[Music] well hey there y'all I'm sitting down here on the dock at the off-grid cabin and I'm a little bummed out man we haven't gotten any water down here and the pond keeps receding to the point to where I really can't even get the boat out there a little paddle boat is everything solo but I wanted to share with you a little story of a situation that I'm having down here it's directly related to this property so I thought I'd share it with you and tell you kind of how I went about dealing with this from the get-go up to this point and then maybe get some of y'all's comments and what you think is the best course of action going forward because honestly I'm kind of a standstill right now so about maybe two months ago I was coming down here and I noticed the people that live up at the end of the road and there's only one person almost a mile away about three-quarters of a mile away from me in a mobile home and they live up on the corner and there's three or four property owners between me and that person and I think it's all one family divided up amongst siblings and there is a road that's coming down here that used to be designated as a county road has since I guess stopped being maintained by the county but I think technically it's still a county road up to you know three hundred yards from my property but every deed along this road even though it's not maintained anymore it hasn't been for several years every deed that owns property adjoining this road has this road specifically mentioned in the deed and when I showed that information to a magistrate he said absolutely you know I don't see any reason why you would be in the wrong here you're in the right here anyway let me back up these people put a gate up right on the road that I access to come down here and a fence alongside the road and the gate right across the road and a sign this is private property no trespassing well the gate was open I came down I drove through extra slow stopped in front of their house waiting for somebody to come out so I can have a conversation with him and nobody came out I got dogs jumping all over my truck so eventually I just kind of slowly drove off when I came out the next day it was open I drove I drove out the following week or a couple weeks later I can't remember which I came down here the gate was closed and it had a chain around it and it had a lock on it but the lock was not closed I stood there by the gate the dogs are jumping in barking nobody came out they obviously would know somebody was out there because of the noise the dogs are making and nobody came out so I took the chain off the gate open the gate you're over the other side thankfully the dogs that seemed to be very aggressive weren't once I got out of the truck but I was concerned about that I still am because there's new dogs there all the time I mean there's like eight or nine of them that come running out anyway shut the gate and put put it back exactly the way that I saw it drove up in front of the trailer and waited nobody came out I drove away went on my way the next morning I came out it was open I drove out but at that point I realized okay I got a I got at least look into this because this has been my main what do they call it egress and ingress so my main means of traveling to and from my property there aren't other means to get here but it's all over private land and they're all either blocked off with a chain or it's much more difficult to get into my property from that direction because I would have to cross through creeks that may not be crossable in my truck so this is the most direct route it's the route that the people that owned this property before me used it's the route and the road that everybody that owns property along here uses to access the property and has been that way for probably 60 plus years this road is on all maps all county maps it shows on there and the people the county said oh well that means that you know we recognize it as a road so it's it's a legal right of way they can't take that away from you my understanding is in South Carolina you can't or sell land that is a landmark that doesn't have legal right away to it so that's why there's so few problems because at some point people go to sell their land they can't sell it if it's land lot easement has to be created if one doesn't exist anyway tell you all that to tell you this the first thing that I did was I called the county and the closest thing I can think of was Department of Public Works or whatever the people that maintain the roads the highway division what have you and I talked to a I left a message and sent an email and never heard back from him and was over a holiday weekend it was two days before the weekend anyway nobody answered the phone I left a message and nobody responded my email so a week later when I was on my way back down to the property I started getting that you know nervous feeling like you know I don't want to have this confrontation why didn't they get back to me why in the county get back to me eventually somebody's going to come running out of the trailer with a shotgun you know my brain goes to all the places that this could spiral out to and I don't know if any of you guys are like this but that's where I go to immediately and I start thinking worst case scenario you know what would I do how you anyway so I called the guy at the county back and I get in touch with them and I say hey I sent you an email I never heard back and he said yeah that was a holiday weekend he said look you know I called the gal that owns that property and he didn't give me any information what he said was well he gave me a lot of information without knowing I guess because I was reading into the way he was telling me things the words he was using the situation he was describing without saying much about the situation but basically he said this isn't something we get involved in she said that she's going to be filing paperwork saying that that's private road and that nobody else can access that she said that there's other ways in and out of your property and that you're just going to have to find another way in and my and maybe this is just me again I I got out of that that this woman was combative the guy the county left me with the impression that she wasn't happy that it's her legal private property and that I have no legal standing a crossover find a new way in so immediately that's where my head goes because he's saying things that are that seem pretty in your face you know and and he definitely said hey we can't get involved in this so get involved in what I mean I was just asking and the questions that I had was in my email hey there's a gate up and did they get permission from the county if not what do you do in this situation you know this is my my my legal right away ah de yada yada I went down to the county clerk's office and I told them the situation they're like oh yeah we get this once in a while let's look up some deeds and the girl was so super helpful like above and beyond my expectation for government employees more often than not is way low and this gal not only surpassed that she did a great job that I would come to expect from a good you know private sector person sorry government employees but you earned it so we went through every deed she printed it we went through every plot map whatever it's called printed it highlighted sections that mention the name of the road that I used to get down here that's now gated off highlighted sections on the map where it shows it on the county map which means the county recognizes it as a road in a right away and I said well what do you suggest they do she said go speak to the magistrate show them all this and see if see if they can get involved in any way I did it was a young kid I wasn't expecting this one when they said go see the magistrate for some reason I just expected somebody older than me but the older I get the less often that happens so I need to come to terms with that I guess but this young man had to be 28 to 30 years old rock star here it's funny it wasn't what I expected apologize for the wind looks like a storm like Iwo nna it was sunny earlier very hot so it's breeze and the cooler temperatures because of the cloud cover feels nice anyway he looked and said yeah what I would do if I were you is I recommend you send them a certified letter stating your position you know save as kindly as you can and because I said look I don't want to make a deal out of this they said oh you can have the sheriff he said initially you can have the sheriff come come rip the gate down they'll come rip it down I'm like you know I don't want this person as an enemy I want them as an ally we we haven't had a conversation about this yet and so there may be feelings on both sides that would muddy the waters and I don't want to start this out on a argumentative foot I want to be seen as an ally here not an enemy well you just need to come to an agreement because I don't necessarily mind that the gates up remember guys I have a gate up down on my end of the property but there's nobody behind me that uses this road as access I'm the last guy on the cul-de-sac I guess you could say so I can have a gate up in the power company that does have an easement through here has a lock on the gate with me they called me up haze' cool with you if we cut a link out of your chain and put a lot yeah absolutely because I left the sign with my name and number and said if you have a legal right to access this property please call worked out so I feel like when I did it I did the best job that I could without taking anyone else off that may need to have a legal access to this property and so I'm hoping that these people can come to see see it in reality terms because in reality the law is on my side again I'm sorry about that so that's kind of where I'm at right now I've hesitated to send the letter because every time I'm writing it in my head I feel like I'm coming off less than cordial and so again I don't want to come off less than cordial I guess I'm just kind of pissed that I had to deal with this I literally spent a day of my life in the county building and waiting for the magistrate and you know 20-something dollars and certified copies from something that shouldn't be it shouldn't be oh and the other thing in South Carolina the other thing in South Carolina my understanding is that if somebody is using an entry and egress and ingress I hope I'm saying that right if somebody is using that for period of seven years uncontested it automatically becomes their legal right of way so I've been down here for it'll be five years this fall the guy before me was here for at least five years and the people that owned this property up along this road was the original family in his parents owned it 80 90 years ago so there's no legal leg to stand on they don't have a legal lettuce leg to stand on and I know that and of course I don't want it to have to go to court because then you're spending more time and money defending something that is a legal right to begin with and I don't think they'd want it to go to court either because I don't think I don't think they have the pockets to where they want to dig in and start and pain-relieving advice but I could be wrong I do plan on sending a certified letter because I think that's probably the right thing to do to have it on record and have a copy with me and I've been carrying around all these deeds and documentation in my car since this started since I got that done just in case it comes down to I come down here the gates lock they don't come out I'm gonna come down to my property they're not going to stop me which at that point unfortunately I would have to call the sheriff to come out here and demand that they rip the friggin gate off the hinges look at me I guess another reason why I'm finding it difficult as I'm writing this letter in my head is because I am ticked and it probably comes across with the way that I'm writing it in my head so I haven't actually put pen to paper yet but I'm gonna have to do that but I wanted to just pose this put this out there maybe some of y'all have experienced something like this I know each state is different so if it happened to you in a different state other than South Carolina maybe you know the laws are different but I would imagine that something like this is pretty similar nationwide not the same but probably pretty similar with legal right aways that sort of thing if you have experience with it if there's something you think I should do differently I can't go back in time and do anything different from this point but I can start doing something different from this point forward so let me know what you think I'm sorry that that was kind of a long-winded conversation I hope I hope some of y'all find some interest in it it's one of those real-life dramas I guess you just can't get far enough away from people these days Kenya it's still just a beautiful sight grateful to be here well the palms way down still we do have rain forecasted this week at least good chances of thunderstorms each day for the next five days or so we need it the Carolinas are dry dry dry at least where we are anyway as you can see there's a lot of pollen back there muck you know pond scum that sort of thing it's kind of a drag because I can't use my cool little boat there with a duct tape on the roof but so I haven't been able to get out and go fishing which has been a bummer you know tis the season that's the way it is wearing the dog days of summer so anyway I'm interested to hear what y'all have to say about that those questions that I post earlier about the situation I'm having with access to my property it's not really a situation yet because I haven't had a problem getting back here but the possibilities there let me know what y'all thinking thank you and by the way I'm trying to be an ally and not an adversary to these people I don't want to make enemies if I can sidestep that but what's right is right legally I'm in the right according to all the research that I've done and the people that I've talked to that should know better you
