WHAT I CAN TELL YOU IS THAT BRIAN FANION WAS FOUND BY HIS BROTHER-IN-LAW WHO WAS OUTSIDE IN THE BACKYARD , CAME IN AFTER HEARING A GUNSHOT AND HEARING BRIAN 'S CRIES FOR HELP. BRIAN WAS HOLDING AMY FANION'S HAND AND SHE WAS LYING DEAD ON THE DINING ROOM FLOOR. IT WAS HIS SERVICE WEAPON THAT WAS USED IN THIS DEATH. NOW, THE DETECTIVES TEST THE GUN AND FOUND PARTIAL FINGERPRINTS ON THE GUN BUT COULD NOT IDENTIFY THEM. HOWEVER, THEY FOUND GUNSHOT RESIDUE ON BOTH AMY AND BRIAN'S HANDS. BRIAN FANION DID GO TO CRIME SCENES AND AUTOPSIES. THE MOTIVE, THE PROSECUTION SAYS BRIAN WAS RETIRING AND HE WANTED TO START A NEW CHAPTER OF HIS LIFE AND HE HAD MET A WOMAN ON A CHURCH MISSIONARY TRIP IN MEXICO AND THEY SAY HE WAS HAVING A ROMANTIC RELATIONSHIP. THEY SAY HE DID NOT WANT TO GET OUT DIVORCE BECAUSE IT WOULD LOOK BAD. THE FAMILY WAS HIGHLY RESPECTED AND THIS WOULD HAVE BEEN A BAD LUCK. >> SO THEN IT BECOMES A CRIME OF PASSION. WHAT WAS THE MOST UNUSUAL ELEMENT OF THIS CASE FOR YOU? >> I HAVE COVERED A LOT OF CRIMINAL CASES OVER THE YEARS, MANY WHERE THE VICTIM DID KNOW EACH OTHER. IN THIS CASE, AMY FANION'S FAMILY , THE MAJORITY OF THEM HAVE SUPPORTED BRIAN, EVEN WRITING A LETTER TO THE DISTRICT ATTORNEY TO SAY WE BELIEVE BRIAN IS INNOCENT. WE BELIEVE AMY TOOK HER OWN LIFE.
