prosecut is now an Alam County Superior Court judge in Oakland Henry Lee KTVU Fox 2 News In Oakland a community response program is offering help for nonviolent emergency 911 calls and KTVU was given to meet the needs of the city macro Street teams respond to some nonviolent calls for Behavioral or mental health problems noise complaints and also calls about homelessness they provided me with after being accused of committing unlawful sexual acts with a student this morning if you've noticed a lack of light along Oakland's Lake Meritt you're not alone the historic Street lamps have recently been vandalized the KTV Bailey o Carol joining us live she's in Oakland to tell us what the city of Oakland is doing about that good morning Bailey good morning Dave and Pam yeah a number of these street lights here along the nearly 3 and2 Mile perimeter of Lake Merritt have been vandalized I want to step out of the way so you can see exactly the street lamps that we're talking about it's these green poles uh with that kind of loop around with the they have the historic look in that's because they are historic they've been surrounding the lake since the 1920s now a lot of people who often walk around the lake at night have noticed the lack of light it's been going on for about a month now according to the city at last check earlier this month 34 curb boxes had been broken into about 10 light poles had been down although some of those have been also because of Fallen trees others because of that vandalism issue now Oakland representative said that they have deployed teams to repair the down lights and install temporary lights because it will take the original vendor time to make those new posts and light poles the crew in Oakland will also reinforce the curb boxes that have yet to be damaged or not yet uh damaged the problem is though not unique to Lake Meritt or Oakland this has been happening actually more and more in cities all across the country as copper wiring used in the lighting fixtures is becoming more and more valuable so people are after that looking to resell it now recently in La the city council put together a task force to address the growing number of copper wire thefts affecting their street light system no word yet though on if Oakland is investing ating the vandalism here to the street lights here along Lake Merritt reporting live in Oakland I'm biley o Carol KTV Fox News all right Bailey thank you KTVU Fox 2 News at 5 Starts Now now at 5 three people arrested in connection with the shooting desk of two young women in Napa the
